Howard K. Stern Files “Seal Document” in Florida Litigation with John O’Quinn; Why?

Why did Howard K. Stern and/or John O’Quinn file a sealed document, unnamed on November 18, to be sure the Court had a copy before the deadline for the Show Cause Order due no later than November 19.
In the filing by O’Quinn’s lawyer on October 31, requesting the Court to release them from all Court Order productions of any future documents the Motion filed by Robert Klein stated in part:
“This matter was fully resolved during a confidential mediation on Thursday, October 30, 2008. Pursuant to the mediation agreement that was executed by and between the parties, a stipulation and order will be submitted to this court, memorializing the agreement, and providing for the retention of jurisdiction by this court for the enforcement of the terms of the settlement. It is anticipated that the draft order will be submitted to the Court at some point toward the middle part of next week.”
On November 4, the Magistrate for the Southern District of Florida issued an Order granting the Motion in part and denying it in part stating the following:
“The Court notes that the parties have ten (10) calendar days from their notice of settlement of October 30, 2008 to file a joint stipulation of dismissal with prejudice. If that is filed and the Court dismisses the case with prejudice, the parties will be relieved of their discovery duties. Accordingly, it is ORDERED AND ADJUDGED as follows:
1. Defendants’ Motion to Be Relieved of Obligation to Produce Financial Statements Pursuant to Magistrate’s Order [DE 243] is hereby GRANTED in part;
2. The Magistrate Judge’s October 24, 2008 Order [DE 234] for Defendants to produce financial discovery documentation described in the Order is hereby STAYED until November 10, 2008.”
So what is going on? In the other cases I found on PACER where Lin Wood was the lawyer for defamation cases as well as other defamation cases I pulled to compare, they are all pretty straightforward IF an agreement is reached. They each file a “Stipulation of Settlement”, including providing the retention of the court involved having jurisdiction for the enforcement of the settlement. In the ones I have found, they normally say that a settlement has been reached that the parties are filing the “Stipulation” with the Court, and that the “Stipulation” shows that each side will pay their own legal fees. This is followed up within a few days with a Motion and Order to Dismiss with Prejudice and then PACER will show the case “terminated”.
Why did that not happen in this case as stated in Robert Klein’s filing that such a stipulation was expected to be filed with the Court for approval around November 4 or 5? What is in the “Sealed Document”? Well here is my “GUESS”.
I think some mild problem in the wording of the settlement or something one of the parties thought of after the mediation and wanted that included in the final papers. My guess is the Sealed Document probably outlined for the Court in detail what had been worked out, what they still needed to work out and the date they thought it would be completed. Remember when Robert Klein filed that he had the flu, the court did extend mediation until December 1. My feeling and OPINION, not FACTS but OPINION, is that as long as the parties are working hard; making a good faith effort to resolve any wording on the Stipulation; and has it completed by December 1, then all will be well with the Court. However, did O’Quinn have to turn in his financial statement and information after November 10? On the other hand, was that also addressed in the Sealed Document filed on November 18? We will just have to wait and see won’t we.
One of our members Fifi was kind enough to look at how she perceived Lin Wood’s history of working multiple cases involving the same client(s) and came up with this “long term” plan. Fifi stated she feels based on if she sees the situations applying to a situation of multiple cases in multiple jurisdictions; some over lapping with parties, third person non-party witnesses; and containing some of the same allegations and/or parties. “Lin’s history he usually has a long term plan. There are three basic steps he usually follows, sometimes they overlap, but generally, it’s a slow process. Step 1 - Quell the media storm. Step 2 - Litigate against the most extreme defamers. Step 3 - Rehabilitate the client’s reputation.”
Perhaps Lin Wood decided if there is to be a court fight that New York is the better case to prove the allegations against Howard K. Stern in black and white, pun intended.

Rose, to me it would make sense that both parties are ironing out the legalities before the extended deadline Dec. 1st [requested by Klein] with Lin Wood preparing to fry the bigger fish, Rita Cosby. Rita’s accusations are easier to prove due they are on the nearest bookshelves in black and white. This not saying that Lin Wood did not get a favorable settlement for Howard from O’Quinn though.

Reading this article helped me too. I believe both Howard and Lin had to be satisfied in order to settle. We’ll never know because ven the settlement will be sealed and I’m sure neither party can legally disclose what it is either.
I feel there will be a win with the Cosby case too. And although I would love to hear what everyone says in court I believe this will be settled as well.

