As the California Criminal Trial of Howard K. Stern, Dr. Sandeep Kapoor and Khristine Eroshevich looms for August 4, 2010, the Estate of Anna Nicole Smith tightens the noose on four major witnesses.

You have to wonder if this will affect the credibility of Ford Shelley, G. Ben Thompson, Gina Thompson Shelley, Gaither Ben Thompson II and Melodie Thompson as well as attorney Susan Brown. It also appears that Magistrate Judge Thomas E. Rogers III for the South Carolina Federal Court decided to issue this Order without need of a Hearing.

On July 1, 2010 the Court in South Carolina issued an Court Order allowing the addition of Gaither Thompson II, Gina Shelley, Melodie Thompson and the attorney Susan Brown and her Law Firm in Atlanta Georgia. The new defendants have twenty one (21) days to answer the Amended First Complaint so don’t look for this to go to trial before the criminal charges in California is tried to conclusion.

HERE ARE THE HIGH POINTS I FOUND IN THE COURT’S SEVEN (7) PAGE ORDER

“Plaintiff asserts causes of action for conversion, wrongful taking of estate property in violation of California Probate Code § 850, et seq., statutory and common law commercial appropriation of right of publicity in violation of California Civil Code § 3344.1, unjust enrichment/restitution, unfair competition in violation of California Business & Professional Code § 17200, et seq., violation of the Computer Fraud and Abuse Act, 18 U.S.C. § 1030(a)(5) and civil conspiracy.

That the Estate’s property has been distributed to other entities including Geraldo Rivera with Fox News, the O’Quinn Law Firm, former television journalist Rita Cosby, and the California Department of Justice.

Counsel for Ford has consented to the filing of the proposed Amended Complaint. See Email from MacDonald to Lantta dated October 28, 2009. Thompson has not filed a Response in opposition the motion. The only opposition comes from proposed new Defendants Brown and the Law Firm. 1 Brown argues that allowing the amendments would be prejudicial to her and would be futile as to the claims against her. Brown does not appear to oppose the addition of Gaither, Melanie and Gina as Defendants in this action or to the addition of factual allegations regarding Ford’s distribution of Estate property to other third-parties.

[Brown] argues that she would be prejudiced due to the fact that she has not had the opportunity to participate in discovery as a party. However, in his Response, Plaintiff asserts that he is not opposed to amending the deadlines in this case to allow Brown to conduct discovery.

Brown argues that, as former counsel in this case, she is immune from the claims Plaintiff seeks to allege. Generally, an attorney is immune from liability to third persons arising from the performance of his or her professional activities as an attorney on behalf of and with the knowledge of his or her client. See Hunt v. Mortgage Electronic Registration, 522 F. Supp.2d 749, 758 (D.S.C. 2007). However, both Thompson and Ford testify that they did not authorize her to distribute Estate property to the O’Quinn Law. Firm.

The Clerk of Court is directed to file the Amended Complaint, which is attached as an exhibit to Plaintiff’s Motion. Plaintiff must serve the Amended Complaint within 15 days of the date of this Order. Defendants must respond in accordance with the Federal Rules of Civil Procedure. Ok after reading the First Amended Complaint I see this is the same exhibit filed with the Court in September 2009, so nothing new here; just has not read it in almost a year.

On the Anna Nicole Smith Estate vs. G. Ben Thompson, Ford Shelley etc. I am did not see any papers filed by some deadline for December 28. I tried to figure out if it was a Response by Susan M. Brown’s being added to the suit as well as Gina Shelley, Gaither B. Thompson II and his wife Melodie Thompson. It could be a Reply by the Estate due on a Response filed by one of the defendants in regards to the Motions for Contempt, Sanctions and Joiner of additional parties. Which ever it was it was not filed on time unless there is a delay on showing up on PACER.

December 29, 2009, G. Ben Thompson filed an Objection to his attorney Mr. Joyce’s Withdrawal as attorney of Record of Thompson in the federal case of the Estate of Anna Nicole Smith vs. G. Ben Thompson, Ford Shelley et al. I wonder if this is the reason that the Responses or Replies due on December 28 have not been filed?

On the Virgie Arthur vs. Howard K. Stern, TMZ, et. al. in the 80th District Court of Houston, signed an Order yesterday on December 28 giving the Plaintiff Leave (permission) to file the late documents in response to CBS Motion for Summary Judgment, and also giving CBS Request to supplemental their evidence for the Summary Judgment we should have a copy of this later today for your downloading pleasure. This Order appears to be no win or win for both Arthur and CBS, the new judge is allowing both of them to supplement their filings in reference to CBS Motion for Summary Judgment.

