How bad is bad? How about when DIVORCE proceedings take a much bigger toll than the cash in your wallet, the equity in your home, and the “love,” long loss from the days of “I do”?
On Wednesday the 22nd of February, Russell Scott Goldberg walked into the the apartment of Margaret “Peggy” Duffy Goldberg and shot her three times, killing her in the kitchen of her home. While their 8 year old son was sitting on a couch watching television in the other room.
Since about November 2010 right up to February 17th, 2012, it is reported that there were approximately 14 days of hearings in Judge David Cunningham’s department 22 at the Stanley Mosk Superior Court here in Los Angeles. All of the hearings conclusions were often met with a certain amount of bravado and sarcasm from Mr. Goldberg, the killer. Except! for the last hearing on Friday the 17th 2012, “something was different.” Patrick DeCarolis, Peggy’s lawyer, noticed something was not right, “it was different,” Mr. Goldberg left the area immediately. In the past he would stand around and make comments and be a little “annoying,” not this Friday…he had noticed something was not right and it was not being his “annoying wiseguy self”.
Mr. DeCarolis, who is a partner at Trope and DeCarolis, was devastated when this reporter interviewed him on Saturday the 25th of February. He recalls that Peggy was “lamenting“ the time this whole process was taking. Can anyone imagine the terror she was going through as her life was being taken one shot, two shot and the third shot from a gun in the hands of her former husband…”till death do us part,” took a whole different direction. Note: Goldberg had no history of any physical abuse, “he never hit her.” For sure he had a reputation of being a jerk, an East Coast attitude thing if you will.
Patrick DeCarolis recalled to me that that last hearing in Judge Cunningham’s court was not a “good day” for the other side. Judge Cunningham had expressed his annoyance as to the time that it was taking on this case. Goldberg was represented by another lawyer in the current proceeding as well as a relative who was a lawyer. This relative brought little or nothing to the case at hand except to add to the madness of this divorce that was already swirling out of control. The end was much closer than anyone could ever have expected.
Russell Scott Goldberg was represented in the early stages by Ron Brot of Brot and Gross. I spoke to Ron and he was shocked to hear that his former client had killed his wife in cold blood and then committed suicide in his car in Beaver, Utah. Ron is a tough lawyer and enjoys a good “battle,” and he too was shocked that his former client would kill his wife. Ron’s thoughts were compassionate as to what “this system can do and how it can drag people into a machine of madness (divorce) and spit them out in conditions that are hard to explain.”

The 13 year old was in school, after Goldberg murdered his wife he took his son to his mother’s house (his mother and Peggy were arch enemies, it is reported to me that they hated each other).
Many may want to point their fingers at Judge Cunningham or at Mr. DeCarolis or Mr. Brot for not being more in tune to the actions that were taking place and its affect on people like Mr. Goldberg. Certainly many could say that Goldberg was a jerk and was not doing anything constructive to get on with his life, folks, it is not easy. Russell Scott Goldberg was being paid alimony from his former wife, the woman he would murder in cold blood. Note: Both Peggy and Russell had choices as to what was happening to the two of them in the world of DIVORCE. Neither could seem to figure it out, got $5.00 each take $2.50…No? Go to DIVORCE court and you will walk away with $.03 each, MAYBE, people it is all in your hands…in DIVORCE court, the odds are against you.
Perhaps if he had moved on and tried to find a job and to make his own living he could have dealt with the “issues” in court on the day everything changed. He found a gun, it would seem, with no problem, too bad he could not have found a job just as easily…he put into motion an act of cowardice and evil beyond belief. “He loved his kids”…maybe not as much as some may have thought.
The decisions that judges make in this country’s courts are often tough ones! As I have stated “can’t do it yourself, then a judge will.” The end result of what happened to Peggy Duffy Goldberg and Russell Scott Goldberg is the same thing as when I was a cop. If in the course of my performing my duty someone killed themselves…sad, I guess, but in the end it is not my problem, when you are assigned to do “God’s Work,” shit happens.

Go to Central Casting and tell them, “I need someone who looks like a judge, and he needs to look elderly.” Guess what? the guy you are looking for is in Dept. 43 down at the “Stanley.” Over the last few weeks I have heard different opinions on the “new” judge that took Judge Rafael Ongkeko’s place. Being perfectly honest here folks, Judge Ongkeko was not the most popular judge among the city’s divorce lawyers. Many — not all — would pass on having Ongkeko hear a case. Judge Ongkeko had a personality that was a little tough to understand, I have had that very same problem over the years. Should I say that maybe criminal courts in Van Nuys might be more fertile ground for his style and warm personality…just a suggestion (this was the judge that Mel Gibson’s legal team got booted from his case. Under California law, lawyers have 10 days from the filing date to apply for a different judge).
Back to Judge Robert E. Willett, a former litigator for over thirty years with the firm of O’Melveney. Pretty much right out of Berkeley’s Boalt Hall School of Law (1974) he went to work with O’Melveney and remained there up until his appointment by former Governor Schwarzenegger in 2010 to the Superior Court bench. Now I am just guessing that this had to be a BIG pay cut for Judge Willett. For any lawyer to become a judge it is almost a crowning point, the icing on the cake and again, Judge Willett was not making minimum wage as a 30 year litigatior with a firm like O’Melveney (sounds like a good name for a cookie). So let’s not do any fund-raising for the good judge, now some judges who had other positions and not with big firms or founding partners, them maybe.
I spoke to several lawyers prior to visiting Dept. 43 and having a seat. Some that I spoke to had a wait-and-see attitude except for Patrick DeCarolis of Trope and Decarolis. Patrick told me that he got a sense of “quiet power“ and furthermore to make his point even more clearly, “I like him.” Well I sat in the front row as I often do and watched and listened as a group of four lawyers attempted to practice law. I immediately saw what Mr. DeCarolis had mentioned, “quiet power,” Judge Willett is not going to wring his hands and I don’t see him sitting on his hands and rocking either, he has been around and in far more difficult positions as a litigator than he will be in the position he holds now. My point is that I think we have a new judge who once he gets his footing is going to be one of our favorites at DesperateExes.com.
Sure he has that smile and glint in his eye, more likely he has that even when he is pissed, you know what I mean? And it is going to be the job of any lawyer in front of Judge Willett to figure out — is he smiling because I am doing a good job or is he thinking, “moron”! To me that is the best part of Judge Robert E. Willett.

