Elizabeth Taylor

When I think of Elizabeth Taylor, I think of my Mother, let me explain; ever since I was a little kid, Liz and my Mother seemed to be living in two different worlds yet shared very similar life experiences and illness problems later in life. Sometimes the cards piled up against Liz and it seemed she wasn’t dealt a fair hand, and I could hear my mother saying, “Oh, poor Liz, I feel for her. I would love to talk with her because it seems she and I would understand each other”.

I know a lot of people feel like Liz Taylor was family to them or an inspiration; her lavish and amazing lifestyle and career were what motivated a generation. She was such a huge star that everyone feels such a strong connection to her.

You can maybe try to compare her to one of today’s new Hollywood generation crop of starlets or socialites like Paris Hilton, one of her relations, but there is no one like Liz! A lot of Hollywood’s Movie A listers claim what a huge influence she was on them and some of them may even copy her style, but to be the first of your kind is very hard to duplicate.

Beside the fact that Mom and Liz both were Pisces; they both liked lavender, they were loving and caring yet brutally honest at times, and a somewhat resemblance that in some photos was “spooky” to me… Liz would have been my Mom’s doppelganger for Face Book!

I remember Liz at a Halloween event I attended in 1998 called “Dream Halloween Children Affected by AIDS Event” at Barker Hanger at The Santa Monica Airport. She was platinum blonde! She had everyone at this event on their feet applauding when she took to the stage. She was the Fairy Godmother of AIDS causes! This was an amazing appearance for her since in 1997 she underwent brain surgery for a benign tumor. I actually couldn’t believe how great Liz looked sans her famous teased hair in her LIFE Magazine post brain tumor operation photo spread! At the event many A list stars showed up in Halloween costumes, like Jamie Lee Curtis in her “Cat” Costume. I remember when Jamie Lee was coming off the red carpet and she was twirling her cat tail and walked up to me and “purred”! Jamie is fun and never takes herself too seriously!

Liz was a very private woman, yet was very sweet and friendly and down to earth once she let you in her world. I first met Liz when she was married to Larry Fortensky. I remember Larry Fortensky and I talking one time, he just rolled in from Palm Springs and was absolutely “smitten” with Liz. Larry was not the typical “Hollywood” type of guy that you think Liz would have been with, but in reality, Larry was what she liked and needed… at that time! Liz had so many marriages to “dream guys” like Conrad Hilton, Eddie Fisher which sparked a war with Debbie Reynolds, Richard Burton and so on, that made every woman in the world dream what would it be like to have been her.

Although, Liz could be brutally honest and be a “broad” at times, and this is what made her so unique. She was strong, yet weak at times.

Her weight gains and losses made news as well as her fashion and hair choices. Her famous mole even made news! Funny, I have a mole on the same side of my face like hers, as so did my grandmother! Hmm, coincidence? Joking of course!

Whether you liked Liz for her acting, persona, charity work, her “White Diamonds” perfumes, or heck you just liked “Her”, she is a legendary lady and “STAR”… yes, all capitals,… and she will be greatly missed. I am sure she will never be forgotten, how could she?

The list of movies that she will be immortalized in; “National Velvet”, “Giant”, “Who’s Afraid of Virginia Wolf”, “These Old Broads” her last movie, and “Cat on a Hot Tin Roof” and of course my personal favorite “Cleopatra”, just to name some.

The funeral for Elizabeth Taylor was held yesterday, Thursday March 24, 2011 at 2:15 PM, 15 minutes “fashionable late” per Liz’s instructions. It was a private service at the same cemetery where Michael Jackson and in the same Mausoleum as Jackson.

I remember a month before my Mother passed away she called me and Liz came up in the conversation because Liz was admitted to the hospital. My Mother said to me “I wonder who will die first, Liz or me?” Anyway, Liz is gone and she will be greatly missed. Legends Never Die.

Keith Olbermann

Never underestimate the power of talent and friends that are media savvy. After Al Gore with Keith Olbermann held a phone conference call with reporters on Tuesday, February 8, 2011 to announce the coup of getting Olbermann signed on the dotted line; the war of words began with ratings being thrown around on Wednesday February 9, 2011 in the ongoing fracas.

