Howard K. Stern Cannot be Trusted, HUH???

In the Reply filed today in the Southern District Federal Court, instead of attempting to reach an agreement, which is the usual course of Motions for Protection, (I. E. you ask for everything and then settle somewhere in between), here it is a firm NO. Which leads to why these filings instead of making a reasonable deal with Howard K. Stern’s lawyers?
I did note that the Florida lawyer for John O’Quinn and the O’Quinn law firm did become confused about which case that Rita Cosby’s excerpt was filed in Texas. It was not the Texas proceeding it was in fact for this very Florida Proceeding but filed in another federal court in Texas. That Motion to Quash and Motion for Protection was filed by Wilma Vicedomine in the Southern District of Texas Federal Court at the same time that O’Quinn filed a Motion for Protective Order for Wilma Vicedomine in Florida. I guess it is easy to confuse which case is filing what Motions and to protect Wilma Vicedomine where, she seems to be everywhere doesn’t she? However, can this be a preview that Wilma Vicedomine is about to become important in the Texas suit and/or suits as well? Was this a mistake by John O’Quinn’s legal team in Florida, or a preview that Wilma Vicedomine’s (Vice) role in all of this extends in more than the two suits we are already aware? How many people are now in line for O’Quinn assets for money due them?
On page seven of the Reply filed by the Florida legal team for John O’Quinn and the O’Quinn law firm; it states in part the following. “Although the Defendants fully recognize that they are not permitted to reargue matters covered in their Motion For Protective Order and original Memorandum of Law …” Then they do exactly that for three pages, repeating the unsubstantiated and unauthenticated claims about the “type of people not able to be trusted that Howard K. Stern and his head lawyer Lin Wood are”.
Again I would point out that the papers did NOT appear on Art Harris’ site “mere moments” after they were filed, it was HOURS, after the hearing for that day held via phone about trying to protect Wilma Vicedomine from testifying in the Florida Proceedings. Which continues to bring up the small tidbit of why are they so afraid of Wilma Vice [Vicedomine] being deposed?
Any bets on if the Court in Florida will have hearings on these latest filings and counter filings to try to unravel all of these issues?

i was thinking the other day of the carnaby case. Wasnt it said that he was reaching under seat for what turned out to b a blackberry? Who throws their phone under a seat when driving?
O’Quinn making claim that Howard or Lin Wood cannot be trusted when it comes to his financial records is his way of trying to hide assets.
O’Quinn is trying to walk under a snake with his top hat on. And delay delay delay.
John O’Quinn and the O’Quinn Law Firm filed the Court’s Requested Consolidated Response as to why the local rules should not be enforced and the Motions not filed on time should be stricken.

My opinion is Wilma Vice can not give a depo because she will lose this case for OQ and they know it.
But from what Clark said, their done.
In his statement he gave us a map of how he came to his conclusions.
I really don’t think OQ is going to want Wood to start asking to talk to
those sources in which I believe he is entitled due to Clarks own statements.

Daisy I agree and which is why O’Quinn is trying to make it difficult for Wilma to be deposition. O’Quinn knows it would be over for him if Lin Wood were successful with getting Wilma’s deposition along with talking to Clark’s so-called sources.
What absolutely just cracks me up is some of the idiotic stuff written by Clark in that affidavit!
Three pages of actions he might have done in the past doesn’t make you ‘Right’ or ‘Honest’ NOW!
Hell, look at who he works for! I said the other day about how many times O’Quinn and firm have been in trouble w/ their ethics in legal cases… Well, Clark has helped him w/ those cases doing the underhanded actions that are not very honorable. So, it MATTERS NOT what he did in the past!
By TX; TRYING SO HARD to not have Wilma deposed only says ONE THING! O’Quinn, Virgie, Wilma, Clark KNEW that they were in a big CONSPIRACY to DEFAME HKS no matter at what cost!
I actually get ill when I think of these low-lifes and some of the stupid bloggers that praise these nuts who would throw anyone of these idiotic followers under the bus in a heartbeat!
This is what has struck me so odd, TX saying there was a conspiracy to tell the truth about VA. (Excuse me - as they call it defame) What a joke! O’Quinn and company did the only conspiracy. IMO
I bet O’Quinn does not want his finances out there only due to all the other people that have and will sue him in the future. I bet in all of O’Quinn’s other suits no one has so thoroughly asked for all of the items that Wood did. Bet that ole drunken big mouth is sorry now! Again, this is just my take and observations from what I see in this mess.
Heath #4 He IS the snake. I wonder if someone is checking on that court case in Baytown to see if that is a true statement? If the Court is as sick of O’Q and Company as I am, they will put a swift end to his tactics. Perhaps his antics are why he has prevailed in so many cases in the past…..They just get tired of him wasting their time.
I find it completely ironic the way OQ life is catching up to him.
He thought he had a slam dunk when it came to Howard.
IMO he thought he was going to win this one in the media not
realizing exactly what he was up against.
He has some hard lessons to learn and I hope he learns and makes amends,

