It is the picture in this article, see red circle of the car, that spawn the gossip that Howard K. Stern was driving a new Mercedes Benz and how tasteless would that be?

First I have not seen the registration nor even the license plate number and until I do I am not buying this. It could be his parents, a rental car, one for his out of town attorneys, etc. However, what if Stern bought a “new Mercedes Benz”? I just don’t think that, it is not his kind of car and what one drives to court does not mean one owns it. Remember we have all heard the stories of Stern’s like for baseball caps and to dress down, so why a Mercedes Benz? For those of you who know cars look at the hood ornament on this silver car and tell me what kind of car it is? If Stern bought this or any other car big deal, if he got money from some of the lawsuits or contracts he negotiated and he chose to buy a new car with that money, great for him. I don’t get what all of the commotion is about. If you have a copy of a registration please scan it and send it on to us, if you prove to me he does own a new Mercedes I will eat my typed words on this blog.

It appears Stern did have one set back yesterday. Judge Robert Perry after hearing the amount of money that had been made since Anna Nicole Smith’s death from body guards to Larry Birkhead, he did agree that better accommodations should be provided to the Texas crew. So out of what is fondly called the roach motel and into better quarters Don Clark and Wilma Vicedomine were entitled to. Stern’s team had paid the airfare although the duo with their attorney Neil McCabe changed it to a later flight on Monday morning, and Stern’s team had to pay for 2 nights lodging at a classier hotel. It came down to in court who was fibbing to the judge? Chris Smith, Stern’s California criminal attorney, said he had contacted the duo and had offered 48 hours notice before appearing. Mr. Smith argued that Neil McCabe should not be allowed to address the court as he was not licensed in California. In the end the Judge did allow Mr. McCabe to speak on behalf of his two Texas clients, asked what his clients wanted, asked the defense team if they were going to call them and then split the argument in half it appears to me. Stern paid the upgrade for the lodging and McCabe’s clients would be hustled out of town by Wednesday morning.

I talked to one person involved in the fiasco to be in town or not to be in town. They said the communications between Chris Smith and Wilma Vicedomine broke down when she emailed him and told him to talk and handle things through her lawyer, Neil McCabe, and Mr. Smith felt Mr. McCabe was not licensed in California. Is there hostility there on both sides?? YOU BET!!!!

However, the big news in all of this to me is that by Howard K. Stern’s legal team subpoenaing Don Clark and Wilma Vicedomine as “hostile material” witnesses for Stern, neither Clark or Vicedomine will be allowed in court for any of the hearings including the trial. I would think that someone else will have to accompany Virgie Arthur to court each day and set with her during the jury trial. In your opinion was this a good move by Stern’s legal team?

It appears the good Dr. Nathalie Maullin is NOT an EXPERT witness, she is just a witness relaying the facts as she remembered them over two years later. I was told she had the personality of aluminum foil and would be a doctor that none of the patients including Anna Nicole Smith would have felt warm, snuggly, or even comfortable with. I went to work yesterday to find out more about Dr. Maullin with the ever changing “definitions and who she talked to” taking place in court. I can sum it up in one long sentence. She had been a doctor barely two years when she “treated” Anna Nicole Smith, and she has been downgraded from the prestigious Cedars Sinai Medical Center to Kaiser Hospital. Enough said.

The other two witnesses yesterday were two pharmacists, Steve Mazlin and Romeo V. Par; very dry testimony reading their records of what was ordered when and by whom.

There was a brief walk on witness to testify that one of Anna Nicole Smith’s alias names was Charlene Underwood and Ms. Underwood made a cameo appearance as this was not her.

Judge Robert J. Perry did not have a good day and is a tad upset with everyone, by yesterday afternoon he was telling Renee Rose to move the case along. Some in the court house heard her say out of court she could be finished by Friday before noon. Court Observers are betting it will last no longer than next Tuesday, October 27. Several Court Observers also said that all three defendants would be bound over for a criminal jury trial and Judge Perry would be happy to be rid of this mess from everyone. I would imagine he has empathy for the judge that inherits this for trial. BEFORE ALL OF YOU GET UPSET!!! Remember I predicted they would be held for trial on a minimum bond, the district attorney has to basically meet the bar of standards of a ham and cheese sandwich and the pharmacists alone probably did that for the prosecution. Judge Perry wants to be done with this. This preliminary hearing has allowed the defense team to see the assistant D. A. Renee Rose in action as well as some of her star witnesses and you can bet that by trial the defense team for each of the three defendants will be loaded for bear and ready to meet and bring reasonable doubt for their clients to a jury. It was Adam Braun, Dr. Khristine Eroshevich’s attorney, who said if the district attorney’s office could not meet the low hurdle required by California statute in a preliminary hearing the assistant district attorneys should be laid off. I agree and if I was any of the defense attorneys I would just let this round go to the State of California. We will see if my prediction is correct.