It appears that Comcast in their take over of that other “network” thought they had Keith Olbermann boxed in with a no-compete FOREVER provision of Olbermann’s termination package including a stipulation that NBC Universal had thought that Olbermann was down and out. The no-compete permanent clause is reported to state; “That agreement also stipulates that Olbermann cannot work for any network considered a competitor.” Current TV was not thought of a competitor and was not included. It appears that the former network thought they had confined Olbermann’s talent to just internet or radio in the future. This is a prime example of never understate real talent and that is what Olbermann has “real talent”.

NBC Universal is also giving Current TV and Olbermann better advertising then money can buy with the war of words that Al Gore seems to be basking in shooting shots back and forth between Gore and MSNBC management.

It is rumored that Olbermann will get stock in the company founded by Gore and other friends as well as “TOTAL CONTROL OF HIS OWN CONTENT”, that will not bode well for MSNBC I predict. It is not much to ask for control of one’s own content when being a news or opinion commentator in television or print media. As far back as Walter Cronkite and Tom Brokaw both insisted on that in contracts. In fact it appears that Brokaw is still having control of the content of NBC Universal and he might have just led his employer down a slippery slope since he began to gun for Olbermann and worked behind the scenes to push Olbermann out.

You know I hated Current TV when it premiered on DirecTV because it replaced the only international news channel that DirecTV had on air. I am feeling all warm and fuzzy about them today as I am sure many of you do as well.

Per the Hollywood Reporter it is reported that “In a conference call with reporters on Tuesday, Olbermann described the show as an improved, amplified and stronger version of the show that I just did at my previous network… …Olbermann said yesterday that he would address his time there at some point in the future. MSNBC had no comment.”

Current TV network has seen the real talent that Olbermann can bring personally but also as the new chief of news officer Olbermann will finally get the control to turn a network around as Tim Russert did for the cable part of NBC News during his life time. Current TV has already set up a production team to work with Olbermann before he premiers in late May on the network.

The Hollywood Reporter went on to report that Al Gore stated that “Among his many talents, he has an eye for what works, what doesn’t ,who would be good on his show and potentially doing other shows. We’re going to let that evolve. He’s always done that. He was more responsible than anyone else by far in making the brand of the network he most recently worked at and. before that he was more responsible than anyone else for Sports Center, the heart of heart of ESPN. So he knows how to do this.”

Al Gore and Current TV did not miss the part of Olbermann being the center tent poll for an MSNBC tent as it appears those programs in prime time begins to dwindle in audience; well all but Rachel Maddow who was mentored by Olbermann. Current Media CEO Mark Rosenthal for Current TV sees an opportunity in what he described as the white space between “scripted reality” found on networks including History and Bravo and the hard news networks including CNN, MSNBC and Fox New Channel.

The L. A. Times has reported that the war of words continue today with Al Gore ruffling the peacock feathers by saying; Current TV, which has about 60 million subscribers in the U.S per Gore who said; “We have more subscribers today than MSNBC had when Keith Olbermann began working for them in 2003”. MSNBC, whose management had clashed repeatedly with Olbermann prior to his exit, cried foul, with a spokesman citing Nielsen Co. data that shows MSNBC had 78.4 million subscribers in 2003. Alerted to the network’s claim, an Olbermann rep fired back by pointing to “The Complete Directory to Prime Time Network & Cable TV Shows, 1946-Present,” a commonly used reference book, which says that only 74% of those subscribers were in the U.S., which could conceivably give Current a slight edge. I don’t know what he’s talking about,” the MSNBC spokesman replied.” DO WHAT??? MSNBC does not know how to read the ratings directories?

