What started out as the Estate of Anna Nicole Smith vs. Ford Shelley, Gina Shelley, G. Ben Thompson, Gaither Thompson and Melanie Thompson, or known as the Shelley and Thompson Clan of South Carolina. The people who broke into Horizons in the Bahamas and then allegedly sold a lot of tapes and pictures to TMZ (remember the Methadone refrigerator picture), Splash (including the tasteless picture of Daniel Smith in his casket), tons of videos to Fox News including On the Record with Greta Van Susteren, Geraldo Rivera Live, and the list goes on and on. Ford was one of the first to holler, Howard K. Stern did something to Daniel and Anna Nicole Smith, and the first at the trial to say Howard never hurt Anna……… so much for credibility. The question is though where is the money that all of that sold for????
Then enters what has become the big fish, Susan M. Brown Esq., Georgia Attorney and the Susan M. Brown Law Office, did this poor woman get left holding the bag and with the O’Quinn law firm dissolved there is no one to hand it off too. Kind of like playing musical chairs and the one left standing alone when the music stops, that would be Susan M. Brown.
Brown has tap danced for two years with the same song just different steps until she finally had a Northern District of Georgia Federal Court say she had waived the attorney client privilege under the crime fraud act…… NOT good for a lawyer’s resume, not to mention the State Bar of Georgia.
Any Objections to Susan M. Brown’s current lawyers, Joseph C. Wilson IV. and Carl E. Pierce II of Pierce, Herns, Sloan & McLeod LLC, has filed to withdraw as counsel for “the Brown Defendants”, stating it would not cause any prejudice because “the discovery concerning the Brown Defendants has not begun”. Do what??? The court ruled a long time ago that because Brown has been present for all of those depositions there would not be that much extra to tidy up the suit and have it ready for trial.
However the big WHAM in the March 2, 2011 filings is asking and filing the Motion to Withdraw with the grounds set out to substantiate the withdrawing should be in a Memorandum in Support filed UNDER SEAL “Counsel is not aware of any other means to communicate the grounds for withdrawal that would protect the confidentiality of the attorney-client relationship and avoid undue prejudice to the Brown Defendants.”
However the case they quote as outweighing the right of the public right to know (I. E. the News media) on its own raises red flags of the potential seriousness of these actions. In the Knight case it states; “we explained that, while a district court has a supervisory power over its own records and may, in its discretion, seal documents if the public’s right of access is outweighed by competing interests, the presumption in such cases favors public access. The public’s right of access to judicial records and documents may be abrogated ONLY IN UNUSUAL CIRCUMSTANCES. Accordingly before a district court may seal any court documents, we held that it must 1) provide public notice of the request to seal and allow interested parties a reasonable opportunity to object. (That date was March 21, 2011 per the South Carolina Federal Court’s Docket). 2) consider less drastic alternatives to sealing the documents, and 3) provide specific reasons and factual findings supporting its decision to seal the documents and for rejecting the alternatives.”
The Motion ends that “Counsel will submit the Memorandum in Support of the Motion to Withdraw to the Court for the Court’s in camera review and shall not file same until further notice from the Court.
Well folks I don’t think there will be any jury selection starting tomorrow, and as of midnight there has been no objections or request for a hearing on the filing being done under seal…
So what do you think Susan M. Brown needs to be protective from “avoid undue prejudice”?
As soon as we have the Court’s decision, and new dates for jury selection will post it, it is noticeable that no lawyer has filed to just transfer the case to them, as new attorney of record, things that make you go Mmmmmmmmmmmm.

So many of us have lost very close family and friends over the past year. That always makes these first holidays horrid. As Heath said to me when Ken and I lost someone that was the foundation of our family: “If you can’t cry for someone you love, then who can you cry for?” Those are very wise words for all of our members as well as Ken and me as we get through this first holiday without our love ones.
I told Ken I wanted to get up early this morning and watch the Macy New York Thanksgiving Parade. That is how the holiday of my youth were all about. My dad and I got up and watch the parade as my mom cooked. Such wonderful smells filled the house every Thanksgiving. I have to say I was disappointed in the Parade, it is not what I remember from my youth. Way back then there were high school bands and college bands that had auditioned, picked to appear and then worked hard to get the money to go to New York. It was wonderful to see those kids so excited and it put excitement in our home as well as we discussed who was the best. Gone are those and the floats for the most part all replaced by very commercial, planned acts and those horrid big balloons. I told Ken today the only thing that remained as I remember it was the last float as Santa arrived. I wish we had those old fashion parades again. Needless to say I will sleep in next year… LOL
The parade was followed by a lot of good eats and then the Dallas Cowboys who still plays every Thanksgiving Day. I have always said that becoming a football fan was not optional in my home, if you did not watch football then there was nothing to do after the feast but be bored the rest of the day. My dad and my brother would sit there and watch and cheer, discussing every play. I learned all I know about football being with my dad and brother. In fact I got pretty good, when my son became a teenager he turned to my husband and said; “Dad what is a shot gun and wishbone formations”? His dad had to tell him; “Ask mom she will know.” Yes I did know, what wonderful memories of people who are now gone.