Tomorrow we will list the five cases we feel was the worse or the most bizarre, we would like to hear which ones you found that way. You can use the archive months found on the right hand side of the main pages for you to do a quick review to pick the five you want to list.

On December 31 we will list the five cases that we feel were the best of the cases or had something unusual happened during that case that changed the dynamics of that case. Again we would like for you to list your cases you thought was best of had something unusual that changed the dynamics.

I will have a short article up later today with links to some of the documents and some musings on who and who not are looking forward to television reality series or be part of a documentaries, it will surprise you we think.

At what point did Gerald say “Tough Shi%@*!”? I remember Ford Shelley appearing on Greta Van Susteren’s On The Record on Fox numerous times beginning shortly after the break in of Horizons with copies of tapes, pictures, emails etc. I believe I remember that Ford Shelley and his wife Gina even invited Greta Van Susteren’s on a tour of their home in South Carolina proudly showing it off and which rooms Anna Nicole Smith her son Daniel Smith and Howard K. Stern had stayed in during the Christmas holidays of 2005. Didn’t Shelley and his family, Laurie Payne and didn’t even Ben Thompson appear on at least of one of Geraldo’s shows? Then there is the March 31, 2007 hour long show that towards the end Ford Shelley told Howard K. Stern to “Bring it on”, I guess Lin Wood took Shelley up on that and it would appear if Shelley’s deposition is to be believed that Shelley cried like a baby to try to keep Geraldo from showing some tape on one of the shows, would that be the Oct. 2007 show? I also remember Shelley saying smugly that Howard [K. Stern] would be surprise when he learned how many copies of the hard drives had been made and who had them. I guess that surprise is now NOT one.

So is Ford Shelley and father-in-law G. Ben Thompson throwing one of their attorneys Susan M. Brown under the bus or would that be an eighteen wheeler?

Ford Shelley refers to both Danny Santiago, his boss lady, Ford Shelley and “for him, [Shelly], Susan Brown. Frankly I don’t see anything wrong with that, would most people who could afford an attorney have one present during a recorded statement to be used by the California DOJ or the California Bureau of Narcotics. It appears from Shelley’s June 2, 2009 deposition that is what he is saying and that it was Susan Brown and not one of his criminal attorneys he asked to be present during that taped statement.

Ford Shelley goes on to say he “avoid Agent Santiago calls until his lawyer Tommy Brittain told Shelley that he “needed to meet with [Santiago]” …”My lawyer in Florida set it up.” Both lawyers were top criminal attorneys that Shelley retained right after arriving back in the U. S. from Horizons after Anna Nicole Smith’s death. Mr. Brittain if I remember correctly went with Shelley to turn in the items taken from Horizons to the Horry County Sheriff’s department on the afternoon of February 12, 2007 and it was Shelley’s attorney in Florida, Walter “Skip” Campbell, Esq., if I am not mistaken that talked Dr. Perper into holding up the autopsy results to late in March 2007 on Smith pending that Shelley wanted Dr. Perper to look at some evidence on some computer that Shelley and his Florida attorney thought would implicate Howard K. Stern and that was all in Feb. and March 2007.

What is up with this tape of Ben Thompson on Fox about being a pedophile that Neil McCabe allegedly called about and then wanted to talk to Shelley about “did I [Shelley] find the tape?” What tape is Shelley referring to in this part of his deposition? That last conversation with McCabe occurred two weeks or mid May 2009 with Shelley if Shelley’s memory was finely alert enough to remember who and when he talked to any of these people. Before that it had been about a year ago, [May 2008], when “they came to town. ..John O’Quinn, Neil McCabe, Don Clark and WV [and] “that was to see the Clown Video”. Didn’t Ford Shelley appear at the burial proceedings in February 2007 as a witness for O’Quinn and didn’t Shelley authenticate and offer into evidence a segment of that now infamous clown video?