I would imagine some top meetings are going on in the penthouse offices of the new Comcast control mega media presence of basically WTF and how did this happen. If Olbermann brings “only” the 300,000 people who supported him with the petition that got him back on MSNBC in 48 hours after they had tried to push him out in November 2010 it will hit MSNBC hard not to mention once the million viewers that Olbermann had find him on Current TV. Remember it was a no no for Olbermann to contribute to political campaigns but the darling of MSNBC management Joe Scarborough had a full backing for donating to Republican campaigns even though Scarborough had given more money and over a longer period of time. Al Gore addressed that during the news announcement saying he believed it was Olbermann’s right to contribute to those candidates he wanted to as long as there is full disclosure Gore stated in his opinion it was a first amendment right
.
I am having visions of Ted Turner dancing in my head like Christmas here and when the news network in the past said his cable news dream would never make it… Ah that would be CNN today.

I have weaned off of MSNBC and count on Anderson Cooper and his 360 program nightly for my news. I must admit I do still watch Maddow on late night repeats because I like what she says but by doing it this way MSNBC does not get to count the viewer ship as it is not in prime time.

We will be following this carefully with as much attention as we can give to Olbermann and Gore as I predict other blogs will do. Olbermann is not only the voice of progressives but those of us moderate independents that just want to learn and then make up our own minds. Then add that to the free clinics and the real death panels that Olbermann became the voice for and this is going to be fun folks. Gore and Olbermann, wow the 2012 political campaigns seem to be a shining new beacon for the election coverage in our home.

As I was sick I watched a lot of television and have been mesmerized by the Egypt youth movement of a revolution and doing it without force but in peaceful means. I will be doing articles of my journey watching this from half a world away in a series called; “Remember my name. If I die here tonight, you will tell our story.”

Keith Olbermann

Subtitle: Or is it an Excuse as Comcast gets Ready to Come on Board?

Late Friday afternoon, November 5 2010, CNN broke the news that Keith Olbermann had been suspended indefinitely without pay for making three political contributions without the “approval” of MSNBC president Phil Griffin. However by today, November 7, 2010 that is not holding water and the backlash is something Comcast, GE, and MSNBC probably never imagined.

If you want a story to die, you release it on Friday afternoon when no one will notice and then it dies over the weekend. Politicians do this all of the time, but this time the Keith Olbermann dispute is gaining steam and putting Griffin in a no-win situation, or as much of that kind of situation you can put a rich dude with a title in.

I watched Rachael Maddow on Friday night to hear the “most” that MSNBC is going to allow to be said on their network… “Allowed”??? Yes they have the final say in what will be on their network, like it or hit the door.

As Thomas Jefferson once said; “[A despotic] government always [keeps] a kind of standing army of news writers who, without any regard to truth or to what should be like truth, [invent] and put into the papers whatever might serve the ministers. This suffices with the mass of the people who have no means of distinguishing the false from the true.” Jefferson also had confidence which today rests with our computers and Google of saying; “I am persuaded that the good sense of the people will always be found to be the best army. They may be led astray for a moment, but will soon correct themselves. The people are the only censors of their governors, and even their errors will tend to keep these to the true principles of their institution.”

After that what did I do? I went to my favorite of “let Google be your friend” and began to hunt for my truth. What I found out there is amazing, confusing and should scare all of us. First Olbermann was suspended for giving political contributions without permissions from his overlords. By today it is because he would not apologize on the air, not that any of us would know why he was doing that, nor would we care. Griffin might be changing to this because over the weekend it is getting more difficult for Griffin to find employees that have not given as in no host to take over for Keith on Monday, so the story has again changed to the apology angle.

Joe Scarborough of “Morning Joe” with nutso co-host, Mika Brzezinski, (I say nutso because she is), and pundit Pat Buchanan, who guarantees a channel change in our home when he begins to spew his hate on air. Besides what Buchanan has given while being on MSNBC it was found that WAY back in 2006, Scarborough had given the maximum $4,200 contribution to the Oregon congressional race of close friend Derrick Kitts. On Friday MNSBC spokesman Jeremy Gaines put out a statement that said; “That contribution was made in accordance with (network) policy. Joe sought permission in advance. Since 2007 we have recommitted ourselves to following these important standards.”

