Lin Wood has gone straight to the heart of the constitutionality of the Anti-SLAPP statutes, could we be seeing the making of a U. S. Supreme Court case on the Horizon?

I read the other day on Face Book where an attorney had just filed his first defamation case and was wishing for a Lin Wood play book. I had forgotten how much I enjoy reading Wood’s filings. At one time I had said Wood’s Court filings were woven with the beauty of a glistering cobweb of a spider on a winter’s morning. As I read through these filings I found myself thinking the same thing. There are ought to be a Lin Wood play book for Libel and Defamation suits, he is still the best there is out there.

Now that the election is over I want to began a dialogue about one of the people I learned about named Sheldon Adelson. Imagine my surprise as I was using Google and PACER as my sources of information that I found that Sheldon Adelson who is an American business magnate, translated Billionaire. Adelson is the chairman and chief executive officer of the Las Vegas Sands Corporation, the parent company of Venetian Macao Limited which operates The Venetian Resort Hotel Casino and the Sands Expo and Convention Center. Adelson also owns the Israeli daily newspaper Israel HaYom. Adelson is listed in the Forbes 400 as the 12th wealthiest American. Adelson personal wealth is estimated to be $20.5 billion as of September 2012. WOW remands me of the case of billionaire magnate Kirk Kerkorian’s divorce and child custody case.

However on PACER I located a defamation suit where Sheldon Adelson is suing David A Harris, Marc R. Stanley and the National Jewish Democratic Council for maliciously false and defamatory statements that conveyed to the public that Adelson personally approved of profit from prostitution in integrated resorts owned and operated by Sands China Limited, a subsidiary of Las Vegas Sands Corp., of which Adelson is a major shareholder, Chairman and CEO.

However what grabbed my attention and caused me to download the papers was the lead attorney, Heavy Weight Defamation Specialist L. Lin Wood.

Rose Speaks.com will be following this case as well as the Beth Holloway case because many of our readers as well as the owners like the Motions and Memorandum of Law L. Lin Wood writes, and you can’t get better than when the rich with unlimited funds sues the rich, besides this case covers the ANTI-SLAPP statutes that gives people like Perez Hilton and TMZ some legal cover for the outrageous in states that have this statute. This case is based on the Citizens United Decision by the Supreme Court that allows Billionaires to give unlimited funds to a political candidate of their choice. In fact in the original filings Lin Wood alleges on his client’s behalf that the defendants’ goal in this lawsuit was to advance their perceived political interests by assassinating Mr. Adelson’s character, punishing him for exercising his right to make monetary contributions to political causes and candidates of his choice, and demeaning him within the Jewish community.

Wood argues on behalf of Adelson that Adelson supports open debate on issues of political concern, the defendants, in this case, made false and defamatory accusations, made with actual malice, and crossed the threshold from constitutionally-protected speech to defamation of a public figure designed to suppress speech for which they should be held accountable.

Although none of the parties lives in New York, Lin Wood states this court has jurisdiction because they all do business in New York and the court has “subject matter” jurisdiction pursuant to 28 U.S.C. 1332.

I don’t know if this is court shopping as we sometime see parties do, for instant East Texas federal courts “specialty” is Trademarks, so you would be surprise at who files lawsuit in our small area for that “specialty in courts” I will check New York and see if there is a “specialty” there as well in defamation or if this is simply the most convenient for everyone.

It appears the main claim by Adelson is that as a philanthropist he has donated significant funds to charitable causes in the U. S. and abroad, one of them is the Dr. Miriam and Sheldon G. Adelson Clinic for Drug Abuse Treatment & Research in Tel Aviv, Israel, which was established more than 20 years ago with his wife, Dr. Miriam Adelson. They have clinics in Tel Aviv, Israel, Las Vegas, Nevada and in Macau.

Many of the hundreds of patients seen by these clinics (the Adelson Clinics), are women whose addiction has forced them into prostitution. The clinics work to support these women, provide them with drug abuse treatment and end their involvement in prostitution.

The Adelsons’ also fund a Medical Research Foundation that conducts, in part, some research into the biology of addictive diseases and the consequential impact on addiction treatment, among other fields.

In a July 3, 2012 article, defendanst David A. Harris and NJDC posted an article and an online petition asking others to support their demand that the Republican Party cease accepting monetary donation from Mr. Adelson. The Original complaint goes on to say the statements contained in the article are false and defamatory and convey the unmistakable message that Mr. Adelson engaged in the exploitation of prostitutes and is worthy of public scorn and contempt. This same author and JNDC posted another article with the same allegations and petition on July 11, 2012. The July 3, 2012 article titled “Tell Romney to Reject Adelson’s Dirty Money”

Adelson claims the only source of this information is a disgruntled former employee of Adelson, Steven C. Jacobs, who was terminated in 2010. The allegations are that Jacobs said he would try to get Adelson and has since then with false allegations in lawsuits as well as giving information to others like being the “only source” in two these articles, has continued to try and carry out his threats to ruin Adelson.