Some of the other highlights from Ford Shelley excerpt of his deposition on June 2, 2009 that caught by eye are the following:

“I didn’t feel comfortable…. I didn’t feel comfortable just in general. I mean, I didn’t – other than that meeting they [Neil McCabe, Don Clark and WV], asked to speak. Susan Brown set it up. … [Meeting] lasted a couple of hours maybe.” … There was nothing to tell. My issue through all of this is just about ownership of the house, not — not being drug into accusing anybody of anything because I have no knowledge of that. My issue is with the house and I don’t want to be involved in the other parts of this thing….on October the 27th of 07, on Geraldo’s show, which — I said it, Anna — when Geraldo referred to Anna in her drunken stupor and those things, it upset me. And I even clarified him and said, “No, she wouldn’t have done anything to her my child ever”, okay? and I know that. …and Howard is — he’s cold hearted. …I’m mad that it’s been drawn out this… My bitch is about the money I spent for the house and I’m being drug into these other things and what I found used against others and I don’t like it. ..No, but I’m going to say this. If she thought it was in our best interest, [Ms. Brown handing over copies of tapes to be copied], or she was served, then she has my authority to release it if that was required. …”

Here are some of the highlights that caught my eye from Ford Shelley’s excerpt of his deposition on June 3, 2009:

(Q) Did you tell Larry Birkhead that you would not return the clown video to him because it showed your daughter Riley on it and so you were therefore asserting ownership of the clown video?

(A) I told Larry Birkhead that — yes, Sir, I did…Because I meant it and I said it. And I turned it over to the California Department of Justice when I was required.

(Q) Have you talked wit her [Susan M. Brown], about why she would have given Don Clark of Neil McCabe or Anna Nicole Smith’s hard drive so that they could copy those hard drives?

(A) I called her yesterday and asked her. …She said it was part of a lawsuit that was in — with Virgie Arthur. And I told her that I don’t know and I don’t remember — I haven’t signed anything agreeing to be a party to a lawsuit. And she said “Well, I have to find out,” I said, “I *wasn’t*

(Q) So this was news to you, what she told you yesterday?

(A) You floored me yesterday, sir. … Your damn right. I didn’t know it. .. I did not know it. …So I had to back up and regroup and say, you know what, he was right to feel what he feels. His feelings are right too. He’s got feelings. And how he is taking this in matters. And I just don’t look at myself anymore. I’ve got to look at how he sees it, how I see it, but what really is the truth, and the truth is in the eyes of the beholder. There’s a happy medium. He wasn’t wrong and neither was I. We both said and did things. Truce I’m ready to go on…”

Is the “he” that Ford Shelley is talking about Howard K. Stern? If it is Howard K. Stern how will this deposition compare with the taped interview with Agent Danny Santiago? If the “he” is Howard K. Stern, how could this deposition and this last statement help or hurt the California criminal charges?

G. Ben Thompson missed the filing date the Court set of November 3 for his mandatory filing of the Rule 26 f of initial disclosures, also Howard K. Stern’s attorney pointed out that due to Thompson’s attorney being ill they had not been able to hold the required conference via phone.

The Court approved Susan Brown to represent Ben Thompson. Howard K. Stern has attorneys approved for Pro Hac Vice status, including Lin Wood, Luke Lantta, Nicole Jennings Wade of Powell Goldstein as well as his South Carolina attorneys.

The best reading in my opinion is the Rule 26f filings required by the Court of which to date Ben Thompson has not answered. Ford Shelley lists only 3 witnesses, himself, his wife Gina Shelley and Howard K. Stern. However, in Shelley’s rule 26-3-a local rule filings, he lists only himself and his wife Gina Shelly as witnesses or persons that have information relevant to these allegations.

What caught my eye was the list of people who have possessions of some of the items alleged to have been taken out of Horizons the day after Anna Nicole Smith’s death.

1. Defendant Shelley has possession of a copy of a clown video.
2. All documents and tangible items related to litigation in the Bahamas which are in possession of the Bahamian authorities.
3. All documents and tangible items in possession of the California Department of Justice as to any investigation relating to Ms. Smith.
4. All documents and tangible items in possession of co-defendant Ben Thompson and/or his agents.
5. All documents and tangible items in possession of Larry Birkhead and/or his agents.

Which leaves the question of who has the ORIGINAL copy of the infamous Clown Video?

Howard K. Stern’s filing is a tad more revealing about where Stern’s team is going. In his required Rule 26-f list of the following witnesses.

(1) Howard K. Stern
(2) Larry Birkhead
(3) Pol’ Atteau
(4) Rita Cosby
(5) Don Clark
(6) Wilma Vicedomine
(7) Stancil “Ford” Shelley
(8) G. Ben Thompson
(9) Tom Pirtle, on of Virgie Arthur’s Texas lawyer at the burial hearing
(10) Tracy Ferguson an attorney that is part of Callendar’s in the Bahamas that G. Ben Thompson is suing.
(11) Gaither Thompson
(12) Melanie Thompson
(13) Gina Shelley
(14) Representatives of Fox News
(15) Representatives of Biscayne Professional Associates (possibly the company that imaged Anna Nicole Smith’s computers and hard drives when the Estate recovered them)

Howard K. Stern lists several Counts that make the basis of the Estate’s case against Ford Shelly and Ben Thompson and a couple caught my attention.

