After being unable to reach an agreed settlement between Virgie Arthur and Teresa Stephens that was agreeable to both parties in the Virgie Arthur vs. Howard K. Stern, Larry Birkhead, TMZ et. al. defamation case and conspiracy to defame.

Today, March 31, 2010 Arthur has filed a Notice of Nonsuit in regards to dismissing Teresa Stephens from the Harris County Case

I do not expect any of the conditions of why a settlement was unable to be reached. However if either side does release a statement in regards to Stephens being released from the lawsuit pending in the Harris County 80th District Court by the Honorable Larry Weiman, Rose Speaks.com will attempt to get an on the record comment from both sides.

We here at Rose Speaks.com are glad to see Ms. Stephens, a blogger who lives in Texas, dismissed after almost two years and wish her all of the best.

In other filings with he court filed with the Court after 5 P. M on March 30, 2010, Art Harris has filed a “Conditional Motion to Quash” the deposition of Turner based on three reasons. The deposition is scheduled for Friday April 2, 2010.

Well let the games begin… In a filing full of false information (And God I hate to side against a good law firm), Amanda Bush on behalf of her client filed a Motion to Quash Deposition of Turner based on “At the time of filing this Motion, counsel for Harris has not received a response. On information and belief, counsel for Harris believes that Turner intends to quash the videotaping of her deposition late Thursday, April 1, 2010, and the Court is closed on Friday, April 2, 2010 for the holiday.” I hope this is one damn good witness Ms. Bush has and one with a LOT of money that can fight off perjury charges and a Civil Suit, because that statement is an out and out lie to the Court by an officer of the Court, which last I checked was pretty serious. Shooting back Virgie Arthur filed Turner had NEVER said and DID not intend to file any Motion to Quash. For those lawyers needing a refresher course I had until 5 PM today to file a Motion to Quash and Harris’ counsel knows that. The holiday, Mmmmm every lawyer that intended to be here had confirmed including Ms. Bush’s boss that he would even stay to Saturday to finish all of this up. So to say I did not want to be cross examined by him is bull shit, I asked if there was any way because of my illness if they could trade out time and try for both sides to wrap this up in six hours if not I would continue to do the best I could through Saturday. Folks this is why I am so angry at Harris for deleting those emails and documents, it seems the only person everyone agrees has not is me… I am hoping we can get an emergency hearing tomorrow and proceed. However it might be Harris’ attorneys strategy to stall until I am on pain management medication and can’t give a deposition before the hearing to bust Art Harris on April 30. What does a well respected Law Firm do when a client screws them over and leaves them to clean up the mess. I guess some consolation is that Harris is now in trouble in Florida in the Haleigh Cummings case for the very same situation he finds himself in the soup kettle in Texas. I will have a lot more to say about Harris’ credibility among his peers of independent investigative reporters and where he actually is when “out of town researching a big murder or case”.

What happened in the Susan M. Brown Esq. deposition with exhibits that immediately within a week caused both of Ben Thompson’s lawyers to file Motions to be released from the suit? His South Carolina attorney filed on September 28 and his Georgia attorney, Susan Brown filed last night, September 30.

Pick up the papers, Anna Nicole Smith’s Estate via the Exucutor has until October 16 and 19 respectfully to file any answer, and no IN CAMERA hearing has been set as of today.

What is going on and will the South Carolina federal case, and could it be the case where the house of cards will fall leading to all of the other cases?

September 28, 2009 G. Ben Thompson’s lead attorney in South Carolina Lead lawyer, R. Scott Joyce, filed a Motion to Withdraw as Thompson’s attorney and asked for an “In Camera” hearing at the earliest possible date for the judge. In camera does NOT mean Ex Parte, I believe it means just closed to the public but it could mean without Stern’s lawyer if there is some possible ethics or criminal charges looming.

September 30, 2009 G. Ben Thompson’s attorney from Georgia, Susan M. We have also been told that the new Court and Judge in Harris County will be decided on October 3, 2009 via electronic “lottery”, in that all of the cases currently pending before the Honorable Tony Lindsay will be put into an electronic lottery on Saturday and be randomly assigned to other courts and then the parties will be notified next week as I assume the judges and Courts will be at the same time. So do y’all think this is like playing Texas Lotto?

As a judge who has been on the bench in Civil cases since 1985, Judge Lindsay is a senior judge in Harris County.

Under some new rules which are to go into affect on or before October 1, Judge Lindsay will get the new court. It has taken us all day to get two firm sources that Judge Lindsay will be in charge of the new Domestic Violence Court. We wanted to be sure before I did this article.

As we get more information, it will be shared here.

Everything in our case is stayed pending finding out which Court our case is transferred to, could we go back to Judge Kerrigan’s 190th Court?

What will happen to the Appeals pending in the First Court of Appeals for Howard K. Stern and in the Supreme Court of Texas for Art Harris?

Most of the electronic media has now been imaged and is sitting with the Special Master Craig Ball, will the new court keep him as Special Master, or will the new court want a Special Master of that court’s choosing?

Whatever the answers to those questions, it is going to get very interesting to see where our case ends up and what the judge decides after reading the file up to date, and how will the new court be decided?

A lot to follow in reference to the bill listed as SB2217 signed on April 30, 2009 and to become effective not later than October 1, 2009.

I noticed this as the Submission Docket for Judge Lindsay’s Court showed that most had been passed and then starting on October 2 none were listed. So I began to research it when I saw Judge Lindsay’s Submission Docket shows passed or re-set as does the Oral hearing docket with NOTHING set on the Oral Hearing docket on October 2, 2009 or forward.

As many of you have said and as all of us have thought this case continues with twists and turns and now a whole different court with different rules, WOW!!!

Folks I am just going to list the documents as they come in and are uploaded and let them speak for themselves because it appears this Appeal that has to be granted or denied by 5 PM today is going to create an onslaught of paperwork coming in to us throughout the day.

This will again end with a cliff hanger of will they or won’t they before 5 PM Grant the Emergency Stay so Art Harris does not have to answer those now eleven (11) infamous questions asked by the Special Master, Craig Ball.

September 11, 2009 Art Harris Volume seven filed with the Texas Supreme Court today, it is only adding to the six volumes filed with the First Court of Appeals and it appears to just be copies of all of the Motions and papers and Responses filed with the First Court of Appeals.

September 11, 2009 Texas Supreme Court granted Art Harris’ Motion for an Emergency Stay and to review his Motion for Mandamus, it was granted at 4:55 PM CDT at the last five minutes before the court closed. I will look up the judge that signed it or one of you can look it up. This does not mean that they are going to hear it; just they are freezing everything until they have time to look at all 7 volumes of filings and exhibits. The Emergency Stay only applies to Art Harris and none of the Pro Se litigants.
