I want to say first and foremost, I don’t ever want to read a slam against the Texas Courts again (just kidding) but WOW!!! For those who live in California is this Jury Questionnaire typical? This is the first of 3 steps to get on the jury of the Dr. Sandepp Kapoor, Dr. Khristine Eroshevich and Howard K. Stern in Judge Robert J. Perry court.

We read through it last night, laughed but also felt like this pool of potential jurors should feel violated.

Rule One: “You can not write on the back or add extra pages”, but how are you suppose to pass along the gossip about friends and what you really think of them? I have had a murder in my family of a cousin and her daughter over child custody, how can you explain all of that and my Aunt’s feelings in 2 lines, including the father died in California but the murders and custody was in Texas? How are you suppose to tell about picking up prescriptions, calling for an antibiotic for you or a child to save an office visit fee. How are you suppose to tell about the friend who is a nurse and said that phobias of hospitals is a good thing and not something you wanted to get over, and then proceeded to tell about huge potential fatal mistakes doctors made that the nurses had to correct or the patient would have died? How do you talk about the nurse you know who works for a plastic surgeon and the tales you heard, which may or may not have been true? How do you say in two lines about patients MUST be proactive in their care and hell yes, at my age I fire stupid doctors to their face.

Yea some cops are honest, some are not and then you have the cops who commit perjury, [remember that cop in the OJ case], and of course some cops are down right sexy. How do you explain a huge cover up of a murder not by the D. A. but by cops covering for cops and that “blue line”. How many of us watch CSI, Law and Order, the ID channel? How do you explain that any one that keeps up with the news just in California knows about the horror that happened to Cynthia Summers? How do you say that once convicted even if your opinion on hind sight you found that D. A.s are more worried about conviction rates and fighting to not overturn convictions even when clear evidence later were shown that cleared the wrongly convicted?

I don’t watch Entertainment Tonight, Access Hollywood, Inside Edition, Extra, TMZ or Fox infotainment news. But if you are even a semi intelligent news watcher, not mention the last week of news cycle about a right wing propaganda site putting up what they knew was an edited video to pull the scab off of racial fears for “page views” or “hits”?

How many of you d have favorite blogs, have a Face Book Account, a My Space, Twitter? Not to mention that for some reason LinkedIN was not listed and was it left off because it is a social media from professionals to network. Then you get into Google Alerts. How many get their news on the run in this busy world via a laptop computer or online reputable news like the AP online?

Then you get down to everything on this questionnaire becomes public record with ONLY your name protected? Is California going to pay your legal expenses when that neighbor, friend, family member, nurse who ever sues you in a Civil Court for running your mouth about them and medications, illnesses, legal problems and you just shared their life?

I was going to fill out this form in the worse type of joke, of spouse, the squeeze on the side, the lover, doctor, lawyer , Indian chief and there is not enough room so can I call home. I got to page four and said F – this.

Ken asked me who drafted this questionnaire that could not spell website [cite] correctly. I said usually the defense and D. A. fills out a wish list that the judge “rules on”, but this looks like a judge decided to take that large latitude they get in their courts because of that black robe. I wish we knew who suggested these questions and then how much did the judge impose because of his personal views?

Then once you get through this giant invasion of not only your privacy rights, but everyone you know; you get to go through a bankrupt California state doing a background check and we still don’t know if that is from speeding tickets, forgetting to pick up your dog’s poop, or something serious. If you get through both of these then you get to go threw jury Voir Dire, where the attorneys get at you hoping the court dismisses you, or the other side does so you don’t have to use one of your “precious strikes”. Not to mention as I said the extreme right wing Bible Thumpers, holier than thou or good cons will get in and a lot of good juror potentials will strike out. It is little comfort for you, your family and friends they want to know about is: “Remember: Questions are not asked to embarrass you. They are intended to make sure members of the jury have no opinions or past experiences which might prevent them from making an impartial decision.”

Here is a Jury Questionnaire from a federal court for a murder trial that involved a crime family.

My questions is that can this jury pool get through this first part, then the background check and then the Jury Voir Dire on August 2 and August 3 by the assistant D. A. and the defense attorneys and be ready to be impaneled for Opening Arguments on August 4, 2010.

