As we talked to Patrik about the upcoming series of articles this week concerning their suit against the ex-Madame, Jody Gibson, in California a few things came up that caused a couple of chuckles in spite of the seriousness of the pending litigation.
They mused as to why the ex-Madame turned publisher always wanted to meet them in a parking lot and not at her “office”. After several meetings, they decided to find her office, and voila, they went to her office and it was at the above location. They then found her record of being convicted, and so many alias names it would make anyone’s head hurt.
They sent emails and letters to stop, cease and desist stating that the publishing contract had been breeched. There was no way to get the money back she had “secured” to publish the book from them. Then the book began to appear in e-form for download all over the internet and it was nothing like the elegant book they had created.
From there the nightmares and the lawsuit began, we think you will find Pol’ Atteu and Patrik Simpson’s interview to be spell binding and very insightful as we here at Rose Speaks have found them. We have the papers and more will go up today. Also will be the first of an exclusive 3-part interview. They will talk about their friend of many years Anna Nicole Smith, Rita Cosby’s book and did she contact them, and what did Wilma Vicedomine said and how did she contact them and when.
We think you will find great insight to all of these people, plus Daniel Smith, conversations they had with Anna Nicole about her mother, but the big part in part one of this exclusive is when did Wilma Vice call them? What did she offer them and why do they feel as if they were “stalked” by her, the term they used to describe the calls. We were able to verify with two independent sources about Wilma having their number and talking about contacting them and the spin she put on those conversations.

There is the Amended Motion to Quash by Lyndal Harrington, as was requested to be filed by Neil McCabe last Friday. The emails are attached as an exhibit and the face letter to the court about trying to retain an attorney in a market where the real estate bust is affecting a large number of homeowners and realtors. There is also a Motion to add Luke Lantta Pro Hac Vice of POGO as part of the legal team for Howard K. Stern. Mr. Lantta’s specialty is media law. Then last night Virgie Arthur’s lawyer filed a Notice to With Draw the subpoena temporarily for the Rose Speaks moderator to be reserved at a later date.
Take a look at the emails between McCabe and Harrington; I thought they made for some interesting reading. However remember we can not comment on ongoing pending Motions any of us here at Rose Speaks are currently fighting and/or Subpoenas about to be served again subpoenas.
This happened once before and we expect that the subpoena will be reserved correctly in the next two weeks, since from the emails it would appear it was not served with the notice of subpoena originally on March 24.
The hearing this Friday at 3:30 PM in the federal court from reading the dockets appears to be going to cover the following items:
1. How electronic requests for discovery will be handled.
2. The parties have agreed that the court has enough information to rule on both the Releasing KPRC as a co-defendant in the suit, which will leave the case in federal court if granting in Arthur vs. Stern, CBS, and KPRC. The court will also decide Arthur’s Motion to remand back to state court.
3. The court will hear and decide on the Motion to compel the continuation of a jurisdictional deposition of Howard K. Stern and to produce certain documents by Howard K. Stern.
4. A decision by the court as to how long the jurisdictional discovery will continue, right now the parties have agreed to have it completed on April 21, but with the Motion to Compel, I would expect Virgie Arthur’s legal team to ask for an extension of time.
5. The new deadline for jurisdictional discovery will then also move out the time for the initial list of disclosure which is now due on May 5, that date will probably be moved out to include any additional jurisdictional discovery the court allows.
6. Right now, it does not appear that the Request to add additional defendants or any other Motions to Quash Subpoenas is on the docket for this Friday, April 18.
Rose Speaks has also obtained exclusive legal papers and will be doing a three day long exclusive with a celebrity trial in California. This trial will go with the Anna Nicole Smith cases as well as give us all some more insight to one of O’Quinn’s “investigators/consultants” as one of the O’Quinn people have listed this person in emails.
We expect to have part one up on April 16 after receiving some paper work from a court to go with the exclusive and this will be the first of a three part exclusive throughout the rest of this week.