That lasted about four hours before it was uncovered by POLITICO, the same organization that reported the Olbermann donations; found that statement was also FALSE. Scarborough made a $5,000 contribution in April 2010 to Alabama state legislative candidate John Merrill, who said the two have been close friends since they attended the University of Alabama together. Merrill had no real Democratic opponent.” So of course he needed Joe’s contribution, Joe tell us it anit’ so? That caused nutso Mika Brzezinski to give an interview to POLITICO, not something anyone is doing that works for MSNBC on behalf of Olbermann by the way. Mika basically said, Joe this is MY JOB, throw you long time friend under the bus, tell them he LIED. Her exact quote was in part; “That contribution should have been in the name of Scarborough’s wife, Susan Scarborough. The Scarboroughs expect John Merrill will amend his campaign report to accurately reflect that reality. If he does not, I will recommend they file an ethics complaint against him.” Brzezinski also challenged Merrill’s recollection of having brought Scarborough to Tuscaloosa for an August 2009 fundraiser for the county Republican Party, which Merrill said “was unbelievably successful. We raised a ton of money that we used to help local candidates.” Mika jumped on that to spin it as; “That event was billed as a tribute to Gov. Bob Riley on his retirement from politics, any suggestion that Joe Scarborough went to the University event to raise money for a political party is false. Sadly, many politicians try to elevate their standing by exaggerating their connection to Joe. This is one of those cases.” Yea Mika like unknown pundits wannabes like you elevate yourself in all of this.

That said it appears that Mika has the power to make a politician change his “story”, go figure Contrary to a VERY different interview with POLITICO earlier on Friday, I suggest you read that interview at POLITICO. Mika (cough cough seems to think she has the power she has claimed) cause on Friday evening, Merrill issued a chastened statement to POLITICO asserting that the $5,000 donation — his biggest individual donation of the campaign — was “from Susan Scarborough … I am very appreciative of her support.”

Mika shut up and sit down. We know your ratings are in the crapper but frankly I liked you better when you showed up at work, with curlers in your hair, very little make-up and chomping your breakfast on camera. I still turned you off though and even if by accident you and Morning Joe are on my television in the early morning hours by accident, WELL let’s just say thank God for quick remote controls. That said I would be doing this of you so think before you are fast to throw someone else under the bus, you might need support one day.

There is a much bigger story here that is probably closer to the truth, when POLITICO wrote that the decision was made by Steve Burke, a Bush fundraiser, who will be placed at the helm of MSNBC and other NBC companies after the buy-out of NBC Universal. Burke has not made any secret it appears of not liking Olbermann, and in previous interviews when asked about Olbermann’s style of reporting said to ask him again in six to twelve months. Perhaps this is a preview?

POLITICO corrected that error with the following: “UPDATED: We have been notified that Comcast has not yet officially taken over MSNBC/NBC Universal. Although Comcast has tentatively finalized a deal to purchase a majority stake in NBC, Comcast awaits final approval of the takeover from the Justice Department and from the Federal Communications Commission. A statement from Comcast reads: “The joint venture between Comcast and GE has not yet received regulatory approval. Comcast is not in any way involved with decisions made currently by NBC News.” However, once Comcast gains final approval from federal regulators to move forward, Comcast COO Steve Burke, a Bush fundraiser, will be placed at the helm of MSNBC and other NBC companies. Our original post inaccurately asserted that Comcast’s Burke was involved in the decision to fire Olbermann. We apologize for the error”.

All of this said and done what causes me the most alarm and this fiasco has I hope brought to the forefront for a lot of us is that Comcast has a pending deal with NBC Universal to buy them for $80 billion, that is right BILLION, dollars and has been moving on getting permission to do that with the Justice Department and the FCC. The why they need permission is what shocked me. With the purchase of NBC Universal Comcast will control 25% of what all of us see on TV. Let that sink in they will control ONE-QUARTER of what is available for every watcher of television. Now their deal is a sure thing to go through because they bought the votes with $32 million dollars in contributions to the best politicians for sale out there.