There are more papers due out today, November 30, 2009 in South Carolina from G. Ben Thompson on the Motion for Contempt and for Sanctions based of his previous attorney, Susan M. Brown’s acts allegedly on his behalf.

Gathier Thompson III, Melodie Thompson, Gaither’s wife, and Gina Thompson Shelley all have Responses to the Estate of Anna Nicole Smith adding them as parties in place of the “Doe” names.

As I read over the papers filed by Susan M. Brown last week I found myself amazed as I always seem to be when it comes to the antics and ever changing lawyers from the South Carolina group of players.

In papers filed last week in the South Carolina Federal Court, Ms. Brown says she was on board with the Horizon’s dispute in the Bahamas from day one in 2006. However it appears if that is true that her clients were not straight up about the happenings in the Bahamas. If Brown’s allegations about her clients prove true in court then they appear to have made sure she missed some memos and certainly some major media news articles. If I remember correctly G. Ben Thompson has dropped all claims to Horizons and is now suing the Estate of Anna Nicole Smith (Dannielynn Birkhead), Howard K. Stern, and the lawyers Tracy Ferguson and Michael Scott. The time line for Ms. Brown being kept in the loop and the liaison between her clients and the attorneys in the Bahamas appear not to include Thompson’s attorney in January 2007, Knowles, at the news conference in the picture with this article and there is certainly nothing from Pro Pinder the current attorney in Brown’s filings. Both were attorneys in the Bahamas for Shelley and Thompson after Ferguson and Scott left the employment of the South Carolina family.

This is either dumber than a suitcase full of rocks on the South Carolina crew for not telling their lawyer everything which equals to tying your legal representatives hands and allowing them to be blindsided by the likes of L. Lin Wood. So did Thompson and Shelley throw their attorney under the bus, and did they wiave the attorney-client privilege in what appears to a free for all for Shelley and Thompson AGAIN!!

My guess from reading these filings is that Brown was not in the loop of the Horizons litigation and the property being distributed, and she is fighting for her legal career and thus like any lawyer who has been betrayed will come out fighting now that it appears that Thompson and Shelley has waived the attorney – client privilege which in my opinion was a dumb move on their part..

In a stunning potential horrendous defeat Georgia Attorney Susan M. Brown has been Ordered to turn over documents and sit for a deposition in the Estate of Anna Nicole Smith vs. G. Ben Thompson, Ford Shelley and others.

It appears at first read of the papers that Brown must give up all information involving any third person conversations she had with anyone else about giving the Estate property to the media and having it copied by other parties involved with other lawsuits as well as Danny Santiago of the California DOJ, although she, [Brown], sent multiple letters to the Estate stating she had the hard drives and would turn them over.

The court’s Order also would appear to open the door of federal criminal fraud against Susan M. Brown Esq. in some of the actions she allegedly took as not being protected under the client-attorney privilege.

The Estate of Anna Nicole Smith lost its attorney fees in pursuing Brown. The Court also tightened up subpoena with subject matter by the Estate in four (4) of the requested production of documents, but definitely Ordering Susan M. Brown Esq, an Atlanta Georgia Attorney to sit for a deposition. However, it opens the door for a wide variety of questions concerning how that Estate property ended up in other people hands and/or copied by others with Brown’s knowledge.

Brown must comply with the request including contracts, bills etc. within twenty (20) days from today which is September 19, 2009.

Is the South Carolina Federal Suit the beginning of the end of all of these cases?

How damaging is it for Susan M. Brown Esq of Georgia and her clients with the federal court saying she with her client, Ford Shelley made have committed federal criminal fraud?

In South Carolina the Court has Ordered a new scheduling Order to be submitted by the Estate, via the Executor Howard K. Stern, and Ford Shelley extending deadlines currently due to accommodate what the Georgia Court Order entails. It also appears to once again open the door for additional depositions from many of the same people we see entwined in these multiple over lapping lawsuits in multiple federal and state jurisdictions and allegations by Howard K. Stern and/or the Estate of Anna Nicole Smith.

In “A Question of Murder,” the true crime book that gives an insider view of the death investigations of Daniel Smith, his mother Anna Nicole Smith, and others, famed forensic pathologist and lawyer Dr. Cyril H. Wecht, and his coauthor Dawna Kaufmann, reveals facts never disclosed before.

