Early morning on April 27, I am tooling down the 101 on my way to the “Stanley.” Traffic is light, I have my buddy Lisa Stanley of KRTH on the radio, I am enjoying my first cup of coffee and life is good.

…As I am parking my Hummer in my $20 parking space, who do I spot out of the corner of my eye, Thomas Mesereau, Lawyer. This guy for my money is one of the best defense attorneys in the United States, having successfully defended Michael Jackson and a host of other high-profile cases. Not too hard to miss, that long flowing white hair, just like I am not hard to miss either I guess. He too is at the Stanley…that is interesting I wonder why, that thought will be answered shortly.

Lining up to get into the courthouse who else do I see, none other than one of my pals, Ira Friedman, Lawyer and one of the funniest people you will meet. Here is an Ira moment in my life, sent to me in the form of an e-mail: “John do you know how bored I am?” – “No, Ira why?“ – “I am reading DESPERATEEXES” – “Thanks Ira!’…

…Making it through the security detail, I make my usual rounds and as in most days I either end up in Judge Trent Lewis’s, Judge Scott Gordon’s or Judge Fredrick Schaller’s courts. As I approach Department 88 who do I see, Thomas Mesereau, Ira Friedman, Larry Ginsburg, David Pasternak, and 7 or 8 other lawyers. Scattered in the group were several others and, not to be missed, a very well-dressed female, when I say well-dressed, what I am trying to convey is the “look.” I find out later she is the U.S. Attorney and is sitting and listening, sure listening in such a way that you know at some point she is going to drop a net on someone.

As I bounced around the Stanley I had just walked in on Salim Karimi of ADI fame, ADI in the course of several years got millions from cities to build housing for low income. In Glendale alone he got upwards of $33,000,000…well it was obvious now why a U.S. Attorney was sitting and listening. There are other cities in the “show me the money” line such as Los Angeles.

Guess what? This all came to light during a DIVORCE proceeding! Salim Karimi v Jannki Mithawaila…I often reflect on the old song by Johnnie Taylor, “ Cheaper to Keep Her”. Please, Mr. Karimi as you sit in India safely and out of reach of the authorities here in the United States…

…Karimi’s wife is represented by Larry Ginsburg, who did a stellar job of making my friend David Pasternak, the court-appointed receiver, feel like a pinata. The point that was being screamed (however quietly) was that Mr. Ginsburg wanted his client to have access to the $44,000,000 that Pasternak the receiver had in his accounts, as well as $600,000 in bullion. Larry Ginsburg was relentless and knew the law and was on target most of the time (Ginsburg did a great job in presenting his case as his client was moving around trying to avoid the inevitable). And a great deal more in property and business enterprises. …My thought was this, upon that money being released it will be in India in nano-seconds, or some other country less friendly to the U.S. and its concerns.

…Mr. Pasterank, release that money and now.” The pieces are now fitting together, Thomas Mesereau, criminal defense lawyer is representing Salim Karimi. His wife it is reported was being hidden away by bodyguards…Note: Sweetie you cannot hide from the Feds, bodyguards or not you will be bagged if the desire strikes that very well-dressed lady sitting in Dept. 88 (also I thought I saw at least one FBI agent in the audience). Judge Gordon makes it very clear that he is not going to be letting Mr. Pasternak continue as the divorce is off, good, now maybe everyone will stop taking swipes at Pasternak. Judge Gordon also made it clear that there would be procedures to follow and loose ends to tie up before he ordered Mr. Pasternak to do anything. It came out in court that numerous lawsuits were filed against Mr. Pasternak in the performance of his duties. Judge Scott Gordon in his very special way made it clear, very clear I thought, that Pasternak the receiver could be sued only if Judge Gordon said it was “OK” to sue him. Pasternak laid it all out, “no general ledgers,“ the other word David used was “Extraordinary” in reference to what Mr. Karimi and Co. had done. Another funny comment made by someone in court was that Mr. Karimi’s relatives were destroying records…”Noooooooo“…Once again, typical behavior of innocent people.

David Pasternak never lost focus and made it clear that Salim Karimi was not sitting in the poorhouse as he made off with $25,000,000 to his native India. It was also made very clear that a great deal of criminal activity had taken place (Mesereau) & (U.S. Attorney). Millions of dollars given to do good ended up in the hands of people not worthy of the trust that went with that assignment. It was also revealed very little if any taxes were paid! No real surprises in this story or the legal proceedings that will surely follow, and the best part, Mr. Salim Karimi was on a large screen, “Live” from India…

…Mr. Karimi the interesting thing is this, as I recall my time in India as a young man, if you in fact did any or ….

Dr. Conrad Murray and Michael Jackson

Los Angeles Superior Court Judge Michael Pastor is overseeing the Preliminary hearing on Dr. Conrad Murray. When assigned the case Judge Pastor made the disclosure he was friends with then California Attorney General Jerry Brown, stating that Brown had placed him on the bench twenty seven years ago. Abiding by ethics requirements, Judge Pastor also disclosed he had written a recommendation for Deputy District Attorney David Walgren, the prosecutor in the case who has applied for a judgeship. Pastor said they are not personal friends, and he would not have a conflict in trying the case. Neither side filed within the ten days to recuse the judge.

Sources have told the media the preliminary hearing will last about two to three weeks and they will be twenty-five to thirty witnesses. Earlier in the week the D. A. shot down the gossip that Micheal Jackson’s oldest son would be called as a witness at this time. However producer/director, Kenny Ortega, of Michael Jackson’s ‘This Is It,’ is expected to be one of the state’s top witnesses. sources told media that Ortega will testify at Dr. Conrad Murray’s preliminary hearing on manslaughter charges today and that he will make it clear that he thinks Murray is responsible for Jackson’s death.

