Straight Talk with John J Nazarian, Nazarian is going to explain to us not living in California why both sides were not happy today, and why did Judge Pastor hint that the D. A. office might have sought second degree murder?
Because of the “realignment” of how cases are sorted in California, what Dr. Murray was found guilty of is not something that Judge Pastor had the ability to send Dr. Murray to state prison for even ONE day, the sentence HAS to be in County Jail which we know is letting prisoners go early on “none violent” convictions. Dr. Conrad Murray’s conviction in relation to the death of Michael Jackson is considered under California sentencing guidelines as a “none violent crime”, therefore the most that Judge Pastor could give Murray was 4 years in county jail.
Murray has already lost his license it appears from what is said in court today. That is what Edward M. Chernoff said while arguing for probation and no jail time. Judge Pastor made it clear he had nothing to do with any lost license to practice when Murray get’s out of L. A. County Jail.
Judge Pastor gave Murray the maximum of 4 years in county jail, so what does that really equal with the crowded county jail and this being a none violent crime by the realignment act passed in 2011? John Nazarian is here to explain that to all who do not live in the land of California criminal courts.
Judge Pastor also ruled in “victim” restitution that Murray pay an $800 restitution fine, $30 court fee, and a $40 criminal assessment fee. Murray must supply DNA to be put in the criminal data base.
However, for now Judge Pastor is not having any of the paying appropriate restitution to Jackson’s children of over $100 million appears for now to be way out of the ball park, even to Judge Pastor; thus Judge Pastor will set a new date for a restitution hearing for Jackson’s children which will be held without Dr. Conrad being present in January.
However using Lindsay Lohan and how many times judges have ordered her to stay for X number of days or months with her to only walk in a day John Nazarian will explain that once the county sheriff takes Murray’s care in his facility today just how long will Dr. Murray really remain an inmate?

I had tuned into the press conference of Gloria Allred and her client, Sharon Bialek, the first woman to step forward publicly with sexual harassment charges against Herman Cain. I had wanted to see the interview, partially because the count is up to four women and partially because if a woman has been “wronged” in the last few years, here comes Allred.
However, I only watched about 4 – 6 minutes just the introduction by Allred and a few comments by Allred about her client Sharon Bialek when across the bottom of the screen came the announcement that the Dr. Conrad Murray verdict was in regarding the death of Michael Jackson. Once again bad timing for Allred, seems there was another crises like this that was bad timing once before for her, but I don’t remember that now, or who it was.
I remember that GOP presidential candidate Herman Cain had scheduled a news conference for his denial and I had better things to do…. but then the Google alerts began to come in…. and with those the name L. Lin Wood Jr. I perked up and for those of you who are behind in the world of politics he said, she said, he said, and piling on candidates, often eating their own; I wanted to know what was going on to pull in two attorneys not normally found in any cases together.
Here is L. Lin Wood’s prelude to Hermain Cain’s press conference:
Well the confidence exuded from Wood for those five minutes. And for legal junkies like myself that was worth taking note about.
Of all of the articles out there the one I like the best was from the Catholic Online by By Keith A Fournier.
Fournier summed it up perfectly:
As a Constitutional Lawyer, it was the first part of the Conference which sent the signal I was watching for. Herman Cain is going to aggressively fight these allegations. In fact, he is very, very serious about it. Let me explain the story behind the story which few in the media are covering adequately.
When I saw high Profile Lawyer, L. Lin Wood Jr. step out on the platform – and then step up confidently to the podium – I knew what was going to follow. Not only in the ensuing Press Conference but in this entire matter as it continues to unfold over the coming weeks. This is a war, and Herman Cain has just recruited a General..
L. Lin Woods is a powerhouse Libel and defamation lawyer with an earned expertise in the intersection between the First Amendment to the Constitution and the right of all citizens to protect their reputation. He is no stranger to representing high profile clients – it has made him a wealthy man and earned him the reputation of being a “lawyer’s lawyer”. He is highly respected in the legal community because of his track record. He is very good at what he does.
…
“Wood’s appearance speaks loudly for those who can read the legal tea leaves. He gave a strong and clear defense of Herman Cain before the microphone revealing his advocacy skills. He told the reporters, “I have represented people who were victims of false accusation, on trial in the Court of Public opinion.”
Indeed he has; he is the expert in this field. He told an interviewer in 2005 “I believe that courts, since the 1964 decision in New York Times v. Sullivan, have steadily eroded the ability of individuals and entities to redress false attacks on reputation by overemphasizing the need to safeguard First Amendment rights.”
Wood’s appearance speaks loudly for those who can read the legal tea leaves. He gave a strong and clear defense of Herman Cain before the microphone revealing his advocacy skills. He told the reporters, “I have represented people who were victims of false accusation, on trial in the Court of Public opinion.”
L. Lin Wood, Esq. is a heavyweight fighter who boxes with words. He understands the necessary balance between the First Amendment’s protection of a Free Press and the right of even public figures to protect their reputations from false accusations. He is the kind of lawyer we in the profession call a “dog with a bone.” He is competent, persistent, aggressive and willing to do battle. He is the real story behind the story in this Herman Cain Press Conference.
….”
However, the story behind the story is that Herman Cain intends to fight these allegations aggressively and continue his candidacy for the Republican nomination. He has hired one of the best libel and defamation lawyers in the Nation. Watch as L Lin Woods steps into the ring. This entire event is far from over, the bell has just sounded for round one.
So it is over, up steps Lin Wood and the four women fold???? Not on your life, Gloria Allred is not to be deter by Wood. She was back on this morning with her client Bialek “suggesting today, Wednesday, that the presidential contender was lying yesterday when he said he doesn’t remember Bialek.”
So now we have the first real shot across the bow and a declaration of perhaps a war in words or actions soon to follow.