The following is a brief summary of Wecht’s take on the case — but you’ll want to get a copy of the book and savor it yourself.

In September 2006, Howard K. Stern and Michael Scott, at that time Anna Nicole Smith’s lawyer, placed a conference call to Dr. Wecht, asking him to perform a second autopsy on Daniel Smith. Wecht agreed, as long as it was understood that he would report his findings to them—even if they were not the findings they had hoped for—and that his report would be made public. With Stern and Scott’s assurance, Wecht flew to the Bahamas.

Wecht had noticed that coroner’s representative Linda Virgill had been in the media, feeding the frenzy that Howard K. Stern was a suspect for having harmed Daniel, his girlfriend’s 20-year-old son. It was time for Wecht to learn for himself why the lad died.

In Nassau, Bahamas Dr. Wecht met with Stern; Anthony McKinney Michael Scott and his associate Tracy Ferguson; and Wayne Munroe at a local beach club after being checked into the Atlantis, one of the Caribbean’s premier resorts. Wecht spent a lengthy brunch getting their background on Daniel, Anna Nicole and Stern. Stern said that Daniel had lost 25 pounds during the summer of 2006 and that he and Anna were alarmed. Stern gave a general rundown of the boy’s health, including hospitalizations, but there was no mention of Daniel having ever had a Valium addiction. When Daniel had arrived in Nassau to meet his baby sister and see him mom again, he was so excited he practically ran into the hospital room, according to Stern.

The book discusses Stern’s financial dealings with various magazines and TV shows, which Wecht felt was common practice in the entertainment industry and good business. Photo shoots of newborns and happy families always command a top price, Wecht explains.

Howard K. Stern describes the minute-by-minute events in Anna Nicole’s hospital room during Daniel’s visit. Smith only drank water or juice, as she had never developed a taste for carbonated drinks, it was reported.

Everything seemed great, although Daniel Smith once wondered aloud why he was so tired. Howard told Wecht that the comment later haunted him.

Nassau medical examiner Dr. Raju, with whom Wecht had worked previously on other cases, performed Daniel’s primary autopsy. He welcomed his friend Wecht and together they assessed the young man’s body once more, comparing notes. They looked at his stomach contents, but there was nothing noteworthy there, such as undigested pills or capsules. As Wecht worked, he made notes which have never been reported elsewhere.

Raju had attributed Daniel’s cause of death as “accidental multiple drug toxicity,” and Wecht concurred. Raju had sent tissue samples to LabCorp, an excellent basic toxicology lab in Tampa, Florida. When the results came back, Daniel was found to have had methadone, Zoloft and Lexapro in his system at death. All three were of a high therapeutic level but the combination of the three was what sent him into a fatal downward spiral.

SSuicide was ruled out because of, among other reasons, the open joy Daniel had shown with his new baby sister, “This family that should have been looking forward to the approaching holidays together, instead of having one of them dead and the others left to defend themselves against baseless charges,” Wecht wrote.

With suicide eliminated, murder, accidental death, or undetermined were the other options for manner of death. Dr. Cyril Wecht would have his own independent toxicology tests conducted with a separate lab, before he could assert how and why Daniel expired.

Dr. Wecht sent his own samples, collected during Daniel’s second autopsy, to the National Medical Services lab in Willow Grove, Pennsylvania. In Wecht’s opinion, NMS is the premier forensic toxicology experts in the U.S., if not the world.

Following Daniel’s procedure, Dr. Cyril Wecht was met outside the morgue in the Bahamas by a barrage of media, consisting of reporters and camera crews. With Stern’s permission Wecht held an impromptu press conference, with attorneys Scott and Ferguson also present. In more than four decades of doing this work, Wecht had never seen such a constant and intense barrage of news media inquires, at the scene and for weeks to come.

After the press conference Dr. Wecht was driven to Horizons. He saw happy family photos adorning the walls, in sharp contrast to the red-rimmed eyes of Howard Stern and Anna, with whom Wecht had a touching and interesting exchange. Before she returned to her bedroom, Anna squeezed Wecht’s hand and thanked him for examining her son. “I don’t know how this happened,” Anna sobbed. “Daniel was a good boy — he wasn’t into drugs.”