Twenty, [20], public interest, industry and consumer groups have announced a coalition to oppose the proposed merger between Comcast and NBC Universal, citing its potential harm on competition and consumer choice. “As the nation’s largest cable company, the largest Internet service provider, the NBC broadcast networks, owner of the local NBC and Telemundo stations in some of the nation’s largest media markets, owner of dozens of national, regional and local news, entertainment and sports cable networks, and owner or part-owner of some of the most heavily visited Web sites on the Internet, the merged entity will exert a degree of power unknown in our nation’s media history,” the coalition’s letter said. “That degree of concentrated power is fundamentally threatening to the public interest. Before allowing such a sea-change to take place, these impacts must be fully studied and understood – and the threats must be mitigated through energetic applications of the government’s regulatory authority.”

As a side note but one to pay attention to is Comcast is anti net neutrality as in they want you to pay to find sites like ours or block small sites altogether and to slow down both the ability to get to sites. , savetheinternet.com explains that companies like Comcast want “to be Internet gatekeepers, deciding which Web sites go fast or slow and which won’t load at all. They want to tax content providers to guarantee speedy delivery of their data. — while slowing down or blocking services offered by their competitors. These companies have a new vision for the Internet. Instead of a level playing field, they want to reserve express lanes for their own content and services — or those of big corporations that can afford the steep tolls — and leave the rest of us on a winding dirt road.”

In closing I want to quote two more great insights to all of this:

Russell Simmons’ op-ed at the Huffington Post.com in saying not only will he pay those pesky three contributions made by Keith but says what many of us feel. “Keith Olbermann has given voice to the voiceless, sanity to the madness, truth where lies are now a daily part of our political discourse. … If he goes we lose the Edward Murrow of our generation, the voice that spits truth to power and vested interests.”

Secondly another quote by Jefferson; “The basis of our governments being the opinion of the people, the very first object should be to keep that right; and were it left to me to decide whether we should have a government without newspapers or newspapers without a government, I should not hesitate a moment to prefer the latter…”

I also want to say that Olbermann puts his money and time in what he believes. When he saw Free Clinics in action in poor areas he took notice. He raised all of our awareness and promoted and help fund much larger Free Clinics to those in need. So for what everyone else is doing he is now punished and perhaps will not return to Count Down, if he does then whether on the right or left we all lose.

Yes I have joined all of the efforts and in disclosure I gave to Barack Obama’s 2008 campaign a very small amount, but sometimes those small amounts or the lone voice can get traction and help.

Only watched tonight to hear what Rachel Maddow had to say. GOOD BYE Mmmmmmmm where will your advertisers go, perhaps CNN where your viewers will go?”

Yes I love Rachel and think I would like Lawrence O’Donnald but sometimes you just have to watch reruns so MSNBC is hurt in the only way that matters, viewers which equal advertising dollars. Keep the heat of MSNBC and say, “you can’t hide something this unfair by saying it late on Friday afternoon, we are smarter than that”.

Judge Robert J. Perry

Judging from my Google alerts, Judge Robert J. Perry is going to become the latest judge to make the list of judges who are household names. I first ask the question, why is this already being picked up by the international media? Anna Nicole Smith has been dead for over three years, and when alive was a B class celebrity. In fact in death she has become a much bigger celebrity. I had never followed her in life and have heard on numerous occasions that I am not the only one.

Judge Robert Perry is whittling down the jury pool to what might become either Fox News right wing Bible Thumpers or just plain good cons.

A jury of ones peers, well that never happens, ones peers are seldom that. For the most part the only requirement is reading, writing, able to think and being a breathing human being, but in the Anna Nicole Smith case this is about to change.

If you don’t want to serve on this jury here is what you need to do.

1. Bring a large bag of prescription medications and asked to be accommodated like any juror seeking disability accommodations as required by both federal and the laws of most states, even here in backward Texas.

2. Talk incessantly about your own illness, your doctors and most importantly agree to waive your legal rights and spill everything to the judge and lawyers, while the news media is quickly making notes of what you say for their next article, about every ache, pain, medical condition and of course every pill, patch, shot, etc. you have taken in the last few years. In the written jury questionnaire mention the great feeling of the drugs used for your last colonoscopy. Tell them you like that high feeling and that you might abuse cold medication.