Now for Mo Mo making over a hundred and fifty thousand with money from interviews which is still probably pouring in from Fox, not bad for five months of work in the beautiful Caribbean with Anna Nicole Smith paying all of his expenses while he was there. His testimony is going to get to when did you lie, at the paid media deals or now at the hearing and on to the jury trial. If Sadow did in fact cause Mo Mo to become angry and agitated then the defense learned a lot from Mo Mo’s three days of testimony and I would bet they are going to go over that transcript with a fine tooth comb so to say. If I was Renee Rose I would make sure there were more people then just Mo Mo that saw what he claims to have seen, if he is the only one I predict that will not get far with a jury.

Next up is Larry Birkhead and the 2.3 million dollars paid since Anna Nicole Smith’s death, well part of it came from NBC contracts to be Tony Potts best paid friend with exclusives for 3 to 6 months back in the spring of 2007, how ever long that contract was for. So the over one million more I would say came from other media like Fox and CBS – Entertainment tonight, and I wonder if Birkhead was also adding up the magazine layouts he has done with Dannielynn since winning the DNA test? If he can make this kind of money GREAT, it means he has the dough to take care of his daughter.

I was sent an excerpt of something that suggested Birkhead was pocketing Dannielynn’s money and cheating Dannielynn trust account, WRONG. If Larry Birkhead is in the interviews or pictures sold, the money goes to him. If the money coming in is for the use of Anna Nicole Smith’s name and/or likeness it goes into Dannielynn’s trust account. IF at a later date Birkhead decides to be in a reality show, which again I heard the first editing was a bomb, then the money MADE by Dannielynn would have to be held for her in another trust account NOT the Estates. The same goes for if she appears in pictures alone or begins to model, that money would have to be held and accounted for, EVERY penny. Since Birkhead testified that he had made that much money there is no reason to doubt him. Birkhead has also become a household name in the last 2+ years as has many in this sad saga.

The big question is did Larry Birkhead lie about the young new assistant district attorney Sarah Slice and his conversation with her. If these allegations floating around the courthouse corridors and the district attorneys office are true and Birkhead did lie what a crappy thing to do to a young assistant district attorney, in my opinion. She was back in court yesterday and all was normal and she has learned to NEVER talk to a witness outside of the courtroom. The reason is because in court it can be spun to look like you did a naughty and the witness is the victim. I do have to say this fiasco got Birkhead international coverage and bumped Mo Mo from the papers, perhaps that was the plan all alone. If Birkhead lied about his conversations with Ms. Slice then shame on him to take advantage of a new and probably friendly attorney. I bet in all future hearings involving this trial, the state of California vs. these three defendants we will see two big burly bailiffs bring Birkhead in and out of court and Sarah Slice will never forget this hard learned lesson in the legal world of the rich and famous.

I have often said this site will close before it becomes a propaganda site for either side in all of these lawsuits. However, if I am told something and I can verify it through at least one and preferably with two other independent sources it will appear here and hopefully start a good dialogue.

I hope we have debunked part of the gossip and put perspective on the rest, and yes it was the courthouse discussion as it was in the offices for the district attorney that the allegations of Birkhead lying is true, I guess we will find out with time won’t we?

There is no court today and I believe the rest of the witnesses are not going to give us the fireworks that Mo Mo and Birkhead provided.

UPDATE: I did forget to mention that there is of course some main media in the courtroom as well as bloggers covering the case. Those bloggers sharing with me or telling me where to look, they are great and neutral…. HOWEVER, there are some bloggers in the courtroom that do not appear to be fair and unbiased, they have been identified as VA bloggers and now their identities are known and they will be dealt with appropriately.

So what is in Howard K. Stern’s hand?

Day six is completed and there is approximately 4 days left until Judge Perry hands this entire mess over to the trial judge for the case. Tell us your thoughts and would someone look up the car in this picture and tell us what the hell it is?

