Rose Speaks

It has been brought to my attention that a blogger on another site that I have great respect for is under a misconception of the Texas State Statutes. Yes I know most of you think we should leave the U. S. and it would be good riddance, However do not judge all of us on sound bites made to make us look like ignorant yokels. My deposition is not over until every party’s counsel gets to ask me every question they want to. Lawyers have jobs, it is not normally personal with them it is what they do for a living. Their ethics require them to be the fiercest advocate for their respective clients, and that is why the lawyers in this case are some of the best in the nation and make those mega bucks.

Texas Statute governing Depositions versus Federal Statues. As we always encourage each of you that read at Rose Speaks.com, let Google be your friend.

A Sworn statement cannot be used at trial in Texas a deposition can be used in Texas in trial.

For use at trial, all parties need a deposition, not a sworn statement. Sworn statements and affidavits are useful for some purposes, such as to support or defeat a special appearance or a motion for summary judgment, but they are not admissible at trial. A deposition is admissible at trial in a civil case.

Here are the statutes governing deposition versus a witness or a party that is not available for trial.

TEXAS RULES OF EVIDENCE

As amended through January 1, 2007

Rule 801. Definitions

The following definitions apply under this article:

(a) Statement. A “statement” is (1) an oral or written verbal expression or (2) nonverbal conduct of a person, if it is intended by the person as a substitute for verbal expression.

(b) Declarant. A “declarant” is a person who makes a statement.

(c) Matter Asserted. “Matter asserted” includes any matter explicitly asserted, and any matter implied by a statement, if the probative value of the statement as offered flows from declarant’s belief as to the matter.

…(3) Depositions. In a civil case, it is a deposition taken in the same proceeding, as same proceeding is defined in Rule of Civil Procedure 207. Unavailability of deponent is not a requirement for admissibility.

FEDERAL RULES OF EVIDENCE

As amended through December 1, 2009

Rule 804.

(a) Definition of unavailability. “Unavailability as a witness” includes situations in which the declarant- ….

…(4) is unable to be present or to testify at the hearing because of death or then existing physical or mental illness or infirmity; ….

…(1) Former testimony. Testimony given as a witness at another hearing of the same or a different proceeding, or in a deposition taken in compliance with law in the course of the same or another proceeding, if the party against whom the testimony is now offered, or, in a civil action or proceeding, a predecessor in interest, had an opportunity and similar motive to develop the testimony by direct, cross, or redirect examination.

With that said, I will share only a tad of my answers today during the fist session of my deposition.

1. It was videotape for the Court and/or jury trial in fact the lawyers continued to say “Ladies and Gentlemen of the jury”, I asked why since there was no jury there today and learned something new about why attorneys say that in Texas if not in every state.

2. I have consistently maintained that I believe that Howard K. Stern got a raw deal in Florida, and I continue to repeat that as I did several times today.

3. I had no reason to believe that Stern has not been honest, forthcoming and sincere in all of the discovery in this or any other case I know about.

4. As I said today and made it clear I would continue to say even on my death bed, there is no defamation and no conspiracy to defame.

With that said, some of the defendants do not have clean hands, and some of them have made this very difficult in both money and time because they have not been forthcoming in my opinion.

AGAIN LET ME SAY I AM NO ONE’S STAR WITNESS, I AM NOT ON ANYONE’S SIDE IN THIS. As a matter of law the court did find I had colluded with Virgie Arthur’s counsel which is not illegal in Texas and so stated during it’s July or August Written Order, HOWEVER THAT SAID there is also no doubt in my mind that CBS’ attorneys did collude with Art Harris in order to piggy back off of him to come into the case early. AGAIN IN MY OPINION THERE IS NOTHING WRONG WITH THAT. The Court of Appeals in Texas in the Flack decision also stated that a defendant can be settling with nothing nefarious going on between the parties.

I did lean today from one of my co-defendants attorney that any of the defendants can file to keep me in this case, although the attorney who shared that with me indicated they would not be going in that direction, I did need to be aware of that.

