You have to just say why? Why would anyone try to hide something so simple to be able to be discovered from the Special Master of the Court, Craig Ball, in the Houston District Court case of Virgie Arthur vs. Howard K. Stern, Larry Birkhead, Art Harris – CBS, TMZ, Harvey Levin, Bonnie Stern and the three Texas bloggers?

Sometimes you just can’t help but feel as if we were all perched on the Titanic and just one person’s actions could throw the whole sync off and began a domino effect that will likely engulf so many and leave not one defendant unblemished by this.

Before any one says Craig Ball was “bought off”, NOPE, could not happen, he was picked by the Defendants previous lawyer, one last “gift” before filing to Withdraw on January 2, 2009.

Those of us who had turned over everything 9 to 12 feet of printed out pages over so many months to show we had nothing to hide, will now end up with our computers having to be turned over to just prove we did in fact not withhold any documents, did not hide anything.

To say I am physically ill over this is an understatement. That one person could have tried to delete some personal files and as the Special Master, Mr. Ball has said might well have cleared us all and now could sink the whole suit; now put every defendant in this suit in such a bad light.

Many of us have been dealing with this knowledge since midnight last Thursday, so no it NOT always about getting the head start or the scoop on another web site; some times it is just what it looks like, nothing more or less.

I have not talked to any of the other co-defendants in this case, but to say there are no words to express how I feel, as I would think many others feel today, it is heartbreaking, that something so stupid could reach out and affect so many of us with a heavy cloud of suspicion now.

There is a heaviness in the air today that seems so engulfing as to take the breeze out of the brightest of days and to be so stifling that you feel you cannot catch your breath. You see it in the emails falling into my email box from different lawyers from all sides.

To those of you who are naysayers, with so many bad things to say about me, the only thing that motivated me was to keep each of your right to blog anonymously guaranteed.

Does it mean that I think Howard K. Stern murdered or facilitated the death of anyone, NOPE, just does not add up. But what a heavy heart we all have today.

He points out there are images of the hard drives and also a virtual server which would also have the back up information the Court Ordered to be turned over to Craig Ball.

Since the exhibits recovered are those that exonerate Bonnie Stern instead of implicate her in something nefarious, thus the question of who, when and why, Mmmmmmmmm could those chat logs from April 18 and 19, 2007 perhaps show some “light” pardon the pun, on all of this?

Let’s remember also that Craig Ball operates blindly for a reason, what he does not know does not impact his findings. Thus he has no idea how those 40 names got on the list any more then most of us do. I do remember our first lawyer telling us to image our hard drives ASAP to protect the integrity. I think both the Special Master Mr. Ball as well as the simple and straightforward recounting by Mr. Bly, only accentuate how easy it is to break into computers, sites etc. Remember now how many times three sites under our control have has now been compromised since April 2007. One has to wonder who had the most to gain by this, and I am NOT saying it is Arthur’s lawyers, but perhaps something that they did not realize. Words and food for thought in all of this.

By the way when I said I had been sick since reading the first email at midnight on Thursday, I mean that literally, I came to the computer yesterday to get this article and documents up ONLY after learning they were up with nefarious comments on two other sites. Here we ask, we don’t tell, and we encourage you our readers to find your own answers. By doing so we are all better educated then we were before, in my not so humble opinion.

Let me finally add there is SO MUCH MORE going on behind the scenes that none of you know nor can we ever write about, suffice it to say for the first time in my life I truly understand the term, “armchair quarterbacking” as applied to my favorite sport of football.

I would also hope that someone like Mr. Bly will explain these things to a jury, even as non tech as I am, this makes some sense to be with straightforward terms, and a beautiful assumption at taking someone at their word when it would have been easier to have assume, Mr. Bly was being highly insulted by Mr. Ball, a lesson well learned and one I hope remains with me.

More documents will be added to this case as the day goes along, right now is just not the time.

We do not have any of the Orders ruled from the bench in the Honorable Tony Lindsay 280th District Court from Friday May 8, 2009. We are aware of other sites who have access to things before we do has the two Show Cause Orders on the alleged contempt of two of the defendants as well as some hearing set on Monday May 11.

As soon as these either appear on the Court’s docket or we receive the papers we will add them to the site.

In the Southern District Federal Court for Florida, on Friday, October 17, Krista Barth and Robert Klein squared off and argued on behalf of their clients for an hour and half.

The hearing was in connection to John O’Quinn and the O’Quinn Law Firm Motion for Protective Order for the financial information with the O’Quinn legal team wanting to wait until 30 days before trial to turn that information over. The O’Quinn legal team is also requesting that Howard K. Stern does not have access to the information because Stern “can’t be trusted”. The Minutes of the Court Proceeding states the Court read the Motions, Memorandum of Law submitted by both side, had the hearing and took the matter under consideration and will issue an opinion in the near future.

In other news the Southern District Federal Court of Texas, issued an Order for a November 4 hearing on the status of the case, and the discovery progress in that case between the parties. That hearing is scheduled for November 4 at 4:00 PM.

The Texas State District Court in Houston, the Honorable Tony Lindsey issued an Order on October 15 setting a hearing on the Motions for Art Harris and Bonnie Stern to hear oral arguments on the Jurisdictional issues brought up by the co-defendants. That hearing per the Court Docket, is set for 1:30 PM on November 21, however the court has also issued in its Order that the parties may request a hearing sooner then November 21.

Howard K. Stern’s Answer to the O’Quinn’s Motion for Summary Judgment based on Stern is a public figure and as such cannot prove “malicious intent”, still appears to be due on October 27.

The New York Federal Court has Order that all depositions of the last five witnesses, Don Clark, Wilma Vicedomine, Mark Speer, and both nannies must be completed by Monday, October 20 in preparation for that trial.

In the Federal Court for South Carolina of the Estate of Anna Nicole Smith vs. G. Ben Thompson and Stancil Ford Shelley, there are two filings due, one by Monday October 20, 2008 of the Rule 26(f). The other required filings in the South Carolina Federal Court are due on November 3, 2008 and includes the Rule 26 & 26 (a).

It looks like October and November is going to be two months of many happenings in all cases, in all jurisdictions with filings due and hearings happening. Be sure to keep up with our calendar on the front page of Rose Speaks.com as we keep up with all upcoming dates in all of these cases.
