Officer John J. Nazarian

A couple of weeks ago I discussed this case briefly on my radio show, ‘Straight Talk with John J. Nazarian. The photo on ‘Rosespeaks.com’ is terrible, how these officers climbed that ‘ladder’ of aggression has been looked at closely. And what we find is an officer or maybe two going a little overboard with the ‘use of force’ to gain compliance.

I was not there and have only the media and now the documents of the Orange County District Attorney’s office to go by. The D.A. is a political animal and this is a great cause to show ‘the’ people, ‘look at how I handled this’. What about the officers? The two officers and maybe more will have their lives ruined and maybe at times they will wish they were dead. Not that many people care in this society but lots of cops commit suicide and it gets a blip in the paper depending upon the news that day.

“First Degree Murder”, Rose? Did you loose one of your oars? These officers did not lay and wait to kill anyone, they responded to a call and for whatever reasons the call spiraled out of control. As a former officer I expected and demanded that people that I was dealing with follow my instructions to the letter. Now am I going to say that I never went ‘hands on’, of course not, I also feel that any officer that goes through his police career and never has had a complaint from some disgruntled arrestee or citizen was either lucky or lazy.

(Who cannot remember the Rodney King debacle and the affect that had on police officers. King was and still is a criminal and knew the game more likely better than the cops, but we all know where that went. When will our society realize that bad people do bad things and it is the cops who have to confront this cultural garbage. Once again, the cops got the shaft and King got the gold.)

Also keep in mind Kelly Thomas went from being someone’s child sweet and loving child, on to a teenager with all the dreams that kids have at that time in their lives and then….he became an adult and at some time a public nuisance. I am sure that his dad and mom did not set out to raise a public nuisance but that was the end result. Where was dad when his son was roaming the streets of Fullerton. This is a sad story on several levels, it is sad that Kelly is dead, should he had been locked up in a mental hospital as it would have been in the days of old? But no, people like Kelly Thomas, and there is no shortage of people like this in our society, they roam our streets and in some instances create havoc. Either rummaging through the recycling or sitting and stinking perhaps in close proximity to us when we want to enjoy some time with family and friends.

It has become the responsibility of our local police and sheriffs to deal with the loons and all related baggage that they bring. The death of Kelly Thomas is a terrible thing.

Knowing this is not a defense, had he been on his medications and or under the watchful eye of ‘daddy’, could this had turned out differently? Perhaps. Officer Ramos appeared to be getting a little overly aggressive, I have arrested hundreds and hundreds of bad guys. I have also smacked a few and would do it again if given the opportunity, I realized that I had all the power in the world at times. I had the power to deprive someone of their freedom and if given the ‘green light’ I could and would have taken their life.

Officers Manuel Ramos and Jay Cicinelli never set out to kill this guy, it was a progression of more and more force being used when it was more likely not needed. I am 60 years old and I have no question I could have taken junior into custody, not a doubt in my mind. For me if it meant walking and talking to this mental midget I would have, that was my style. And again, I loved having the opportunity to put my tight leather gloves right into a bad guys face, only when it was warranted.

Now, that the cheering squads are getting their pound of flesh and these officers are no longer going to be cops and will be made to be the most miserable that the system can make former cops. Remember for a cop this is nothing short of a death sentence, yes I can see some of you wriggling your fat asses on the couch, will this also make you happy? What about Kelly Thomas’s dad, what explanation does he have of not taking charge of his ‘not so right’ kid? For me, I taught all my kids to cooperate and don’t say anything other than their names, and call me. Cooperating a little more may have stopped what was coming and on the other hand, just maybe that train has already left the station.

God Bless the men and women in blue and Khaki and I wish both of these officers all the best in defense that they can get. They are going to need it now that they are going to be a part of ‘Political Tom Foolery’.

Here is a ‘second thought’, who? Other than maybe Kelly Thomas’s father is really going to miss him? Will a street in the run down part of town be named after him? Will a special issue garbage bag be made in his honor? Will there be a Kelly Thomas super dooper stun gun? And who is going to miss his presence at Thanksgiving dinner or those wonderful and warm moments sitting around the Christmas tree? Who I ask?

My other thought is did his mom and dad have him over for those special holidays, I am only asking. Quite frankly if this guy was a dog he would have been put down as a public nuisance, and I understand that we don’t do that in our society. Nor should we, it is not fair to dogs, but boy do I have a problem with all of this.

