John O'Quinn whispers to Debra Opri in court in Florida Feb. 2007

It has been passed around in court filings from last June in California, to Florida, to New York that Mark Speer(s), a/k/a Speer, Spear and Spears, seems to have almost as much connection to all of the lawsuits in differing jurisdictions as does Wilma Vicedomine, which leads to the question of why?

In the California dueling banjos of the Birkhead sues Opri sues Birkhead cases there are a few facts they did agree on. The main one being that a disagreement over money given to Opri on or about March 2, 2007, which ended up in her client trust fund, caused a disagreement on March 13 following a hearing in California.

After that the tale gets hazy, Larry Birkhead has always claimed he fired Opri on March 13, Opri has maintained she fired Birkhead on March 15 and released a statement stating that right before a hearing in the Bahamas on the morning of March 16, 2007.

Court Filings by Opri shows she filed on March 20, 2007 to be released as Birkhead’s attorney of record in California and that the court granted that on April 23, 2007.

We have many allegations if you all remember of whether Rita Cosby secured Opri for Birkhead and if Opri then released confidential information to Cosby as a thank you for the high profile client. That is a lot of he said, she said, except that Cosby does say in her book she did introduce them but did not know of any financial arrangements. Greta of Fox, during a L. A. Times article on the woes of Debra Opri did recount a conversation she had with Birkhead in September 2006 in which she said Birkhead told her Opri was going to represent him free. Opri, Cosby and Paul Barresi all agree they met and became friends during the Michael Jackson Criminal Trial in California in 1993.

Then there are all of those people in all of these suits, especially the lawyers of Cosby, Opri, Arthur tend to keep mentioning the Marshall monies Dannielynn might get one day, which seems to be an ongoing current in all of these cases and with all of these people.

In Opri’s filings, and statements made by both Ford Shelley and Ron Rale there was a meeting in Rale’s hotel room between Shelley, Birkhead and Howard K. Stern about funeral arrangements for Anna Nicole Smith as well as attempting to reach agreements on all disputed facts including Horizons and a private DNA test for Larry Birkhead. This meeting occurred the night of the last day of hearings in Florida in February 2007. However, until Cosby’s book was published that is the only meeting anyone has ever talked about other than Opri thanked Stern on the last day of hearings for Stern agreeing to allow Birkhead permission to see Dannielynn during Birkhead’s next visit to the Bahamas.

In Court Filings in California, Opri seems to “believe and states” that Birkhead and Harvey Levin of TMZ.com were “good friends”. Larry Birkhead bragged about that per Opri’s filings, including releasing her bill to TMZ.com, and it does appear that TMZ.com had the exclusive following Birkhead’s ten-hour deposition this week. So perhaps that allegation is true, after all it would appear that possibly TMZ.com might have bought some of Birkhead’s celebrity pictures over the years to me, what do y’all think?

Then comes the surprise why did John O’Quinn’s law firm claimed “privilege” on all third party correspondence that ended up with Wilma Vicedomine to “check out” but not those that ended up with the rest of the firm including Don Clark. Thus, the law firm released the long rambling email of Carolyn Herring, which several thought was hiney einy of Florida only after reading that email it is clear that Ms. Herring lives in Texas in the Dallas Fort Worth area. There is a long rambling correspondence with a Howard Lynn, which is just that. Then there are emails from a Joyce Cornwell of Florida that is interesting, as well as a nurse from Denton Texas offering her service “pro bono” to Virgie Arthur. Many of you have pointed out the interesting email from someone claiming to be with the Montel Williams show, which is interesting only in that Cosby ended up on that show with Don Clark and others selling her book in the fall of 2007.

There is a fan email from Marilyn Williamson of Fenandina Beach Florida, dated March 28, 2007. Ms. Williamson is proud to say she figured out John O’Quinn’s strategy in getting Howard K. Stern to file a slander suit against O’Quinn for the “m” word so O’Quinn could get jurisdiction over Stern in Texas, now that is an interesting email since it now appears to have a ring of truth to it.

However, I found three emails of particular interest, one from Virgie Arthur’s Bahamian lawyer, Debra Rose. That email states to Don Clark the following:

“Debra Rose wrote:

Don,
We are aware of the Bahamian connection; add to that the son of Roger Gomez, Roger Gomez, Jr., was recently an associate of the law firm of Lockhart and Munroe, Howard Stern’s attorneys.

DEBRA”

You have to wonder why O’Quinn did not claim attorney-client privilege on that one for Virgie Arthur.

But then there are some interesting letters and two very interesting emails, the letters are to and from Brian Cavanagh in Florida as well as the FBI in Miami asking for a more thorough investigation into Anna Nicole’s death.

The letter to the FBI states in part the following:

Dated April 16, 2007

“[A]n expert, Mr. David Liebman, a two time president of the National Association of Document Examiners, says the signature appears to be a forgery is also enclosed. Additionally I [Clark] have enclosed a copy of a magazine article that identifies the expert who says he believes the signature of the Will is a forgery.

Based on the investigation conducted by this law firm, the media and private citizens, we strongly believe that Anna’s death was anything but an accidental overdose. We believe that there should be a thorough investigation into Ms. Smith’s death, which would not be complete without including the circumstance surrounding the death of her son, Daniel smith, who died in the Bahamas on September 10, 2006 under almost identical circumstances…

Don Clark then names both DEA agents and telephone numbers in California that are conducting an investigation, Lisa Troncoso and Alma Tongson, as well as Jon Genens an “investigator” for the State of California Medical Board, are investigating the methods of procuring prescription drugs”.

Clark thanks SSA Patrick G. Brodsky, for taking the time and meeting with him [Clark] on “April 11, 2007 to discuss what I [Clark] believe to be severe mis-steps and incomplete investigations conducted by the Seminole Police Department”, (OUCH!), “surrounding the death of Anna Nicole Smith. I am available to provide you with any assistance I can to ensure justice is done as it relates to Ms. Smith’s death and the death of her son Daniel. I can be contacted at any time at the below numbers…”

Don Clark sends a CC to Valerie Parlave, Assistant Special Agent In charge, FBI, Miami Division.

Then we have the letter dated August 2, 2007 from Brian T. Cavanagh to Don Clark that states in part:

“August 2, 2007

From Brian T. Cavanagh

“…letter dated July 23, 2007, and our follow-up telephone conversation this week with a “representative of your firm”.”