Count Three: Statutory and common law commercial appropriation of right of publicity:

Under California law, the right of publicity survives the death of a celebrity. Thus, any person who uses a deceased person’s name, voice, signature, photograph, or likeness, in any manner . . . without prior consent from the executor of the deceased person’s estate commercially misappropriates the deceased person’s right of publicity. Cal. Civ. Code § 3344.1.

There can be no dispute that Ms. Smith held a fully descendible right of publicity
in her Estate property. See Cal. Civ. Code § 3344.1. Further, Shelley has admitted to removing documents and materials from Horizons after Ms. Smith’s death. There is no question that these documents and materials are owned by the Estate. Further, there is no dispute that these items removed by Shelley contained Ms. Smith’s name, voice, signature, and photograph. Shelley used the property by, among other things, distributing it to third parties, including media entities. Shelley had no prior consent from the Executor to use the property he stole from Horizons.

Count Six: Violation of the Computer Fraud and Abuse Act:

Whoever knowingly causes transmission of a program, information, code, or command, and as a result of such conduct, intentionally causes damage without authorization, to a protected computer; intentionally accesses a protected computer without authorization, and as a result of such conduct, recklessly causes damage; or intentionally accesses a protected computer without authorization, and as a result of such conduct causes damage and Forensic analyses confirm that Shelley copied and deleted files contained on the password protected computers and external hard drives owned by the Estate, which Shelley unlawfully removed from Horizons. Shelley lacked authorization to access the computers and external hard drives. Shelley’s conduct caused damage and losses in excess of $5,000 in a one-year period. causes losses of at least $5,000 in a one-year period, violates federal statute. 18 U.S.C. §1030(a)(5).

Forensic analyses confirm that Shelley copied and deleted files contained on the
password protected computers and external hard drives owned by the Estate, which Shelley unlawfully removed from Horizons. Shelley lacked authorization to access the computers and external hard drives. Shelley’s conduct caused damage and losses in excess of $5,000 in a one-year period.

Stern’s Local Rule 26-3-a, lists most of the same witnesses with the exception of Wilma Vicedomine which leads to ask when and why did she become involved with Ben Thompson and Ford Shelley?

Howard K. Stern’s lists the following evidence and documents in the same disclosure that he and/or the Estate (Dannielynn Birkhead as the sole heir) might use to prove the claims.

The following categories of documents in the Executor’s possession, custody, or control may be used to support his claims:

(1) All documents referred to in the Complaint.
(2) Documents relating to the investigation into Defendants’ unlawful conduct in the Bahamas.
(3) Media interviews of Defendants.
(4) Communications between Defendants and third parties regarding the factual circumstances that form the basis for the allegations in the Complaint.
(5) Deposition transcripts of third parties in other litigation regarding the factual circumstances that form the basis for the allegations in the Complaint.
(6) Forensic analyses of Ms. Smith’s computers.
(7) Communications from counsel for Defendants which support the factual basis for the allegations in the Complaint.

So folks why did Ben Thompson miss the date of November 3 and has not notified the court or ask for an extension due to one of his lawyers being ill? Who edited the Clown Video and who has the original now? Why is Tom Pirtle listed, but the rest of Virgie Arthur’s legal team in Florida are not? Then we have Don Clark on both disclosures but Wilma Vicedomine as the lone separate person missing in one of the filings.

Could the Clark/Vicedomine investigation lead us from California, to Florida, to New York to South Carolina in the alleged attempts to have Howard K. Stern arrested and tried for something, anything it appears if the filings are to be believed.

We have added these two pictures to our birthday mystery of “two of everything” for Riley’s birthday party. Do you know who the four adults are in the first picture? Do you see two bikes and two dolls in either of these pictures? We have the whole interview on tape, and I did not see that even going frame by frame.

Smith’s computers, hard drives and digital videotapes and disks, containing all of her personal digital pictures and phone videos, were stolen. Also taken were infant daughter Dannielynn’s birth certificate, banking information – and a yet-to-be-released DVD copy of Smith’s flick “Illegal Aliens,” in which she plays a lingerie-clad babe intent on saving Earth from intergalactic evil.