Here is another thought to go with the one above, who is going to miss officers Ramos and Cicinelli? My bet is going to be lots and lots of people, and was there a point that this should have stopped, it did not. So now we have two cops who will be sacrificed to a system that they both supported. They will both become political stepping stones for many gutless politicians who would not know whether to shit or throw donuts if they had to for one minute confront what cops have to on a daily basis. Will Officer Ramos’s family miss him at Christmas and Thanksgiving, I am thinking yup! Jay Cicinelli’s family I am guessing another yup.

For me as a former cop and writer I guess I was lucky, sure lucky that we did not have the technology that haunts the modern day coppers. Sure the old days of ‘gunfighters’and ‘metro’ units are gone. Hey what about the ‘Hat Squad’ of the old L.A.P.D. There was a time when a cop if he knew that a felony had been committed could shoot ‘a fleeing felon’, ah what the hell, ‘I Roger That’.

We have the exclusive pictures of John J. Nazarian with Pauley Perrette at the Oscar viewing party at West Hollywood’s The Abbey tonight February 27, 2011!. We talked to John J. Nazarian earlier today as he was getting ready, seemed very upbeat and promised Rose Speaks.com a few exclusive pictures this evening including one of Pauley Perrett and him tonight.

So here they are John J. Nazaraian and our favorite actress Pauley Perrette, she is talented and she gives so much of herself in the charities she promotes… And she was born in Louisiana. It is nice to hear that someone so famous is also so giving and down to earth. I love the autograph picture I have of her as much as I do the one of John that each of them sent me. We were lucky enough to do an article on the Matthew Sheppard event Ms. Perrette did last year.

Rose Speaks

So many of us have lost very close family and friends over the past year. That always makes these first holidays horrid. As Heath said to me when Ken and I lost someone that was the foundation of our family: “If you can’t cry for someone you love, then who can you cry for?” Those are very wise words for all of our members as well as Ken and me as we get through this first holiday without our love ones.

I told Ken I wanted to get up early this morning and watch the Macy New York Thanksgiving Parade. That is how the holiday of my youth were all about. My dad and I got up and watch the parade as my mom cooked. Such wonderful smells filled the house every Thanksgiving. I have to say I was disappointed in the Parade, it is not what I remember from my youth. Way back then there were high school bands and college bands that had auditioned, picked to appear and then worked hard to get the money to go to New York. It was wonderful to see those kids so excited and it put excitement in our home as well as we discussed who was the best. Gone are those and the floats for the most part all replaced by very commercial, planned acts and those horrid big balloons. I told Ken today the only thing that remained as I remember it was the last float as Santa arrived. I wish we had those old fashion parades again. Needless to say I will sleep in next year… LOL

The parade was followed by a lot of good eats and then the Dallas Cowboys who still plays every Thanksgiving Day. I have always said that becoming a football fan was not optional in my home, if you did not watch football then there was nothing to do after the feast but be bored the rest of the day. My dad and my brother would sit there and watch and cheer, discussing every play. I learned all I know about football being with my dad and brother. In fact I got pretty good, when my son became a teenager he turned to my husband and said; “Dad what is a shot gun and wishbone formations”? His dad had to tell him; “Ask mom she will know.” Yes I did know, what wonderful memories of people who are now gone.

Ken and I wish for each of you a safe and wonderful holiday, and like us remember those who are no longer with us and shed a tear at the loss in your life, Ken and I will today. However, also remember the memories you have, not everyone has those great memories, so in that we are lucky as many of you are lucky.

Remember our service men and women so far from home and pray by next year they will be safe with their families for Thanksgiving dinner.

We also wish an exciting new adventure for Jay Patton of Bryan Cave and Neil McCabe of the O’Quinn Law Firm as they leave those firms begin new journeys and new endeavors. We hope both of them find something they love and thrive at in the year to come.

Surround yourself today with family and good friends and have a great day, lots of goodies to eat. Ken has been cooking for two days and the smells from the kitchen reminds me of long ago days and my family and those memories I made. The most important thing is remember those we have loss in the last year and with the tears, remember the good times, as Ken and I will do. In closing, how about those Cowboys?