I had court observers tell me over and over again this week, that before this preliminary hearing started they felt it had been a fatal error on Howard K. Stern’s part to bring in an out of state lead criminal attorney, Steve Sadow. It was thought that as many good criminal attorneys as there are in California and especially around the Los Angeles area that any jury would not relate to the southerner in cowboy boots, Steve Sadow.

During the preliminary hearing we have read from court observers that Judge Robert Perry stops Sadow as he is going into a long oratory before asking a question of something like “hold on, this is a preliminary hearing not a trial keep the questions short and to the point”. Then we had Daniel DiCriscio describing in just the morning session that Steve Sadow, lead criminal attorney for Howard K. Stern, was jumping up every few seconds to object to something the Los Angeles assistant district attorney, Renee Rose would began to ask to object.

However, that seems to be evened out by the judge not allowing a lot of evidence in about Anna Nicole Smith, her life, potential sex escapes, tapes etc. that Renee Rose is trying to introduce. One witness blames Stern and Dr. Khristine Eroshevich as Mo Mo did, and then another witness does not know anything about Dr. Khris but did talk to Dr. Sandeep Kapoor and so the “show goes”.

“Show”?? Yea but about a real person’s life and every facet of it more then two years after her death, I keep asking myself why?

Did we need to know about all of her physical ailments? Did we need to know, as one writer, said where even the remote to her T. V. was kept? Did we need the dueling banjos of testimony of Mo Mo followed by Larry Birkhead to dispute that fact? Birkhead explained what seemed to be a far more logical explanation and one I had heard way back in the spring or early summer of 2007. If I could find this why did the “lead investigator” Danny Santiago NOT find this?

Everyone who is a court observer agrees that the most damning evidence to date is Mo Mo, after all he was with her the last 5 months of her life. By the way if he did that because he loved her and never got paid, doesn’t that mean he lived off of Anna Nicole Smith in the beautiful Caribbean as the fingers he pointed at Stern seemed to indicate? Why was Mo Mo willing to lie for months and months and then decided he wanted to set the record straight? For that matter which record is he sticking to finally? I have so many questions about the devoted Mo Mo and so few answers.

I have heard it said that Howard K. Stern better hope that Sadow has a big enough bat to handle Mo Mo or his legal name of Maurice Brighthaupt, and does he? Well I talked to several court observers after the almost 3 days of Mo Mo then followed by the southern voice of Larry Birkhead and here are some things they are saying. First and foremost to date the only damning witness has been Mo Mo, but let’s look at that and what some have not written about.

Under cross examination Sadow was able to agitate Mo Mo, that won’t play good to a jury for Mo Mo to appear like a giant ex bodyguard with an axe to grind with Anna Nicole Smith’s Estate which equates to Howard K. Stern and Larry Birkhead. One court observer told me about this last week that they did not care for Sadow personally but that he was “very likeable” and that is what plays to a jury. If the lawyer is likeable and has some good points and can agitate the top witness to date that does not bode well for the prosecution. One court observer told me, it does not matter if you like Sadow personally he is one hell of a likeable lawyer in court. Here is my own interpretation of what MIGHT have happened between Mo Mo and Sadow in just one question and all of you have posed some great questions here on the blog by the way. Sadow: “So Mo Mo which time are we to believe when you are choosing to tell the truth, now or when you were being paid over a hundred grand for appearances when you said something entirely different”? Mo Mo, gets agitated and glaring at the lawyer and said: “This time I am just now trying to set the record straight”. Now agitated and that lame of an excuse for lying while the money was coming in but not now, how do you think that is going to play to a jury?

I had heard the account given by Larry Birkhead about the AMA show before and have written about it. Allegedly Anna Nicole Smith had a grand mal seizure the night before her appearance. Two doctors were called and both said to give her a double dose of her seizure medication. As hard as it is for most of us to believe the beautiful Anna Nicole Smith had anxiety before a public appearance and especially for this one with her weight loss. She had insomnia and had not slept for thirty six hours straight. I have heard “gossip” that besides the seizures and no sleep she had taken a Xanax several hours before she was to appear to try to sleep. Did Mo Mo have any explanation for that? Another witness who is suppose to give damning evidence is Nathan Collins but even he told me he had asked around and had talked to Kim, Anna Nicole’s personal assistant for years and had been told way back in 2005 the same recounts as Larry Birkhead gave on Friday. So could Mo Mo have just forgotten all of that as the months and years have gradually slid past?