Ford Shelly Jr., the landlord’s son who admitted taking the items after Smith’s death, said he had a right to enter the property – and anyway, he wanted to “secure” the items for Dannielynn. “Let’s get something straight: That is our home,” Shelly told The Post. “We were going to make sure that Dannielynn’s mother’s possessions were kept protected for her.”

The above will become important as we go through the ever shifting of stories/memories of Ford Shelley and crew.

Now onto the Feb. 19 2007 There is only a partial “paper” transcript of excerpts on this interview in the Fox archives. However, we are fortunate to have the whole video that we watched before doing this article. This would have been eleven days since Anna Nicole Smith’s death, ten days since the “allege theft” of Anna Nicole Smith’s things, a full week after the first appearance on Greta’s On The Record, and 6 days after turning over “select items” to the Horry County Sheriff’s department of the booty admitted taken by Ford Shelley.

All shows not done live are edited, and thanks to John O’Quinn latest court filings, we now know they are edited for sensationalism and not to “educate the public”. With that line of thought we have edited this partial transcript of the Fox News archives.

Ford Shelley: We got her in the middle of May, she went to the Keys end of June or first of July and she stayed there until July 18, when we moved her to a rental house in the Bahamas. While at the Keys she was there with Ben (G. Ben Thompson), his mother, Gaither II, Melanie and their 2 children.

Gina Shelley: Gaither and Melanie left the Keys and left Anna their at the Keys with Ben’s mother.

This “memory” changed since the interview on February 12 with Greta when Ford and Gina Shelley said they were with Anna Nicole Smith during that full eight to ten weeks of Anna Nicole’s last trimester of pregnancy “except to leave for a weekend trip”. So which is it, they were the ones shoveling drugs down Anna Nicole Smith, Ben’s mother was doing the shoveling, because as of now Lori Payne has still not be named as the “main person” who shoveled the prescriptions that kept Anna Nicole Smith “out of it” for that time. This will become VERY important in the March 31 interview with Geraldo, because per that interview someone had to be doing the shoveling of drugs down Anna Nicole Smith to keep her as wasted, as that interview will “imply”.

Ford Shelley: On July 18 Ben and I flew down to the keys. Ford Shelley goes on to add in response to a question from Greta; “from mid May to end of July Anna was the happiest he had ever seen her”. From July to Mid August with Howard only showing up for brief periods of time from the end of July until in August.

Again, I have to ask who was in charge of the “duffle bag of drugs” that Ben and Ford would become so fond over the next year of describing for us? Who gave Anna Nicole Smith ALL of the drugs during the last trimester of her pregnancy? Did this crew keep her so drugged up that is why Ford says, “she was the happiest he had ever seen her” [Anna].

Gina Shelley: …at some time in end August, Riley (their 9 year old daughter) spent some time with Anna. Anna knew we were coming to the Bahamas for a week and Anna said, “I want to have a Riley – Anna day”. We said that was fine, and Anna said, “no you don’t understand I just want it to be me and Riley, and that’s it, and I want to play with Riley for a WHOLE day ”.

Gina Shelley: Everything was fine when we got there, everything was decorated, they had MATCHING bicycles, matching baby dolls and coloring books and crayons. Anna had bought TWO of everything for them. Gina remembers saying, “You sure you are up for this and they were like yea, ya’ll go have a good time for a few hours, just give us a few hours we want to have some time by ourselves.

Gina Shelley: That’s fine so we went to ah dinner…

Remember during sweeps just a couple of weeks ago, Ford Shelley told Tony Potts that Riley was with Anna Nicole Smith and Howard K. Stern for 36 HOURS; however, we will give him that slip and say from 3 to 6 hours, but how long was dinner that night/day?

Just one week before when describing these eight weeks with Anna Nicole Smith, Gina Shelley had said, “We had a wonderful time. She spent a lot of time with our children. And my brother and his wife and their children went and stayed with her when me and Ford had to go out of town one weekend“.

As responsible adults did, Ford and Gina Shelley “mention” to Anna Nicole Smith or Howard K. Stern that it would not be a good idea for Anna to be riding a bicycle just three weeks before her baby would be born [referencing the comment Gina Shelley made on February 19 that Anna had bought two bicycles]. As responsible adults that would later on Geraldo tell us that Anna Nicole Smith was so stoned when she was with them ALONE, that her eyes rolled back in her head. In fact, they would share on March 31 that Anna Nicole Smith was out of it on drugs the whole time in their care from mid May to the end of July. So Ford, tell us who gave her [Anna] all of those drugs to keep her out of it and her eyes rolled to the back of her head while in your care?