It’s hard to find a true friend in Hollywood or as TMZ calls “The 30 mile Zone”. Anna Nicole Smith had few “true friends” as Daniel DiCriscio, Anna Nicole’s stylist of nearly 10 plus years, claims. Few Celebrities have true friends after they make it in Hollywood. Of course, everyone claims to be your friend, your good friend, your best friend. It seems they throw the word friend around like a Frisbee, hoping that someone or something will take notice and catch on to it. Jackie Hatten has gone as far to say on many infotainment shows that she was Anna Nicole’s best friend and so close to Anna that she was Daniel Smith’s godmother, among other things, to get “her” 15 minutes of fame, she threw that Friendship Frisbee so hard I’m not sure where it landed. Of course there is no proof. Daniel DiCriscio likes to see the proof or else he will brush those types off and say … “You didn’t know them, you were not their friend.”
In my exclusive interview with Daniel DiCriscio, he wanted to make sure that I did not include him in the same category of those that have a need to brag about their friendships with this or that “celebrity.” I can say that after talking to DiCriscio for almost 3 hours last night off and on. I could tell he checked me out to make sure he was not going to be interviewed in a way that was gossipy. He is not about gossip, although I am sure he has some delightful tidbits he might share with me later… *wink, wink*. He should know a lot, after all he worked his magic and did an over the top makeover that made headlines and had everyone take notice of Paula Jones, President Clinton’s accuser and was even present during President Clinton’s deposition in that scandal.
Daniel DiCriscio (pronounced Dee-Cris-see-o) has worked with many famous clients and was one of Anna Nicole’s stylists from 1994 to 2005. What impressed me about DiCriscio was the way he spoke about Anna, Daniel and Howard on the Court TV interview with Jamie Floyd. I found him to be refreshing and sincere in his comments. This rang true again last night as we talked, laughed and discussed the wacko’s, as he calls many of them that were in Anna’s life or claimed to be her “friends”. Here’s Daniel DiCriscio’s take on all things Anna in his own words.
About Anna ~
When asked if Anna ever talked about Virgie and their relationship, DiCriscio said, “Anna never talked about her mother one way or the other…Virgie was like… off limits” DiCriscio said, “I never asked her about Virgie, I let Anna talk about what she wanted to talk about. Anna was in the type of lifestyle where you can’t go backwards concerning Virgie and she was trying to make a new life. Anna was not the average girl, she created a whole new life for herself and Daniel.
DiCriscio talked about the day he witnessed Anna in pain as he mentioned on Court TV with Jamie Floyd and I could hear the pain and seriousness of the occurrence in his voice when he spoke of that day with me. He says Anna “Got up and wrapped both of her arms around her waist and then collapsed down on the floor in front of me.” DiCriscio wanted to call in her bodyguard or 911 and Anna said, “No!” Anna said to DiCriscio, “Daniel, get my medicine out of my purse!” … while she lay there on the floor in excruciating pain. DiCriscio not one to go in a woman’s purse, handed it to Anna. Anna while looking for her pain meds, found some unfamiliar pills in her purse that were not hers. DiCriscio says, “I helped Anna get up and sit in a chair. She said to me … Daniel get me the phone and can you dial this number for me. She talked to the pharmacist and asked him what the peach colored pills were… that’s when the pharmacist told Anna that the pills were Daniels” She was very upset about this. This was serious, very serious. DiCriscio tells me this must have happened between 5-6 yrs ago, but he is not one to keep notes or pencil in some ones misfortune for his own fortune. “Daniel was still young, not that old yet.” Scary day for both DiCriscio and Anna, as he tells me he has never seen anyone in that much pain before. It was heart wrenching for me to listen to this account as DiCriscio described Anna in such severe pain physically and for Anna to find out her son was taking prescription drugs, which is believed most likely to have been methadone, Anna had to be just as scared for Daniel at that time and feeling also a Mother’s pain. “She was in control then, as she always was. But this was Anna Nicole and how could she tell Daniel not to do what she did?” DiCriscio told me he never saw the infamous “Duffle Bag” that has been said she took with her everywhere.