Daniel DiCriscio and Susie Borges Rossi

I was noticing the other day that Rose tagged some articles on Rosespeaks.com with names like Gary Condit, etc., I haven’t seen that name is a long time. I talked to her on the phone and asked her about the tags. She explained and I told her about my dealings with that scandal. Rose responded to my dealings with the Condit/Levy Scandal by saying, “Daniel, you do know a lot of people!” and then said,”And you seem to know a lot of the mistresses!” I retorted back to Rose, “If there’s Scandal, there’s Daniel!” LOL!

Back when the Condit/Levy scandal hit the press, you couldn’t get away from that story, it was everywhere! Although, it seems “politicals” like to have a little something on the side, if you know what I mean. Just look thru the history books: Look at Bill Clinton, John Edwards, and so on! So, I assumed that Gary Condit and Chandra Levy did have a liaison or something. And then to hear that Chandra was missing, and the tragic final details made me feel so sad for the family, and for Chandra.

I did not know that one day I would get a call from The National Enquirer to do a makeover on one of Gary’s mistresses, a woman named Susie Borges Rossi, that was coming forward to tell all to the tabloid. I was flown up to the Bay area and then driven to the location, somewhere in Stockton CA near Modesto, in a community of ranch style homes in a rustic, “country-fied” setting. The photo shoot that was to accompany the story took place at one of the homes. I can recall when arriving at the location thinking, “I am not in Beverly Hills anymore”, much like Dorothy said in the Wizard of OZ, but the other way around.

Susie answered the front door when I arrived: she was sporting a long, one length hair style, wearing glasses, no make up, and T-shirt and jeans. She did not look like a savvy mistress, more like a mom who had just finished working in the yard. Susie and I hit it off immediately, she and I got along very well. She was friendly but was quite nervous, as one would be with a tell all interview about to take place, a crew of strangers, and a new look on the horizon.

Well, I gave Susie a whole new look, you can see the new look in the NE story, the pic where she is sitting in the chair in a red blazer looking “politically correct”. All I remember was the NE telling me to “make her look sexy” but that was all the instruction I got. I usually do what I want, and I did just that! This was to be a “cover” story! Anyway, during the photo shoot, which was pretty fun, Susie was juggling doing one part photo shoot, with one part interview. The funny thing to me in these kinds of events is that everyone is very serious; on the set, etc…. reminds me of when I go into Anna Nicole Smith court hearing lately, no one talks to anyone; almost like being called into the principals office at school..

I was told that Gary had numerous girlfriends and was told their names, plus I was informed about the “fix it” team and their way of disposing of Gary’s body if, heaven forbid, he died during one of their, Gary and Susie’s, trysts. Also when I was doing her makeup, she would tell me some juicy details about Gary, and I was like “Whoa!” I remember Susie saying she was so sure Gary and his “fix it” team did something to Chandra. I remember Susie getting very passionate at telling her story, and somewhat a little angry, too. Lots and lots of details were unveiled during this conversation. When Susie told me of her dealings with Gary and how he gave her the phone number to the so called “fix it” team, it made my bones chill!

A funny thing that happened between me and Susie was when I was redoing her hair. Susie said only her sister had been doing her hair, and I was like, “Yeah, I can tell”. Susie was stuck in one look for so long and was scared to change. I told her to trust me, and with no mirror around, I did her new look in the laundry room (garage) of the house, very Beverly Hills, I know. We did it there because the rest of the house was crowded with photogs, lights, assistants, etc. This was the only place we could be quiet, plus the laundry sink was there too so I could wash her hair, plus the concrete floor was an easy cleanup!

I gave her a sassy new updated look, makeup, and clothes. FYI…the shirt she is wearing in the NE photo with the red blazer is actually my shirt..yes, the one I was wearing I gave to her last minute because I didn’t like the other shirts! A last minute decision. When one tells their story in these high profile scandals, you better look your best so the public will listen to you, just look at Paula Jones! Like I have said before, her makeover practically overshadowed her court case with Clinton.

The day the NE hit the stands was the day 911 happened, talk about bad timing for a story to hit the press. Susie’s story got “squashed” by the 911 disaster. Of course the magnitude of 911 would “squash” any story which would not be a shocker. If you note the date on the a href=”http://www.rosespeaks.com/images//images/Conduit-cover.jpg” target=”_blank”>cover, it says September 11, 2001. I actually recall that Gary and Chandra took a back seat , way in the back, when 911 happened. Susie did make a “blip” on the radar, but not the magnitude that we all were expecting, due to the bad timing.