I have NOW posted my Settlement Agreement with Ms. Arthur in the members only forum section. I have done this because although I have the right to keep that private from the public and the members of this site, I have insisted that it be made public for all to see, because I have always said I will be transparent. I will also ask when it is appropriate based on some of the information deemed confidential and/or covered by the Agreed Protective Order that a transcript of my deposition also be released to the public for all to read.

Virgie Arthur February 2007

After being unable to reach an agreed settlement between Virgie Arthur and Teresa Stephens that was agreeable to both parties in the Virgie Arthur vs. Howard K. Stern, Larry Birkhead, TMZ et. al. defamation case and conspiracy to defame.

Today, March 31, 2010 Arthur has filed a Notice of Nonsuit in regards to dismissing Teresa Stephens from the Harris County Case

I do not expect any of the conditions of why a settlement was unable to be reached. However if either side does release a statement in regards to Stephens being released from the lawsuit pending in the Harris County 80th District Court by the Honorable Larry Weiman, Rose Speaks.com will attempt to get an on the record comment from both sides.

We here at Rose Speaks.com are glad to see Ms. Stephens, a blogger who lives in Texas, dismissed after almost two years and wish her all of the best.

In other filings with he court filed with the Court after 5 P. M on March 30, 2010, Art Harris has filed a “Conditional Motion to Quash” the deposition of Turner based on three reasons. The deposition is scheduled for Friday April 2, 2010.

Well let the games begin… In a filing full of false information (And God I hate to side against a good law firm), Amanda Bush on behalf of her client filed a Motion to Quash Deposition of Turner based on “At the time of filing this Motion, counsel for Harris has not received a response. On information and belief, counsel for Harris believes that Turner intends to quash the videotaping of her deposition late Thursday, April 1, 2010, and the Court is closed on Friday, April 2, 2010 for the holiday.” I hope this is one damn good witness Ms. Bush has and one with a LOT of money that can fight off perjury charges and a Civil Suit, because that statement is an out and out lie to the Court by an officer of the Court, which last I checked was pretty serious. Shooting back Virgie Arthur filed Turner had NEVER said and DID not intend to file any Motion to Quash. For those lawyers needing a refresher course I had until 5 PM today to file a Motion to Quash and Harris’ counsel knows that. The holiday, Mmmmm every lawyer that intended to be here had confirmed including Ms. Bush’s boss that he would even stay to Saturday to finish all of this up. So to say I did not want to be cross examined by him is bull shit, I asked if there was any way because of my illness if they could trade out time and try for both sides to wrap this up in six hours if not I would continue to do the best I could through Saturday. Folks this is why I am so angry at Harris for deleting those emails and documents, it seems the only person everyone agrees has not is me… I am hoping we can get an emergency hearing tomorrow and proceed. However it might be Harris’ attorneys strategy to stall until I am on pain management medication and can’t give a deposition before the hearing to bust Art Harris on April 30. What does a well respected Law Firm do when a client screws them over and leaves them to clean up the mess. I guess some consolation is that Harris is now in trouble in Florida in the Haleigh Cummings case for the very same situation he finds himself in the soup kettle in Texas. I will have a lot more to say about Harris’ credibility among his peers of independent investigative reporters and where he actually is when “out of town researching a big murder or case”.

Grandson James Nazarian with John J. Nazarian

The Birth Announcement read round the world I would guess of James Nazarian born March 11, 2010!

“There was a flash of joy within the universe early Thursday morning — my son Chris and his adorable girlfriend Victoria together brought their new son James Nazarian into the world at 4:20 A.M. James is 9.9 lbs and 21 inches, and upon hearing this I was so glad that I always gave Victoria the chair at the head of our table during dinner…extra room, 9.9 POUNDS, not-so-little James came into the world at almost 10 POUNDS!! Thank god for medical technology, as what an “OUCH” factor that had to be…I am just guessing, never having given birth.