No date but in response to the August 2, 2007 letter Don Clark makes some interesting statements.

Don Clark says in part “…However, I and others in the law firm do believe that the investigations was not conducted in sufficient depth to determine actual motives and more detailed actions of the individuals surrounding Ms. Smith from prior to her travels between the Bahamas and the Hard Rock Hotel on the Seminole Reservation. I [Clark] believe that a more detailed look into individuals associated with Ms. Smith and the actions of each of the individuals prior to her clinical time of death will produce different results.

…Frankly sir, we don’t question the coroner’s conclusion that Ms. Smith died of an overdose of various drugs, but we do question that her death was accidental. We find it extremely unbelievable that a person in Ms. Smith’s mental and physical condition, which has been established by witnesses and according to Howard Stern, was never left alone, could have the quantity of drugs found in her body as a result of ingestion or by using a syringe herself.

Below, is a partial list of individuals and what information they should provide. Some of the witnesses may require subpoenas. However, I believe their information is key to developing the whole truth surrounding Ms. Smith’s death.

Witness number 1 is Mark Speer.

Now in August of 2007 we seem to have a different story from Tas including “information regarding computers and cell phone activities”, as well as Moe, [which goes to Moe Moe tell us it ain't so did you sell out prior to Cosby's book], Dr. Khris and the Bahamian nannies…”

Don Clark goes on to say he is, “now prepared to meet with you and your staff for the purpose of providing you with additional information, names of potential witnesses and some pertinent documents, which I believe will provide sufficient probably cause to re-open the investigation into the death of Anna Nicole Smith.”

My question is if Mark Speer was so crucial to the investigation into the death of Anna Nicole Smith why throw Mark under the bus now in July 2008?

We have Mark Speer, connected to all things California, Florida, the Bahamas, and New York as a source for Cosby’s book and now when it appears he is not needed tossed under the bus to fend for himself. You ask why we know this happened to Mark? I suggest you pull the 2 emails from Mark Wilson dated March 20, 2007, the date that Opri filed to be removed as Birkhead’s lawyer in California, very interesting timing. Both emails from “Mark Wilson” are desperate to reach John O’Quinn to tell him he worked free with Opri and Birkhead and that he has important information for O’Quinn about a “SECRET MEETING”. In the second email dated the same day the “SECRET MEETING” is added as occurring at “HORIZONS” and that Dannielynn might be in danger and what he is willing to do and for free… WOW so many working free here. However, it is that secret meeting at Horizons, which found its way into Cosby’s book. Not to mention at her New York book signing party there was Mark Speer with Don Clark, John O’Quinn and Virgie Arthur all big smiles for the photo ops.

What is interesting is Mark Wilson also goes by Mark Speer, a/k/a Mark Wilson Speer etc., and that Mr. Wilson/Speer has been a member of Rose Speaks.com from almost the beginning or Rose Speaks.com. Even after we were hacked into in November and December 2007, Mr. Speer joined quietly again on January 22, 2008 under the name of Marcus, Ooooooopppppppppss we need to add that name to the many names of Mark Speer(s). On another interesting note, it appears we had or have a pending member that is actually Wilma. These things make you all snuggly to know these people want to be close to us including trying to join our new forums, doesn’t it?

Therefore, with this article the main site member list is NOW CLOSED to all except admins. That said we welcome both Mark and Wilma. Although I must say I would have more respect if you had joined with your “real name” like John Nazarian did, just my opinion. Rita Cosby, reduced to another paparzzi

Rita Cosby has filed her “Disclosure 26 witness list” but NOT in the New York Federal Court where she has been able to get the court to agree to a gag order on almost anything Hachette Books and she feels is going to expose her to embarrassment or public ridicule. The court did issue a new “Consent Amended HIGHLY Confidential Order” as the lawsuit goes forward and while asking some witnesses to, now after the fact of the book, give Rita Cosby and Hachette Books very sensitive and personal information as the objection filed in California by Larry Birkhead’s lawyer, Michael Trope shows. The Order also allows Howard K. Stern to play by the same rules. Again, I would add it would have been nice if Cosby had tried to vet her sources before the book instead of after the book, in what now appears allegedly as an attempt of saving her Azz so to say.

We had to dig to come up with the papers in California but come up with them we did, as well as a subpoena served on CNN in Atlanta Georgia by Howard K. Stern. Yes, we have to prowl through the national databases occasionally but as with these papers we found filed in California it is well worth it.

Now what does the witness list tell us about Rita Cosby’s defense? First, we noticed she has many of the same witnesses as Howard K. Stern. However, Cosby now tells us that Bruce Littlefield of New York, alleged friend of Cosby’s good pal; James Edstrom was her “ghost writer”. James Edstrom, whom by the way is NOT on the witness list, I wonder why when he brags about being Cosby’s official photographer for years. Perhaps he will be added to the gang of Cosby’s defenders, as the trial gets closer, isn’t that what good friends are for? Perhaps James Edstrom was never a long time good friend and like so many others in this tragic tale, just hung onto the coat tails of Cosby for a bit to get his own publicity. Any of you know how long Edstrom has been Cosby’s “good buddy”? I continue to say this book read so bad that you have to wonder who wrote it and how quickly, you would think an “award winning journalist” would have taken some writing classes to get her degree. Who is Bruce Littlefield anyway, did he do some garage sale shopping books?

Back to the witness list and who are on it and who is NOT on it which can be, I predict very telling about this blond ambitious “who dunnit” novel passed as fact to readers, in my opinion. We now know that many of the allegations of sure fire, yeppers we know it, stand behind it 120% no 200% is not quite there, it now appears.