After the shoot and interview were wrapped up, as I was leaving, Susie gave me a big hug and said she really loved meeting me, and I said the same to her. And we snapped a pic together, this was before digital camera days.

I remember sitting on the airplane waiting to go back to La LaLand, we were departing from Oakland, and the plane was being held up for a passenger. I was like, “let’s go already!”. At first when the late passenger and his “security” finally boarded, I thought it was Gary Condit…I was like “OMG” …but it was Gray Davis, former Governor of California. I was like, ” We had to wait for him?” LOL!

When I arrived back in LA, Susie sent me a very sweet email saying “Thanks” for all I did and that she loves her haircut! We are still in contact to this day, and she seems to be very happy presently.

Finally, for the details that I could tell you, that I know you’d love to hear. . .all I can say is. . . “BUY THE BOOK!” LOL!

Rose Speaks

It has been brought to my attention that a blogger on another site that I have great respect for is under a misconception of the Texas State Statutes. Yes I know most of you think we should leave the U. S. and it would be good riddance, However do not judge all of us on sound bites made to make us look like ignorant yokels. My deposition is not over until every party’s counsel gets to ask me every question they want to. Lawyers have jobs, it is not normally personal with them it is what they do for a living. Their ethics require them to be the fiercest advocate for their respective clients, and that is why the lawyers in this case are some of the best in the nation and make those mega bucks.

Texas Statute governing Depositions versus Federal Statues. As we always encourage each of you that read at Rose Speaks.com, let Google be your friend.

A Sworn statement cannot be used at trial in Texas a deposition can be used in Texas in trial.

For use at trial, all parties need a deposition, not a sworn statement. Sworn statements and affidavits are useful for some purposes, such as to support or defeat a special appearance or a motion for summary judgment, but they are not admissible at trial. A deposition is admissible at trial in a civil case.

Here are the statutes governing deposition versus a witness or a party that is not available for trial.

TEXAS RULES OF EVIDENCE

As amended through January 1, 2007

Rule 801. Definitions

The following definitions apply under this article:

(a) Statement. A “statement” is (1) an oral or written verbal expression or (2) nonverbal conduct of a person, if it is intended by the person as a substitute for verbal expression.

(b) Declarant. A “declarant” is a person who makes a statement.

(c) Matter Asserted. “Matter asserted” includes any matter explicitly asserted, and any matter implied by a statement, if the probative value of the statement as offered flows from declarant’s belief as to the matter.

…(3) Depositions. In a civil case, it is a deposition taken in the same proceeding, as same proceeding is defined in Rule of Civil Procedure 207. Unavailability of deponent is not a requirement for admissibility.

FEDERAL RULES OF EVIDENCE

As amended through December 1, 2009

Rule 804.

(a) Definition of unavailability. “Unavailability as a witness” includes situations in which the declarant- ….

…(4) is unable to be present or to testify at the hearing because of death or then existing physical or mental illness or infirmity; ….

…(1) Former testimony. Testimony given as a witness at another hearing of the same or a different proceeding, or in a deposition taken in compliance with law in the course of the same or another proceeding, if the party against whom the testimony is now offered, or, in a civil action or proceeding, a predecessor in interest, had an opportunity and similar motive to develop the testimony by direct, cross, or redirect examination.

With that said, I will share only a tad of my answers today during the fist session of my deposition.

1. It was videotape for the Court and/or jury trial in fact the lawyers continued to say “Ladies and Gentlemen of the jury”, I asked why since there was no jury there today and learned something new about why attorneys say that in Texas if not in every state.

2. I have consistently maintained that I believe that Howard K. Stern got a raw deal in Florida, and I continue to repeat that as I did several times today.

3. I had no reason to believe that Stern has not been honest, forthcoming and sincere in all of the discovery in this or any other case I know about.

4. As I said today and made it clear I would continue to say even on my death bed, there is no defamation and no conspiracy to defame.

With that said, some of the defendants do not have clean hands, and some of them have made this very difficult in both money and time because they have not been forthcoming in my opinion.