The Birth Announcement read round the world I would guess of James Nazarian born March 11, 2010!
“There was a flash of joy within the universe early Thursday morning — my son Chris and his adorable girlfriend Victoria together brought their new son James Nazarian into the world at 4:20 A.M. James is 9.9 lbs and 21 inches, and upon hearing this I was so glad that I always gave Victoria the chair at the head of our table during dinner…extra room, 9.9 POUNDS, not-so-little James came into the world at almost 10 POUNDS!! Thank god for medical technology, as what an “OUCH” factor that had to be…I am just guessing, never having given birth.
Becoming a grandfather is an incredible thing. My middle name is James and what an honor to have my grandson named after…me! They named their son after me! I am looking forward to watching James grow, and to assure that he is in the right financial place a stock portfolio will have been put together by the time you read this! After all, if James is going to be named after me he should, at the appropriate time, have a few bucks in his pocket.
I wish Victoria and Chris all the best, and they will have to remember that for the rest of their lives they are now Mom and Dad. And their focus should be to make sure their son James has all the world can offer to him, but most of all the love and caring of each other and together sharing that with James…I am sure they will do all of that as they will be reminded “once in awhile” who James’s grandfather is.

On a personal note, Ken and I have gotten to know Mr. Nazarian over the last two plus years via email and a few phone calls, ever since I talked his publicist into allowing Rose Speaks.com to pick up Mr. Nazarian’s coverage of the Anthony Pellicano trial. Mr. Nazarian is devoted to his two sons and if you look at pictures we put up occasionally with his articles of his cars (the Rolls and Bentley) you will see that the hedges around John’s home is 20 feet high. I think he has always been aware that in his business he has made a few enemies along the way, but I have NEVER seen a picture of his two sons anywhere. So to me, this cute James Nazarian, the grandson of John, he could not ask for a more protective grandfather.
We here at Rose Speaks wish Chris, Victoria and James a long and happy life and to remember your children grow up so fast, enjoy every day, and EXPECT advice from your dad, Chris, grandparents are put on earth to do that and I would imagine John will do that with grace, love and as fierce of protective grandfather as any grandchild can have.
I feel Ken and I at Rose Speaks joins with all of John J. As you can see the list is so large we cannot begin to list them all, but I am willing to bet that James Nazarian’s birth is going to be celebrated in California by all who have been positively touched by the dedication, commitment, professionalism and knowledge John shows to his clients, and to the few lucky enough to call him a friend. Not to forget his one of a kind wit that can make me laugh with my fist cup of coffee.
James Nazarian is beautiful Mr. Nazarian! All of our best to you and your family.

Folks none of this is going to be pleasant, maybe two or three times I have had clients who realized what time it was and did the right thing. What you ask is the right thing? You have ten dollars and you take five dollars and the other side gets five dollars. Otherwise the ten dollars goes like this, your lawyer will take $4.00 and the other lawyer will take $4.00 and some lucky private investigator will get $1.50. I have made this as simple as I can and yes I have seen this done with millions of dollars and yes everyone was thrilled, that is the lawyers and me!
The subject of these articles will be based on real people going through a real day in court. No one has ever accused me of mincing words and if it is a pig I am calling it just that, a pig.”
…. So I hope that my perspective will help women and men who have decided to take the plunge and DIVORCE each other. After seeing Laurel and Hardy on Monday I got away from the craziness that comes with famous dead people and headed for higher ground. Well let me tell you, I stopped by the Honorable Amy Pellman, Judge, department 65. Action for me is judges being just that — judges — and liars, excuse me, I mean people who sit before the judge and tell their sad stories, true or not? Who can ever tell, after awhile it is like being a parent or an old copper who has heard so much crap on a daily basis that even before the offender opens their pie hole you know they are liars.
…I have to tell you that for anyone to have to sit and listen to divorce people wanting to get through the process for 5 minutes can make you want to grind your teeth. These judges who handle family law, aka DIVORCE, are not paid enough nor am I for the constant attack on our common sense. ….She had a Big Fat Liar in her sights and she was not going to be playing anymore games with him or his lawyer. Talk about interesting, here was the “doctor” who was just “broke” and had already paid over $500,000 in legal fees, investigative fees, accounting fees and only God knows what else…But not one cent for child support. This guy had performed the now famous “Persian two step.” For those of you who do not know what this is well let me explain, there are other versions of the two step, but this one is one of the best. …
…Judge Pellman busts one over this guy’s head by telling him that “not to pay child support for five years” was unconscionable and she has had enough. She asks Da Doc’s lawyer, “how many days in a week?”… It is simple folks, you want to totally screw over the X-wifee all you do is get rid of all your assets….
