Here is the first group of filings unsealed in the New York Federal Court for the Southern District as Ordered by the Honorable Denny Chin.

These are the filings unsealed by Howard K. Stern, the filings by Rita Cosby and Hachette Books Ordered to be Unsealed have not appeared yet. As soon as they do we will have those as well which will be parts of depositions we don’t have this go around from Stern.

I have not read through these yet but wanted to get them all listed for you and then we will discuss and do articles on these documents as we go back through the debunking of the book to the lead up of the Jury Trial scheduled to begin on November 30, 2009, let the games begin!!!!

September 28, 2009 G. Ben Thompson’s lead attorney in South Carolina Lead lawyer, R. Scott Joyce, filed a Motion to Withdraw as Thompson’s attorney and asked for an “In Camera” hearing at the earliest possible date for the judge. In camera does NOT mean Ex Parte, I believe it means just closed to the public but it could mean without Stern’s lawyer if there is some possible ethics or criminal charges looming.

September 30, 2009 G. Ben Thompson’s attorney from Georgia, Susan M. As we wait for the papers, or at least the Order unsealing the papers in New York, a solid source contacted me about all of this, a source who had contacted one of the people facing a Preliminary hearing legal team and whom they felt was very rude to this person.

This sounds like the old song for some reason “Leroy Brown”, dunno why it just does.

As we await all of the papers today, why would Tom Bednarek not want anyone to know he had the “ear” of AG Jerry Brown? It could not possibly have to do with Rita Cosby?

Why did Bednarek tell this source from 2005 to the spring of 2009, I can help and did in fact help? Why would Rita Cosby need Bednarek to call in a “favor” from his old at least has the ear of “AG soon to be gubernatorial candidate Jerry Brown? Why would helping this source/friend with Brown hurt the Howard K. Stern prosecution?

Why tell someone you had been working with that as this source said to Bednarek in an email, “I told him that you know Attorney General Jerry Brown so you may get a phone call.” In another email just two months before the indictments this source wrote to Bednarek, “I want to thank you for helping, [name omitted], by contacting Attorney General Jerry Brown.” Why in an email did he request this source to always refer to Rita Cosby as “R” saying, “Would appreciate it if from now on… in all of our correspondence…? THAT we only refer to one another ONLY as K and T… AND my gal as R… Okay?! This IS very important…” In another email Tom Bednarek said in part, “Again, should you ever want to discuss this with me, we can certainly do so, so long as it is CAREFUL HANDLED over the TELEPHONE.” In yet another email about offering help he stated; “Additionally, other than “Tom” … there will be no need to include my name within any letter you enclose. He will be aware of the package…”

In another email about the pillow talk while Rita Cosby was fast hammering out her future best selling book and shopping it around why did Tom Bednarek wanted to brag about his closeness to Cosby and exactly how close that pillow talk is as he states; “Although she is heavily committed on a number of major initiatives at this time, she is always very interested to learn more about a story such as this… I know… we’ve been together for well over seven years now, and I know her heart. She would be a phenominal ally to have, BUT I can tell you first hand… that she is extremely engaged right now… and has a number of prior works she is deeply involved with. On the other hand … she is an amazing “multi-tasker!!! HA! But seriously, as mentioned, I will see what either she can do to help AND get this into the right hands for you.”

Finally just less than two WEEKS after the indictment of Stern Bednarek called this source and said “I can’t help you with AG Jerry Brown, and please don’t contact me again”. Following that was the last email exchange of four years of working together on ONE project with Bednarek and Cosby:

“Hello Tomaczek, It’s sad you decided not to keep in touch with me after you told me you would send the documents I sent you … to Jerry Brown. It’s been 8 months since …I’m asking you again to send the information I sent you and Rita …to Jerry Brown. I remember you telling me that you had a direct phone number for him. I can’t understand how you think sending this information could hurt the Stern case. You reasoning just doesn’t make sense to me. Thank you,”

Yea Tom why would helping with the ear of “feel good AG Jerry Brown” hurt the pending Stern case? Did you use up all of your “favors” keeping “R” or Rita Cosby as most of us know and call her by out of the deep fat frying pan? Why did you and Cosby want to make sure the indictment was announced before the Summary Judgment was ruled on in New York? How long had you been sharing pillow talk with “R”, [Rita Cosby], with AG Jerry Brown?

All good questions I think, what about ya’ll? My source has snail mailed me a ton of information on this project that we will begin to explore in the new year in greater detail right before the gubernatorial candidates, including Brown, began their major fund raising? By the way the “project” that is discussed with promises to help by Tom Bednarek is about a non-profit foundation of which there are allegation of “money for favors”, isn’t Brown in charge of those? Could AG Jerry Brown’s friend Bednarek with over four years of documentation sink feel good Brown’s bid for that brass ring called the governorship? A brass ring that Brown wants so badly in what some say is a hope for the blissfulness and power he once held as the prince and the rising star in the Democratic Party way, way back in the 70’s as a young “cool feel good” Brown.