Looking at the witness list we see that “grouping of people” we have suspected will tie this up with a Los Angeles, Houston, Florida and into New York of people with similar interests and agendas, in my opinion. After you read it be sure and give us your opinion on this “grouping of people” and if you think they were “reliable” sources for Cosby’s ambitious book. Let’s start with the Texas connection: We have some that both Rita Cosby and Howard K Stern listed including, Virgie Arthur, Don Clark a private investigator for the O’Quinn law firm and the biggest surprise, per Cosby list, once again Wilma Vicedomine listed as a PRIVATE INVESTIGATOR. She is listed on Stern’s list as just a “witness”, not as a private investigator as she ranks on Cosby’s list. So all of you out there that said, she is not important and never passed herself off as a private investigator when we interviewed Pol’ Atteu and Patrik Simpson, they seem to be vindicated here. Why might you ask, simply because Cosby and Hachette both have listed Wilma as just that, a private investigator? I did not know Wilma had a Texas PI license, they are hard to come by. However, per Cosby and Hachette’ list we now know that in fact she claims to be just that, a private investigator; however as the O’Quinn law firm continued to state in December 2007 only for the cases of Virgie Arthur. Can one now get a P.I. license in Texas by the mere fact of knowing a “real” P. I.? Of course, she could be a “P. I.” in training “studying under” Don Clark. I bet some of you can check into the requirements in Texas to claim that special title and get back with us on when Vice accomplished this feat. However, it does appear Wilma is in fact a Private Investigator if Cosby is to be believed.

Then we have a surprise witness on Cosby’s and Hachette’s list, John O’Quinn, was he a source or did he only loan Cosby Wilma and Clark as sources? Is Cosby going to hang these Texas people out to dry so to say if it comes down to “outing” them as prime sources for her book? Did John O’Quinn ever meet Anna Nicole Smith or Daniel Smith? What could he have been a source for in Cosby’s book, other than then what he now claims? If you believe Rita’s past now cancelled show, just like Greta’s On the Record, you have to know that is not real news, and no one believes what is on those shows, called “infotainment. Wonder if he told Cosby that no one watching her now cancelled show on MSNBC would ever accept that as anything but “infotainment”. O’Quinn has gone on to continue to say that Greta and Cosby should never be believed, that has to make both women feel warm, snuggly and loved, NOT. If you doubt that about John O’Quinn’s opinion of Cosby just read the latest filings in the federal court in Florida. None of Anna Nicole Smith’s other family members or friends are listed on Cosby’s list, although some are listed on Howard K. Stern’s list filed publicly with the New York court back in November 2007. Which by the way is when Cosby filed this list, she just chose not to make it public, must have been one of those “confidential documents”.

Then let’s swing out to California, and we have Mark Speer (only now we “think” his name is Spears, or Speers, or Spear), he was “the security person”, working for Debra Opri, the long time good friend of Rita Cosby. Then as we peruse the list we see, some more interesting people on Cosby’s list, some that did and some that didn’t make it on Stern’s list. Cosby and Stern both agree that Mark and Jackie Hatten as well as Jack Harding are all important to this case. I wonder what Jackie Hatten said in her deposition and watching her in court during the trial should be great entertainment. We have all now had a good look at jailhouse Mark Hatten; did Cosby ever look into who this guy really was before interviewing him via phone in prison for her book? You would think that “award winning journalism” might have caused her to stop for a second or two to determine his “believability scale”.

Now getting back to the ever changing tales of Jack Harding the P. I. who did talk to Daniel Smith but only briefly met him for coffee at Starbucks with Ray Martino; Jack Haring whom as the weeks following Anna Nicole’s death “story” grew and evolved kind of like Pinocchio’s nose. Jack Harding, remember him, the P. I., whom we were able to debunk on this site, using his multitude of ever changing interviews. Jack went from saying there was “one brief” meeting to having “several meetings”, from being told Daniel Smith had a previous prescription problem to saying that Don Clark had contacted him and offered to pay his expenses to the Bahamas for the Inquest. Which brings up the question, why didn’t someone as important as Jack Harding not make it on the Bahamas officials “main” people who needed to testify list, but did make it on Don Clark’s list? Jack Harding ended up, it appears, being a major source of information for Cosby’s book, did she not pick up that this guy’s story kept changing? She based almost a whole chapter on what Jack Harding had to say, including having to save John Nazarian from being treed, ah I mean fenced by Harding’s dogs.

Both Cosby and Stern continue to agree in California that Ray Martino is important; Larry Birkhead whose lawyer is trying to reign in the broad reaching subpoena with Cosby and Hachette’s lawyers to see if the new “Consent Amended Order” is enough for Cosby to be able to go through all things concerning Larry Birkhead. If I had the money to make a bet, I bet that “fishing expedition” into Birkhead’s life will be severely limited by the federal court in California if Birkhead and Cosby’s lawyers cannot reach an agreement. I might add here that Cosby and Hachette are “beefing” up their list of Pro Hac Vice lawyers to appear if a court hearing is needed in California.

Stern and Cosby both have Anna Nicole’s ex-assistant, Kim Walther on this list; as well as Ron Rale, Anna’s lawyer and ex-law partner of Howard K. Stern and still friends with Howard K. Stern. On Cosby’s list he is just listed as a friend to Howard K. Stern. Is Ron Rale the attorney close to Stern and Birkhead that Rita said in interviews that she had several conversations with before and during her writing of the book? Everyone in all lawsuits, in all states wants the ET employees, especially Bonnie Tiegel and Mark Steines; it appears they are listed in this lawsuit as well as the Houston Texas federal suit and the Florida federal suit. Am I the only one here seeing overlapping players in all three federal suits?

Both lists have Dr. Kapor and Dr. Khris listed. However, with Cosby bragging about how her book got all of the investigations kicked back into high gear, Florida and the Inquest in particular, I wonder if she can get either doctor to appear. I know we continue to lose our Constitutional Rights, but last I heard if these doctors are still being investigated by anyone then I doubt Cosby is going to get any “good and spicy” testimony from them to back up her and Littlefield’s books claims.

Now we have some interesting developments in all of this: First Pol’ Atteu and Patrik Simpson, they are listed on Stern’s witness list but NOT on Cosby’s witness list. However, we might note that making a full disclosure to us for their deposition that stated they had dinner with Cosby, her lawyer and her lawyer’s assistant in New York in mid-March and then received a subpoena in April by Cosby’s people. Remember that Pol’ and Patrik swears to us in their “full disclosure” that they only talked about raising children, and Pol’ and Patrik were “curious” about Rita so decided to take her and her lawyer up on an offer for dinner. Second, during our interview with Nathan Collins, he said up front that Hachette’s private investigators had interviewed him; he is on Stern’s list as possibly having information about Cosby’s book but not on Cosby’s list.