Then there are all of the horrid things we are learning about the health and habits of this beautiful previous playmate of the year turned model. Did any of us really or need to know about everything she suffered from? Did any of us want to really know about her personal habits including liking to drink out of a baby bottle, keeping baby food snacks near her bed and all of the other very personal things we are now finding out? I did not and it kind of makes me physically sick, how about each of you?

This brings up an email I found I still had from 2007, it is talking to someone else, now remember I have never spoken to Howard K. Stern, Larry Birkhead, Virgie Arthur, Mo Mo and most of the people in this saga and certainly NONE of Anna Nicole’s inner circle. However let me recount in part what this email says. Remember at one time I did do some domestic violence advocacy work and I can say for certain that adult survivors of child abuse are almost impossible to reach out to or help. In this email I say “I have been able to “VERIFY”…. I have no idea who I was talking about when I said “verify”. However, the email goes on to say, “there were at least four different personalities of Anna Nicole and she referred to them as this. Vickie Lynn is the girl that came from Mexia Texas, Nickie was the stripper, Anna Nicole was the model and red carpet walker, and Robin was a little girl”. I believe in the email I am musing could one of the secrets that Stern has vowed to protect in death could be the fact that Anna Nicole suffered from multiple personalities? I don’t know but those of you who have read the last week and followed Anna Nicole Smith in life, could that be true? If it is do we have the right to know all of that now over 2 years after her death?

So in the end as it appears now that all of Anna Nicole Smith’s secrets will come out will Steve Sadow have a big enough legal bat to handle those like Mo Mo as Howard K. Stern dearly hopes so? This will be only a half day session from 8:00 AM to noon in the California Court where the Preliminary hearing is being held for Howard K. Stern, Dr. Sandeep Kapoor and Dr. Khristine Eroshevich.

Witness of the State of California expected to be called today is first a toxicologist to explain the interactions of Anna Nicole Smith’s various prescriptions medication and the way the interact and to firm up the state’s case that any prudent doctor would have known Smith was taking a lethal combination of prescriptions. We have now learned from the AP this morning that the toxicologist is Dr. Harold Schueler, the Broward County coroner’s chief toxicologist. He testified under cross examination by one of Stern’s attorneys that; “Anna Nicole Smith’s poor health in her final weeks may have complicated her reactions to drugs prescribed by doctors now facing charges. He confirmed that Smith was suffering from a bacterial infection before she died. He said in court today that could have affected her sensitivity to drugs she received for pain, anxiety and sleeplessness.”

Also scheduled is the body guard Maurice Brighthaupt, “Big Moe” and Larry Birkhead, although Adam Braun, attorney for Dr. Eroshevich says he will ask that Birkhead testimony be postponed because he had only recently received an audio tape of the interview that State Investigators had with Larry Birkhead about the prescription drugs and the drug use of Dannielynn’s mother, Anna Nicole Smith.

Big Moe, Maurice Brighthaupt, Anna Nicole Smith’s body guard for several years has just laid out today’s bombshell in court and now has the press running to get cameras in place and TMZ to start rolling live coverage outside of the court room. I have been told he is coming across very credible by one court observer and has been on the stand about an hour. Moe is testifying that he saw Howard K. Stern in the bathroom “cooking up drugs in a spoon” and then injecting them into Anna Nicole Smith, more on this as we find out, and everyone thought this would be a dull half day testimony.

In a Houston court this morning one of Virgie Arthur’s attorney,Tom Pirtle, and Wilma Vicedomine are expected to ask a judge to stay the subpoenas for them to testify in the preliminary hearing as “hostile witnesses” for Howard K. Stern. We will keep you posted as to how this turns out as well. I have been told that the team for Ms. Arthur sees this as harassment to keep anyone from her team out of the court where now they can not observe the court proceedings to let her know as she remained in Texas how the Preliminary hearing is progressing. We have now been able to verify that Don Clark, Tom Pirtle, one of Virgie Arthur’s attorneys and Wilma Vicedomine will be present for court in California on Tuesday, October 20. The strange thing about that is that there is NO COURT on Wednesday, October 21, so could that be a vacation day for these three witnesses being called by Howard K. Stern’s legal team?

We do not know where Neil McCabe and Don Clark are today or if Don Clark has been asked to stay over to testify later in the week in the preliminary hearing as we get information on that we will keep you updated.

Expect today to go for the state and the prosecutors after a jerky start yesterday, I predict Renee Rose will make a quick come back today and now she has had time to study the defense lawyers strategies and each of their style in this Preliminary Hearing. Danny Santiago is now finished setting the frame work for the rest of the state’s witnesses.