AGAIN LET ME SAY I AM NO ONE’S STAR WITNESS, I AM NOT ON ANYONE’S SIDE IN THIS. As a matter of law the court did find I had colluded with Virgie Arthur’s counsel which is not illegal in Texas and so stated during it’s July or August Written Order, HOWEVER THAT SAID there is also no doubt in my mind that CBS’ attorneys did collude with Art Harris in order to piggy back off of him to come into the case early. AGAIN IN MY OPINION THERE IS NOTHING WRONG WITH THAT. The Court of Appeals in Texas in the Flack decision also stated that a defendant can be settling with nothing nefarious going on between the parties.

I did lean today from one of my co-defendants attorney that any of the defendants can file to keep me in this case, although the attorney who shared that with me indicated they would not be going in that direction, I did need to be aware of that.

I have NOW posted my Settlement Agreement with Ms. Arthur in the members only forum section. I have done this because although I have the right to keep that private from the public and the members of this site, I have insisted that it be made public for all to see, because I have always said I will be transparent. I will also ask when it is appropriate based on some of the information deemed confidential and/or covered by the Agreed Protective Order that a transcript of my deposition also be released to the public for all to read.

PLEASE ALSO CHECK THE NOTICE OF THE SERVER WE ARE WITH WILL BE DOING MAINTENANCE OVER TWO NIGHTS THIS WEEKEND.

Folks we got the email a couple of days ago but forgot to post the information.

The server that hosts our site is going down for upgrades tonight, March 7, 2010 at 11:01 PM CST and will be down until March 8, 2010 at 2:00 AM. CST

Now we all know how upgrades go but hopefully they are ready and will do it fast.

However until it comes back up there will be no Rose Speaks at all and no way to reach us by email. Many of you have our personal emails and if you need to reach someone email and we promise to get back to you.

Rose Speaks.com News

Ken and I would like to wish each of you a very Happy, safe and healthy New Year.

If you are going out tonight please be safe, we have had a lot of wrecks here during the holiday season so be safe.

Remember that Ken will be doing updates on both the blog and forums this weekend however neither of them will be down at the same time, his work will be on Saturday night, January 2.

We have asked that all of you think about what are the best cases we have covered this year. What are the saddest cases we have covered? What are the most interesting to you? What do you want to see in 2010 covered? You can list up to five cases if you remember that many.

For me it is for the best cases, a toss up, I am not sure if I would list the “best cases” as those who settled in a way I was pleased. So many of the people we have covered in 2009 have been heartbreaking. The most interesting one was the Howard K. Stern vs. Rita Cosby, there were so many publicly available depositions and filings in this case that for someone who loves legal papers this is the most interesting one.

The saddest cases we have covered would be the Casey Anthony case. The most frustrating one was the Roland Carnaby alleged CIA case. The federal court granted the motions for Summary Judgment so we will never learn what really happened in that wreck, why the computer went to the Secret Service, and of course this will continue to feed the conspiracy nuts. The death of John O’Quinn was another tragedy. I remember in 2007 I said that we were witnessing two titans in the legal field in the numerous Anna Nicole Smith cases and I predicted one would go on to be thought of as the top lawyer with the most recognizable name and one would retire. I was so wrong about that I still think of the people who loved this man, yes there were many, facing this first holiday season without their colleague and friend. This is followed by the Michael Jackson tragic death and the beginning of family members fighting to control his Estate. For some reason that always happens and it must be very heartbreaking for all three of Jackson’s children. The two most bizarre cases we followed in 2009 was the Lori Drew federal criminal case of violating the TOS of MySpace and of course we can’t leave out Michelle Bruan, the Hollywood Madam

For 2010, we will finish all things Anna Nicole Smith as we have always promised, although I have to admit I am really worn down on these cases and will be glad when the last one to wind up hopefully by the summer of 2010. We will cover the Casey and Caylee Anthony case in 2010, as I have said many times I do not like to cover missing or murdered children because it is heart wrenching to me. However as the documents become public in this case with three trials coming up in 2010, I feel this is a have to case to follow. I also think Michael Jackson’s death, indictments, trials and continued fighting over his Estate will be at the forefront of our coverage. Now that Roman Polanski’s appeal to drop his case in the California Appeals Court has been denied we will follow whether the U. S. is successful in expediting Polinski and if so we will cover that trial.
