I want to say first and foremost, I don’t ever want to read a slam against the Texas Courts again (just kidding) but WOW!!! For those who live in California is this Jury Questionnaire typical? This is the first of 3 steps to get on the jury of the Dr. Sandepp Kapoor, Dr. Khristine Eroshevich and Howard K. Stern in Judge Robert J. Perry court.

We read through it last night, laughed but also felt like this pool of potential jurors should feel violated.

Rule One: “You can not write on the back or add extra pages”, but how are you suppose to pass along the gossip about friends and what you really think of them? I have had a murder in my family of a cousin and her daughter over child custody, how can you explain all of that and my Aunt’s feelings in 2 lines, including the father died in California but the murders and custody was in Texas? How are you suppose to tell about picking up prescriptions, calling for an antibiotic for you or a child to save an office visit fee. How are you suppose to tell about the friend who is a nurse and said that phobias of hospitals is a good thing and not something you wanted to get over, and then proceeded to tell about huge potential fatal mistakes doctors made that the nurses had to correct or the patient would have died? How do you talk about the nurse you know who works for a plastic surgeon and the tales you heard, which may or may not have been true? How do you say in two lines about patients MUST be proactive in their care and hell yes, at my age I fire stupid doctors to their face.

Yea some cops are honest, some are not and then you have the cops who commit perjury, [remember that cop in the OJ case], and of course some cops are down right sexy. How do you explain a huge cover up of a murder not by the D. A. but by cops covering for cops and that “blue line”. How many of us watch CSI, Law and Order, the ID channel? How do you explain that any one that keeps up with the news just in California knows about the horror that happened to Cynthia Summers? How do you say that once convicted even if your opinion on hind sight you found that D. A.s are more worried about conviction rates and fighting to not overturn convictions even when clear evidence later were shown that cleared the wrongly convicted?

I don’t watch Entertainment Tonight, Access Hollywood, Inside Edition, Extra, TMZ or Fox infotainment news. But if you are even a semi intelligent news watcher, not mention the last week of news cycle about a right wing propaganda site putting up what they knew was an edited video to pull the scab off of racial fears for “page views” or “hits”?

How many of you d have favorite blogs, have a Face Book Account, a My Space, Twitter? Not to mention that for some reason LinkedIN was not listed and was it left off because it is a social media from professionals to network. Then you get into Google Alerts. How many get their news on the run in this busy world via a laptop computer or online reputable news like the AP online?

Then you get down to everything on this questionnaire becomes public record with ONLY your name protected? Is California going to pay your legal expenses when that neighbor, friend, family member, nurse who ever sues you in a Civil Court for running your mouth about them and medications, illnesses, legal problems and you just shared their life?

I was going to fill out this form in the worse type of joke, of spouse, the squeeze on the side, the lover, doctor, lawyer , Indian chief and there is not enough room so can I call home. I got to page four and said F – this.

Ken asked me who drafted this questionnaire that could not spell website [cite] correctly. I said usually the defense and D. A. fills out a wish list that the judge “rules on”, but this looks like a judge decided to take that large latitude they get in their courts because of that black robe. I wish we knew who suggested these questions and then how much did the judge impose because of his personal views?

Then once you get through this giant invasion of not only your privacy rights, but everyone you know; you get to go through a bankrupt California state doing a background check and we still don’t know if that is from speeding tickets, forgetting to pick up your dog’s poop, or something serious. If you get through both of these then you get to go threw jury Voir Dire, where the attorneys get at you hoping the court dismisses you, or the other side does so you don’t have to use one of your “precious strikes”. Not to mention as I said the extreme right wing Bible Thumpers, holier than thou or good cons will get in and a lot of good juror potentials will strike out. It is little comfort for you, your family and friends they want to know about is: “Remember: Questions are not asked to embarrass you. They are intended to make sure members of the jury have no opinions or past experiences which might prevent them from making an impartial decision.”

Here is a Jury Questionnaire from a federal court for a murder trial that involved a crime family.

My questions is that can this jury pool get through this first part, then the background check and then the Jury Voir Dire on August 2 and August 3 by the assistant D. A. and the defense attorneys and be ready to be impaneled for Opening Arguments on August 4, 2010.

Do yo think this is going to end up with the Fox Infotainment News Crowd, the Bible Thumpers, the holy then thou crowd and just those who con to get on a jury or is this a real attempt to get a “fair jury” of “one’s peers”? Share your thoughts with us.

July 12, 2010 Howard K. Stern’s Notice of Unavailability for ANY hearings any party sets that he=lawyers for him also or for trial from August 1, 2010 through October 15, 2010. Yes this will cause all of the discovery hearings that Stern’s attorneys have to be present, depositions, and will move the trial back to probably close to the end of the year. Stern’s lawyers are going through the August 6, 2010 hearing so if his Special Appearance is granted he will be gone. My feeling is that since the articles were read in Texas like the federal court found in that suit, Stern will probably lose this, let’s hope not though.