Several court observers said yesterday that Ms. Barth was back and in tight pants again with the gallery of about 65 people getting a good look at the pants riding up in the crack of her behind. Someone should tell her to get a size bigger and to be aware of what she looks at to the gallery which are the majority of who is in the courtroom. Ms. Barth was also described as hugging and “hanging off” of Neil McCabe before the hearing started yesterday.

FINAL UPDATE FOR OCTOBER 14 IN STATE OF CALIFORNIA VS. HOWARD K. STERN AND THE TWO DOCTORS

Tomorrow will be the cross-examination of Big Moe, Maurice Brighthaupt, Anna Nicole Smith’s one time body guard. Following that will be Larry Birkhead who just recently gave the state a statement on the record that the state has now turned over that tape to the defense. It is predicted that the whole day will be taken up by just these two witnesses. One of our court observers said Stern looked like he wish he was dead, another observer said he just shook his head no, bit his nails and wrote on a legal pad.

Court will resume tomorrow at 8:30 AM, wonder if we should expect a new bombshell daily in all of this?

In “A Question of Murder,” the true crime book that gives an insider view of the death investigations of Daniel Smith, his mother Anna Nicole Smith, and others, famed forensic pathologist and lawyer Dr. Cyril H. Wecht, and his coauthor Dawna Kaufmann, reveals facts never disclosed before.

The following is a brief summary of Wecht’s take on the case — but you’ll want to get a copy of the book and savor it yourself.

In September 2006, Howard K. Stern and Michael Scott, at that time Anna Nicole Smith’s lawyer, placed a conference call to Dr. Wecht, asking him to perform a second autopsy on Daniel Smith. Wecht agreed, as long as it was understood that he would report his findings to them—even if they were not the findings they had hoped for—and that his report would be made public. With Stern and Scott’s assurance, Wecht flew to the Bahamas.

Wecht had noticed that coroner’s representative Linda Virgill had been in the media, feeding the frenzy that Howard K. Stern was a suspect for having harmed Daniel, his girlfriend’s 20-year-old son. It was time for Wecht to learn for himself why the lad died.

In Nassau, Bahamas Dr. Wecht met with Stern; Anthony McKinney Michael Scott and his associate Tracy Ferguson; and Wayne Munroe at a local beach club after being checked into the Atlantis, one of the Caribbean’s premier resorts. Wecht spent a lengthy brunch getting their background on Daniel, Anna Nicole and Stern. Stern said that Daniel had lost 25 pounds during the summer of 2006 and that he and Anna were alarmed. Stern gave a general rundown of the boy’s health, including hospitalizations, but there was no mention of Daniel having ever had a Valium addiction. When Daniel had arrived in Nassau to meet his baby sister and see him mom again, he was so excited he practically ran into the hospital room, according to Stern.

The book discusses Stern’s financial dealings with various magazines and TV shows, which Wecht felt was common practice in the entertainment industry and good business. Photo shoots of newborns and happy families always command a top price, Wecht explains.

Howard K. Stern describes the minute-by-minute events in Anna Nicole’s hospital room during Daniel’s visit. Smith only drank water or juice, as she had never developed a taste for carbonated drinks, it was reported.

Everything seemed great, although Daniel Smith once wondered aloud why he was so tired. Howard told Wecht that the comment later haunted him.

Nassau medical examiner Dr. Raju, with whom Wecht had worked previously on other cases, performed Daniel’s primary autopsy. He welcomed his friend Wecht and together they assessed the young man’s body once more, comparing notes. They looked at his stomach contents, but there was nothing noteworthy there, such as undigested pills or capsules. As Wecht worked, he made notes which have never been reported elsewhere.

Raju had attributed Daniel’s cause of death as “accidental multiple drug toxicity,” and Wecht concurred. Raju had sent tissue samples to LabCorp, an excellent basic toxicology lab in Tampa, Florida. When the results came back, Daniel was found to have had methadone, Zoloft and Lexapro in his system at death. All three were of a high therapeutic level but the combination of the three was what sent him into a fatal downward spiral.

SSuicide was ruled out because of, among other reasons, the open joy Daniel had shown with his new baby sister, “This family that should have been looking forward to the approaching holidays together, instead of having one of them dead and the others left to defend themselves against baseless charges,” Wecht wrote.