“Anna was very giving. She was like a little kid in away, she wanted happiness and to have fun with adults and kids alike. Anna loved to pretend. She loved to pretend to be Marilyn Monroe and really loved living in her house.” She talked about the home a lot to DiCriscio, about how it was haunted and stuff, telling him to come over and see! “She loved to create another world. That was what made Anna so fun, she made you forget reality for awhile with her stories and fantasy’s. She was fantastic at posing and flirting with the camera. She was like an Enchantress, she would bring you in and grab your attention with her stories or whatever her fantasy was that she was telling you.”
Asked if he had seen what’s called the clown video, DiCriscio’s voice got deeper and he went on to say, “This looked bad because it was not normal behavior for an average person, so that’s why they (the public) say, how dare you, Howard and Anna. But you see Anna and Howard had figured out how to do some business without Anna having to be out in front of the camera in public.” He adamantly adds, “It was bad press. Stupid, judgmental people, no one really knows what was going on and shame on them!”
I asked DiCriscio if Anna “always” seemed high as a kite and he was quick to say, “Anna was not always stoned and out of it. She loved to have fun and could also be very serious. You couldn’t be Anna Nicole and not be smart. You have to be smart to play dumb like that and she could be very intense.” DiCriscio told a little story about Anna’s sense of humor, ”She was so funny, one time while I was working with Anna, she asked someone to go get her some Ho-Ho’s, Twinkies and Snickers and said Daniel (DiCriscio) l-o-v-e-s snickers. Huh? You didn’t know if she was being funny or serious. She still had that country in her.” The way DiCriscio told this story, he had me laughing like crazy as he was trying to talk country like Anna. He adds, “You never knew if she would be up or down.” I have a feeling Anna most likely kept DiCriscio laughing while trying to do his job on many occasions.
The last time DiCriscio bumped into Anna in LA he goes on to say, “She looked great and was thin.” He said to Anna, “You look so thin, like a normal girl”, and then he shares with me something that put goose bumps up and down my arms, He goes on the tell me…“You know what she said back to me, Lyndal?… Daniel, I’ll never be normal.”
About Daniel Smith ~
DiCriscio says while around Daniel, “Daniel never talked back, he respected his mother, he loved her. Daniel was timid and quite but liked to kid around a lot when he was younger. He was into the typical things most boys were, like video games, etc. and he was never ashamed of Anna at all. He accepted his mother the way she was.” DiCriscio felt that, “Anna knew she could not control him after he started doing drugs.” He went on to say, “Daniel liked being around Anna and Howard” He goes on to describe the last time he saw Anna’s son, Daniel Smith, “He seemed not happy and a little lost and moody. His body was getting thicker, his skin tone had become shallow and pale looking. I could just tell he was taking some type of drugs.”
DiCriscio does not believe Daniel committed suicide or Howard had anything to do with Daniel’s death, “Daniel just poisoned himself with too many drugs, accident.” He goes on to add, “Howard was like a big brother to Daniel. Howard and Daniel were close and Anna was a modern day mother.”
About Howard K. Stern ~
DiCriscio tells us, “After the contract with Guess was over, Anna all of the sudden basically was out of control and spiraled down. Howard totally helped to reinvent Anna and bring back her career. Howard and Anna were partners in everything Anna.” He goes on to say, “Howard always had Anna’s back in everything. She needed someone like Howard to be real with her and not trying to just be a kiss ass friend for her and Daniel and that’s what Howard was, someone she could trust to not betray her and be honest with her.”
DiCriscio feels really sad for Howard when asked about what he is going through, “Not happy about it at all. For Anna’s sake and her spirit I am not happy at all. It’s not fair all the opinions of people that are talking trash and only opinions. Shame on them!” The phrase “Shame on them” would be used over and over in this interview.
When we were talking about why he thought Howard was being attacked so much in the media, DiCriscio enlightens me with, “He is judged so much by his looks and his profession and not as the person he is. Looks play a big part in Howard being labeled the bad guy. Howard was serious, more conservative and educated. He brought her security. Howard did a lot for Anna and he did nothing wrong.”