Ken and I wish for each of you a safe and wonderful holiday, and like us remember those who are no longer with us and shed a tear at the loss in your life, Ken and I will today. However, also remember the memories you have, not everyone has those great memories, so in that we are lucky as many of you are lucky.
Remember our service men and women so far from home and pray by next year they will be safe with their families for Thanksgiving dinner.
We also wish an exciting new adventure for Jay Patton of Bryan Cave and Neil McCabe of the O’Quinn Law Firm as they leave those firms begin new journeys and new endeavors. We hope both of them find something they love and thrive at in the year to come.
Surround yourself today with family and good friends and have a great day, lots of goodies to eat. Ken has been cooking for two days and the smells from the kitchen reminds me of long ago days and my family and those memories I made. The most important thing is remember those we have loss in the last year and with the tears, remember the good times, as Ken and I will do. In closing, how about those Cowboys?

What do we do as the cases involving Anna Nicole Smith fade into the sunset where they belong? Folks while it might appear nothing is happening here on the site there are a lot of exciting things happening behind the scenes.
We will NOT be covering any child murders (I. E. Casey Anthony or Haleigh Cummings cases). We will have links to the sites we like the best for updates, but I just can’t write about missing and murdered children.
We will be listening to all of our readers about new cases, see the “contact Us” link at the top of the page and that will be included also in all future articles.
Right now we have the following cases:
1. All Things Anna Nicole Smith: That will be until the end of the criminal trial of Howard K. Stern, Dr. Sandeep Kapoor and Dr. Khristine Eroshevich; the South Carolina Suit of the Estate vs. Ford Shelley, G. Ben Thompson, Susan M. Brown, etc. In fact see the calendar in that a status report is due this Wednesday September 22, 2010 on the Motion for Sanctions; the Appeals court on the Estate vs. Marshall and keeping up with the Supreme Court starting when they announce the cases they are taking next month.
2. All Things Michael Jackson: This will include the criminal case, the probate and associated cases with the Estate, Joe Jackson’s civil suit in federal court and Katherine Jackson civil suit on behalf of the Estate and Jackson’s children in the Los Angeles state Court.
3. The Cynthia Sommer case in federal Court and things going on in the San Diego D. A. office, Bonnie Dumanis, which has some strange occurrences in what appears to be a trend that I can only describe as witch hunts.
4. Any and all Defamation cases that draws our attention as in right now it is L. Lin Wood and his client Jeff Greene in Florida.
5. The Nancy Grace case heading to a jury trial in October 2010 that involves the tragic suicide of a mother, Melinda Duckett, and the question of did Nancy Grace pushing her in an interview caused the woman to commit suicide and more importantly did it close the door to law enforcement and their investigation?
7. The Nancy Novack murder case that involves millions of dollars and the “accidental death” of her mother-in-law, Bernice Novack, in Florida and then the brutal murder of her husband, Ben Novack Jr., in New York, with questions about why it took the federal government using a little known across state lines domestic violence law to finally get Nancy Novack and her accomplishes including now what appears to be a plot to kill a witness.
8. The Honorable Sharon Keller here in Texas, which is going before a new panel of judges today on her public warning for not following execution day policies, the “misplacing and forgetting over 2 million dollars of assets and now the legislature announced intention of impeaching her.
There are several others we are looking at but if any of the readers know of a good one, preferably just beginning, in filing of court papers let us know, we accept all tips and keep them confidential.
The Member only Forums is are NOT accepting any new memberships, however we are going to be opening up a new “Community” ran by Diamond Girl that will be easier to join and have a lot of discussions on a lot of cases. We have been working with her for several weeks as we develop that. We hope that will be a very busy community with a chance to the members to have good debates.
We are also working on a permanent document download area for court documents on all cases and that will be up this week with the first listings of documents probably starting with All things Michael Jackson and Anna Nicole Smith.
We will still have our featured guest columnists John J. Nazarian and Daniel DiCriscio and hope now others will write for us as cases they are interested in began.
There are a lot of new happenings at Rose Speaks. We do thank all of you for staying with us as readers and/or posters for the last 3 years that we have been around and hope you are around for the new cases as they come along.