Nice argument O’Q gives there, for why the documents were filed after the deadline. It was Jessica’s fault, I guess. Or whoever took over for Jessica. And then the issue of the O’Q affidavit. O’Q needed to look at it before he signed it? So then who wrote it? While O’Q was busy being an attorney? I swear if the FL judge buys this one I’m done. Deadlines are just that. Deadlines. Meet it or you are a big fat looser. No more bloody excuses.
If this is how a so called high power attorney works, OMG, He is not responsible for anything, Its the other guys fault, He said he did not say it, ok he said it but he did not believe it Or any reasonable person would have believed him, ok he said it and now believes it because his investigator told him it was true Because his investigator followed the media and Internet, which by the way all the accusations were started by him, his client, and his investigation team in the media and Internet. He was told by other pundits on numerous shows how irresponsible he was for his accusations. His other response was that he was leveling the playing field, There was no playing field, Just a court proceeding on were the body should be buried, He was looking toward the next playing field, The Marshall money. but now it is all repeating what he was told as fact, What is O’Q a parrot or mocking bird? What is next defence?, The devil made me do it. Now saying he believes it, I think imo that is just to save face.
What ever happened to O’Q saying that he wanted to be sued by Howard? Or was he saying that for if he got sued that he would turn around and sue Howard?.
Remember McCabe’s statement on LKL when Howard and L. Wood were on I think it was in Oct. of 07,” How Howard would regret suing him as in I think Oscar Wilde in a case for libel”? I took that as a flat out call out., Now that Howard put him on blast O’Q has one excuse after the next. I am understanding how the court system works with all these cases and I have all the faith, If a woman with no real law education at all can see right through this I sure hope that a court of law has much better insight and hopefully knows his background courtroom antics, will not allow his antics to go on any further

O’Q left out two excuses. He didn’t think about the Florida time zone…or he didn’t realize that daylight savings time was still in effect. lol
IMO, O’Q has avoided so many questions, I think in his depo he lied, He knew who Wilma was, Did they take different planes at the time going to Fla. or the Bahamas? When DC was starting his investigation with his helper?
I hope that they get any kind of surveillance cameras to say that they were on different planes. Everyone rushed to Fla. then the Bahamas. The whole was gang was there, Rita, Opri, O’Quinn, …etc. I thought that private planes were small and a reasonable person would know who is sitting next to them.
I should say with my last commit, That O’Q’s team has tried to pick apart everything about Anna, Howard and now his counsel L.Wood, Now it is time for L.Wood and Howard to not pull out any stops, Start from the beginning and work your way down from all the lies and books and the court case in retaliation, have the gloves off. Get to why Howard is suing him, not all O’Q excuses, I know that the court has to hear all this But damn O’Q just make a point and stick to it. Every step that team Tx. did is documented somewhere or somehow can be checked out.. Maybe tried to go over and cover tracts like Rita did, That was the best advise Rita took,,, NOT, Didn’t Rita say that she consulted with her atty, and a respected investigator and his assistant? or I should A Attorney?.
The more I read about these lawsuits the less i think our justice system is fair and impartial.Excuses excuses from O’Quinn it is never his fault.So the judge should jsut take his word LOL after ever stall tactic in every case he has had.They sure are keeping VA on a short leash.Maybe they think than people won’t know shemayed herself a public figure JMHO