With suicide eliminated, murder, accidental death, or undetermined were the other options for manner of death. Dr. Cyril Wecht would have his own independent toxicology tests conducted with a separate lab, before he could assert how and why Daniel expired.

Dr. Wecht sent his own samples, collected during Daniel’s second autopsy, to the National Medical Services lab in Willow Grove, Pennsylvania. In Wecht’s opinion, NMS is the premier forensic toxicology experts in the U.S., if not the world.

Following Daniel’s procedure, Dr. Cyril Wecht was met outside the morgue in the Bahamas by a barrage of media, consisting of reporters and camera crews. With Stern’s permission Wecht held an impromptu press conference, with attorneys Scott and Ferguson also present. In more than four decades of doing this work, Wecht had never seen such a constant and intense barrage of news media inquires, at the scene and for weeks to come.

After the press conference Dr. Wecht was driven to Horizons. He saw happy family photos adorning the walls, in sharp contrast to the red-rimmed eyes of Howard Stern and Anna, with whom Wecht had a touching and interesting exchange. Before she returned to her bedroom, Anna squeezed Wecht’s hand and thanked him for examining her son. “I don’t know how this happened,” Anna sobbed. “Daniel was a good boy — he wasn’t into drugs.”

The people at Horizons gave Dr. Wecht a good overview about who Daniel was and his relationship with his mother and Stern.

Later, still at Horizons, Wecht had a phone conversation with Dr. Sandeep Kapoor, who was both Anna Nicole and Daniel’s doctor. Kapoor confirmed that he had prescribed methadone for a then-pregnant Anna because it was safe for a fetus, but he had never prescribed that drug to Daniel.

When Dr. Cyril Wecht returned to the states, he saw that public interest in Daniel’s demise was still raging. Fox News’ Greta Van Susteren led a panel where talking heads suggested there had been foul play. Wecht marveled that so many people had opinions, without having seen the toxicology results yet.

Wecht spends a fair amount of time discussing how Daniel might have come to ingest the drugs that killed him. Both Stern and Anna Nicole said they did not furnish the pills, so where did Daniel get the medicine, who prescribed it to him, and why?

Over the next several weeks, Dr. Wecht continued to appear on TV shows to discuss this case, always with Stern’s blessing — but by no means did Stern have input on what Dr. Wecht would say.

Coauthor Dawna Kaufmann describes playing for private eye Jack Harding the video clip of Anna Nicole inviting Daniel to visit her in the Bahamas. This fresh insight is also exclusive to the book and fascinating to read. Harding tells of his encounters with Daniel, asking for the P.I.’s help in saving his mother.

Multiple sources—from Harding, to Anna’s mother Virgie Arthur to former pals and employees—have said Stern controlled Anna and doled out drugs to her every four hours. This book analyzes ever person’s commentary and their possible motivations.

Dr. Cyril Wecht says he received at least 20 phone calls from Stern, at all hours of the day and night, making specific requests, seeking information and urging the doctor to communicate with the toxicology labs and various people. Stern seemed to be aware of every comment about the case on every cable TV news program and in every magazine and newspaper, and appreciated Wecht’s skill in getting across accurate information in those sometimes fast-talking, sound-bite environments.

Drs. Raju and Wecht spoke frequently via their respective offices in Nassau and Pittsburgh, Pennsylvania, while awaiting the final toxicology results. There’s some charming personal information about how these two expert medical detectives viewed the media storm surrounding this case.

On Nancy Grace’s Cable Headline News’ program, information was given as fact that was later disproved by toxicology reports. But Grace’s show wasn’t the only one where wild speculation occurred. Wecht talks about watching many of them and wondering if they were more vested in promoting an agenda, rather than following the facts.

Dr. Wecht has many cogent observations about Virgie Arthur and her clear pain over losing a beloved grandchild and fearing for her daughter’s well-being. And Wecht gives rich details about his views of Stern, whose sincerity seemed genuine. Of course, Wecht was also mindful of the potential giant pot of gold these people, and others, might be chasing. In looking at the motivations of the many people who had been around Anna and her son, Wecht performs psychological autopsies and holds back nothing.

This riveting book also contains new details surrounding Daniel Smith’s funeral that I have never read in any other accounts. Included is Anna Nicole Smith’s plaintive wailing: “I don’t want my husband, I want my son back. Leave me alone, leave me alone. Don’t touch me!” Rosespeaks.com readers know what the nannies’ account of the day was like, but “A Question of Murder” offers another view.