The only consistent thing about Nanny Q and Nanny N is the inconsistencies. The biggest question I have is who thought bringing the “Ninneys” from the Bahamas? Along those same lines did anyone from the DA’s office go and speak to these two people? Now we have nine people, eating three meals plus a day, nine accommodations, and because they are flight risks (my thoughts) there is security assigned to them 24 hours a day! To assure that they don’t get lost on the way to the airport…do they have escorts also? Cha-ching!!! Once again, Judge Perry had it with these Bahamian shenanigans…
From my personal knowledge and not from any of the stooges, Nanny Q was close factually on some of the issues but again, Judge Perry is not going to allow any “sliders” or “spit balls” in his courtroom. It almost seems to me that the prosecutor knows that what she is asking is “wavy gravy,” but what the hell, ask it! And if one of the three barristers doesn’t catch it or the guy in the black robes misses it, Madam Prosecutor wins… …biggest lucky charm was of course the incredible presence of Steve Sadow, Esq. “The Gentleman from Georgia”…and Judge Perry.
The idea that has to gall the defendants is the costs involved in charging them with what was charged. And what about the costs involved for the defendants, for sure if Kapoor is found not… The type of medicine he practices I am not sure if his patients care what his background is. Eroshevich, she is old and will at least… …Howard, who knows, as I said in the past he is very bright on some issues, others, hmm no so much. Did anyone intentionally kill anyone, I don’t think so. Did Dr. Bubbles and Dr. Fabulous try and do the right thing, I think so, and did Howard love Anna not a question in my mind.
…For a law enforcement authority to charge a group or individual, they must have strong evidence that will stand on its own… …Fine-tuning is one thing, but what I have seen so far in the witnesses and experts, fine-tuning, sure like trying to play a piano that fell 10 floors to crash on the street below. …There will always be those who will “really” want to know what happened in the final hours of Daniel and Anna. And the biggest wild card of all, with this being Los Angeles, is the jury pool….

The Houston Chronicle announced that a group of Texas history buffs has purchased a vacant, partially submerged 19-acre tract near the San Jacinto Monument from the estate of the late Houston lawyer John M. O’Quinn with plans to restore it to its 1836 appearance and open it to the public as an extension of the battleground complex.
The $625,000 sale was announced this week by O’Quinn’s estate and the Friends of the San Jacinto Battleground.
The group announced it’s intention to raise the $625,000 last January and said they had until June 1, 2010 to come up with the $625,000. It appears they were close enough that the Estate of O’Quinn held the property until the purchase was complete earlier this month.
The San Jacinto battlefield is a monument to the battle that secured Texas as it’s own republic from Mexico. It is not as well known throughout the U. S as the Alamo is but it is sacred ground to Texans.
The Friends of San Jacinto president Jan DeVault said work at the site likely will begin next year as an archaeological team surveys 11 acres of the site covered with shallow water in search of a Civil War-era naval compound.
The Houston Chronicle goes on to say that although the hardest fighting in the April 21, 1826, clash between Sam Houston’s 900 Texan troops and Gen. Antonio Lopez de Santa Anna’s 1,400 soldiers occurred near the San Jacinto Monument, the newly acquired property still holds historical significance, DeVault said. “We consider it sacred ground,” she said.
In 1836, the property was transected by the Harrisburg-Lynchburg Road, and in the days leading to the final battle of the Texas Revolution, was crossed by both Mexican and Texan troops. In the weeks before the battle about 5,000 Texas settlers fleeing the Mexican advance crossed the property.
After the battle, the site was occupied by a sawmill and a small community called San Jacinto. During the Civil War, the site was home to a Confederate armory, barracks and shipyard.
The Confederate complex was covered by water as the land subsided. DeVault said archaeologists will survey the area with side-scan sonar and “make efforts to retrieve whatever we find.”
DeVault said it is significant that work at the site will begin in 2011, the battle’s 175th anniversary. “We are giving the site to the people of the state of Texas as a birthday present,” she said.
Gerald Treece, executor of the O’Quinn estate, said he was “overjoyed that we could see that this historically significant property went to the Friends of the San Jacinto Battleground, who will not only preserve it, but work to recapture the way the land looked and felt when Sam Houston marched the Texas army across it to go to battle for the state’s independence.”
If you visit us here in Texas I would say this monument is a must see and that most visitors to vist the Alamo in San Antonia Texas are disappointed. The Alamo is in downtown San Antonia and only a chapel is left with some history and a souvenir store within it’s walls. The San Jacinto sacred ground, will give more of a feel for the true history of Texas.
We will have an article up later today that recaps the testimony in California. There is not testimony or court today or tomorrow. Testimony will resume on Monday with more of the Thompson and Shelley family testifying.
