Howard K. Stern’s Legal Team Shares Same Consented Protective Order from New York to the Florida’s Legal Team for John O’Quinn. Was this Gracious and Ethics at Work or Stupidity?

L. Lin Wood’s office sent a letter to John O’Quinn’s and The O’Quinn law firm’s lawyers, (see the file in our download section open to ALL not just members of Rose Speaks.com), saying they would provide a copy of the Order they had agreed to in the New York Southern District Federal Court to keep the Florida suit from becoming a media circus. Was this a gracious and ethical offer to the O’Quinn legal team or pure stupidity 101?
Once again the ones who allegedly did the horrible defaming have been offered and granted protection under the Consented Protective Order signed by the Florida Court yesterday, [September 4]; my question is why?
Certainly, when the allegations were made by John O’Quinn of the Will of Anna Nicole Smith being faxed to Howard K. Stern five days before her death thus setting the stage of why that happened unless Stern knew Anna would soon be dead; later that was proved wrong. Then there was the seven life insurance policies touted and talked about on every media that O’Quinn could get on as “motive” to murder Anna Nicole Smith; only now O’Quinn admits he was wrong. There was the constant mantra of “Motive, Means and Opportunity”, all three components to allege that Stern had in fact killed Anna Nicole and her son Daniel Smith, again later to be proved wrong. Then we have John O’Quinn saying if anyone really believed him when he said those things to Greta and Nancy Grace they could not have possibly believe that to be true, it was hyperbole. Has he read TMZ.com or Topix.net, many of his followers not only believed him but continue to push those allegations.
It matters not that Stern has been cleared by every investigative entity; the murder allegations are still a daily mantra by those that think John O’Quinn is a hero, which would never have misrepresented anything to any of them through the media. Yet O’Quinn seems to be saying if you believed my lips, then you are dumb because no one with comment sense would have believed me; and yet those people continue to type out about Stern killed two people has hidden money, cashed in life insurance policies and made off with the money.
Now though John O’Quinn the associates of the O’Quinn law firm including Wilma Vicedomine, are getting just that offered and accepted of protection from Stern’s lawyers led by L. Lin Wood. Was this the gracious, logical, ethical provision that Wood offered and O’Quinn’s lawyers took them up on or is it stupidity 101?
A note from us here at Rose Speaks.com about the feverish accusations out there on the internet, please read the two consented protective Orders out of New York and now this one out of Florida. You will note that not even everyone in the legal offices have access to confidential and highly confidential records turned over via subpoenas to the officers of the court (I. E. either legal teams attorneys). Sun NEVER sent me a list of neither IPs nor her chat record logs, Art Harris has NEVER sent me a list of IPs, and TMZ.com has NEVER sent me a list of IPs. The only lists of IPs ever sent to me were from two site owners who are considered to be in the inner fold of Red and others; therefore you might look within for what was released to lawyers if anything was and not at Rosespeaks.com, TMZ.com, Art Harris.com or Sun.

Why would you do this Lin? This gives Wilma privacy when she had no thought of HKS privacy. None of Team Texas deserves this. Topix hags will love this. Their hero won’t be shown for the crap they have done.
I agree they dont deserve it and they do derserve ridicule in the media. All these people need protection because they did wrong. Why r they still fighting in court and wasting taxpayers money?
I believe they are doing this for ’self-preservation’.
To be honest if I was in HKS’s shoes I would do it too.
I realize that we all want to ’see the real dirt’…
I believe this FL case will settle; as O’Quinn was WRONG! We will never know the amount it settles for.
The NY case will settle, and the TX case will be dropped > most likely for ‘less of a settlement amount in FL’.
This is how the big civil cases usually end up IMO.
I know that many lives were torn by this mess, but remember we are all responsible for how much time and effort we put into voicing our opinions on it.
That statement is not meant to be mean or harsh… just my take on it.
I really don’t understand why LW would do this, I was so hoping that we would be able to see what some ppl have been up to.
Do they maybe think that this will help stop the soap opera we call Topix? Or is it going to make it worse?
I guess we just have to put our trust in LW, he is a smart man and there must be a good reason for him doing this.

Beth I see what you are saying and agree. I also agree the Florida and New York case will settle out of court in favor of Howard Stern and with that, there will be no choice but to drop the Texas suit. They will settle for an undisclosed amount is how it will read no doubt. However, it does suck that O’Quinn, Rita and Wilma will not face the same ridicule via-Internet Media and Blogs that Howard Stern did.
Yes it sucks big time but is not a surprise if nothing else WV has to protect her job and not the o’q one either.I agree with Beth if and when these cases are settled no one will know for how much or why..IMO they will all have to sign nondisclosure forms and could be sued if they disclosed anything.I am hoping the same is true of LB case against Opri That sure is taking a long time also.