Also revealed in the book is a prescription drug that Daniel took, which Wecht declined to identify during his Nassau press conference. Wecht explains his reason for mentioning it in the book, and why it should be part of Daniel’s autopsy record now. I must say the inclusion of this drug stunned me.

Daniel Smith’s full autopsy results, including the NMS Labs toxicology, were made public in January 2007. Around the same time, in Nassau, attorney Wayne Munroe became the sole attorney for Howard K. Stern and Anna Nicole Smith. Munroe would be behind every important behind-the-scenes move for the pair from then on.

More surprises come with Dr. Wecht’s accounts of the Bahamian Coronial Inquest, including how and why it seemed to start and stop. Wecht found two inquest witnesses especially problematic, and he paints a vivid picture as to who and why. One man’s testimony was so troubling to Wecht, it evokes a series of emails and calls between the doctor and Stern.

In the final analysis, Wecht writes his truthful views of all of the players in this case — the people we know so well at Rosespeaks.com. You may agree with him, or you may disagree, but you can’t help but be impressed by his decision to expose the full spectrum of personalities and events surrounding Daniel’s death.

And Dawna Kaufmann’s research and writing nicely fills in who this tragic 20-year-old was in life, making him a complex and fun human being who never got the chance to live his life to the fullest.

As convoluted as Daniel’s investigation was, Wecht notes the sorrow he left in his loved ones’ hearts. He ends the chapter with this thought about Daniel: “Hopefully, when [people] think of him, they will remember the joy of his life, rather than the mystery of his death.”

As we wait for the papers, or at least the Order unsealing the papers in New York, a solid source contacted me about all of this, a source who had contacted one of the people facing a Preliminary hearing legal team and whom they felt was very rude to this person.

This sounds like the old song for some reason “Leroy Brown”, dunno why it just does.

As we await all of the papers today, why would Tom Bednarek not want anyone to know he had the “ear” of AG Jerry Brown? It could not possibly have to do with Rita Cosby?

Why did Bednarek tell this source from 2005 to the spring of 2009, I can help and did in fact help? Why would Rita Cosby need Bednarek to call in a “favor” from his old at least has the ear of “AG soon to be gubernatorial candidate Jerry Brown? Why would helping this source/friend with Brown hurt the Howard K. Stern prosecution?

Why tell someone you had been working with that as this source said to Bednarek in an email, “I told him that you know Attorney General Jerry Brown so you may get a phone call.” In another email just two months before the indictments this source wrote to Bednarek, “I want to thank you for helping, [name omitted], by contacting Attorney General Jerry Brown.” Why in an email did he request this source to always refer to Rita Cosby as “R” saying, “Would appreciate it if from now on… in all of our correspondence…? THAT we only refer to one another ONLY as K and T… AND my gal as R… Okay?! This IS very important…” In another email Tom Bednarek said in part, “Again, should you ever want to discuss this with me, we can certainly do so, so long as it is CAREFUL HANDLED over the TELEPHONE.” In yet another email about offering help he stated; “Additionally, other than “Tom” … there will be no need to include my name within any letter you enclose. He will be aware of the package…”

In another email about the pillow talk while Rita Cosby was fast hammering out her future best selling book and shopping it around why did Tom Bednarek wanted to brag about his closeness to Cosby and exactly how close that pillow talk is as he states; “Although she is heavily committed on a number of major initiatives at this time, she is always very interested to learn more about a story such as this… I know… we’ve been together for well over seven years now, and I know her heart. She would be a phenominal ally to have, BUT I can tell you first hand… that she is extremely engaged right now… and has a number of prior works she is deeply involved with. On the other hand … she is an amazing “multi-tasker!!! HA! But seriously, as mentioned, I will see what either she can do to help AND get this into the right hands for you.”

Finally just less than two WEEKS after the indictment of Stern Bednarek called this source and said “I can’t help you with AG Jerry Brown, and please don’t contact me again”. Following that was the last email exchange of four years of working together on ONE project with Bednarek and Cosby:

“Hello Tomaczek, It’s sad you decided not to keep in touch with me after you told me you would send the documents I sent you … to Jerry Brown. It’s been 8 months since …I’m asking you again to send the information I sent you and Rita …to Jerry Brown. I remember you telling me that you had a direct phone number for him. I can’t understand how you think sending this information could hurt the Stern case. You reasoning just doesn’t make sense to me. Thank you,”

Yea Tom why would helping with the ear of “feel good AG Jerry Brown” hurt the pending Stern case? Did you use up all of your “favors” keeping “R” or Rita Cosby as most of us know and call her by out of the deep fat frying pan? Why did you and Cosby want to make sure the indictment was announced before the Summary Judgment was ruled on in New York? How long had you been sharing pillow talk with “R”, [Rita Cosby], with AG Jerry Brown?