I have told my source to print out the hard copies of all of the documentation and send them to me, put them in a bank vault and at least in two other people’s hands so Bednarek cannot undo the damage to his beloved “R”, known to us as Rita Cosby.

Tom, Tom, Tom, you tried so hard to not leave much of a paper trail in all of this, but in trying it rings of nanny gate in my ears.

We will be bringing you more of what this source has to say, including the way they were treated by one of the legal teams of one of the people facing the preliminary hearings in October of this year.

Now for today, we await the Court’s Order releasing the papers, could “exhibit J” be Bednarek deposition about nanny gate? Who knows only the unsealing of all of these promising delicious documents will tell us.

To keep up with the papers to be unsealed keep this list handy, and remember ALL of Howard K. Stern’s deposition and all of Rita Cosby’s deposition is included in the documents. I don’t know about all of you but I await the release with excitement that a lot of the pieces will begin to make more sense and like a haze in the morning light will become the bright sun of daylight and the telling of all of those secrets, including pillow talk of nanny gate.

Very quietly in January 2009 was published a book by Crime Story writer, Dawna Kaufmann, and renown Medical and Forensic Examiner Cyril Wecht M. D. J. D., called “A Question of Murder” appeared on store shelves and online book stores. The book deals with five cases and goes through how Dr. Cyril Wecht arrived at his conclusion in relation to “A Question of Murder”. I now have the book and this one TRULY has never before published information surrounding the death of Daniel Smith and Anna Nicole Smith. I have only skimmed through the 2 chapters, having laid the book on my bedside table, and saw two glaring things that caught by attention. That Dr. Wecht contacted Howard K. Stern about the testimony of Dr. Hern at the Inquest in Daniel Smith’s death in the Bahamas. The second thing that caught my eye right off is the related facts that in the chapter concerning was Anna Nicole Smith’s death “A Question of Murder” or even of possible murder, is a detailed dialogue of a conference call between Dr. Wecht, Howard K. Stern and Dr. Khristine Eroshevich. Dr. Wecht had extraordinary access to many of the main people who were really in the know about the death of Daniel Smith and his famous mother Anna Nicole Smith. It is well written which is a relief after reading the ninth grade level of writing of Rita Cosby’s book.

I suggest Barnes and Noble for the book but then I have a preference for them. After I read the chapter I will discuss the “A Question of Murder” for Daniel Smith. That will be followed by a discussion of “A Question of Murder” for Anna Nicole Smith. If you don’t like Barnes and Noble a link section on our main site has numerous online stores to purchase the book from.

This book is riveting in the teaming up of Cyril Wecht M. D. with Dawna Kaufmann the Crime story writer to make sure it holds one interest and is not loaded with too much medical jargon. It holds the attention of the reader in great details about all five cases covered in “A Question of Murder”.

I am going to give each of you time to order your copy or pick it up at your local book store before I begin to discuss it. After you have purchased your copy write down the questions you have about “A Question of Murder” we will have access to the authors to finally separate, rumors the out and out lies that tabloid media deal with, and I hope we find the truth; or as much as we can before the preliminary hearing in October.

How Rita Cosby’s book made it to the best seller list and this book did not is beyond my comprehension. Oh yea, the book of the true blond ambitious Rita Cosby had explosive allegations often not covered by facts at all per Judge Denny Chin. His finding outlines his “thoughts” on the meeting the bar of both malicious intent and for punitive damages to be tried before a jury.

Here is a list of documents that will be released by Court Order no later than August 20, 2009. Note that Rita Cosby and Howard K. Stern’s complete deposition are two of the more interesting documents to be released as is Wilma Vicedomine.

On the night of December 15 into the early morning of the 16th for about seven to nine hours, on PACER were the filings of Elizabeth McNamara’s Declaration in support of her client, Rita Cosby’s Motion for Summary Judgment with exhibits A – HH.

After the seven to nine hours that the documents were on PACER for the whole world or those of us with PACER accounts to download, Ms. McNamara filed a letter with the Court dated December 16. She was both advising the Court that the exhibits had been filed in error and requesting that she be allowed to file her Declaration corrected. Her letter went on to state she had contacted the other counsels in this case and had also contacted the Clerk of Court to remove the documents because some of them should have been filed under Seal. The Court granted this request on December 17, and Ms. McNamara got a “do over” on December 19, however, she also filed corrected versions of ALL of Rita Cosby’s filings that were due and had been filed with the Court on time by the Court’s Ordered due date of December 15. We have not yet completed rechecking those documents compared with the Originals filed on December 15 to see if any of them had been changed or redacted. However, all of those filings from both December 15 and December 19, minus the infamous document number 73 remain on PACER for everyone to download.

