Howard K. Stern’s Lean, Mean, Fighting Machine in Florida?

The Southern District Florida Federal Court Issued two Orders approving both Howard K. Stern’s Unopposed Motion for Leave to have an additional 10 pages in his Memorandum of Law due on October 27, as well as his Opposed Motion for 5 additional pages in his filing of “Material Facts” due also on October 27. In the New York Case we also have the filing of notice of move by Douglas Maynard on behalf of the Akin, Gump, Straus, Hauer and Feld Law Firm.
On October 23, the Florida Court also issued an Order, granting the Request to withdraw as counsel of William V. Custer, Nicole J. Wade, Eric P. Schroeder and Benjamin T. Erwin, from the Florida suit, noting that the plaintiff Stern had no objection. We will never know what these people contributed behind the scenes as preparations for trial as I cannot find any declarations or affidavits filed in this case or any of the other cases pending in multiple jurisdictions filed by any of the lawyers now withdrawing. I did notice that Nicole J. Wade is still listed in New York as well as a new lawyer from Powell Goldstein added to the New York case on behalf of Howard K. Stern. Stern now has the same number of lawyers on his Florida team as does John O’Quinn and the O’Quinn Law Firm as this Florida Case rounds the final couple of corners and is set for trial on December 29.
In other filings, Stern is asking to file his Response and Memorandum of Law on the Motion for Summary Judgment for failure to prove actual malice under Seal, and his Memorandum of Law on “Material Facts” that he alleges will prove the actual malice under Seal. Stern filed a
Memorandum of Law and a Declaration by John Patton in the first Motion, and a Memorandum of Law and a Declaration by Luke Lantta in the second Motion.
In these filings we get a glimpse of an odd combination, in my opinion, looking at the extensive witness list and knowing that in New York there has been a lot of depositions and Subpoenas Duces Tecum, issued and completed. Judge Chin’s ruling on October 20 was a huge win for Howard K. Stern as the ruling allowed the crossover of not only the defendant party, Rita Cosby’s materials but also that of all third party witnesses in the New York case that Stern wanted to use in the Florida case for his Response.
I am not surprised by Rita Cosby’s deposition and confidential documents that are to be filed in the Florida Suit as we got a look at that occurring from the letters and Orders that came from the New York Court. I am also not surprise that the Wilma Vicedomine’s deposition and documents including all screen monikers she posted under, all sites she posted on and allegedly is still posting on if the posters on Topix.net are to be believed. Vicedomine was to also turn over any chat channels she might have posted in and specifically any and all requests of fellow posters to blitz TMZ.com with posts and asking that fellow posters launch writing campaigns on behalf of Vicedomine and since she is an agent of the O’Quinn Law Firm, allegedly at the direction of someone in that firm. I remember getting posts sent to me by an “Oh Really” on TMZ.com that seemed to know what was about to happen and be knowledgeable of upcoming events as far back as May 2007. Oh how I would love to know if “Oh Really” was in fact Vicedomine. The reason I would love to know this is the writing campaigns to multiple agencies, from the Bahamas, to Florida officials, to California officials, to FOX network hosts of shows, to advertisers to federal agencies. If Stern can connect those to the O’Quinn Law Firm via Vicedomine’s posting and via forensic computer specialists he might be able to prove that the defamation of him was a very well orchestrated “hate campaign” to have him convicted of horrid crimes to further the agenda of either Cosby or O’Quinn. Wouldn’t it be stunning if Vicedomine were the key that would link California, Florida, and the federal government of the U. S. as well as the Bahamas and show the conspiracy to keep the defamation going via Cosby and online “volunteers”, right back to the lap of O’Quinn so to say? Sadly, I predict that we will never know if that can be proved because of the extensive Protective Orders in place in both suits.
Then we have learned that Vicedomine did not agree to be deposed for the Florida Suit, only the New York case however, Don Clark did agree and was deposed in both cases. However, the big surprise to me was why is the Jack Harding deposition so important? We know his story was ever changing. We even know that Harding changed his story in interviews; we know that because of all of the changes as y’all pulled transcripts and videos showing that in the end he had talked to Jackie Hatten, Don Clark and that allegedly O’Quinn had offered to pay his way to the Bahamas to testify at the Inquest of Daniel Smith. This is if Harding’s ever-changing story is to be believed.
Stay turned folks as we round the bend in both suits and head for trial. I am a tad miffed and disappointed that after months of labeling Stern as a murderer, blackmailer, abduction of a child for ransom, gay with tapes to prove it, a pimp, an illegal drug obtainer, etc. related to Anna Nicole Smith, Daniel Smith and Dannielynn Birkhead. Now we find out that all of the upcoming documents involving the very people that are alleged to have done this with “actual and provable malice”; want to; insisted on and have been granted Protective Orders to prevent both the media and us, the public from knowing the truth until the trials.