Gina Shelley: That’s fine so we went to ah dinner and we KEPT calling and checking on Riley, and Riley would say I’m fine, I’m fine, don’t come get me I’m fine.

Stop the camera folks; turn off the lights, let’s read this “scripted” television show again. Gina Shelley is saying they “KEPT calling and checking on Riley”. During any of those frequent calls why didn’t Riley mention to them that Anna Nicole was not acting right, or Howard would not help Anna, and Riley was scared for herself or Anna?

Most of us who have raised children are in tuned with the sound of our child’s voice from reassuring us that they were having a fun time, to 45 minutes of hell and being scared. Don’t most of you notice a change in one of your children voices? Aren’t most of you VERY in tuned with that change? As my husband just said, most parents can even tell if you are lying to them or not.

Now we are going to change to the brief transcript of an excerpt from the Greta show, F. SHELLY: Well, it was almost like Howard was taping these so he could sell them, because he — on the tape, he made reference to — it was going to be worth some money.

Once again, a year later Ford Shelley was able to “remember” with Tony Potts that Anna Nicole Smith made her living selling video diaries. Ford Shelley with Tony Potts even said, “All of these things were done for profits to SENSATIONLIZE, for them [Anna and Howard] to make a living”. SENSATIONLIZE, meaning being something that is fantastic and incredible, to cause intense interest, curiosity, or emotion, commanding attention, “a stunning performance”, a manner of being extremely controversial, loud, or attention-grabbing. It is especially applied to the emphasis of the unusual or atypical. It is also a form of theatre.

My next question is knowing that was true when did Anna Nicole Smith stop putting video diaries up on her site to sell? Didn’t a guy named Mark come forward later to say he did edit many of those video diary tapes but did not do this one? If this was done in August 2006 and Howard K. Stern had wanted to make money, would this have been put up on Anna’s official site? Perhaps Anna Nicole Smith and Howard K. Stern did intend to keep an afternoon party, documented but not sale it. After all, to sale it they would have had to obtain a signed release from the four other adults there as well as one from Ford and Gina Shelley to allow their daughter to be on the web site “for sale” at Anna’s official site, right?

G. SHELLY: It [the video of the birthday party] shows them having a party and Reilly painted her face like a clown and they had face painting and they started playing baby dolls. And then Anna’s believing that this baby is her baby.

I have an observation here since the parts of the edited video we have all seen has ONLY ONE doll in it, could Anna Nicole Smith been in a “child like mode” saying to another child, “Stop that is my baby, don’t take my baby”? Like hey kid you have your own doll why are you trying to take my doll too. Have any of you ever seen two children “fighting or claiming ownership” of the same doll or toy?

G. SHELLY: And then Reilly keeps going up to Howard saying, you know, “Howard, tell her it’s got a battery. Let’s go get a screwdriver and take it out and show Anna this is not a real baby.” So, I mean, this went on for probably about an hour. Until…

Ford Shelley interrupts Gina so we will never know what the rest of her sentence was going to be.

F. SHELLY: Well, that’s all we know.

GINA SHELLY: “Please call the doctor, Howard. Let’s call the doctor,— Reilly’s like, “I’m going to call my dad.” And Howard’s like, “That phone doesn’t work, honey, the one in the kitchen does.” And when Reilly ran out to call, Howard tells Anna, “You’re scaring Reilly. You’re scaring Reilly, Anna. You really need to straighten up. You’re scaring her.”

Once again, I am going to say that most of us who have raised children are in tuned with the sound of our child voices from reassuring us that they were having a fun time, to 45 minutes of hell and being scared. Are we to believe that during all of those frequent calls of Gina and Ford Shelley to check on Riley they NEVER noticed something was not right? Hello, am I the only one to see a hole big enough in their story to drive a Mac truck through?

VAN SUSTEREN: How about Anna, how does she look to you in that tape, Ford?

F. SHELLY: Just distorted. It wasn’t Anna. ………..And I’ve looked at that tape, and I have regretted ever letting my child go to that house.

Ford, Ford, Ford as we will later hear during the March 31, 2007 interview, you and your employees are going to share that for the whole eight weeks Anna Nicole Smith was stoned out of her head with her eyes rolled back in her head, Howard K. Stern was NOT there. That Ford and Gina Shelley’s employees NEVER saw Anna during that time when she was not completely stoned. Sounds to me like good personal friends and responsible adults, NOT!