Beth [8] what gets me is O’Quinn files a defamation suit on behalf of Virgie due to what was found in public records and claims it defamed her by which ruined her chances of getting custody of Dannielynn. However, when Don Clark uses media gossip and bloggers opinions as some sort of proof that Howard was/is responsible for the death of Anna and Daniel that is acceptable in their eyes.
Therefore, in O’Quinn’s opinion, what is in public records is a conspiracy to defame his client but media/blogger gossip concerning Howard Stern is not.
Liann [12] exactly what does he mean by “leveling the playing field,” I mean this is not the schoolyard. To me that was a very childish remark on O’Quinn’s behalf.

Can we just change O’Quinns name to O’Excuses? “If we had any inclination that it would take 30 minutes to upload the first motion then we would have started the process earlier” BLAH BLAH BLAH. That one sentence tells you that the motions were ready to be filed BEFORE they started them because they could have filed them earlier. What kind of game is O’Quinn playing here? Why wait so late if you can file them earlier? I really hope the judge has had enough of O’Quinn’s games and excuses. He needs a slap in the face by the judge. This slap on the back of the hand, “bad boy,” isn’t working. O’Quinn is making a mockery of the system and the judge.
It’s going to be interesting to see what the judge rules. The way I see it, if the judge accepts O’Quinn’s interpetation of the rule, it will basically gut it. I wonder if the judge wants to go out on that limb.
O’Quinn is thumbing his nose at the court. His attitude appears to be that he will set his own priorities and deadlines not the court. He seems to be accustomed to throwing his weight around.

Ann we can only hope that the judge does not tolerate O’Quinn’s attitude and gives him a good old fashion adjustment. O’Quinn needs to remember this is not his good old Texas courts that he is trying to throw his weight around in so let us hope the judge shows him that.

1 - When O’Quinn files ‘Responses’ I do not believe there is a filing fee. To start a case like to make a ‘Motion’ those can be anywhere from $75.00 to a few hundred dollars. I do know even in an open case to file an Order to Show Cause is almost $50.00 here in CA. I believe the Courts in each State has a fee schedule for motions filed. Depending on what action is filed will be a different fee.
2 - Most likely the Judge will NOT Order a sanction on this late filing due to the fact that it is ‘within (1) day of deadline. I bet the Judge will not be so lenient next time O’Quinn and his lawyers mess up though.

-You can’t lose a custody case if you never followed through with one.
Regardless! She cannot holler ‘loss’ when it was all of her actions of her own free will.
-You cannot lose your reputation as a mother; when her own actions of the gun incident and giving Anna away (or making her leave) as a teen are from VA’s own actions.
-You cannot lose anything if your own actions to marry from either relatives or ’semi in-laws, or step, or whatever’ whether it be before or after her own family married with in that family… well Hell! Now, I am LOST!
Of course this is the way it should end up, but we will see how far O’Quinn and company can keep this case in TX going…

Judge won’t accept two motions filed after midnight. Howard has until October 27 to answer the one filed before midnight. Paper’s coming soon.
Howard K. Stern wins three Court Decisions and John O’Quinn wins one? Does this sound more like a baseball score then court rulings?
October 10, 2008 Florida Federal Court for the Southern District strikes two of the three Motions for Summary Judgments filed by John O’Quinn and the O’Quinn Law Firm. Court leaves until October 27 for Howard K. Stern’s lawyers to file a Response for the third Motion still before the Court, Motion for Summary Judgment based on the theory of “Absence of Actual Malice”.

October 8, 2008 New York Federal Court for the Southern District Issues Order that Rita Cosby can share all of her deposition and all of her confidential documents with the O’Quinn legal team for the Florida suit, but her legal team CANNOT share Howard K. Stern’s deposition and confidential documents absence a Court Order from Florida. Why would Rita’s lawyer offer up Rita to the Florida Court? Will be doing a new article tonight.