VIP? Bullshit, if you visit the Mandalay Bay Hotel in Las Vegas I need to warn you, it may not be what you think. Especially if they ask you to check into “VIP.”

…On April 1 I decided to go to one of my favorite places in the world, Las Vegas, Nevada. For a long time I had visited Mandalay Bay going back to the early days with my “pal” Oscar De La Hoya. Over four of five years I always had a great room set up, 2 big bedrooms at both ends of a nice suite and a living room/dining room in the middle. My good friend back in those days took great care of me, Joanne Barnes, she is now retired. Bill Hornbuckle has moved to the Bellagio. It was nice then, we played and had a cabana at the pool it was what you would expect…NOT ANYMORE!

This time I called and spoke to Flavia Ernest, she is the assistant to Bill Monson, VP of the place. This guy Monson is no Hornbuckle but still you would think that someone from his office would carry a little weight, not at the Mandalay Bay. She tells me that I have not been here for almost 6 years (after this experience it maybe another six years). Harrahs in Las Vegas treated us pretty nice and I thought it would be fun to go back in time, and hang out at the Mandalay Bay…OMG, BIG MISTAKE! Flavia tells me that she will take care of me and to report to VIP check in when I arrive, good I thought…

…Well we go to the “VIP” room and it is the smallest room I have been in since staying in that little castle outside of Rome last summer. The one I called the “tomb,” it was very quiet and very small. I call the “VIP” desk and get a nice young man, Juan Gatti, he listens and understands that I am unhappy and places me on hold. Juan is trying to make a guest happy and comfortable, he asks if we could use a fold away if he can’t find a bigger room? Well I can’t, but one of the boys can I guess. After a short while here comes Mr. Shit for Brains, Brett Jones, Stupidvisor. He asks, “is everything ok?”, “is the water working?”, is my mother’s picture on the nightstand next to your bed? Then he tells me “the entire hotel is booked and there are no rooms available.” When I asked for his name he gave it to me as to say “who cares.” Brett I hope you think of me every time… …this guy in VIP is and what a great job he is doing in helping “guests” leave the casino/hotel and go someplace else. This is why, folks, all is well in Las Vegas, no rooms and high prices and Brett Jones showing guys with lines of credit the door! If this moron is a “stupidvisor” all I have to tell you America is that all is well in Las Vegas and they don’t… …BRETT JONES, I predict that after…

Funny PTI, I told we would leave and not come back, his response that’s fine. Funny PTII, I have a line of credit at this hotel and still got “yellow carpet” service. You know, stand here and…

In the course of preparing to leave I return to the VIP check-in and the wretch who checked us in was at the “oh well” stage when I asked what is the difference between Mandalay Bay VIP and the rest of the cattle, I mean guests waiting in line to get their “special” rooms. I tell her to find me another room in one of this groups other properties.

That is when I meet Mr. Mike Hejazi, he too is a supervisor but a problem-solver not a miserable “go ahead and leave” kind of guy. He even tells us, “I want you to stay at this property.“ Mike makes a few phone calls and has us moved to THEhotel, this was at one time one of the best hotels in Las Vegas. I stayed at THEhotel in the early days and it was nice, all suites, so I thought that is a good idea and we moved over to their tower. Arriving at THEhotel we go to a VIP check-in again and this time we are greeted by a young lady, Deanna. Deanna looks like she likes her job and has everything ready in a few minutes, her laugh and her pleasant demeanor made myself and the boys feel comfortable. Here is a thought, Brett Jones if ever you get canned here why not try the Tenderloin district of San Francisco, lots of “hotels” that could use your special talents.

Bottom line is this folks, I got hustled by this hotel when I contacted the VP’s office. How? They knew they were going to give me a standard room for top dollar and I guess they really did not remember me. All my old friends are gone and this new batch are not nice…except for Mr. Mike Hejazi and Deanna at VIP check-in at THEhotel.

DESPERATEEXES.com advice: avoid this place, [Mandalay Bay Hotel], at all cost, if they will screw with a guest like me, can you imagine what…

You’ll recall at the last hearing there was a large supportive crowd, a showing of friends and relatives of Lauren Ann Freeman that made quite an impression on the court. My feeling is that the world, so to speak, was watching what was going to be done to Ryan Bowman. He hit and killed a young girl, Lauren, and drove on with little or no thought, other than what I believe was to figure out a way to cover the horrible deed he had just committed. You know, abandon the new Bentley with lights on, keys in ignition, car running and, did I hear, took the license plates off the car…nice touch, Mr. Bowman, very nice touch. And thus, you will always be known as the “Scum From Down Under.”