VAN SUSTEREN: Why do you think the videotape? I mean, , this whole party there’s videotaping.

Because we now know this tape was edited into segments for the court, and these shows, it appears to me that Greta is saying that the video tape in its entirety shows a “whole party”.

F. SHELLY: But we can’t say — we don’t know. I mean, we didn’t — we’re seeing this for the first time. We’ve seen her act different and we’ve witnessed mood swings with Anna.

“We’re seeing this for the first time”. Ford, Ford, Ford, you had this copied by February 9, 2007, you have stated word for word on several shows by now what you wanted us gullible watchers of Infotainment, as John O’Quinn said in his latest filing, to “get”.

BY THIS TIME OF SHOWING SEGMENTS OF THE “CLOWN TAPE”, FORD AND GINA SHELLEY HAS THIS PART OF THE TAPE THEY ARE TALKING ABOUT MEMORIZED WORD BY WORD BUT WITH A DIFFERENT TONE THEN WHAT YOU HEAR HOWARD WITH ON THE TAPE.

This appears to me, to be a recurring statement of Ford Shelley. “That they had witnessed mood swings” with Anna Nicole Smith and had seen her “act” differently over the time they spent with her. Wouldn’t responsible parents have been a tad concern about leaving their nine year old daughter with Anna Nicole Smith before dropping her off and spending part of that time knowing about the video taping of the party? Clue to that the four adults in our first article picture, so “adults” did know the party was being taped. Wouldn’t responsible friends and adults have reacted to “something is not right with Anna Nicole Smith”? Why would Riley not tell or not think if she told her parents about her fears that day that her parents would not act like responsible adults and get Anna Nicole Smith to the doctor or hospital. To borrow a phrase from Lincoln Bains, I smell a rat here. How long after Riley called her parents scared, did it take them to get there? We know Riley had access to the phone because Gina Shelley tells us that.

VAN SUSTEREN: Had you ever come to learn that maybe the day was not a particularly normal one?

FORD SHELLY: We’ve later found out and we didn’t know it, that Anna wasn’t up (INAUDIBLE) herself that day. Anna was — Anna had — must have taken something to calm her down, but Anna wasn’t herself that day.

VAN SUSTEREN: That day was taped, do we have some clips of it…

Ford Shelly: And she didn’t understand. Anna didn’t mean it. But, Howard is a grown man, and he’s sitting there videotaping this and watching Anna. She needed help. She didn’t need that.

Which Ford, brings me back, you are a grown man, and all of your family are adults that had Anna Nicole Smith under your care for most of the last trimester of her pregnancy. If we are to believe this “sell job” from you, son of a used car sales man, then why didn’t you get Anna Nicole Smith help if not before this day, then as soon as your daughter called and told you she [Riley] was scared something was wrong with Anna?

VAN SUSTEREN: The one on the video, frankly, she looks like she’s on something to me.

G. SHELLY: Right. And it’s.

VAN SUSTEREN: See and this is three weeks before her baby is being born or two weeks.

G. SHELLY: Right.

So once again, we know Anna was at the end of her pregnancy, and once again, we know most of that time was spent alone with the S. C. group. Now we are being told their nine-year-old thought Anna needed help and these responsible parents, adults, never made one phone call to get help to their “good friend”. We are now told it appears to me that they never pleaded with Anna Nicole Smith to go to the hospital. Sadly, if they and these edited clips are to be believed they never attempted to intervene.

VAN SUSTEREN: So, what’s the role of Howard in all of this?

F. SHELLY: We don’t — I’m not going to be the judge of that.

We now know this is NOT true by all of Ford Shelley’s actions. He has been the main peddler of this tape among other things, with many different law enforcement agencies, including having three criminal attorneys and at least 2 of them trying to get Howard K. Stern arrested in Broward County. Therefore, in my opinion, if one is to believe that Ford Shelley was “not going to be the judge of Howard K. Stern” then that goes back to selling swamp property. However, the infotainment industry did act as an enabler to Ford Shelley in my opinion. Fox especially gave Ford Shelley a stage for his attacks on Howard K. Stern any time Ford Shelley wanted on and was prepared to give Geraldo or Greta just a tad more of the mud Ford Shelley was “peddling”.

F. SHELLY: I don’t think we ever knew Howard.

G. SHELLY: But, yeah, I mean, I don’t think.

F. SHELLY: I don’t think we ever knew him. I don’t even know him today. The man I thought he was.

G. SHELLY: So many things have transpired over the course of us being with Anna, that I don’t think I knew the person that I met, you know. The person that stayed at my house, I don’t know him.