Katherine Jackson and two of Micheal Jackson’s siblings entered the court this morning and Jackson’s mother, Katherine Jackson, is expected to be there daily for the hearings. The Jackson family maintains that Murray is the fall guy in a larger conspiracy to harm Jackson, perhaps because of the insurance the promoter took out on Jackson’s life. Brian Oxman, Joe Jackson’s attorney maintains that a conspiracy did occur. Oxmann acknowledged that Micheal Jackson was an addict which made what Murray and others gave Jackson criminal neglect.

Thomas Mesereau went on MSNBC yesterday to make as statement saying on national television, [that]“The defense lawyers have to do something and what they’re gonna try and do is reflect attention away from their client and onto Michael Jackson. The reality is Michael Jackson was not suicidal, he was not self-destructive in the way they’re trying to say, and hopefully their defense will not succeed. I’m sorry that the defense is going to have to bash Michael Jackson to try and divert attention from their guilty client”

The prosecution team is led by Deputy District Attorney David Walgren. Murray’s team consists of defense lawyers, Michael Flanagan of Glendale, and Ed Chernoff of Houston, Texas. There have been hints that Murray’s defense team will put on witnesses during the preliminary hearing which could be began to show the defense they intend to pursue. The defense is not obligated to put on witnesses at this stage so that is interesting

It is generally considered extremely difficult to win criminal negligence cases against doctors, whose professional judgments juries tend not to second-guess – in fact, it’s by no means a foregone conclusion that Judge Pastor will order the case to trial.

That said remember that the bar for going to trial is very low for the prosecution to reach, in most state you can almost get a ham and cheese sandwich held over for trial.

Dr. Conrad Murray is only charged with involuntary manslaughter, for some reason giving a known addict dangerous drugs were not charged against Murray or any other doctors who treated Jackson over the years. On June 25th, 2009, Jackson died of a overdose of propofol, a prescription anesthesia drug normally used in hospitals during surgery.

Our friend, Spocket reported today on her blog that the Court’s PIO has recognized her as a member of the media. Sproket has covered other trial before Judge Pastor. Sproket stated that there would be no video or media transmitting from inside the courtroom. Computers and blackberries can only be used for note taking. All media reporting must be done from outside the courtroom. This rule also applies for the media overflow room. There is a lottery for the media to get seats in the courtroom as well as the overflow room, Sproket will have an update on her site about 1:30 PM PST today which is 3:30 PM CST. In other news about Murray, a Las Vegas federal prosecutor announced that U.S. Attorney Daniel Bogden issued a statement that Dr. Conrad Murray has agreed to pay the federal government $1.25 million after prosecutors say he inflated health care claims for surgeries and supplies. There are also civil proceedings in Harris County Texas by Murray’s malpractice insurance company disputing that they do not have to cover Murray’s criminal defense only malpractice suits.

Mark Geragos the newest odd Couple of Hollywood Justice Perhaps

…Eric Safire, Esq. was one of the best criminal defense attorneys in the state. Back in the day I would meet Eric at the trunk of his Mercedes and he would brief me on what he needed. Today Mr. Safire works out of the “Safire Building” …Eric took me aside and said, “Look, you get into trouble, I can get you off and it is no big deal.” But, Mr. Safire further explained to me, if he got into trouble, he could loose his right to practice law — his “ticket” aka a “bar card.” Along with surrounding myself with good people, I always remembered that very sound advice…and have treaded cautiously. Most of the people I work with are off-duty and retired police officers — that helps, right “Bobby” and “Bill”?

In yesterday’s Los Angeles Times a headline caught my eye, “Private investigator pleads no contest.” Well, Mr. Bradley G. Miller, the former private investigator …I was curious as I had always associated Mr. Miller as being one of Mark Geragos’s guys …The AP is reporting Geragos has long worked with Miller, including during Geragos’ unsuccessful defense of the little shop lifter Winona Ryder…

Nazarian and Associates is very proud to say that we have never ever associated with Gagagosh and for myself, I would sooner eat lunch with Harvey Levin than to work with anyone in Gagagosh’s office. Funny, TMZ.com was reporting that one of Gagagosh’s P.I.s (”big name” in this town, it was reported) is working on Nicole Richie’s car wreck case…

…I will never understand, being in a town with Adam Braun, Harland Braun, Thomas Mesereau and Barry Tarlow. These names are royalty in the world of defense. Is it the face time he gets on “Geraldo” or on TMZ? and how TMZ handles Gagagosh makes one wonder what is that relationship about…..funny stuff….

Gagagosh also represented Michael Jackson before Michael smelled the coffee burning and went to a real defense attorney, one of the best criminal defense attorneys in Southern California, Thomas Mesereau. It is reported that Mr. Mesereau has had to file a $341,000 claim against Mr. Jackson’s estate for his fees. What? Michael Jackson “stiffed” someone? Am I surprised? LMAO… Many years ago I was contacted to handle a “de-bugging” at the Neverland Ranch, all was going very well till I asked for money to be placed into an escrow account and to have my good friend Robert M. Cohen handle all the legal ends of the transaction. I got silence first and then the “that will be fine, we will be in contact in a few days” line (that is like verbal air kisses in this town).

…You know it is like thin ice, you see some fat guy waddling across and all is good, you take two steps and you go through the ice and you find yourself up to your knees…go figure.

Note: Geragos is not accused of involvement in the alleged conspiracy or payoff that his private investigator was involved with and plead to.