Seriously, did Wilma really think by only agreeing to be depo’d in New York that she would be off the hook in the O’Quinn case? I absolutely love the fact that she has to turn over everything she has been doing since this saga has begun. I cannot wait to see which blogger names she gives.

Jack Harding was obviously getting his information from somewhere during his 15 minutes of fame. Didn’t John Nazarian visit him at one time? I bet Wood had no problem at all getting him to spill all during his depo. Probably proved the ‘malice’ all on his own.
Although I am a little bit disappointed and of course a little frustrated with not being able to know whats going on, if we have to wait for the trails to start to be able to finally know the truth- then I have no problem with that whatsoever. I trust Lin Wood and I know he knows whats best for TeamSmith. And if we have to sit tight and wait, then we have to sit tight and wait.
This is my opinion—–I think at this stage of the game,Jack Harding is comming clean.The only reason that Lin Wood ,would use harding is to verify that OQ,approached him and ask him to lie.I am sure Ray Martino.will tell what happen any way,and it was that all three had coffee in a coffee shop and Harding handed Daniel his card,nothing more nothing less,and that was the end of it.IF this is proven,OQ cannot blame the puplic for being stupid in believeing what he had to say on Nancy Grace and Greta show,this shows a deliberate attempt to smear Howard(malice).
Does anyone remember “canadian cutie” who posted on the Crime Library forum? She appeared to have an advance copy of Cosby’s book and was posting info about the book before it came out. I wonder if that was Wilma.
canadian cutie…Some really gave her a run for her money on CTV. Very questionable poster. Acting all innocent. He/she was heavily defended by those posters supporting Virgie. IMO, canadian cutie was definately a plant. And I’m not much into conspiracy theories and all, lol.

The counsel for the defendants in the Blonde Ambition Litigation has requested that the Confidential Discovery Materials, and Confidential Information contained should remain under seal for eighteen months.

Bet this will read like a great mystery, a conspiracy novel that will reveal the true culprits in this saga.
I for one cannot wait to see all of this information!
Though if the cases are ‘settled’ - this information may remained sealed forever.

Ann - A few of us have wondered about “Canadian Cutie” for awhile now and we all wondered where she was getting her info from, I have no idea if it was Wilma or not but it sure did seem like she had some inside info. Wasn’t her book also published in Canada? I can’t remember but I thought I read that somewhere. I have never even looked at the book so I have no idea where it was published. I do remember asking my book store to take it out of the true crime section and put it where it belonged in the novel or sci-fi section. LOL.
I am still having a hard time understanding how they can get Wilma to give up all her nic’s she might of used. How are they ever going to know all the nic’s she used???? MS did say the other day something about a poster having the same technique as Wima, so to me that says alot. She pretty much told us with that comment that Wilma was a blogger, which most of us already knew or thought anyhow.

“Canadian Cutie ” was and had only posted abt 70 post before she become the most popular person for the Virgie side. She question other posters, and days before the time of the book coming out she sprung it on the other posters her’s was deliveried early. It was all a set up, and the Virgie bunch were in on it. It was like throwing slop to the pigs, and they were walling in it. It was a good laugh to think… all did not know what had occurred, and who was the master planner behind the curtains. How many times have they played the game, and most of us have watched… and shook our heads, wondering what they will try next. Guess it never helped them, now Rita probably wished she had never wrote a drama book.
What I wonder about is if Cosby still thinks Howard had to disprove anything about the tape.Seems to me she has to prove it.She once said that sh wasn’t worried about a suit because he would have to disprove her comments.Some yes but everything is out their and she did herself in when she tried to bribe the nannies.And yes Febbie I remember Canadian from TMZ also when she first came out and said she already had a copy of the book. I still think the book was published out of country so no one knew about it till it came out or rather was finished and Cosby told on her self
I smell a settlement and soon. Fine and dandy by me too. If for any reason they go to trial, all the better. All of the truth can come out and they can leave Howard alone finially without question. No one can dispute the facts!
It is not uncommon to get a book early. They reserve so many to give out as gifts before it comes out. The fact that this candian cutie was on the special list would be interesting to know. All her monikers would be even better scoop, as I am very snoopy!