Then we have two surprises on Cosby’s list, John Nazarian, again why didn’t she talk to him while writing her book she put his email addy in the book so we all could email Mr. Nazarian? By the way, thanks Rita for doing that, after your book came out we emailed him and he ended up writing about the Anthony Pellicano trial for us. However, I have to wonder how many idiots emailed him thanks to you putting his email address in your book. Bottom line is that Cosby really could have contacted him if she had wanted. He would not have talked to you about any clients, like Birkhead and Stern, but I bet he could have talked to you about being treed (ah fenced) by Harding’s dogs and then saved by Harding himself. However, if Cosby had done that homework about vetting her sources that “intimidation chapter” about Mr. Nazarian would have probably had to end up on the editor’s floor.

Drum roll here, we then have Debra Opri listed as a witness. Am I the only one seeing a pattern of lawyers or ex-lawyers as key players end up on Cosby’s list of people who can vouch for her “who dunnit” book? Can Opri discuss an ex-client like Birkhead? I mean she did that June 6, 2007 filing that became almost the entire bases for chapter 12 of Cosby’s book. It is just a “minor fact” that the June 6, 2007 filing by Opri had been stricken by the California Court before the book was published, perhaps she can testify as to why she filed that in the first place. I am willing to bet that little filing has cost Ms. Opri some television appearances, some clients, but she did get a new Hollyweird term named after her, the “I’ve been Opried”.

The South Carolina, Florida and the Bahamas list of people are also overlapping in the lawsuits. However, Cosby gives us two surprises here, it appears we now know the name of the boat handyman she based so much of her book on, Todd Smith. The other person that seems to be very absent from Cosby’s list is the “male employee confidante” from the Bahamas that so much of Cosby’s book about Stern mistreatment of Anna Nicole was based on. Which brings up my next question, is it cool to put a character who is perhaps fictitious into a “non-fiction book” even though it reads like a “who dunnit” novel? Perhaps L. Lin Wood and Howard K. Stern were right in their interviews about saying this guy never existed.

I suggest you pull Stern’s witness list and the Cosby and Hachette witness lists and compare them side by side. For me it was all of the same people gathering in all of the different jurisdictions from sea to sea and to foreign countries. It seems to be a close-knit circle of “friends-enemies”, and a lot of “who dunnit” alleged theorists.

 Ex-FBI Don Clark with Virgie Arthur

As I sat and listened to the interview last night that was sent to me from Don Clark’s, Tuesday April 8 Scared Monkeys Internet Radio, I found Mr. Clark’s words did hold some things I hope we can all agree about.

Dana Pretzer, the interviewer, mentioned that the focus had left Daniel Smith and Anna Nicole Smith and had focused instead on Howard K. Stern, and whether he did something wrong. I was amazed that Dana, said he felt like this was unfair and due to media coverage.

Don Clark also made some thought provoking statements. Don Clark mentions a “she” that was responsible for the drugs and the doses of medicine taken and that person was not there to testify. Don Clark never mentions whom the “she” was leaving us to ponder if that was a nurse, one of the nannies, who never met Daniel, or a doctor. He mentioned that the person had been on the list to testify so that leaves me wondering if perhaps it was a “he” as in Dr. Kapoor, however without a name we will never know who Don Clark was referring to. Mr. Clark did point the finger at Howard Stern, saying that he [Don Clark] is not going to pull any punches and pointing to Howard Stern and that his testimony changed from Florida to the Bahamas police statements to what he testified to at the Inquest and the jurors at the Inquest was not allowed to see the inconsistencies.

Dana Pretzer brings the interview back to the media coverage including Entertainment Tonight, all of the news shows, even including Dana’s internet radio show, TMZ.com. Dana goes on to say “All you see is these young star and starlets and they are in so much trouble because of substance abuse problems either prescription or otherwise”. Mr. Pretzer says that people are making money off of this story but Mr. Pretzer chooses not to say who he thinks is making money, preferring to keep that to himself and focusing instead on that “two people are dead and a young child without a mother”.

Dana Pretzer ends with a question that I think is beneficial to all of us; “What has today’s society done to contribute to this whole tragedy that we keep talking about here”?

Don Clark’s answers with; “…It is all about the money, and unfortunately that is what it seems to be. It is about whatever that a particular entity can get on film; or get on camera; and be able to display and show; and unfortunately for the viewing public is that they only get. …sound bites of what somebody else has decided that they need to see or hear and they judge and make their opinions based on that. … I have seen this in this case repeatedly, ah people make their decisions …on people, their personalities, their character, whether they are good or bad on a particular sound bite that they see or a particular photograph or video they see in one particular place. And that is unfair ah for the system…”

Don Clark goes on to say we have the best system in the world and it is important in sitting a jury that we weed out the people he just described.

Don Clark continued with; “…This case, in my life, I have never seen anything like this that moved to the scale it has and seems like certain outlooks or certain people have different views on different things and they only paint those and paint the other party in the absolute worse light and sometimes whether it is true or not”.

Mr. Clark advocates that there is still an opportunity for further investigations as to what happened to Anna Nicole Smith and so I think each of you will come away with something from listening to the whole interview.

Dana Pretzer finishes with his own thoughts about “movies, books and litigation that will go on for years and years until the next star or starlet unfortunately will come to their demise in some sort of sad, depressing, questionable way.” Then Dana finishes with a question of “What can we in the media do Don, to be fair in something like this…?”

Don Clark says; “People want to surmise and come to their own conclusion as to what their thoughts are. And I think that they really want to be smart about these things”. Mr. Clark recommends to just “…Try to follow the facts instead of putting a (in audible) a different twist onto it on whatever direction you want it to go. Let the facts lead you to whatever the end may be. …get away from that and start putting your own analysis of it, and let’s face it many of our media people are well liked in the public and if it is said by some of our media people, it is gospel.” He goes on to say, “the media system needs to stick to the facts and circumstances and not be so selective as to what pieces of sound bites and that is what it is about and most (inaudible) a sound bite…”

Don Clark ends with a lesson for all of us, “Just be more responsible about what they [the media] say and what they say about people that someone might have casually said to them and they don’t even know this person…”

Dana Pretzer ends with, “In this situation that has happened to all of the different people”.

So now my editorial opinion here:

I agree with a lot of what this interview says. I wish none of these people involved had become a household name for me. Not following Anna Nicole Smith in life, I had never heard of most of these people until the trial for possession and burial of Anna Nicole Smith began in February 2007 in a Florida Probate Court. I can see where Anna Nicole Smith and Larry Birkhead might be household names because they both were what we refer to as “red carpet walkers having their pictures made at events”, thus they both became very public figures by choice.