All good questions I think, what about ya’ll? My source has snail mailed me a ton of information on this project that we will begin to explore in the new year in greater detail right before the gubernatorial candidates, including Brown, began their major fund raising? By the way the “project” that is discussed with promises to help by Tom Bednarek is about a non-profit foundation of which there are allegation of “money for favors”, isn’t Brown in charge of those? Could AG Jerry Brown’s friend Bednarek with over four years of documentation sink feel good Brown’s bid for that brass ring called the governorship? A brass ring that Brown wants so badly in what some say is a hope for the blissfulness and power he once held as the prince and the rising star in the Democratic Party way, way back in the 70’s as a young “cool feel good” Brown.

I have told my source to print out the hard copies of all of the documentation and send them to me, put them in a bank vault and at least in two other people’s hands so Bednarek cannot undo the damage to his beloved “R”, known to us as Rita Cosby.

Tom, Tom, Tom, you tried so hard to not leave much of a paper trail in all of this, but in trying it rings of nanny gate in my ears.

We will be bringing you more of what this source has to say, including the way they were treated by one of the legal teams of one of the people facing the preliminary hearings in October of this year.

Now for today, we await the Court’s Order releasing the papers, could “exhibit J” be Bednarek deposition about nanny gate? Who knows only the unsealing of all of these promising delicious documents will tell us.

To keep up with the papers to be unsealed keep this list handy, and remember ALL of Howard K. Stern’s deposition and all of Rita Cosby’s deposition is included in the documents. I don’t know about all of you but I await the release with excitement that a lot of the pieces will begin to make more sense and like a haze in the morning light will become the bright sun of daylight and the telling of all of those secrets, including pillow talk of nanny gate.

Very quietly in January 2009 was published a book by Crime Story writer, Dawna Kaufmann, and renown Medical and Forensic Examiner Cyril Wecht M. D. J. D., called “A Question of Murder” appeared on store shelves and online book stores. The book deals with five cases and goes through how Dr. Cyril Wecht arrived at his conclusion in relation to “A Question of Murder”. I now have the book and this one TRULY has never before published information surrounding the death of Daniel Smith and Anna Nicole Smith. I have only skimmed through the 2 chapters, having laid the book on my bedside table, and saw two glaring things that caught by attention. That Dr. Wecht contacted Howard K. Stern about the testimony of Dr. Hern at the Inquest in Daniel Smith’s death in the Bahamas. The second thing that caught my eye right off is the related facts that in the chapter concerning was Anna Nicole Smith’s death “A Question of Murder” or even of possible murder, is a detailed dialogue of a conference call between Dr. Wecht, Howard K. Stern and Dr. Khristine Eroshevich. Dr. Wecht had extraordinary access to many of the main people who were really in the know about the death of Daniel Smith and his famous mother Anna Nicole Smith. It is well written which is a relief after reading the ninth grade level of writing of Rita Cosby’s book.

I suggest Barnes and Noble for the book but then I have a preference for them. After I read the chapter I will discuss the “A Question of Murder” for Daniel Smith. That will be followed by a discussion of “A Question of Murder” for Anna Nicole Smith. If you don’t like Barnes and Noble a link section on our main site has numerous online stores to purchase the book from.

This book is riveting in the teaming up of Cyril Wecht M. D. with Dawna Kaufmann the Crime story writer to make sure it holds one interest and is not loaded with too much medical jargon. It holds the attention of the reader in great details about all five cases covered in “A Question of Murder”.

I am going to give each of you time to order your copy or pick it up at your local book store before I begin to discuss it. After you have purchased your copy write down the questions you have about “A Question of Murder” we will have access to the authors to finally separate, rumors the out and out lies that tabloid media deal with, and I hope we find the truth; or as much as we can before the preliminary hearing in October.

How Rita Cosby’s book made it to the best seller list and this book did not is beyond my comprehension. Oh yea, the book of the true blond ambitious Rita Cosby had explosive allegations often not covered by facts at all per Judge Denny Chin. His finding outlines his “thoughts” on the meeting the bar of both malicious intent and for punitive damages to be tried before a jury.