Well, it was not till the following morning that his “male” passenger decided to turn himself into the West L.A. Sheriff’s Department. My sources tell me that he was traumatized after Bowman hit and killed Lauren. After a nice shower, a light breakfast and phone calls to whoever he thought could lower the heat on his cowardly ass, Mr. Bowman decided to turn himself in. Sure, well-rested and certainly any of the festivities and beverages from the previous night at the Four Seasons Hotel on Burton Way and Doheny in Beverly Hills would be gone or almost impossible to detect — again, all of this is my sole speculation. I am not mentioning the name of the “male” passenger at this time, perhaps later.

….By the way, a system that is broken and at some point will collapse, and I almost forgot, a system that I have little respect for anymore. If our legal system and many of the components were a game in a casino in Las Vegas, I believe it would be shut down for “questionable gaming practices,” my thoughts.

…but in about an hour I will have tears running down my face as two parents describe for the court how their once perfect lives have been destroyed by the “scum from down under,” Ryan Bowman. Truly one of my worst days.

…There was a 9 minute film and soft music showing Lauren Ann Freeman, from a little girl to a young woman in the glory of her life. There was one lady in the courtroom who picked up a box of Kleenex and passed it out.

I cannot remember in recent years my being so emotionally wrecked as I sat and watched the short film, then friends came forward and addressed the court. Each and every one was as tearful and heartfelt as the previous one. Then Steve, Donna and Andrew Freeman stepped forward. I sat and watched as Steve and Donna broke down again and again as people spoke, and now it was their turn. Steve looked at Ryan Bowman and addressing the court stated, “What I can’t understand is how the defendant could leave my little girl in the street like a piece of trash.” I have been with Steve and Donna for months, and heard the pain still fresh in his voice. Later on as Steve, Donna and Andrew stood and looked at Bowman, Steve again looked at him and in a tone that you would have had to be present to understand said, “Like a piece of trash on the road…my little girl.”

All of this was very difficult for me to have to deal with, but this is what I do, I work with and help families who have been devastated by the scum bags, hoodlums, grifters and people like Ryan Bowman. Andrew Freeman, Lauren’s brother, looked at Bowman and stated, “I will never forget what you did here.“…

…Steve Freeman mentioned in his address to the court that Lauren’s diploma came one month after she was killed by Bowman, one month and Lauren never got to see it. It was at or around this time that Judge Eldon Fox removed his glasses and wiped his eyes. The entire court room was in the grips of an emotional roller coaster that seemed impossible to stop. Mr. Bowman’s lawyer Blair Berk also looked drained. Ms. Berk is a mom, too…strapped with the task of a defense attorney. I have it from very close sources that she is a very nice person. And for you who want to complain about Ms. Berk, send it someplace else, she has a job and does it.

……Ryan Bowman will be doing his time in an absolutely wonderful place, located in one of the most picturesque locations in California, Seal Beach.

…Seal Beach Police Department, 911 Seal Beach Blvd. Seal Beach, California 90740…Please I want all of my readers to visit this “Official” website for Seal Beach Detention Services, this is just wonderful for all you rich SOB’s who commit crimes and kill people. This site almost reminds me of camp, you know get a little physical, “bring the following items”…if you or one of your ass-wipe friends need to start the process call 562-799-4100 ext. 1117 and talk softly, don’t want to wake the resting shitheads! Females cannot be sentenced to the Seal Beach Detention Center…hmm, that is interesting, perhaps the gods of shit and misery knew one day Ryan Bowman would be staying here?

… “…Returning offenders to society as contributing members of the community”…sure at one hundred dollars a day, VIP room and board…if you don’t think that the rich and powerful are treated differently visit my world one day…….

I tried to watch the Academy County Music Awards show Sunday night but just could not make all the way through. Instead of being broadcast from Nashville, This years awards were presented at the MGM Grand in Las Vegas. It was a very big production and I’m sure many who were in attendance or who were watching it on CBS enjoyed it very much. I could not because I was swept away with nostalgia and had to change the channel.

The open number was a rock classic and not a country song. Laura Bell Bundy’s big dance number of her debut single, Giddy On Up, look more like a performance from Madonna, Brittany Spears or Lady Gaga, than Loretta Lynn, Tammy Wynette, Dolly Parton or Reba McEntire. The awards may have been for country music but I’m not sure the show could be called country. There was no mention of the Grand Ole Opry, Nashville or the Ryman, which has been called the Mother Church of Country Music. It’s true that time and country music have moved on with time, but has it lost contact with the roots that made it county?

Maybe the fact that it was the ACM awards and not the CMA awards that made a difference. The Country Music Association, CMA, was founded in Nashville in 1958 and has a closer attachment to the Ryman. The ACM was founded in Los Angeles, California in 1964 and in the beginning had closer ties to Bakersfield artist than Nashville insiders.

Whatever the reason, the changing times, ACM vs. CMA politics, or the influence of Las Vegas and the MGM Grand, as big a production as it was, it could not hold this country boy’s attention.