3. Be sure and tell them about your grandmother, grandfather, your parents, your brother or sister, hell even throw in aunts, uncles and neighbors who you feel any empathy for due to medical conditions and of course inform this Court of any prescriptions you have ever picked up for anyone.

Now that will get rid of about everyone over the age of fifty-five and any person that feels anything for a fellow human being and the court appears in yesterday’s rulings to guarantee you will be gone within the fist thirty minutes on August 2nd as the jury is being picked.

That leaves the under fifty crowd, watch Fox News, [Infotainment], for your news and already have judged that people who take medications, or are ill, disabled etc. must inherently be bad and it appears you are in like glue on this jury.

How many good potential jurors is this going to exclude in the guise of “getting rid of the kooks” or as Judge Robert Perry stated; “The problem with celebrity trials is it has a tendency to bring out kooks, frankly.”

Now you are down to twenty to forty five year old jurors of your peers. Weed out parents with young children that need care, those who are care providers for the disabled, throw out any juror who questions being drilled about medical conditions and even prescriptions they take. That will whittle it down to the Fox news watchers, Bible thumpers and those with a holier than thou complex or really good cons.

Then you will go through a back ground check by Judge Perry, to be sure you are “clean enough” to be a jury of ones peers.

See there are many ways not to get involved in this mess in California, and who would want to be on this jury? Yes some have illusions of making the news with interviews at the end, but those are going to qualify under these rules. The lawyers will never know your name and the judge’s staff will be browsing the internet to be sure the jurors don’t blog about the case. DO WHAT??? Blog about the case, I thought jurors were not even allowed to talk about the case, read about the case, would that not include blogging in your night time hours???

A bankrupt California state spent most of Tuesday, July 20 discussing Motions related to “…arguments about publicity, the Internet and the effect of social media and blogs on the jury. Judge Perry plans to keep the names of jurors secret from lawyers, who complained that would make it impossible to track whether they were blogging or reporting on the trial via social networking websites. However, Judge Perry did agree to ask prospects if they have blogs or have social media accounts.” You know those pesky networking sites like Face Book, My Space, even LinkedIn which most professionals belong to, in fact just throw out anyone with a home computer to be safe here.

Judge Perry also intends to ask his staff to check periodically to make sure jurors are not blogging about the case. Of course most posters don’t use their real names so the jury should be asked about any monikers ever used on the internet. However this all goes back to I thought you were not suppose to read or discuss a case if you are on that jury, silly me, I am not up with the times of twittering while sitting in Court. Oh yes eliminate everyone with a Twitter account.

I am hoping more courts go in this direction, [said tongue in cheek], it will save all of us in this new era where many of us use Google the AP, the HuffingtonPost.com, The Washington Post.com, The online versions of the Houston Chronicle, the Fort Worth Star Telegram, CNN.com, MSNBC.com, and even Google alerts to get out of jury duty by just confessing these sins. Throw out the fact that for most these are all ways that today’s news junkies get their information. More and more print media is going out of business while the advances in news by internet increases with new technologies and more and more of us turn on our computers to get our news. It appears that is ok with this Judge, however not being in Court yesterday I don’t know this for sure, but to be safe just don’t admit you ever posted a comment on any site whether a reputable news site or TMZ. Better yet, tell the judge you don’t believe in any of these new fangled gadgets, ah no, then you would be in the age group of aches, pains and medications which is automatically excluded. What is a modern day juror to do???

Perry also intends to take the unusual step of checking the names of jurors against criminal records to see if they are hiding anything. If you are a con without a criminal past you are in the jury pool, bring a bathing suit and towel for fun and games for the next six to 10 weeks. However this newest step by Judge Perry creates my next question is criminal as in a speeding ticket or criminal as on parole??? However good cons are going to say the right things if they want on this jury and the honest people who have real doctors, real medical conditions or family members who do, just fill out that form, get your six dollars for the day and you are on your way back to the office or home. Oh be sure you say you believe all policemen and investigators or lie proof and there is a election this year in California, use that as extra “insurance”, [cough cough].

Another tidbit you can do to get out of this jury, whisper the two words that are guaranteed to send you home. What two words can you say that will cause the D. A. and most Judges to go screaming in the night to make sure you are no where near their court room?