DiCriscio feels strongly that Howard “worked damn hard for her in litigation and otherwise to protect her. Howard was helping Anna always in a positive way. Anna and Howard both used each other, they were very close and he was the one Anna chose, because of that trust. It was a two way street. Anna chose Howard to be in her life, it was always her choice.” He brought home what many of us have heard, that if Anna didn’t trust you anymore… well she would disassociate from you and as DiCriscio says, “Lot’s of wacko’s in her life and maybe that’s one of the reason she needed him.” He feels, “Howard is getting a bad rap and that Howard did a lot of good for Anna.”
About Virgie Arthur ~
DiCriscio earnestly feels “Virgie trying to play the role of mother and grandmother now is bullshit!” “Together, Howard and Anna were doing business and many people were jealous of the two of them as a team from friends to family.” He goes on to say only one other thing about Virgie, “Mother’s don’t compete with their children, no one knows what really went on, I think that there was a lot of jealousy of her success.”
About the Media ~
DiCriscio was surprisingly approached by a lawyer after his interview on Court TV…..”This attorney approached me out of no where and offer to represent me but was quick to point out … only on TV appearances with me.” What the hell? As we all know everyone wanted a piece of the action when it came to Anna. DiCriscio is … “Not buying that Howard had anything to do with either deaths.”
He read parts of Rita’s book and thought it was “Totally Disgusting! No facts in the book, only opinions of people claiming to be friends. Not friends, users and abusers that thought they could gain something by talking trash about Anna … Shame on them! Rita Cosby ~ is one of the users/wacko’s ~ The Princess of Darkness.” I made sure I could use that name he came up with for Rita … I liked it. DiCriscio elaborates, “We all sin in one way or another and while all these so called friends are pointing a finger at Anna or Howard at the end of the day they are pointing three fingers back at themselves. No one is without faults, no one. You can’t trust anyone when you are a celebrity, not anyone. That’s why she had Howard, she could trust him.” No one contacted DiCriscio for his involvement in Anna’s life, for Rita’s book, but then again, she didn’t really contact many people, did she?
About Anna’s “so called friends” ~
DiCriscio talks about the “so called friends” as “Users and abusers around her and they turned it around on Howard, Shame on them all!” DiCriscio explains that… “So many of her “good friends” would call over and over and over, constantly trying to push themselves into her life by being sugary sweet and phony, always hounding Anna hard to get what they wanted, such as Bobby Trendy and others. Anna had Howard to protect her from them at her request and for her own sake and sanity. Howard became the bad guy because of it.” DiCriscio describes, “It’s a fake picture that they are painting of her for their own benefit, personal gain and profit.” When questioned had he ever heard Anna talk about Jackie Hatten or that she was Daniel’s godmother he was quick to say, “Never heard that Jackie Hatten was Daniel godmother. She is not a friend, she is disgusting and stupid. She must have said those things to try and get approval from someone… Another wacko!”
Anna’s effect on DiCriscio’s life ~
DiCriscio’s experiences with Anna left him feeling, “Very fortunate to have had her in my life. Everyone has a bad side, I feel, I brought out her good side and that’s what I saw.” DiCriscio tells me he strongly believes that we alone are responsible for what side we bring out in a person. Now I don’t know about you, but he sounds like the type of “friend” I would want around me, as I’m sure he was just that to Anna, Daniel and still is to Howard with his support and understanding of all things Anna Nicole Smith and the way of Hollywood.