Ok, my opinion only. I am not to sure if Stern will settle out of court in Rita’s lawsuit. Would this not be the case where Stern’s reputation could be salvaged ? Maybe the agreed amount might be sealed. Oh I know in some people’s mind it will never be salvaged.
There is something happening since now the Virgie supporters are throwing Wilma under the bus and that happened so fast even tho the majority of us said the same thing many months ago. Daisy, to me JO sold his soul a long time before he joined forces with Virgie. You know many talk about a conspiracy but when you step back and look at the total picture, there actually was one. It began with JO and his cronies. I don’t know who said it but they believed that JO was involved in this whole story right after Daniel’s death. I believe it. I think JO set up Virgie to get to the money that might or might not become available to Dannielynn, meaning the Marshall money. JO was involved before Anna’s death. Geesh what the hell was Clark doing at Anna’s funeral?
DiamondGirl, Clark was also at the Florida hearing sitting right there on Virgie’s side. I mean if O’Quinn hired Clark for investigation services then he should have been everywhere else but the Florida courtroom. I agree, why the hell he attended the funeral, same goes for Opri being there, WTH.

first Howard is not crasy to be in front of the camera. He never whant to be the FAMOUS. Anna was his Famous. I also have in my idea it is to avoid frenzy circus, he was part of the one who ask the doc and court to be private. As for Vergie Arthur, IMO, O’Q law Firm, ask her to be low profile cause in the lawsuit. Judge have to decide if she is ,public semi-public or private.I think is the reason why she did not make any public apparence.

Humor For The Day -’Puff’ Piece about McCabe
FOXNews Local Station in Houston (http://www.myfoxhoustonlive.c om/) led off tonight’s newscast (just after 9 PM local time)with a story about today’s hearing in Harris County regarding VA v. HKS/bloggers/TMZ/etc.
Unfortunately, the reporter provided no details of what was said or done with regard to the case. No mention was made of who was there and for what purpose and what was decided. But the reporter did lay out McCabe’s position and quoted from the McCabe/VA lawsuit as if the allegations had merit. McCabe was shown saying that he has an email from a blogger stating the blogger’s goal was to ‘destroy’ VA and the reporter recounted the TMZ story about VA having a child with her step-brother. McCabe went on to say that he was looking for millions of dollars.
The reporter referred to Lawyers walking away from the cameras having said ‘no comment’ as being the representatives for ’several’ people but didn’t say who those people were. Only McCabe media-whored for the reporter.
Overall, an odd report. The reporter didn’t state the basis of the McCabe/VA lawsuit or the purpose/results of today’s hearing or the positions of any of the defendants. Odd because he was at the Court House with cameras rolling. He left the impression that McCabe was suing because VA had her reputation ‘destroyed’ by some conspiracy spearheaded by HKS, etc. which resulted in a true, but unflattering story about her being posted on TMZ. The reporter never made it clear what difference it would make to anyone to have such a story printed about them or maybe the reporter thought it wasn’t true that VA had a child when she was a child herself with a boy who would later be her step-brother.
So what happened to the claim VA was denied the chance to have visitation rights with DL because of this alleged ‘conspiracy’? How could a reporter be at the Court House and yet have no information about what happened? Why lead a newscast with a story without details?

It looks like McCabe never passes up a chance to mug for the camera. What a ham he is. Does it really help Virgie’s reputation to repeat the stepbrother story in case anyone missed seeing it? LOL On top of that the story is essentially true. She did have a child by the boy who later became her stepbrother. So what? Does McCabe really think that’s worth millions? GMAB
I agree with Swims that the report was essentially content free as to what happened in court other than it looks like McCabe is trying to drag the same unauthenticated emails back into court again. It looks like he’s getting a fight this time. It really gets me that he could bring that kind of thing into the suit without independent authentication first. Maybe that’s what the fight is about.
IIRC the hearing was about jurisdiction over Howard and Bonnie. So is McCabe trying to use those emails saying that constitutes them doing business in Texas? Does McCabe even know how TMZ got the story? I do recall that family tree thing was on the CTV forum and on Jane Devin’s blog before it was on TMZ.

I have not seen any of HKS’s sister posts… I did hear a few speak of Bonnie posting in the beginning after ANS’s death. I also seem to remember on this blog reference to something she posted when many were posting on that site that was all for Howard then when seemingly bullied by Texas changed their minds and were all for virgie.

I an only hope that Howard came away with a settlement from O’Q. His reputation will always be questioned by those that still follow the story. Doubt that it matters to him at this point in time tho. I’m sure he would rather have the love of Anna and Daniel by his side than any money that could come his way. Her B-day is coming this next week and as with anyone that has lost a loved one, the first few holidays and B-days are bittersweet. If he does walk away with cash, I doubt he will use much to benefit himself, but to provide for the little girl and to expand on Anna’s legacy.