Jury Nullification… the act of saying this is bullshit. In the old days, our forefathers wanted jurors that went by common sense and their conscious and jury nullification was encouraged to prevent run away legislature or unfair laws. However today, it is a guarantee to get out of jury duty which is why the jury instructions normally says, “you are only to judge this case by the facts involving the law as I instruct you to do”.

John Adams, our second president, had this to say about the juror: “It is not only his right but his duty…to find the verdict according to his own best understanding, judgment, and conscience, though in direct opposition to the direction of the court.” That is not true today, if you even admit you know about your right as a citizen on a jury to use exactly what our forefathers wanted, you are practicing jury nullification which is a big no no in today’s society of complex laws and nustso statutes.

Now if Dr. Sandeep Kapoor, Dr. Khristine Eroshevich and Smith’s former lawyer-boyfriend Howard K. Stern knowingly fueled a known addict’s addiction and threw caution to the wind, then convict them. That is how it should go down.

If they did more then what is common practice in the world of Hollyweird, then convict them. If you sense a potential juror is a kook, of course dismiss them. That is why there are jury consultants, but don’t trample on privacy laws to be sure you get that Fox News listener and exclude the CNN and MSNBC crowd.

I loved this exchange yesterday as reported by the AP and I bet Harvey Levin and the TMZ.com staff cringed as the AP led with this exchange:

“Rose made the unusual disclosure that she was filing all of her legal documents under seal to keep them from falling into the hands of celebrity website TMZ. The judge said he was going through her sealed motions and unsealing many of them.

“I don’t think you should file under seal just because you don’t want the media to see it,” Perry said.

“Everything I file ends up on TMZ,” Rose said.

“Who cares?” said the judge.

“Our jury pool is out there,” said the prosecutor.

“Do we even want people who watch TMZ on the jury?” asked the judge.

“We’re going to get them,” Rose said.

“I hope not,” said the judge.”

One way to guarantee those people are not part of the jury pool is just ask any potential jurors if they know who or what is TMZ.com.

Does that mean TMZ.com has received a failing grade in intelligent readers? If so the Court should cruise around “T”, at least TMZ has slowly begun to enforce the TOS and Privacy Policy instead of remaining like the wild west of internet posting.

Be sure and print this article and carry it with you the next time you get a jury summons in Hollyweird, where the right wing nut cases and good cons are welcomed as jurors and those “normal people” get sent home.

Ah the joy of doing ones civic duty of serving on a jury.

Now on a serious note: Judge Robert J. Perry has a tremendous amount of discretion. Judge Perry is known as a no-nonsense judge with a distinguished legal background as a former federal prosecutor, he is often selected to preside over high profile trials. In Dec. 2009, he barred television cameras and other electronic recording devices from the trial court in another high profile trial reaffirming his penchant for mitigating intense media coverage in the interest of a fair trial in his courtroom.

Perry has been a trial judge on the Los Angeles Superior Court. Since 1992, he has presided over more than 580 felony jury trials, including 237 murder trials, 28 of which were death penalty trials.

He was honored as “Judge of the Year” by the Los Angeles County Bar Association Criminal Justice Section in 2009 and by the Century City Bar Association in 2002. Born and raised in Glendale, California, Judge Perry is a graduate of Claremont McKenna College and Loyola Law School. He served as an Assistant United States Attorney in Los Angeles for 12 years, and then was in private practice with Epstein Becker and Green, and later with Douglas Dalton.

In short, you could not ask for a better judge for a criminal high profile case, and he likes Stern’s attorney Steve Sadow, so what more could anyone ask for in this case. Lessons learned over the last three years appear to have paid off in changing the Court back to Judge Perry who presided over the preliminary hearing which means he has the background on this case.
He has also ruled against the prosecution and at times has added lesser charges to jury instructions stating the state had not reached the standard of the charges assistant district attorneys have asked to present to a jury.

Google Judge Perry, he is impressive in the way he handles cases that could become powder kegs of any racial tensions in the past and handled them well.