I was thinking about Rita Cosby and her #1 Best Seller - Blonde Ambition: The Untold Story Behind Anna Nicole Smith’s Death. I remember it stayed on the New York Times Best Seller List for several weeks and continued to garnish a spot there for a little longer, until of course the dreadful episode in the Bahamas where she was allegedly caught bribing witnesses along with her boyfriend posing as a representative from her publishing company. I believe after that incident the book sales slowly declined. The jacket of her Best Selling Book and on her website, she guarantees to donate 10% of all advances and all royalties given to her from her publisher, Hachette Book Group, USA to D.A.R.E. America, a 501c3 non profit Corporation. So I set out on a mission to learn how much she had donated to this worthy cause based on a tip I received that I really might want to check it out and see if indeed Ms. Cosby had made the donation as advertised. I had always thought that it was a brilliant marketing idea by Ms. Cosby to pledge 10% to D.A.R.E America.
Based on reports she was advanced $600,000 from her publisher, I calculated her first donation would have been at least approx. $60,000 give or take since she stated she had decided to write the book in April 2007. I started out by researching D.A.R.E America on the internet, as I have seen many non-profit 501c3 Corporations list their donors along with an amount or a range of the donation posted on their websites. I googled, I yahoo’d, and I searched relentlessly for any reports of donors to no avail. I found a page on their website that listed major sponsors and supporters and Rita Cosby’s name was not included among them.
So my next step was to call the Corporate Offices in Los Angeles, California. I spoke to Tina Gonzales, the sweet and very accommodating receptionist. I explained to Tina that I was writing an article concerning Rita Cosby’s philanthropy to D.A.R.E America from her book sales, she informed me that Jan Appel, the Executive Assistant, would be the person that would be able to answer my questions concerning Ms. Cosby’s donation and to verify the donation. Unfortunately this being a late Friday afternoon, Jan was out of the office until Monday, so I reluctantly left a request for her to return my call on her voice mail.
To my surprise, about 15 minutes later, I received a call from Tina, the receptionist, informing me that the person I really needed to talk to would be Mr. Ralph Lochridge, the Director of Communications for D.A.R.E. America. Ralph coordinates all aspects of communications—including the website (dare.com) and is the spokesperson for D.A.R.E. America. I proceeded to call Mr. Lochridge. Ralph was also very polite and an upbeat man who was willing to talk to me, that is, until I asked if he knew and could confirm the amount Rita Cosby had given D.A.R.E from her book sales or if could he possibly direct me to the website to find out. He laughed and told me something to the effect of…. Oh no, I can see why they told you to call me, because I handle all media and since you are writing a story they gave you to me, however, I have no idea as to the amount Rita has given to D.A.R.E, because I don’t keep up with those figures; I handle communications and media only. You need to talk to either, Ron Brogan, he is the New York Representative, Frank Pegueros, the Deputy Director or Charlie Parsons, the President and they would be able to answer your questions.
So I thought for a moment, which of these men can give me an answer? I decided to call Ron Brogan, as I was told he was the New York Rep. Actually he is the Bureau Chief for the New York City office. Once again to my astonishment, he too answered his phone and was as delightful to talk to as Ralph Lochridge was. I asked him point blank if Rita Cosby had given any type of donation as promised according to her website and book jacket. He quickly responded, “No monies have been given yet.” I was a little taken back with his quick answer and said I assumed she would have at least donated the 10% portion she had promised of her advance which would be a sizable amount. He proceeded to tell me that really it’s not all over… with all the book signings still going on. I questioned his response, since I had not seen anything in the television media, print media or otherwise to indicate that Rita was having book signings, as in “book stores”. He swiftly corrected his statement from book signings to book “parties”, like the one he attended in New York on October 3, 2007. I thought that would have been a perfect opportunity to hand a check to Ron, the New York Bureau Chief of D.A.R.E., with a photo of the two of them showing her commitment and standing by the statements she had made, but it didn’t happen.