I wish that Virgie Arthur, Howard K. Stern, Dannielynn, John O’Quinn, Lin Wood, Ron Rale, Krista Barth, G. Ben Thompson, Ford and Gina Shelley, Big Moe and Taz, the Stern family etc. had never become household words to me. I must admit that when I read on another blog about Lin Wood coming on board as one of Howard K. Stern’s lawyers I had no idea who he was, as I did not know whom John O’Quinn was. I had to, as I advocate, let google be my friend and do some internet research to see who even those two lawyers were.

I can also agree with Don Clark about the media and the need for more responsibility in the future and not to base all things on a sound bite, it is way too easy to do that and not think for our selves, but let the talking heads feed us those sensationalism sound bites.

That is the reason that Rose Speaks houses ALL the court papers on all trials we follow so that each of our readers can download the documents, do their on research and reach their own truth.

I don’t’ think at this stage of this sad saga that the two polarized viewpoints is ever going to change. It is going to remain divided between those who think Howard K. Stern killed two people and those who do not.

However, I have something else to offer to you all to think about in all of this that is not going to make many of you happy. I think that NO ONE in this whole saga walks on water or has the absolute truth. In fact, there are no winners in this to me, only lives being destroyed some due to this being thrust into each of our living rooms by infotainment masking as news from last February to the present; and some because they are only observers in this. If there is any one innocent person in all of this it is Dannielynn, and sadly, it appears with time and the internet her innocence might be lost at all too young of an age.

That being said I also believe this is about money and power, between Lin Wood and John O’Quinn and the rest of us are observing two titans at war as I have said before. One will come out as attorney of the decade the other will not. Thus, my fascination in loving legal papers will keep me covering all of these different trials to the conclusions of each.

Nathan Collins, Anna Nicole Smith’s last personal assistant

Nathan Collins wanted to go on the record about his National Enquirer Interview. “When I stated she, [Anna Nicole Smith], had many men as sexual partners, I never implied nor did I confirm or deny the allegations that ‘Anna was pimped out’. I simply stated that as a reference that Anna was NOT monogamous with just one partner, that she did indeed live a very carefree sexual lifestyle, nothing more, nothing less. I asked Nathan Collins if he knew why Kimmie left after being with Anna Nicole Smith for several years; Nathan stated that Kimmie had just suffered burn out, but remained good friends with Anna Nicole Smith after she left as her personal assistant. Kimmie he believes moved back to Palm Springs, which is where she grew up.

On my questions about Ray Martino, Nathan Collins only knew a few things, that he was private, never gave interviews, and had been friends with Anna Nicole Smith for many years. When Anna Nicole had to ask Daniel Smith to leave as the drugs and drinking became more of an issue in Anna and Daniel’s relationship, Daniel moved in with Ray Martino.

Nathan stated he knew “of” Wes, Dr. Khristine Eroshevich husband and that the couple were good friends of Anna Nicole Smith. Nathan never met Dr. Eroshevich, and to the best of Nathan’s memory, Dr. Eroshevich never treated Anna Nicole. Dr. Sandeep Kapoor was the main doctor for both Anna Nicole Smith and Daniel Smith in the several months that Nathan lived and worked at the studio city home.

In the first part of November 2005, Nathan Collins accompanied Anna Nicole as she appeared as the surprise celebrity for the “Legendary Bingo”. Anna Nicole Smith was the caller of the numbers at that charity and the funds went to give scholarships to student nurses who otherwise could not have attended nursing school. Nathan observed Anna Nicole for four straight hours, posing for pictures with fans and signing autographs. Nathan stated she never complained about not eating or getting a break. Anna Nicole always tried not to disappoint her fans who wanted to meet her at any event. Nathan shared with me moreover, she never turned a fan away.

Anna Nicole Smith was a prolific artist and was very artistically talented in painting. Nathan Collins recounted, there was one extra large room next to Daniel Smith’s bedroom. That room was used to store Anna Nicole’s artwork. Nathan says there had to be in excess of over 100 paintings by Anna Nicole in that room, not to mention original artwork that hung throughout the home that was done by her.

Nathan did not know what Anna Nicole Smith’s favorite country songs were, but did say she had a Karaoke machine in her bedroom and she loved to sing “Santa Baby”, Anna Nicole had a lot of fun with the Karaoke and insisted others, including Nathan on many occasions, join in with her singing.

Nathan Collins recalled that on November 15, 2005, he left to do some errands for Anna Nicole and she was going to sit down and watch an ABC Prime Time special where they were going to show some home video tapes of her. He believes these were filmed while she was dating or married to J. Howard Marshall II. When Nathan Collins left for the errands Anna Nicole Smith was fine and upbeat, when he returned from the errands Anna Nicole had already had an anxiety attack upon learning that members of her Texas family had apparently sold videos of Anna’s personal life to the media. This anxiety attack was so severe that it brought out a total paranoid side of Anna and she could not leave her bed. It was this attack and the trauma of Anna Nicole Smith watching that ABC Prime Time special that was one of the main reasons for Anna Nicole, Daniel, and Nathan to visit the Shelley/Thompson home in S. C. for what was to be a short visit and then turned into a two-month stint.

I asked Nathan what he thought Anna Nicole Smith would have felt and said about leaking the pictures, and in some cases what appeared to be selling pictures, videos, etc. of a personal nature about Anna. Nathan was quick with an answer; Anna Nicole would be enraged, furious that her personal and private life was out for the world to see. When I asked him about the infamous pictures of the Methadone in the refrigerator and the so-called death pictures of Daniel, Nathan said if Anna Nicole Smith had been alive when any of those were released it would have caused, in his opinion, a complete spiral downward into a dark depression and a feeling of betrayal to Anna.

Nathan Collins said Virgie Arthur was just an off-topic situation with Anna Nicole; she made it clear there were major problems and reasons for the estrangement between them. That on the few times Virgie’s name came up when he was employed by Anna, she would almost growl while talking about her mother. Nathan also came from a background of child abuse and he said only once did Anna Nicole Smith and he sit in private and discuss Anna’s childhood. When he saw the ET special of Anna Nicole talking about her childhood and calling Virgie Arthur, “mommy dearest” she was once again recounting what she had said to others as well as to Nathan about their estrangement. Nathan Collins mused that he bet the ET film editors had to do a lot of editing to remove profanity from Anna Nicole before that clip could be shown on television. Nathan also said when he watched that clip, he did not see an Anna Nicole drugged or stoned, he saw a very sober Anna Nicole shaking with rage and breaking her long silence publicly.