Dr Drew appears on HLN weeknights at 9 PM EST & PST which is 8 PM CST and MST.
HLN’s Dr. Drew was joined by Dr. Klein’s attorney Garo Ghazarian to discuss Michael Jackson’s alleged addiction to Propofol and how different doctors contributed to or attempted to stem the King of Pop’s use of the drug that ultimately killed him. The two quick talkers exchanged volley after volley of quips and arguments about the medical and legal implications of how Dr. Klein and other doctors were left in the dark about which and how much drugs Michael Jackson was being given.
Dr. Drew said of Murray’s care strategy:
”Insomnia is like saying fever. It’s a symptom. It’s not a diagnosis… My point is that Dr. Murray was treating withdrawal systems, not insomnia. It’s the multiplicity of drugs here is amazing… Murray is the guy at the center of the hurricane. He knew what was going on here. He was the primary care doctor here.”
Ghazarian was quick to point out that his client was not in the least aware of what was happening:
“Why do you think Dr. Klein is furious with Dr. Murray? It’s because he didn’t know his existence!”
The final arguments should be completed today. How long do you think the jury will be out? If convicted that Dr. Conrad Murray might serve any sentence under home arrest with an ankle bracelet? Do you think he will see the inside of prison in California?

Dr Drew appears on HLN weeknights at 9 PM EST & PST which is 8 PM CST and MST.
Demerol – a powerful narcotic, and part of the loosely-managed drug regimen leading up to Michael Jackson’s Death.
The question is – did abuse of this drug stoke a cycle of addiction that ended with fatal levels of the surgical anesthetic propofol? And more importantly – were Michael Jackson’s doctors to blame for this haphazard use of pharmaceuticals? According to Dr. Drew, the answer to both questions is a resounding ‘Yes.’
Calling into his own show (guest-hosted by In Session’s Ryan Smith) Dr. Drew lays down a passionate, razor-sharp condemnation of the use of Demoral on Michael Jackson for cosmetic procedures. He explains that it sparked a cycle of dependency and suppression of withdrawal symptoms with cross-tolerant drugs, including propofol.
Even more egregious according to Dr. Drew – providing Demoral to a self-described addict – Jackson admitted in 1993 to opiate addiction.
After Dr. Drew’s explanation, a fiery debate ensued with the Lawyer for Michael Jackson dermatologist Andrew Klein. Attorney Gara Ghazarian argued that Jackson was in fact not addicted to Demoral, as evidenced by the long gaps in his use of the drug.
Dr. Drew responds that during those days of abstinence, Jackson was suppressing withdrawal using other drugs, hence the snowballing of pharmaceutical substance abuse, culminating in the death of the pop legend.

What do you think? Could Michael Jackson have caused his own death? What do all you think about the latest news that Dr. Conrad Murray might serve any sentence under home arrest with an ankle bracelet? Do you think he will see the inside of prison in California? Is a conviction possible or can the defense still pull this out as Jackson’s killing himself because he was an addict?
Do you think the jury is picking up the fact that it is now Judge Michael Pastor is objecting to the Deputy D. A. Walgren’s cross examination of Dr. White? Will Walgren be able to destroy Dr. Paul White as needed for the “beyond a reasonable doubt” that Walgren MUST do or will he alienate the jury by “picking on a witness” he did not choose? Remember the defense handled Dr. Shafer with respect, will this backfire on Walgren?