What Ron was telling me, I took it to mean, that she had not tallied up the total as of yet from sales and the advance, therefore had not donated anything as of yet. He quickly said… ahh, ahh, hmmm, well she could have sent the donation straight to the headquarters in California. I asked him if he had been told by the California office of the donation. He basically said… No he doesn’t know who sends in donations. I was puzzled, I was under the impression he was the New York Representative and in that position I would think he would get some type of report detailing what contributions had been made in his “territory” for year end, after all he is the Bureau Chief. He informed me that he never gets reports like that and doesn’t keep up with donations. I asked him since he attended the New York “Book Party” if he knew Don Clark and if so did Don Clark have anything to do with arranging D.A.R.E to be the charity that Rita chose for her donations. He quickly answered, “Oh no! Rita has been active in D.A.R.E for a long time”. I kept him on the phone for a little longer; he continued stumbling over his words concerning not knowing what goes on between the California headquarters and the New York office. He could not get off the phone quickly enough and advised me to call Frank Pegueros, the Deputy Chief or Charlie Parsons, the President of D.A.R.E., at the 1 800 number that I already had called.
Next I decided to skip the Deputy and go straight to the President of D.A.R.E. I called back and asked Tina if I could speak with Mr. Parsons and she put me right through, as if he was expecting me to call. I started asking him the same questions that I had asked the previous reps of D.A.R.E. Although this time I wanted to talk more about where I might find a published report on the web or elsewhere concerning the 501c3 non profit organization. I told him that most non profits that I had been affiliated with usually posted or published reports concerning fundraising and donations. I had explained to him how normally you see a persons name or organization with an amount say…. $100 to $500, $500 to $1000, $1000 to $2500, $2500 to $5000, $5000 to $10,000 and so on. He sort of laughed at me and said, yes he had seen that type of report, but they did not publish anything like that and at the same time sort of mocked me. I asked him if indeed D.A.R.E. is a non-profit 501c3 organization and he said, yes, but he did not and was not going to disclose what donations and contributions D.A.R.E. gets and I took that to mean, especially concerning Rita Cosby and her much advertised promise to contribute 10% to this non profit. I pushed him a little more to at least give me a ball park figure so that I might write how she held up her part of the bargain as publicized on her website and on her book jacket. I asked him, “Well, will you tell me if she has donated “at least” the 10% from her advance? He said, “She has been very generous.” I said, “Can I take that to mean she has given at least $60,000?” He said, “You said that, those are not my words.” I went round and round with him, about how the word “generous” could mean a different amount to different people and he agreed. Believe me; he was not going to budge on a figure at all just to say she has been generous, period. I wonder if Mr. Parson’s was one of the four men from D.A.R.E., along with Jack Harding, that attended her “book party” in L.A. on October 30. 2007? That too would have been a perfect time to hand D.A.R.E. a check with a photo opportunity. I found Charlie to be much more official and less cordial in our conversation. He ended our conversation with the statement; “You need to call Rita Cosby and ask her about any donations”.
I decided to dig some more on the website and low and behold there was a list of sponsors and supporters, that the CEO of D.A.R.E told me didn’t exist. I also found many pictures of other celebrities and organizations handing over checks to Charlie Parsons, CEO. I can only assume Rita Cosby did not provide them with a photo opportunity. I finally also found through google on the D.A.R.E website a press release of the upcoming release of Blonde Ambition of September 4th, announcing she would be contributing a significant portion of the proceeds from this book.
After hanging up my head was swirling from the run around I got from each of these D.A.R.E. Officials. I set out to get a simple answer to a simple question. At first I was told by Ralph that he only handles media and could not help me. I was told by Ron, that no monies had been given, but then again…it’s not over yet, as in all the “book parties” were still happening and so there is no final tally, however, she could have sent a check to the headquarters and not told Ron about it and of course, he wouldn’t get a “monthly report” stating anything about contributions. Lastly by D.A.R.E. America’s own CEO and President, Charlie Parsons, that Rita Cosby has been very generous, whatever that means? I remember discussing with him that generous could be $100 to $100,000 or any unlimited amount, at which point he instructed me to ask “Rita”.
I can say that it was both interesting and a bit fun listening to grown men stutter and side step a simple question concerning Rita Cosby and I felt like I had been treated to a dog and pony show.
So I ended as I began to find out if indeed with the question still unanswered – Did Rita Cosby or didn’t Rita Cosby stay true to her promise to give 10% as her website and book jacket still states to the D.A.R.E. Program?