Nathan asked me during our interview, what kind of mother or grandmother would be making appearances only six days after the death of her grandson in what she had to know was Anna Nicole’s darkest hours and say what Virgie Arthur said. About selling any pictures of Daniel to the media, he felt only Virgie Arthur would ever be able to answer that question, in Nathan’s opinion that had to add to what would have already been inconsolable grief for Anna Nicole Smith.

Nathan Collins started this part of the interview with the statement; “Daniel Smith was a slice of heaven, very smart and never said an unkind word about anyone.” He was like that, Nathan said, up until the time he became involved in drugs and alcohol. Once that happened then he and Anna Nicole began to fight. Nathan Collins left the studio city home and the employment of Anna Nicole near the end of February 2006 but remained very close to Daniel Smith until just a few weeks before Daniel left for the Bahamas.

Then the most surprising part of the interview was when I asked Nathan why he and Daniel Smith remained close. Simple answer, said Nathan Collins, Nathan’s roommate was none other then the older “woman” whom Daniel Smith had once been involved with and loved. I of course, wanted to know EVERYTHING. Nathan Collins decline to go into that wanting to protect this woman and was surprised that I knew her first name. Nathan described that relationship as Daniel being in love and infatuated with her, but the emotions were not reciprocated. Nathan agreed, with other reports by Daniel’s friends that Daniel picked girls or women to fall in love with that would eventually break his heart.

Not getting very far in that line of questioning I proceeded to ask about Anna Nicole Smith’s relationship with Daniel. He said Anna Nicole was a great mother, but also very complex. Like some of my generation of parents, would say if you are going to drink stay at home so I know you are safe, that is how Anna Nicole was about mild use of drugs and alcohol by Daniel.

Daniel loved his mother; the bond between them would be hard for any outsider to understand. Daniel was the one constant in Anna’s life, her rock, the one person that never betrayed her, until he began to experiment with drugs. “Anna would have taken a bullet for Daniel”, quoted Nathan.

Daniel had a hard time in public school, Nathan said, because Anna his whole life had sheltered him. Daniel was shy to the point it would be almost like a disability, Nathan explained during our interview and because of that alcohol allowed Daniel to over compensate with friends he desperately wanted to fit in with those last few months.

Nathan has heard the story of Daniel contacting Jack Harding and in his opinion, it is totally beyond being able to believe. Howard K. Stern had been in Daniel’s life since Daniel was ten, why would Daniel suddenly want Howard K. Stern investigated, he does not believe Jack Harding and feels like that is one more person looking for television time. Nathan added that Howard K. Stern was never a father figure to Daniel but he was like a big brother. Nathan said that Howard was very good to Daniel; went to movies with him; played pool with him and Howard’s nickname for Daniel was “Cracker”. Nathan did not know where the nickname came from but when I told Nathan of the yacht Anna Nicole Smith had bought in Florida and had named it “The Cracker”, Nathan became silent for a few moments as if to take that in. He then said it would be very much like Anna to name a yacht “The Cracker” and it was not a racial slur at all, but probably a living tribute to Daniel and her love for him. The name of the yacht was probably something that would have made her smile with time as she loved the water and loved to go boating.

Nathan knows that Daniel had at times been around marijuana but to the best of Nathan’s knowledge never used it. When I asked him about Larry Birkhead testifying about the Ecstasy, Nathan remembered that as well. Nathan also remembered one time in May 2006, when Daniel tried cocaine once after moving out from his mother.

I asked Nathan about the Bahamian authorities contacting him and he said; no they had not and that surprised him since he spent so much time with Daniel as Daniel’s downward spiral with drugs began. Daniel Smith never brought Virgie’s name up; it seemed to be a non-issue for Daniel. He also said no investigator had contacted him on behalf of Virgie Arthur, and he hopes they do not for he does not think they would like what he would have to say.

Nathan said, Daniel was prone to depression and had bad eating habits, he loved Pizza and as he began to experiment with drugs, he began to let himself go and not eating healthy. Nathan said that Daniel liked all of the normal things young adults liked and he thought he was invincible. Also a little “fun fact” about Daniel is that he LOVED the Madonna album “Confessions on a Dance Floor”, but his preferred music genre was hard rock/heavy metal.

Friends of Daniel, including Nathan and the female roommate, “we would love to get an interview with”, saw a severe misuse of Methadone and alcohol with Daniel in the spring of 2006 and they all feared that Daniel was spiraling out of control. Daniel stole Anna’s Methadone pills, that and alcohol were his drugs of choice. Nathan said who knows why someone picks using one drug over the other.

I asked Nathan if he had heard the accusations of Howard being responsible in some way for Daniel’s death. I expected since he does not like Howard K. Stern a different answer than what Nathan gave me. Nathan said, “IN NO WAY” did he think or would he ever think that Howard was in any way complicit with Daniel’s death, he loved Daniel and Daniel felt close to Howard.

Nathan feels that Daniel’s death was a horrible accident. That Daniel was terrified of flying and had never flown alone. The trip to the Bahamas would be his first time to fly alone and would be coast to coast. Nathan thinks that Daniel took Methadone and other downers to calm his nerves and probably to try to sleep throughout the flight. He feels sometime later after getting to the Bahamas, while Howard and Anna were asleep, that Daniel popped some more downers to try to sleep, laid down in his mother’s arms and died from a terrible accident, in Nathan’s opinion.

Anna Nicole Smith was superstitious and yet had great faith, she might have thought about bringing Daniel Smith to California to be buried, but would have never wanted Texas. In the end, Nathan felt that Anna decided on the Bahamas because “she would have wanted to bury Daniel where Daniel’s soul had departed his body” and that was the Bahamas. I had to stop our interview for a few minutes after that because of the effect of Nathan’s words. Nathan feels that is why it took Anna Nicole Smith so long to decide, she must have been torn between California but settled on the Bahamas, and she would of course wanted to be buried next to him and would NEVER want either of their graves disturbed or moved because of those beliefs.