Becoming a grandfather is an incredible thing. My middle name is James and what an honor to have my grandson named after…me! They named their son after me! I am looking forward to watching James grow, and to assure that he is in the right financial place a stock portfolio will have been put together by the time you read this! After all, if James is going to be named after me he should, at the appropriate time, have a few bucks in his pocket.

I wish Victoria and Chris all the best, and they will have to remember that for the rest of their lives they are now Mom and Dad. And their focus should be to make sure their son James has all the world can offer to him, but most of all the love and caring of each other and together sharing that with James…I am sure they will do all of that as they will be reminded “once in awhile” who James’s grandfather is.

On a personal note, Ken and I have gotten to know Mr. Nazarian over the last two plus years via email and a few phone calls, ever since I talked his publicist into allowing Rose Speaks.com to pick up Mr. Nazarian’s coverage of the Anthony Pellicano trial. Mr. Nazarian is devoted to his two sons and if you look at pictures we put up occasionally with his articles of his cars (the Rolls and Bentley) you will see that the hedges around John’s home is 20 feet high. I think he has always been aware that in his business he has made a few enemies along the way, but I have NEVER seen a picture of his two sons anywhere. So to me, this cute James Nazarian, the grandson of John, he could not ask for a more protective grandfather.

We here at Rose Speaks wish Chris, Victoria and James a long and happy life and to remember your children grow up so fast, enjoy every day, and EXPECT advice from your dad, Chris, grandparents are put on earth to do that and I would imagine John will do that with grace, love and as fierce of protective grandfather as any grandchild can have.

I feel Ken and I at Rose Speaks joins with all of John J. Nazarian’s clients including in part the firms and lawyers of Trope and Trope, Hersh, Mannis & Bogen, LLP, Meyer, Olson, Lowy & Meyers LLP, Trope & DeCarolis, LLP, Ron Rale, Sorrell Trope, Michael Trope, Patrick Decarolis, Lisa Helfend Meyer, Gary Fishbein, Ira M. Friedman, Ron Litz, Harland Braun and Adam Braun. There is not enough room to name them all and the clients who became friends along the way including Pauley Perrette and Michelle Phillips. Clients including Oscar de la Hoya, Vin Diesel, Steven Bochco, and Les Moonves, and it could go on from there.

As you can see the list is so large we cannot begin to list them all, but I am willing to bet that James Nazarian’s birth is going to be celebrated in California by all who have been positively touched by the dedication, commitment, professionalism and knowledge John shows to his clients, and to the few lucky enough to call him a friend. Not to forget his one of a kind wit that can make me laugh with my fist cup of coffee.

James Nazarian is beautiful Mr. Nazarian! All of our best to you and your family.

Folks we got the email a couple of days ago but forgot to post the information.

The server that hosts our site is going down for upgrades tonight, March 7, 2010 at 11:01 PM CST and will be down until March 8, 2010 at 2:00 AM. CST

Now we all know how upgrades go but hopefully they are ready and will do it fast.

However until it comes back up there will be no Rose Speaks at all and no way to reach us by email. Many of you have our personal emails and if you need to reach someone email and we promise to get back to you.

Rose Speaks.com News

Ken and I would like to wish each of you a very Happy, safe and healthy New Year.

If you are going out tonight please be safe, we have had a lot of wrecks here during the holiday season so be safe.

Remember that Ken will be doing updates on both the blog and forums this weekend however neither of them will be down at the same time, his work will be on Saturday night, January 2.

We have asked that all of you think about what are the best cases we have covered this year. What are the saddest cases we have covered? What are the most interesting to you? What do you want to see in 2010 covered? You can list up to five cases if you remember that many.

For me it is for the best cases, a toss up, I am not sure if I would list the “best cases” as those who settled in a way I was pleased. So many of the people we have covered in 2009 have been heartbreaking. The most interesting one was the Howard K. Stern vs. Rita Cosby, there were so many publicly available depositions and filings in this case that for someone who loves legal papers this is the most interesting one.