Hi everyone, this is to funny to come back on line and read all of this.
My opinion is Wilma thinks she can lie and not get caught. I find it quite hilarious they caught her in her own web. She has tangled
the most ridiculous, lamb brained plot I have ever seen. There are so many flaws to her tactics I don’t even know where to begin.
Bottom line, she’s done and they know it. Not that she realizes it but most of her team does.
One other thing I forgot to add, here is a great big shout out to Wilma Vice for making it so easy on Wood.
This case is a slam dunk and you have given him all he needs to prove malice intent to harm Howard and his family.
I think what you did was wrong, harmful and hateful and frankly I am tired of people like you who do nothing but harm our world.
Having said that I will still pray for you and hope one day you learn what you do is wrong; realizing, with what I know, you
will probably never change because your mind will justify what you do with some twisted reasoning because that is the way your life apparently
works. I will pray more for the people whose life’s cross your path.
I want to ask a question. Do you think it’s possible that Wilma emailed TMZ for one thing or the other and they have her IP address and all the nicks she used with that IP address. I really do feel that Woods knows her nicks and he was waiting for her to lie. That is what a good attorney does, ask a question knowing the answer. And if you lie he drops the information in front of you.

does anyone else think that JO is too arrogant to settle w/o trial? considering he is suppose to be such a great (?????) lawyer he had to know that by saying the things he did to the media that he was opening the door for a lawsuit against him. although most of the time in interviews and even in his depo he came across as an uneducated and a not very intelligent old man (was this personna a planned tactic?). did he have such grandiose ideas about himself that it was inconceiveable to him that he the GREAT (??) JO couldn’t be brought down by HKS. did JO underestimate HKS’s abilities as an attorney and his determination to get justice for ANS and for Dannielynn’s peace of mind when she gets older? did it ever enter JO’s mind that HKS would hire LW.
one should never underestimate their opponent especially if they have done harm to someone that their opponent loves and has devoted their life to.
human beings and even animals have always had a powerful natural instinct to go to any lengths to protect their loved ones and it has been this way long before money was ever invented!!!!
also think a win in court against JO is probably more of a priority for HKS than the money from a settlement. besides if HKS wins in court he wins the lawsuit plus money. remember at ANS funeral HKS said that he and ANS knew the truth because they lived it. i think HKS is motivated by his love for ANS and getting justice for her for all the things done against her before and after her death. remember taking care of ANS was HKS life for years and now that she is gone it appears that getting justice for her is his life now.
a bit off topic but in FL court (case about ANS burial) I wonder how many people questioned at the time or since whether JO’s passing out in court was a tactic to get the attorneys, witnesses and judge seidlin off track? i wondered about it at the time but i’ve never brought it up to anyone before?

When OQ was in Greta Van Susteren show”Daniel was-had already figured things out. He was trying to get an investigator to investigate Stern and he went to his mother for money and Stern learned of that and decided he needed to get rid of Daniel”.Now,none of that happened if harding will testifly OQ,asked him to lie,and that is the only reason I would think Lin Wood who want him to testifly,or get a depo,That is more than slander and malice,it will show what a unscruplous,Officer of the Court OQ is.
OQ –She sat in the courtroom(she meaning Virgie).She has her own judgement about what she heard,everybody has a judgement by now about what they heard GRETA—– And you agree with that judgement–murder, OQ you better believe it.Why does a man ask for a will four days before a person dies. Well,as a Officer of the Court,that was a stupid statement,or deliberate intent to harm Howard,Daniel had just died ,and I would think any will of Anna.s would have to be looked at NO one was thinking anything else . #23 Sarah54 ALL good questions and yes I have thought about the passing out from O’Quinn could have been a ploy to get the court to take a break (which it did) so that they could reorganize the witnesses for Virgie, a lot of good questions you have posed here.
I cannot remember who exactly was in the witness seat being asked questions when O’Quinn fell.
I seriously thought he was leaning back in the chair and fell asleep… (or) just fell over sideways off the chair from falling asleep.
I remember the ’spin’ about the low blood sugar and all, but it was actually the Judge who brought that up I think.
It would be very interesting to see the footage of who was being questioned and exactly what the ‘topic’ was about at the time of his fall…

It was Denise James Beth, if I remember correctly, any one else remember that? She was crying on the witness stand, apologizing for what she was sharing about what Anna had told her about Virgie, and that Mrs. James had told Anna she would think of her like a mother. It was very moving testimony in my opinion or it was for me, and then O’Quinn fainted. They reorganized during the lunch break, and Ms. James was not required or needed to come back to finish up. That always stuck out to me since I did not know who O’Quinn was at the time except for his comments to Cosby coming and leaving the courthouse and how I thought what he was saying was so over the top of spinning for his client.