Howard K. Stern’s Motion to consolidate cases for the alleged defamation and conspiracy and the Breach of Contract case. I am not sure what the statue is on this and will look up what is quoted. I can see the Court handling BOTH cases and allowing the discovery to go for both cases to conserve resources, however Stern already has set for August 6, 2010 as part of the hearing the very Rule 11 Agreement that this breach of contract is regarding. I guess this was a housekeeping Motion to get the same court I am not sure though if you can consolidate one case with 2 parties into a different case with multiple parties.

July 12, 2010 Howard K. Stern Submission ONLY for the Motions filed today to be set for July 26, 2010. Since Arthur did not agree to the Motions, I would think her response will ask for a hearing which will bring everything to a halt until the fall on this Texas case for discovery hearings, and depositions.

July 1, 2010 First Court of Appeals issued a new opinion, denied Arthur’s request for a rehearing, corrected the original opinion issued in April 2010. The court has granted Harris Motion for Mandamus for the three Orders to Compel. It appears to me on first glance that the Court has now extended In Re. Weekley Homes to cover appointing a Special Master in cases such as this. Which IMO is good and should continue to be expanded in Texas.

July 1, 2010 Virgie Arthur’s SurReply with exhibits attached to Howard K Stern’s’ Motion to Quash and for a Protective Order, the Reply says Stern had been served with the new lawsuit but has not reply… I think and would have to look it up that he has 21 days to reply and if the information that Arthur is depending on says he was served on June 18 then I think his answer is not due until July 9 (21 days later). July 1, 2010 Art Harris Notice of SUBMISSION ONLY OF THIS MOTION FOR JULY 12, MOTIONS TO COMPEL ALWAYS HAVE TO BE SET FOR A HEARING. One has to wonder why Harris’ attorneys wanted all of this up for the public once again right before a long holiday weekend.

A brief few comments, lawyers can put anything they want to in a filing even if they know it is false at the time. They are covered by judicial immunity with filings and in a courtroom as just gamesmanship and being a fierce advocate for their client.

Ms. Hamilton is well aware of the truth and what she is saying here is out and out BS.

It will be interesting to see how this plays out. Some of the defendants need to say “Ms. Turner was honest 2 years ago and she is honest in this deposition”, and obviously it is in Art Harris’ best interest to say Ken and I have been paid off, that Ken is an “email drop” for communications between Virgie Arthur, her family lawyers etc. when the deposition clearly shows I have never had any communication with any of the main parties in this lawsuit except for Larry Birkhead. I remember at the beginning of these lawsuits the Plaintiff’s attorney accused Ken of being an “email drop” only for the evidence to show how false that was. However we are merely collateral damage in this free for all it appears.

Our bank account sure does not reflect any payoffs or bribes Ken and I have received and the whole deposition as Lin Wood said in a filing will show something completely different. That goes double for what Jackson and Walker feels the need to say about Ken and me right now.

Some times the best defense if your client is in trouble is to go on a strong offense against another party and call it just “advocating”, sadly lawyers do not have to prove things they say in filings, nor can the person being defamed and once again being accused of illegal activities have any recourse for an attorney doing just that.

Like I have said before Mr. Babcock and his wife, Ms. Hamilton, wear the hire gun label with pride, it is all about business and little about truth.

I have redacted those things said that should be covered by the Agreed Protective Order AGAIN, as I have redacted personal information of witnesses and parties to this suit. Ken and I would never want someone else to go through what we have since our address and phone number was made public over 2 years ago. That said, we can not do anything about Harris’ counsel filing this as pubic information on the Harris County Clerk of Court website.

Why was Dr. Conrad Murray only charged with one felony of manslaughter? Why are the doctors who treated Michael Jackson in California not being charged for over prescribing? Who were Michael Jackson’s California doctors? More important was it suicide as Dr. Murray’s attorneys seem to be hinting? We have the range from suicide to murder with a settling of one felony count of manslaughter.

Now that Joe Jackson, Micheal’s father, has filed a wrongful death suit in the Central California Federal Court against Dr. Murray, we may get a look into the thinking of everyone in this sad saga. The papers are not up on the public site to purchase yet, but when they are we will be following this case til it’s conclusion. The papers are on TMZ.com to download and beginning next week we will be following this case through legal filings as we like to do here.

LATEST TEXAS FILINGS

Here are the latest filings in the Texas state court in Houston on the Virgie Arthur vs. Howard K. Stern, Larry Birkhead, Art Harris, Harvey Levin, TMZ Productions Inc. etc. I consider these filings as I often say as housekeeping issues and nothing earth shattering new. There has been some additional discovery release involving court proceedings in the Bahamas in relation to Daniel Smith’s Inquest. I will check on Monday and see if they are public record and if so will post them for discussions. It is rare that we get to look into how another country courts conduct investigations and hearings.