Rose Speaks.com did in fact download that now infamous filing of docket number 73, the Declaration of Ms. McNamara with all of the exhibits attached. We have struggled since the morning of December 16 as to whether to put up these documents including the Exhibits marked “confidential” or “highly confidential” filed with Ms. McNamara’s Declaration. We have pondered whether any of the other parties and/or their legal counsel involved in suits in other jurisdictions, (I. E. Texas both federal and state; California probate, South Carolina etc.), some of which have the same parties in those cases had downloaded the documents. Since they, [the papers], were put up in error by Ms. McNamara then that brings up the question of was any of the three versions of the Agreed Confidential Orders the Federal Court in New York had issued previously, each time tightening up the previously filed Agreed Order to protect the privacy of the parties? I have to say on a side note that what Ms. McNamara filed in error, makes those fourteen pages of Rita Cosby’s deposition filed by Lin Wood back in November 2007 look like a minor mistake and one hopefully that NOONE ever refers to in the future. Like with these papers, Rose Speaks.com had on November 29 – 30 downloaded those papers at 11 A. M. making Lin Wood releasing them to Art Harris after 5 PM on November 30 a moot point.

However, I regress to other days and other papers filed in error and not under Seal as the Federal Court in New York had intended and displayed by the additional Orders issued by the Court. The infamous document 73 with exhibits contained four of the eight excerpts of depositions referred to in Ms. McNamara’s Declaration. These excerpts of depositions were clearly marked confidential. I cannot begin to imagine the horror and personal violation that each of the four people whose excerpts were filed in error must feel. Some of the excerpts referred to delicate financial information with exhibits attached including one of the person’s social security number. The other filings that were marked confidential or highly confidential were multiple documents filed in the California Court regarding Dannielynn’s paternity in the fall of 2006. Clearly, both the California Family Court as well as Larry Birkhead never intended for any of these documents to be filed for the world to read. The documents ALL showed “highly confidential” marked on each of four exhibits of documents, including affidavits involving that suit filed under Seal as is my understanding required in Family Courts in California where a minor child is a subject of the suit. Mr. Birkhead’s attorney Michael Trope placed “highly confidential” on those documents before releasing them per a Court Order.

Other documents filed in error included the copy of the Royal Bahamian Police Affidavit filed by Ford Shelley on November 17, 2006, after the fight about Horizons had become front and center both in the Bahamas Courts as well as the Court of public opinion. There is also a partial filing of Howard K. Stern’s Affidavit filed with the Royal Bahamian Police dated September 10, 2006.

Ms. McNamara, in her Declaration, has marked exhibit R as being filed under seal and showing it redacted on her declaration as to the contents of the exhibit, in actuality all ten exhibits marked as exhibit R were filed by Ms. McNamara, some filed on December 16 and the rest filed on December 19 with the “do-over”. Exhibit R refers to the Court Proceedings, in the Bahamas related to Daniel Smith’s death and inquest.

After almost a week of discussions between Ken and myself weighing the “right of the public to know” versus the “right of privacy of these individuals” we have made a decision as to what to put up from this infamous filing of document 73 and what not to put up. We will NOT put up any of the four excerpts of depositions with exhibits filed in error. We will NOT put up any of the documentation involving the filings under Seal in 2006 with the family courts in California marked “highly confidential” in the accidental filing by Ms. McNamara on December 15. We did upload those exhibits that referred only to the CDs filed with the Court that were marked either “confidential” or “highly confidential”. We are also making available to download exhibit X, which is a brief excerpt from the book “Big Beautiful Doll” by Eric Redding. Although that exhibit is marked confidential since anyone can buy the book we felt like nothing in the Stern vs. Cosby case would be compromised. Exhibits BB and CC are identical except for about 15 pages marked “confidential” or “highly confidential”. Since this appears to be hand written notes by either Rita Cosby or her ghost writer Bruce Littlefield, those pages have been redacted and removed from what is available for you to download.

We hope you understand what we have gone through this week as we struggled with what we felt was the appropriate documents to put up for all to read. We hope each of you understand those documents we elected not to put up was strictly based on the fact we firmly believe those person’s involved, especially Dannielynn, “rights to privacy” trumps you the public, “right to know”.

Lawyers make mistakes as this filing clearly demonstrates. Hopefully, throughout the rest of the lawsuits involving these same people and lawyers, Lin Wood included, instead of the “mantra” of, (fill in the blank with a lawyer’s or party’s name here), cannot be trusted will now change. Our hope is that based on this horrible accident that in the future, as exampled in the case where Wood released 14 pages of a deposition, that the “mantra” of not being able to trust a lawyer and/or party will now be replaced with a sincere apology. As well as to figure out how to avoid in the future damage done by this type of mass filing of confidential papers which were available to the world via PACER for seven to nine hours.

One debunking either Hachette’s filing for Summary Judgment including declarations and exhibits or the debunking of Cosby’s filing for Summary Judgment including declarations and exhibits. The second article that will be put up today will be about Casey Anthony and what happens now in that sad saga since the remains of Caylee have now been found.
