Pol’ Atteu and Patrik Simpson will be appearing on the television celebrity show Extra on Wednesday May 28th. This will be the kick off of their tribute book to their friend Anna Nicole Smith, Portrait of an Icon. The interview was partially done in the studio of Extra but some of it was filmed at Pol’ Atteu’s Contour Boutique. Perhaps we will get to see some of the gorgeous designs for Anna Nicole Smith.

Pol’ and Patrik will barely catch their breath following the Tuesday show of Extra before each being deposed for seven to eight hours in Los Angeles by subpoena from Rita Cosby and Hachette Books. Patrik Simpson will be deposed on May 28, 2008 and Pol’ Atteu on May 29, 2008. My first question is wouldn’t it have been better for Rita Cosby to talk with them BEFORE the book came out then to have to pay the legal expenses to depose them now? Can you imagine the powerhouse lawyers that will be present during those depositions, from Elizabeth McNamara for Ms. Cosby, Douglas Maynard and Deborah Newman for Hachette Books. Then add Lin Wood, Luke Lantta and John Patton for Howard K. Stern; two lawyers for Pol and Patrik, and they are going to need a huge room to accommodate that many plus the staff doing the depositions. This should be the making of two fun days of questions and answers NOT.

I am assuming since Ms. Cosby and Hachette Books lawyers are the ones doing the deposing they feel Pol’ and Patrik will be helpful to their case or are they on a fishing expedition? We were given copies of the Subpoenas for Oral Depositions on condition of anonymity therefore, Rose Speaks downloads open to all visitors, not just registered members is the only place you can pick up copies of these papers. We still have not been able to reach Pol’ Atteu and Patrik Simpson’s lawyers to check to see if Pol’ and Patrik have filed or are going to file Motions to Quash any parts of the Subpoenas nor do we know if any records are being asked for the depositions. If we get a statement from their attorneys, we will be adding that to this article.

We have also added new papers under the Pol’ Atteu and Patrik Simpson vs. Jody “Baby Doll” Gibson and Corona Books, again open to ALL not just members. Two of the more interesting papers that you will only find here at Rose Speaks are two letters. One is a letter from Lin Wood to Pol’ and Patrik threatening to sue them because of their books of Anna Nicole Smith, Portrait of an Icon. The other is a response letter from Pol’ and Patrik’s lawyers back to Lin Wood threatening to sue Howard K. Stern and the Estate.

I don’t see any love fest occurring this next week, stay tuned here at Rose Speaks for the latest all week, but make sure to set your televisions to tune in on Wednesday May 28 for Extra to watch Pol’ and Patrik’s take on all things Anna Nicole Smith.

As we talked to Patrik about the upcoming series of articles this week concerning their suit against the ex-Madame, Jody Gibson, in California a few things came up that caused a couple of chuckles in spite of the seriousness of the pending litigation.

They mused as to why the ex-Madame turned publisher always wanted to meet them in a parking lot and not at her “office”. After several meetings, they decided to find her office, and voila, they went to her office and it was at the above location. They then found her record of being convicted, and so many alias names it would make anyone’s head hurt.

They sent emails and letters to stop, cease and desist stating that the publishing contract had been breeched. There was no way to get the money back she had “secured” to publish the book from them. Then the book began to appear in e-form for download all over the internet and it was nothing like the elegant book they had created.

From there the nightmares and the lawsuit began, we think you will find Pol’ Atteu and Patrik Simpson’s interview to be spell binding and very insightful as we here at Rose Speaks have found them. We have the papers and more will go up today. Also will be the first of an exclusive 3-part interview. They will talk about their friend of many years Anna Nicole Smith, Rita Cosby’s book and did she contact them, and what did Wilma Vicedomine said and how did she contact them and when.

We think you will find great insight to all of these people, plus Daniel Smith, conversations they had with Anna Nicole about her mother, but the big part in part one of this exclusive is when did Wilma Vice call them? What did she offer them and why do they feel as if they were “stalked” by her, the term they used to describe the calls. We were able to verify with two independent sources about Wilma having their number and talking about contacting them and the spin she put on those conversations.

Los Angeles — On Wednesday, April 9, 2008, The Honorable Judge Joe Hilberman granted a Preliminary Injunction in favor of authors Pol’ Atteu and Patrik Simpson, authors of

Anna Nicole Smith Portrait of an Icon

, Case No. SC097218 is set for a Status Conference June 16, 2008. THIS CASE IS NOT OVER! DEFENDANT GIBSON MISREPRESENTED TO MEDIA THAT IT IS – NOT TRUE!! The Complaint sets forth the following Causes of Action: Breach of Contract; Fraud, Interference with Economic Relations, Damages, Intentional Interference with Contract, Breach of Fiduciary Duty, Accounting, Unjust Enrichment, Conversion and Unfair Competition.

Plaintiffs Atteu and Simpson were granted the Injunction against Gibson to stop her from interfering with their right to sell their book, among other things. AGAIN, GIBSON MISREPRESENTED TO THE MEDIA THAT ATTEU & SIMPSON LOST – NOT TRUE!! This is a major victory for Atteu and Simpson because a Court very rarely grants an injunction unless it is proven that irreparable damage will be caused if the offending party (Gibson) is not immediately stopped and enjoined by the Court. This is exactly what the Honorable Judge Joe Hilberman decided.

California law requires that every prevailing party for an Injunction must post a bond according to Code of Civil Procedure Section 529. THIS IS STANDARD PROCEDURE, NOT SOMETHING SPECIAL THAT THE JUDGE ORDERED AS DEFENDANT GIBSON ALLEGED! Plaintiffs’ Atteu and Simpson posted a $10,000 bond as required by California law.

Judge Hilberman acknowledged that Defendant Gibson’s actions of contacting Amazon.com to have Plaintiffs’ version of their book removed from the website constituted improper interference with Plaintiffs’ own third party contracts and Defendants must be stopped from continuing to interfere with Plaintiffs’ attempt to market their own work. Further, the Honorable Judge Hilberman noted that a letter sent by Plaintiffs’ attorney on January 25, 2008, appeared to operate to terminate the agreement between the parties and Defendant Gibson’s failure to comply appears to have been improper.