The people at Horizons gave Dr. Wecht a good overview about who Daniel was and his relationship with his mother and Stern.

Later, still at Horizons, Wecht had a phone conversation with Dr. Sandeep Kapoor, who was both Anna Nicole and Daniel’s doctor. Kapoor confirmed that he had prescribed methadone for a then-pregnant Anna because it was safe for a fetus, but he had never prescribed that drug to Daniel.

When Dr. Cyril Wecht returned to the states, he saw that public interest in Daniel’s demise was still raging. Fox News’ Greta Van Susteren led a panel where talking heads suggested there had been foul play. Wecht marveled that so many people had opinions, without having seen the toxicology results yet.

Wecht spends a fair amount of time discussing how Daniel might have come to ingest the drugs that killed him. Both Stern and Anna Nicole said they did not furnish the pills, so where did Daniel get the medicine, who prescribed it to him, and why?

Over the next several weeks, Dr. Wecht continued to appear on TV shows to discuss this case, always with Stern’s blessing — but by no means did Stern have input on what Dr. Wecht would say.

Coauthor Dawna Kaufmann describes playing for private eye Jack Harding the video clip of Anna Nicole inviting Daniel to visit her in the Bahamas. This fresh insight is also exclusive to the book and fascinating to read. Harding tells of his encounters with Daniel, asking for the P.I.’s help in saving his mother.

Multiple sources—from Harding, to Anna’s mother Virgie Arthur to former pals and employees—have said Stern controlled Anna and doled out drugs to her every four hours. This book analyzes ever person’s commentary and their possible motivations.

Dr. Cyril Wecht says he received at least 20 phone calls from Stern, at all hours of the day and night, making specific requests, seeking information and urging the doctor to communicate with the toxicology labs and various people. Stern seemed to be aware of every comment about the case on every cable TV news program and in every magazine and newspaper, and appreciated Wecht’s skill in getting across accurate information in those sometimes fast-talking, sound-bite environments.

Drs. Raju and Wecht spoke frequently via their respective offices in Nassau and Pittsburgh, Pennsylvania, while awaiting the final toxicology results. There’s some charming personal information about how these two expert medical detectives viewed the media storm surrounding this case.

On Nancy Grace’s Cable Headline News’ program, information was given as fact that was later disproved by toxicology reports. But Grace’s show wasn’t the only one where wild speculation occurred. Wecht talks about watching many of them and wondering if they were more vested in promoting an agenda, rather than following the facts.

Dr. Wecht has many cogent observations about Virgie Arthur and her clear pain over losing a beloved grandchild and fearing for her daughter’s well-being. And Wecht gives rich details about his views of Stern, whose sincerity seemed genuine. Of course, Wecht was also mindful of the potential giant pot of gold these people, and others, might be chasing. In looking at the motivations of the many people who had been around Anna and her son, Wecht performs psychological autopsies and holds back nothing.

This riveting book also contains new details surrounding Daniel Smith’s funeral that I have never read in any other accounts. Included is Anna Nicole Smith’s plaintive wailing: “I don’t want my husband, I want my son back. Leave me alone, leave me alone. Don’t touch me!” Rosespeaks.com readers know what the nannies’ account of the day was like, but “A Question of Murder” offers another view.

Also revealed in the book is a prescription drug that Daniel took, which Wecht declined to identify during his Nassau press conference. Wecht explains his reason for mentioning it in the book, and why it should be part of Daniel’s autopsy record now. I must say the inclusion of this drug stunned me.

Daniel Smith’s full autopsy results, including the NMS Labs toxicology, were made public in January 2007. Around the same time, in Nassau, attorney Wayne Munroe became the sole attorney for Howard K. Stern and Anna Nicole Smith. Munroe would be behind every important behind-the-scenes move for the pair from then on.

More surprises come with Dr. Wecht’s accounts of the Bahamian Coronial Inquest, including how and why it seemed to start and stop. Wecht found two inquest witnesses especially problematic, and he paints a vivid picture as to who and why. One man’s testimony was so troubling to Wecht, it evokes a series of emails and calls between the doctor and Stern.