Maybe this protection order is more about protecting the information that Rita Cosby has already given to Lin Wood. She had to have done some type of deal here re the information she was given,cause she sure didn’t investigate any of it.
The Court case against Hatten and Speer has the feel of information from Rita Cosby. And it was a surprise, no one saw this coming.
Maybe it works so that evidence can be preserved and not let out into the Public arena and hashed up like what happened at topix and tmz.
It also stops O’Quinn and McCabe etc from taking to the public as well. A 2 edged sword maybe. I think they are playing their cards close. So no leaks.
I just asked about the leaks that were ongoing to the topix people and wondered how the Texas team would handle those.The suit against Hatten and speers was a surprise especially cause neither has any money but than I don’t think this is only about money anyway.If they want a trial they certainly do not need what topix and TMZ handed out to sway jurist

It looks like to me that O’Quinn was going to get a protective order anyway, so Wood acquiesced and suggested the order that was used in New York. Why reinvent the wheel. Frankly I was expecting everything to be sealed, so I’m not surprised.
If these people have to file protective orders then there is no way they would want a jury to hear it. They will settle it just makes them look stupid wasting taxpayers money as well suing innocent people in a last ditch attempt at marshal money. I wish texas would just drop it asap. I do understand having to let oquinn go through all the legal avenues so they dont appeal later on etc. Its just frustrating IMO
#13 Ann ~~~ I was expecting the protective order also. I think it has to do with what has already come out of New York and if they want to use that information from that case it has to be sealed. We have all known they all tie in together. So good deal……… time to move forward.

Lyndal yes we do know all these suits are tied together one way or another. We also know the only reason VA filed suit against Howard was because Howard filed against O’Quinn. We know the Hatten & Speer’s suits tie into Rita’s suit. What I wonder is can VA be tied into Rita’s suit as well. I have not read the book and do not plan on it, but do wonder was there anything in there that could possible come from VA. Seems somewhat suspicious how VA went and talked to Mark Hatten while he was in jail. Makes you wonder was VA searching for info from him to give to Rita for her book.

I do believe that VA helped that is for sure, as it was proven to the world by her own words in my opinion.
Remember when she did an interview and said something to the effect… re: Larry > ‘I asked him; Son, does Howard have something on you? … a tape?’
Like she was trying to make it seem that LB was being blackmailed by HKS…
Howard and Mr. Wood would probably never sue her though. As then she could say the same thing that they are, that HKS is suing her because she has sued him.
*The TX suit has a lot of paperwork in it, with many allegations. The thing is there is NO SUBSTANCE that can be proven beyond a reasonable doubt!
They (TX) made a big mistake by adding TMZ! Due to TMZ having 99% defaming remarks of HKS and 1% against VA in the comments.
My God! They KNEW (TX) that they could not win against Howard by blaming him for what Anna said.
I am so sorry about the site and the people being dragged into that mess! Those two that gave the sworn avadavits have SUNK themselves by all the stuff they have written about this site, the people here and most of all the untruths and allegations they have made about Howard and even his lawyer; Lin.
The Courts, the whole world can reasonably see by their statements (the site owner and by the comments made on the site) that they had an absolute agenda to ‘GET’ this site and try and bring it down!
They have put those two TX lawyers up on some kind of makeshift pedestal, and tried to make it seem that Lin Wood is not a good lawyer.
Mr. Wood’s record as a lawyer is reputable, and it is TX’s firm that has been sanctioned over and over again for unethical behavior!
It is in black and white for everyone to see! They just ignore the facts and try to say that we do not know the real truth! Nuts on the Net I call them!
Of course that is just my interpretation of the situation.
Lyndal, I think you’re right. If Wood wants to use the discovery material in the Cosby suit in the O’Quinn suit, then the transition would be easier if the protective orders were the same for both suits.
And we all know why O’Quinn wants everything protected.
L Wood is a very smart lawyer, he has his reasons, and it will work for him in the end. The mess the Oquinn law firm and Rita have got themselves in, they don’t want the public to see what has happen. When it comes out, then all of us can see the crying…
OMG Beth exactly. VA’s supposed questioning Larry about what Howard may have on him. How ironic now there is a supposed sex tape which no one is able to produce of not just Larry but possibly Howard & Larry. My opinion is VA commenting publicly about her supposed conversation with Larry set the stage for this little tidbit to be printed in Rita’s book and by adding Jackie and the Nannie’s as sources to this info was to make it seem more believable.
I can’t help but think that it’s some kind of strategy move on Howard’s part to have filed suit against Hatten and Speer. I think it may be another way of getting more discovery information that will help in the other suits.
I envision oquinn clark and wilma in jail… Do u think they will look good in orange or black/white stripes?

Also, to prove in the NY case that the information in Rita’s book is false.
*I think the biggest pay-off in all of these suits will be from the Publishing Company!
They are the ones responsible for ‘SPREADING’ the defamation and outright false facts to the majority of the public.
For example there are many people who have never watched Greta, Geraldo, Nancy Grace shows…
By Rita going on Montel, Access Hollywood… and promoting this book of lies, and the Publishing Company following through with selling it - well, they are the real culprits that can be legally proven guilty in a Court of Law and I truly believe thier fines will be enormous!

Not really the Publishing Company’s ‘fines’ it would be their compensation to harming Howard decided by either a settlement that both parties agree on, or by a jury deciding how much monetary damage they caused Howard and his reputation.

My two cents: Although I to do feel some frustration with all this apparent secrecy. Given that Lin Wood is not just a defamation lawyer but one of the top defamation lawyers in the country I like to believe that at the end of the day he knows what he’s doing; so, for the time being at least, I’ll give him the benefit of the doubt.

OK folks we know about yesterday, don’t know what is going on but we are working on it… Rose Speaks.com is moving to a new server we wanted to do it slowly with almost no down time but after yesterday and the fact there are problems on the current server and has been since the email breach in July was found, it seems like the server never fully recovered.
The forums have now been locked down, we are redirected Rose Speaks.com to the new server so some of the site might go down temporarily today, tonight or part of tomorrow. BOOK MARK the chat channel to get updates from moderators and members in the chat channel it should remain stable throughout the move..
We are so sorry for the delay in things.
