| Title : In the Government versus Rod Blagojevich |

In one of the new cases we will be following in 2009, we have the first filings up on USA vs. Rod R. Blagojevich, his chief of staff John Harris as well as others at they become known to the government. There are seven of the first documents in this case for you to download to read and then discuss with us.

The two documents that caught my attention is the Indictment dated December 7, 2008, which you have not to mind obscene language at its worse to read the indictment. The other document I found interesting was the filing on December 29, 2008 by U. S. Attorney Patrick Fitzgerald, of the Scooter Libby fame, filing to release the Intercepted communication relating to Rod R. Blagojevich to the Illinois State Senate for possible Impeachment Proceedings against Governor Blagojevich.

| Title : All of the Arthur – Stern newest Court filings |
|
There are five new filings up in the Virgie Arthur vs. Howard K. Stern, CBS, et al. Two of them have to do with CBS filing notice with the Court of Subpoenas in Document Production. The two also state the intent to take the deposition of Stephen Tunstall, one of Arthur’s Florida attorneys, on January 7, 2009 at 1 PM. The other is the CBS filing notice with the Court of the Subpoena. The other is for Production of Documents and the intent to depose David Leigh of Splash News in Miami Florida on Jan. 7, 2009 at 9 AM at a law firm in Miami.
The other three are notices of filing and notice of case number for the filing of Appeals by Riches in regards to the Court denying his Motion to Intervene in the Arthur vs. Stern, CBS, et al with the 5th Circuit of Appeals in New Orleans.

Ken and I have worked most of the night downloading the documents and there are tons of them, filed right before and right after midnight of Rita and Hachette's Motions for Summary Judgment and Memorandum of Laws to Support, Affidavits to support, Declarations to support and a LOT of exhibits... I still am going to say; if there is NO TAPE, then you have Malicious Intent, and Rita is gonna pay...
The first of the documents are up under the Howard K. Stern vs. Rita Cosby and Hachette Books for your downloading and reading pleasure. I will have an article up a tad later on my take of this "dance to get out of the mess" as Judge Chin so aptly put things and I am paraphrasing here the Book is the Book either it is true or not and it can stand on it's own.
Final thought with all of the yahoo and google searches they did to present their side, I saw no search of Howard K. Stern and Larry Birkhead getting a blow job... strangely missing ......

|
On December 11, 2008, there was a letter addressed to Judge Denny Chin from Elizabeth A. McNamara requesting the Court for permission to file Motion for Summary Judgment for Rita Cosby and Hachette Books under seal. The Court DENIED the request to file the papers under seal “except that the parties may file a set of papers publicly, with confidential exhibits omitted and references to any confidential matters redacted, with a second complete and unredacted set that will be filed under sealed”.
Looks like the New York Court is going to allow us to see publicly some of the information that Cosby and Hachette is attempting to show in the Motions for Summary Judgment due to the Court by December 15.

| Title : The Newest Texas Papers are up |
|
The newest nine papers filed in the Texas State Court lawsuit that we have access to, are now up.
Howard K. Stern’s Response to Virgie Arthur’s Opposition has a couple of new and interesting facts alleged.
Virgie Arthur filed a Second Amended Original Petition has been filed with the latest alleged new facts and attempting to add Larry Birkhead as a defendant but the date to join additional parties was December 1.
The rest as you know we cannot comment on because one of the co-owners of Rose Speaks.com is a defendant currently in the lawsuit.

| Title : Rules for Motion Regarding Summary Judgment New York |
|
We now have the rules for the Motion for Summary Judgment to be filed by Rita Cosby and Hachette Books and the Reply of Howard K. Stern to those Motions. Wonder if this is why we have those seven pages released from the Florida suit on Don Clark.
On December 2, 2008, New York Southern District Federal Court sets page limits on Rita Cosby’s Motion for Summary to 50 from the normal 25 Judgment and then Howard K. Stern’s reply can be 75 pages; Hachette intends to use the 25-page limit per the Civil Rules of Procedures.

| Title : Florida Lawsuit Settled and Dismissed with Prejudiced |
|
The last three documents to EVER be filed in the Howard K. Stern vs. John O’Quinn and the O’Quinn Law Firm have now been filed and/or issued by the Southern District Federal Court in Florida.
The only surprise in the Stipulation for Settlement was that part of Don Clark’s deposition regarding this litigation, seven pages, would be unsealed by agreement. Wonder what is in that seven pages and if that is going to be used in one of the other multiple lawsuits involving Howard K. Stern or the Estate of Anna Nicole Smith.
November 24, 2008 Order from the Southern District Court in Florida, granting a postponement of the Joint Stipulation and Motion to Dismiss with Prejudiced until December 4.