~About Anna Nicole Smith her son Daniel Smith, their life, death and legacies~

Nathan Collins again said he personally did not like Howard K. Stern, but he also does not think Howard K. Stern had anything to do with Daniel or Anna Nicole Smith’s death. On a practical aspect, Nathan stated, Anna Nicole Smith made a lot of money, why would Howard K. Stern want her dead.

Why did the world become obsessed with Anna Nicole Smith in death? Nathan Collins said it was partially the 24-hour “Infotainment coverage by the media”, but he also thinks Anna Nicole Smith is this generation’s “Marilyn Monroe” story.

Anna Nicole Smith was a “wonderful person, funny, great qualities in her life, but also sadly, there was a tragic ending waiting for her, and some people who met or knew Anna Nicole sensed that”.

Nathan still has dreams about Anna Nicole, he tries to hold onto the good memories and let go of the bad ones. He has not been offered any book deals and if he ever did one about his life, Anna would only be a chapter out of his life; it would not be about her.

Nathan like Kimmie has returned to where he was raised to regroup and decide what he wants to do with his life. He is doing stage plays and loves doing that but does not know if he will ever move back to Hollywood.

Daniel Smith’s legacy: Nathan says, that young people needed to know that at 20 you are NOT invincible. That mixing drugs is deadly, and he hopes instead of all of the finger pointing that the real message for thousands of other kids not get lost. Nathan also feels that is what Anna Nicole would have wanted Daniel’s life and legacy to be, to educate other young people of the danger of prescription drugs.

Anna Nicole Smith’s legacy: She is our Marilyn Monroe; learn from her ability to dream big and to rise above her tragic child hood. Another important lesson like Daniel Smith, “improper abuse of prescription drugs kill”. A simple legacy but one Nathan hopes everyone will learn from and that would be a living legacy to Anna Nicole Smith.

In heart wrenching testimony, the world found out today that sadly, Daniel had been abusing drugs far way too young and as with a lot of drug users showed the classic signs. A very hard blow for the grandmother, Virgie Arthur who insisted Daniel Smith never did drugs while blasting her daughter in the fall of 2006. How devastating that must have been for Anna Nicole Smith who had the toxicology report and knew that Daniel had been in trouble with drug and alcohol use spiraling out of control.

As our exclusive interview will show, Daniel Smith had chosen sadly to go down the path that many young people who are shy and caught in a world of fitting in with friends take and can result in a deadly accident.

Art Harris exclusive says; “He said Anna Nicole grew concerned that her son had a drug issue after he became rebellious, threw a television through a window, missed curfew, failed to bring back her car on time and hung out with friends she considered a bad influence. He called it a dramatic personality change between January and May 2006. That July, medical records showed Daniel admitted to the ICU of an LA hospital for valium.”

Jack Harding, PI

Going through all of the transcripts of the ever-changing memory of Jack Harding certain things stick out to me. When and why has Jack Harding’s “memory” changed, grown or been added to along with new leather jackets and what would appear at times to be someone right off camera he is looking at for guidance?

Let’s go through these, beginning with February 23, 2007 09:40 AM EST with People Magazine; “Jack Harding, a private investigator based in California, told police that last year Daniel expressed to him “his concern about the kind of persons his mother was associating with.” Daniel also said, “He did not like the idea that she was moving to the Bahamas” and that he “felt that her associates were taking advantage of her.”

When I first read that my thought was G. Ben Thompson and Ford Shelley they were new in Anna Nicole Smith’s life, they are the ones who allegedly gave Anna Nicole Smith an almost one million dollar home in the Bahamas for Anna Nicole Smith to move. Could Daniel Smith as protective as he was of his mom, had picked up something that concerned him? On the other hand, was this merely a meeting at Starbucks with Daniel having coffee with Ray Martino and Jack Harding walking up, handing Daniel a business card as we all get at times? How many business cards of people you have met have remained resting in your billfold or purse?

March 15, 2007 CNN Nancy Grace with Jack Harding: Joining us tonight is Jack Harding. He is a PI who says the boy, Daniel Smith, met with him, voicing concern. Welcome, Mr. Harding. Thank you for being with us. What happened?

HARDING: Well, as I said, Danny came to — well, he called me and I visited him at a coffee shop. And I asked him why he wanted to meet me there, and he said that he didn’t want other people to know that he was talking to a private investigator. I asked him, do you feel that someone is following you or what? And he says, Sometimes I do. And he says he has friends around that he didn’t want them to know about it. But he had a fear of — I said — of — of…

GRACE: A fear of what?

HARDING: Of the attorney, her boyfriend. I can`t even think of his name right now.

GRACE: Howard Stern.

HARDING: Howard Stern.

On March 15, 2007, Jack Harding could not even remember Howard K. Stern’s name; why if Daniel Smith was so alarmed and Jack Harding had so much contact would this happen? Was it because of just forgetting on camera out of nerves or was it something else? I have some ideas and I will share those at the end of this article.

So many of the interviews are very similar with more and more facts being “remembered” each new interview, so I am going to fast forward to the end of March and beginning of April 2007.

23 March 2007 In a private meeting, Daniel told Harding he feared his mother was being held “a virtual prisoner” in Nassau, the Bahamas by Stern, who was controlling her like a Svengali. Harding tells US tabloid the Globe, “Daniel felt Stern was keeping her on mind-bending drugs even though she was pregnant (with baby DANNIELYNN). He feared for his mother’s well-being… and he was angry at being pushed out of his mother’s life.” Following Daniel’s suspicious drug overdose death days after his baby sister was born, the private detective contacted Bahamian detectives. He adds, “I told them of our discussions and Daniel’s concerns. They seemed interested.”

So, eight days later, Jack Harding had his story straight, well scripted and putting on the show as some of our sources have told us. He was out there, almost as if he had cue cards to read or a teleprompter. He still did better on phone interviews or in print, but Jack Harding was now a PI on a mission. It was more then just 15 minutes of fame; it was to take Howard K. Stern down, but why and for whom? He was already in contact with the O’Quinn machine, is my take on this and from two independent sources this seems to be the case and from the next interview on March 26, it just got better.

March 26, 2007 on CNN Anderson Cooper 360, Jack Harding.