June 21, 2010 Turner’s Notice Notice of Submission of the Motion for Leave to Designate Responsible Third Parties due to a filing error in May 2010. This is for submission only without hearing and is set for June 28, 2010.

June 22, 2010 Art Harris Notice of Submission of the Motion to Strike Turner’s Motion for Leave. This is for submission only without hearing and is set for June 28, 2010.

June 25, 2010 Virgie Arthur’s Motion Objecting to any mediation to settle this lawsuit while discovery is not complete and the Appeals pending in the First Court of Appeals are decided.

June 1, 2010 Court Order with new Docket Control Dates, as well I expect this all to change again because of the pending hearings, Motions, depositions, etc. I just don’t see it being done by August 17, 2010 regarding Discovery let alone the Writs decided by the First Court of Appeals and the Howard K. Stern Motions set for hearing on August 6, 2010. I see the Court once again changing all of the dates.

June 8, 2010 Virgie Arthur’s Notice of hearing on all Motions pending against Howard K. Stern on August 6, 2010 at 2:30 PM at the same time Stern has all of his Motion’s set.

June 9, 2010 Letter from her to her mother from 2000.

Excepts Anna Nicole Smith’s Diary from 1991 and 1992.

I am putting this up because I believe they have been public since probably 2007, just not easily located. By going through the diary excerpts I found several interesting things. 1.) Anna Nicole Smith was a very screwed up woman, however she knew what she wanted any child to look like and it was not Howard K. Stern. 2) Stern was so in meshed with his love and/or addiction to Anna Nicole Smith that he would have said and done anything she wanted. 3) That goes along with what many of you have said but I was unable to believe and that is Stern knew all along that Dannielynn was not his daughter but Larry Birkhead’s which is kind of sad he was willing to lie for Anna to have a baby and no father. I think Anna desperately wanted love and feared being alone, the diary shows she was a very lonely woman IMO. It also shows she appears to have been attractive to abusive men, I found that interesting. How sad she finally got the blond hair blue eye baby she so wanted before Daniel grew up and left home; a child loves unconditionally and I see a woman in here that displays that over and over again. I think the significance I see in this is that Virgie Arthur is going to be able to show that Stern lied and attack his character and credibility on those facts. So to those of you who told me over and over again that Howard K. Stern knew he was not the father, you had greater insight in to all things Anna Nicole Smith and I did not. I remember when the DNA was announced and I called Krista Barth and cried on the phone with her for poor Howard, boy did I call that one wrong.

NEWS ON THE CALIFORNIA CRIMINAL TRIAL

Multiple sources have told me that Dr. Khristine Eroshevich is on her fourth attorney in the criminal case, NOT good wonder what the problem is with her and her attorneys? Stern and Dr. Sandeep Kapoor has kept their legal teams in tact from the beginning. Could Eroshevich being going through lawyers like stockings you discard because you don’t like them or is this a smart ploy to get the August trial date moved past the California elections in November of this year. I was also told that Nazarian and Associates are no longer representing her. I was not able to contact any of the attorneys involved in this musical chair like of switching attorneys, however I was able to get in touch with Nazarian and Associates and asked them if that was true only to be turned away with the norm for Hollywood of “No Comment at this time”. So what’s up with Dr. Eroshevich? Perhaps y’all are again right in your take she is going down for that laundry list of drugs but not Kapoor or Stern. It appears I might have called this one of none convicted as wrong, glad I don’t bet on football or horses.

“I wish to put to rest the latest accusations by Mark Hatten,” attorney J. Christopher Smith told RadarOnline.com. “They are absolutely false. Mr. Stern has not in any way made any recent attempts to contact or threaten Mr. Hatten.”

“Mr. Stern does not even have a MySpace account,” Stern’s lawyer insisted. “The hope is that MySpace and the authorities at the Greeleyville Police Department will quickly conduct the appropriate investigation. At which point, they will most certainly conclude that there is absolutely no basis in fact to this ridiculous story.”

May 21, 2010 Art Harris Response to Virgie Arthur Motion for Rehearing. NOTE FROM ROSE: OK I was wrong here, I thought that Harris would let this be ruled solely on the Court Abusing its Discretion violating Rule 171 on appointing a Special Master. This shows how we can all still learn. I did not know that an exhibit to a Motion was in fact a Motion. The Response for Request for Production to Arthur was things that attorneys send out to just the other parties. I did not know because a Protective Order was requested in a Response that once it was filed with a Motion to Compel that part then of itself becomes a Motion for Protective Order once filed as an exhibit to the Motion to Compel. I continue to learn from all of these filings. Looks like the First Court of Appeals got it right the first time around.