#76..yes Bev. It does not compute. Condolences also for the loss of the child/young man. The mothers pain is something you can understand. My son was flown into the ER a few days back. For hours they just shot him up with more painkillers when the pain got too bad only to bandage him up and made an appt. with a surgeon on Mon. I don’t have alot of respect for the medical field at this moment and if not for the post-op nurse, I would of been more of a basket case than I was. And because I feel totally brain dead, I laid around and watched too many episodes of Trading Spouses today. The last one was about a mother who felt her family would think she was a monster because of her views and not want her around anymore. And all these thoughts run thru my head on how could a mother be so heartless and I don’t want to believe that there is a Mom like that out there altho there probably are. Just can’t wrap my head around it, and try to reason why. Doubt if I’ll ever know.
I read in one of the O’Quinn articles that he donated quite a bit of money to a woman judge in the Harris country courts.Sure hope this is not the one and I hopr she decides just what the federal court did that the bloggers do not belong in this case,McShame talks about vicious maybe some one should show the posts about the stern family and others who believe in Howard.What happened with the stepbrother story was nothing compared with being called a M or being told you would be shot etcI don’t know if it would help or not but I would hope that those kinds of posts from TMZ and topix are shown also.They are much much worse than anything I have heard said about arthur

There is NO Judge that would order Larry to let that woman see his daughter AFTER VA’s Lawyer said he was just a sperm donor. After her lawyer said (threatened in a way on TV) the Bahamas give MORE ‘weight’ to the grandparents than the US; and Larry could have visitation! Then if you add the times VA went on and implied that Larry NEEDED to have her or her family ‘in partial charge of Anna’s estate’!!!

Son was hurt at work. He’ll be OK and he will heal. Last time I was at that hospital, the kid did not fare as well but he lived. Just watching him go thru the pain was hard. After we got home, he was eating pain killers like candy trying to cope with it. Warned him that is not what you want to do!! So wrapping my head around the fact that Virgie had to know the kind of pain Anna was in! I would of sold my soul to be close to my child! And those screams Bev, that keep you awake. How can you not sympathize? Unless the blood in your viens runs cold.
This is just one of MANY on how custody of Dannielynn was already settled a couple weeks before they are saying this alleged defamation caused it. Specifically states LB won the custody battle and he is UNWILLING to share custody with Virgie. It was his decision and nothing anyone else did after this time did anything to change his decision

McCabe’s statement about seeking “Millions” is dreaming on his part. Does McCabe think he is playing with amateurs here? Those Attorney’s hired by ET and the others know exactly what they are doing and will represent their clients to the fullest, which is why they are paid the big bucks by these organizations. McCabe seems to think he can win this case from supposed e-mails, the man is nuts. If this is the case then the e-mails from David Leigh selling Virgie before Anna’s death and even before the ET interview aired along with her many interviews will prove Virgie created her own bad reputation as far as the public is concerned. None of this kept Virgie from getting custody or visitation of Dannielynn that was Larry’s decision. Another thing the decision the Bahamas court made in reference to Larry taking Dannielynn home in his custody had nothing to do with what was going on here in the US. The Bahamas courts plainly said the custody issue was out of their hands and that the matter should be taken up in the US courts. Virgie never pursued the matter once everyone one returned to the US, so how is it she was denied any of these rights McCabe is stating if she never pursued them on US soil.
JMA——Unless I am reading Virgie wrong,I think she is trying to claim,because of the tape.(anna tape on ET) which put her in a bad light and the thing with the stepbrother she cannot have a recourse with the court and win.No court would award her ,to be dog catcher never mind custody of Dannielynn,I think Larry would make the biggest mistake ever letting dannielynn near her,VIRGIE WOULD USE IT FOR A PHOTO OP.The way I SEE IT,Virgie,thinks she is losing money every which way.no charging admission to Anna gravesite,no Dannielynn pictures with her to sell,no Marshall money.so lets try and make money,this way SUE EVERYONE,

It’s Grey cup day in Canada today, so it’s party time around my house ( well party for everyone but me as I have to do all the cooking lol) Our favorite team is playing so it should be exciting.

I’m glad that your son is going to be ok. I know all about those screams. It makes you feel lower than dirt that your child can be in so much pain and all you can do is hit the nurses button and ask them to give them something else for it and then try to comfort them in some way until it comes. I get chills remembering it and he was only 11 years old at the time and would just give me this look that just begged for me to make it stop…..

Bewildered sorry to hear about your son hope everything gets better for you both. You are right Virgie knew exactly what kind of pain Anna was in after losing Daniel and instead of her running to Anna’s side; Virgie chose the media route instead. In my opinion that is not, what a mother is supposed to do in order to comfort their child regardless if they are a celebrity and in Anna and Virgie’s case estranged. This tragedy could have brought them back together if only Virgie was willing to take that step and in my opinion, Virgie was not.
Beverly, in my opinion Virgie put herself in a bad light the moment she chose to use the media to make accusation against Anna and Howard. The ET video was Anna’s word regardless of what Virgie wants to think, and no one should be held accountable for Anna telling the world what she thought of Virgie.