HARDING: Well, I had talked to — well, actually, today, I had met and talked to Jackie (ph) — I believe it’s Hammond (ph). I may be mistaken. … And she was talking to me about Anna Nicole’s drug habit. And she said she was constantly on drugs, and Stern was giving — giving her drugs all the time. And it’s the same thing that Danny told me when I met him. He wanted to get his mother off drugs.

Was Jackie Hatten ever the godmother of Daniel Smith? Multiple sources we have contacted have said no, Ms Hatten had not been in Anna Nicole Smith’s life for years. Remember it was Virgie Arthur who became pen pals with Mark Hatten in prison as early as November 2006; it was Jackie Hatten that said in interviews she was on the phone with Virgie Arthur because they were such good friends when she heard of Anna Nicole Smith’s death.

On March 27, 2007 on Ashley Bancroft of Court TV, Jack Harding on the phone says he met “Daniel at a coffee shop, as a matter of fact it was Starbucks in Tuloco (sic) Lake”. Ray Martino called Jack Harding over in Starbucks and introduced him to Daniel Smith. When Daniel Smith found out Jack Harding was a private investigator “Danny” wanted Jack Harding’s card. Jack Harding says he and Daniel met again in a coffee shop when Daniel called him. Daniel told Jack Harding he wanted to go into the military and Jack Harding asked him why. Daniel said it was because he wanted to build himself up and to become a man. Jack Harding knew from Ray Martino that Daniel had done some prescription drugs in the past, but even though now Daniel was “clean” it would still show up in the drug tests given by the recruiting system.”

Ashley Bancroft, cut Jack Harding off to steer the questions, it appeared to me, back to Howard K. Stern was giving Anna Nicole Smith drugs. Jack Harding in this interview says, “that four Bahamian police came to him to interview him with two local officers that came to Jack Harding’s home.”

On March 27, 2007 On Catherine Crier of Court TV, she brings up that Daniel was having “serious drug problems” and wanted to know what Ray Martino or Daniel had told Jack Harding about that. Jack Harding said, “Raymond said Daniel had some drug problems, with prescription drugs, apparently some kind of pill”. In this interview, it went from one meeting to “several over a period of time”. This time instead of meeting at a coffee shop they “met at a restaurant and Daniel did NOT want anyone to know about it not even Ray Martino.”

Although Jack Harding had maintained since first being paraded out on every television show possible in March 2007 to April 2007, the P. I. had said Daniel was not taking drugs, however, on March 27 he suddenly remembered he, [Daniel Smith], could not pass a drug test on two different court TV shows. How long do drugs remain in the body that would show up on a drug test, one day, three days, a week, a month, how long? Wouldn’t the length of time that a “prescription” drug shows up on a military physical with drug test depend on the medication taken? How long do Zoloft, Lexapro, Valium, and Methadone show up in a urine or blood test? Which kind of test is given at a military testing clinic?

Just two short days later, Jack Harding has remembered or been told, or read, or dreamt, or how did he come up with the perfect way for Daniel to be intentionally given something that Daniel Smith would not be aware?

March 29, 2007 Showbiz Tonight

HARDING: Well, he contacted me - oh, four - about four months now - it’s been a little while. And he wanted to talk to me because he felt that Stern was giving his mother mind-bending drugs and he was in control of her faculties, and he was being pushed out of the picture - or the family picture all together.

HARDING: …And as I said before, he loved his mother, and he wanted to get her off of these drugs. And he said especially these mind-bending drugs that Stern had been feeding her. And so I said, `Well, what do you want me to do?` And he says, `I want you to` - `I’d like you to be able to go down to the Bahamas and perform a criminal investigation on Stern and his` - and he did use this term - `cohorts.` … He felt his mother’s life was in danger. He felt that his life was in danger, or anyone that - that dealt with Anna Nicole who was friendly with her, who tried to help her, he - he felt that. As a matter of fact, when I was talking to him, and he was looking out the restaurant windows, and sort of at times looking around - and when I see someone doing that, that sort of indicates to me that he feels someone’s watching him.

HAMMER: We do know that Daniel died of a lethal mix of prescription drugs. Did you have any indication, Jack, when - when you met Daniel and when you spoke with him, that he had been taking any kind of drugs?

HARDING: Not at all. As a matter of fact, as I have said before, the boy was coherent. He - he - he wasn’t really weak at that time. He didn’t stumble; he didn’t slur. If you’ve been around people who have been taking drugs, or if you’ve dealt with them, you know the difference.

Daniel had been dead for 6 almost 7 months when this interviewed occurred, was it a visit from beyond the grave? If I remember right and I checked with a source, “mind bending drugs” is a term from the 1960’s and not one a shy young man would instantly state in my opinion. It would not be anymore of Daniel Smith’s vocabulary then “Svengali” which Jack Harding appears to have borrowed that term from John O’Quinn’s press conferences back in February 2007. Why would a young shy man of twenty use terms that were more common for the older generation from the 40’s or the baby bombers of the 60’s? For most of us, breaking out in a sweat, looking out at windows and convinced someone is following you is normally a sign of drug use, not what Jack Harding is describing, but then why did Harding change from Daniel not being able to past a drug test to clean as could be?

There are other interviews in which Jack Harding describes a very paranoid young man, could this be because of continued drug abuse, or did any of these other meetings ever occurred? It would seem that Jack Harding is saying no one can verify this, not even Daniel Smith’s “father figure”, Ray Martino, because Daniel Smith was too afraid to let anyone know. Fact, or convenient for Jack Harding and no one can check that out?

On April 1, 2007, Jack Harding has the story down pat that the pills that Daniel Smith had ingested could have been ground up and put in his drink without Daniel Smith ever knowing what was being given to him. On Fox News Kimberly show, Jack Harding tells us that he is in contact with Don Clark and they were talking about “them” (O’Quinn machine?) were discussing paying Jack Harding’s way to the Bahamas to testify.

I find it interesting that as the case is being built at the Inquest by Virgie Arthur’s team of Daniel being “slipped drugs in a drink”, that Jack Harding would have “thought” of that. I also found this was rather interesting that this “concept” was remembered after Jackie Hatten and Don Clark had come into Jack Harding’s life. Jack Harding, in my opinion, appears to have been in contact with the “O’Quinn machine people” for a few weeks or months, so a new leather jacket and a better memory began to develop for Jack Harding.