On Thursday and Friday the defense of Dr. Conrad Murray led by Edward Chernoff with medical special attorney Michael Flannigan.
Dr. Robert Waldman an addiction medicine specialist said Dr. Arnold Klein’s records from treating Michael Jackson show the King of Pop was receiving “large” doses of the powerful painkiller Demerol for seemingly no reason. He also said based on the testimony of Jackson personal assistant and the head of Jackson’s security it appeared that Dr. Arnold Klein had not turned over all of his medical records that the Judge Michael Pastor had ordered those records be produced. I found that very interesting.
Chernoff displayed the Klein’s records for treating “Omar Arnold,” one of Jackson’s many aliases. The records showed Klein injected the singer with Botox and Restylane, drugs used for smoothing wrinkles. Dr. Klein also treated Jackson to reduce “excessive perspiration” by injecting Botox into his groin and armpits. “Groin”? OHCH!!!!
During an intense cross examination Thursday, by Deputy D. A. David Walgren,Dr. Robert Waldman accused Walgren of putting words in his mouth. Walgren seemed to be trying to imply that because Dr. Waldman also practices dialysis, he may not be most knowledgeable expert for this case. Dr. Waldman testified earlier that Michael Jackson was dependent on the painkiller Demerol. Is that like asking Walgren how many first degree murder trials he’s tried?
Dr. Paul White the “God Father of Propoful testified today.
Dr. White testified that lollipops laced with propofol may be an effective way to sedate patients without having to give them an IV, because the anesthetic can be absorbed through the tissues in the mouth. Blood testing of one of the subjects from Dr. Shafer’s study showed the presence of propofol. Dr. White said this could have been the due to absorption through the tissues in the subject’s mouth. Dr. White also said he agreed that Dr. Murray should have never left Michael Jackson’s side while giving Jackson propofol.
What do all you think about the latest news that Dr. Conrad Murray might serve any sentence under home arrest with an ankle bracelet? Do you think he will see the inside of prison in California? Is a conviction possible or can the defense still pull this out as Jackson’s killing himself because he was an addict?

On Monday night’s show of Dr. Drew, which airs Monday – Friday at 9 PM EST – 8 PM CST on HLN; Dr. Drew was joined by truTV’s In Session host Ryan Smith to discuss the latest in the Conrad Murray trial, as the state rested its case on Monday. The defense called Dr. Allan Metzger to the stand on Monday to show the jury that Michael Jackson was seeking and getting drugs from other doctors at the same time Dr. Conrad Murray was working as his full-time physician. Defense lawyers will use this week to challenge the prosecution’s contention that Dr. Conrad Murray’s alleged reckless use of propofol to help Jackson sleep makes him criminally responsible for the King of Pop star’s death. But when the prosecution began questioning Dr. Metzger, his testimony appeared to be working in their favor at certain points.
Ryan Smith was quick to comment on Metzger’s statements:
“It just goes to show that even with this witness being a defense witness, he [Dr. Metzger] came off like a prosecution witness because he said ‘no matter what was going on here, I never would have done what Conrad Murray did,’ and he said he wouldn’t do it for money. That really hammered home a point.”
Dr. Drew explained:
”They’re trying to prove negligence, but doing very little conversation about the quality of medical care … I get so frustrated with this case. I have to tell you. I have a thing I keep on hand to remind me how outrageous it was, This man, Michael Jackson, went to bed every night with this because he was so sedated that he couldn’t function. He couldn’t get up to go to the bathroom. As an addictionologist – all the multiple prescribing doctors not communicating with each other – bad timing – Michael Jackson got the worst my profession has to offer.”
What do you think? Did Dr. Metzger’s testimony help or hurt the defense’s case?
What do all you think about the latest news that Dr. Conrad Murray might serve any sentence under home arrest with an ankle bracelet?

A must hear interview with Dr. Cyril H. Wecht who is an expert in Forensic Medicine who has frequently appeared on several nationally syndicated programs, national News Magazine shows, and HLN, CNN, NBC, CBS, ABC, etc. His expertise has been utilized in high profile cases involving the assassinations of both President John F. Kennedy and Senator Robert F. Kennedy, the death of Elvis Presley, the O.J. Simpson case, and the JonBenet Ramsey cases. He is certified by the American Board of Pathology, in anatomic, clinical, and forensic Pathology, and is also a Fellow of the College of American Pathologists and the American Society of Clinical Pathologists.
Dawna Kaufmann his co-author on “A Question of Murder” and “From Crime Scene to Court Room” also appeared on Sunday night, October 23, 2011. Dawna Kaufmann is an accomplished true crime journalist. Her new book, “From Crime Scene to Courtroom: Examining the Mysteries Behind Famous Cases,” written with Dr. Cyril Wecht, blasts open the death probes involving Michael Jackson, Casey Anthony and five other criminal cases. Kaufmann has covered hundreds of high-profile homicide and missing person cases for national publications. She is also an award-winning producer and writer, with a multitude of credits in television, including late-night comedy programming and prime-time network variety series.
Neither held back in the one hour interview. You can hear Dr. Wecht being blunt about the jury verdict in the Casey Anthony case as well as his opinion of both Dr. Murray but also discussing the friendship that appears to be unraveling between the D. A. expert Dr. Shafer and his previous teacher and mentor Dr. White.
What do you think? Could Dr. Cyril Wecht have been any clearer to his thoughts of the Casey Anthony jury or of Dr. Conrad Murray in the death of Michael Jackson; then add his thoughts of the battling expert? Dr. Wecht and Dawna Kaufmann gave us a look into behind the scenes of these cases and a new one Dr. Wecht has been hired this week to exhume a body for a second autopsy in a high profile case in California.