The saddest cases we have covered would be the Casey Anthony case. The most frustrating one was the Roland Carnaby alleged CIA case. The federal court granted the motions for Summary Judgment so we will never learn what really happened in that wreck, why the computer went to the Secret Service, and of course this will continue to feed the conspiracy nuts. The death of John O’Quinn was another tragedy. I remember in 2007 I said that we were witnessing two titans in the legal field in the numerous Anna Nicole Smith cases and I predicted one would go on to be thought of as the top lawyer with the most recognizable name and one would retire. I was so wrong about that I still think of the people who loved this man, yes there were many, facing this first holiday season without their colleague and friend. This is followed by the Michael Jackson tragic death and the beginning of family members fighting to control his Estate. For some reason that always happens and it must be very heartbreaking for all three of Jackson’s children. The two most bizarre cases we followed in 2009 was the Lori Drew federal criminal case of violating the TOS of MySpace and of course we can’t leave out Michelle Bruan, the Hollywood Madam

For 2010, we will finish all things Anna Nicole Smith as we have always promised, although I have to admit I am really worn down on these cases and will be glad when the last one to wind up hopefully by the summer of 2010. We will cover the Casey and Caylee Anthony case in 2010, as I have said many times I do not like to cover missing or murdered children because it is heart wrenching to me. However as the documents become public in this case with three trials coming up in 2010, I feel this is a have to case to follow. I also think Michael Jackson’s death, indictments, trials and continued fighting over his Estate will be at the forefront of our coverage. Now that Roman Polanski’s appeal to drop his case in the California Appeals Court has been denied we will follow whether the U. S. is successful in expediting Polinski and if so we will cover that trial.

There have been so many personal tragedies for so many of you in 2009, we wish you healing and only the good memories of those of you who have lost someone remain in 2010. May each of you find peace in the New Year.

If you are a new reader here and have a tip for a case you want to give us then please use the contact us button at the top of each page. We want to hear from you and what you want. This leaves only the updated documents that are still not relinked, however with each article we do on each case we are putting up the downloads up to date on that case. We hope to have a document link at the top of the page as we catch up that will give you the ease of all cases you want papers too. If you want or need one of the papers that are not linked yet drop us an email and we will get that right out to you.

On the Anna Nicole Smith Estate vs. G. Ben Thompson, Ford Shelley etc. I am did not see any papers filed by some deadline for December 28. I tried to figure out if it was a Response by Susan M. Brown’s being added to the suit as well as Gina Shelley, Gaither B. Thompson II and his wife Melodie Thompson. It could be a Reply by the Estate due on a Response filed by one of the defendants in regards to the Motions for Contempt, Sanctions and Joiner of additional parties. Which ever it was it was not filed on time unless there is a delay on showing up on PACER.

December 29, 2009, G. Ben Thompson filed an Objection to his attorney Mr. Joyce’s Withdrawal as attorney of Record of Thompson in the federal case of the Estate of Anna Nicole Smith vs. G. Ben Thompson, Ford Shelley et al. I wonder if this is the reason that the Responses or Replies due on December 28 have not been filed?

On the Virgie Arthur vs. Howard K. Stern, TMZ, et. al. in the 80th District Court of Houston, signed an Order yesterday on December 28 giving the Plaintiff Leave (permission) to file the late documents in response to CBS Motion for Summary Judgment, and also giving CBS Request to supplemental their evidence for the Summary Judgment we should have a copy of this later today for your downloading pleasure. This Order appears to be no win or win for both Arthur and CBS, the new judge is allowing both of them to supplement their filings in reference to CBS Motion for Summary Judgment.

Tomorrow we will list the five cases we feel was the worse or the most bizarre, we would like to hear which ones you found that way. You can use the archive months found on the right hand side of the main pages for you to do a quick review to pick the five you want to list.

On December 31 we will list the five cases that we feel were the best of the cases or had something unusual happened during that case that changed the dynamics of that case. Again we would like for you to list your cases you thought was best of had something unusual that changed the dynamics.

I will have a short article up later today with links to some of the documents and some musings on who and who not are looking forward to television reality series or be part of a documentaries, it will surprise you we think.