My take on this is that the above statements about not knowing Howard K. Stern is the truest statements spoken on this interview, but not for the reasons that Ford Shelley and Gina Shelley are saying here. In my opinion, a LOT of people did not know Howard K. Stern. A LOT of people underestimated him. Beneath his calm laid back exterior, in my opinion, is a brilliant man with a stone resolve NOT to let “friends” like these destroy Anna Nicole Smith’s image and legacy. They did in fact never know Howard K. Stern or the love he had for Anna Nicole Smith. To defame Howard K. Stern was probably one thing to Howard K. Stern in my opinion. However, they crossed the line when they bashed Anna Nicole Smith and Howard K. Stern knew that Dannielynn would grow up one day to read and hear all of this garbage.

F. SHELLY: She wanted to be loved. She didn’t want to be laughed at. She didn’t want to be the tail end of someone’s joke. She just wanted to be loved and to be normal, but that didn’t sell. What sold is her crazy antics and the way she was. And I understand that, but she needed down time. She needed some down time and that’s what she wanted from us.

Here is a HUGE insight to Ford Shelley and all of the S. C. crew in my opinion. With this statement, “… She needed some down time and that’s what she wanted from us”. However, that was the LAST thing Ford Shelley, G. Ben Thompson and this crew ever gave Anna Nicole Smith. Instead of loving Anna Nicole Smith, instead of cherishing her as a generous friend, they have tried to destroy her image in my opinion. Not to mention serving an eviction notice the day after Anna Nicole Smith buried her beloved son. Not to mention the now infamous tape released of Ford Shelley taunting Anna Nicole Smith and suddenly going from $950k and/or a gift to 1.4 million in wanting her to sign papers to pay them ALL of that over one year. Yea, Ford Shelley didn’t get rich as a real estate mogul by kindness. He turned the electricity off twice after serving Anna Nicole Smith with eviction notices between October 1 and November 21 of 2007. What a friend!

Ford Shelley: Howard was there for both, I believe he loved her but I don’t know if his love I think he was obsessed and infatuated by her. Because if he had actually done, what a grown man in charge of a woman who was unstable he would have …

Well Mr. Shelley, you and Ben and Gaither II were ALL grown men and from your accounts were in charge of Anna for most of her last trimester. You seem to be saying here that Howard K. Stern knew Anna Nicole Smith was “unstable”, if you are to blame him, then must you and your family also take responsibility as well? What did all of you do for Anna Nicole Smith if your “shifting memories” are to be believed during the time you were “in charge” for all of those long weeks?

VAN SUSTEREN: Howard ever say anything to either one of you?

G. SHELLY: No.

F. SHELLY: No. He don’t need to, now. I don’t want to ever lay eyes on him again. I don’t want to, you know, we got to — I don’t want to lay eyes on him. And we got Anna’s funeral.

If this wonderful family did not bother to attend Daniel’s funeral to comfort their good and close friend, Anna Nicole Smith, because they were out having eviction papers drawn up on her during her darkest hours, why should anyone believe they would have been invited to Anna’s funeral. Oh wait, Virgie Arthur’s third of the church was empty, because she would not allow Anna’s friends to have those seats, but I bet she offered them to the S. C. crew if the truth be known. For some reason I have the feeling that Howard K. Stern does not want to “lay eyes” on you either, Ford Shelley, unless it is to finally recover all of that stolen booty, hawked and sold by what appears to me to be Ford Shelley and NOT Howard K. Stern.

Ford Shelley: Well I will say for the last 6 months I have not been myself and the last few weeks have been really difficult for me. Howard stole her heart from her, I preserved what was left of it and that child will get it.

During the six months before Anna Nicole Smith’s death, Ford Shelley was “enough of himself” to draw up eviction papers; mortgage papers; and have electricity turned off twice. Ford Shelley was “enough of himself” to pillage Horizons right after Anna’s death; to snatch and grab anything that might be of value to Mr. Shelley; copy computers; external hard drives; have glossy pictures made from those images taken from Horizons by Ford Shelley’s own admission. Now he says, “he was not himself”, WHOA, wonder what Ford Shelley is like when is “him self” and is really capable of attempting to get over on a real estate deal? One more thing “that child” has a name of Dannielynn just like your child has the name of Riley.

About the four people in that first picture we will be repeating in at least 3 more articles about Ford Shelley, G. Ben Thompson and family, another hint. None of the four extra adults at the pool birthday party EVER worked for Anna Nicole Smith.