In the final analysis, Wecht writes his truthful views of all of the players in this case — the people we know so well at Rosespeaks.com. You may agree with him, or you may disagree, but you can’t help but be impressed by his decision to expose the full spectrum of personalities and events surrounding Daniel’s death.

And Dawna Kaufmann’s research and writing nicely fills in who this tragic 20-year-old was in life, making him a complex and fun human being who never got the chance to live his life to the fullest.

As convoluted as Daniel’s investigation was, Wecht notes the sorrow he left in his loved ones’ hearts. He ends the chapter with this thought about Daniel: “Hopefully, when [people] think of him, they will remember the joy of his life, rather than the mystery of his death.”

At what point did Gerald say “Tough Shi%@*!”? I remember Ford Shelley appearing on Greta Van Susteren’s On The Record on Fox numerous times beginning shortly after the break in of Horizons with copies of tapes, pictures, emails etc. I believe I remember that Ford Shelley and his wife Gina even invited Greta Van Susteren’s on a tour of their home in South Carolina proudly showing it off and which rooms Anna Nicole Smith her son Daniel Smith and Howard K. Stern had stayed in during the Christmas holidays of 2005. Didn’t Shelley and his family, Laurie Payne and didn’t even Ben Thompson appear on at least of one of Geraldo’s shows? Then there is the March 31, 2007 hour long show that towards the end Ford Shelley told Howard K. Stern to “Bring it on”, I guess Lin Wood took Shelley up on that and it would appear if Shelley’s deposition is to be believed that Shelley cried like a baby to try to keep Geraldo from showing some tape on one of the shows, would that be the Oct. 2007 show? I also remember Shelley saying smugly that Howard [K. Stern] would be surprise when he learned how many copies of the hard drives had been made and who had them. I guess that surprise is now NOT one.

So is Ford Shelley and father-in-law G. Ben Thompson throwing one of their attorneys Susan M. Brown under the bus or would that be an eighteen wheeler?

Ford Shelley refers to both Danny Santiago, his boss lady, Ford Shelley and “for him, [Shelly], Susan Brown. Frankly I don’t see anything wrong with that, would most people who could afford an attorney have one present during a recorded statement to be used by the California DOJ or the California Bureau of Narcotics. It appears from Shelley’s June 2, 2009 deposition that is what he is saying and that it was Susan Brown and not one of his criminal attorneys he asked to be present during that taped statement.

Ford Shelley goes on to say he “avoid Agent Santiago calls until his lawyer Tommy Brittain told Shelley that he “needed to meet with [Santiago]” …”My lawyer in Florida set it up.” Both lawyers were top criminal attorneys that Shelley retained right after arriving back in the U. S. from Horizons after Anna Nicole Smith’s death. Mr. Brittain if I remember correctly went with Shelley to turn in the items taken from Horizons to the Horry County Sheriff’s department on the afternoon of February 12, 2007 and it was Shelley’s attorney in Florida, Walter “Skip” Campbell, Esq., if I am not mistaken that talked Dr. Perper into holding up the autopsy results to late in March 2007 on Smith pending that Shelley wanted Dr. Perper to look at some evidence on some computer that Shelley and his Florida attorney thought would implicate Howard K. Stern and that was all in Feb. and March 2007.

What is up with this tape of Ben Thompson on Fox about being a pedophile that Neil McCabe allegedly called about and then wanted to talk to Shelley about “did I [Shelley] find the tape?” What tape is Shelley referring to in this part of his deposition? That last conversation with McCabe occurred two weeks or mid May 2009 with Shelley if Shelley’s memory was finely alert enough to remember who and when he talked to any of these people. Before that it had been about a year ago, [May 2008], when “they came to town. ..John O’Quinn, Neil McCabe, Don Clark and WV [and] “that was to see the Clown Video”. Didn’t Ford Shelley appear at the burial proceedings in February 2007 as a witness for O’Quinn and didn’t Shelley authenticate and offer into evidence a segment of that now infamous clown video?

Some of the other highlights from Ford Shelley excerpt of his deposition on June 2, 2009 that caught by eye are the following:

“I didn’t feel comfortable…. I didn’t feel comfortable just in general. I mean, I didn’t – other than that meeting they [Neil McCabe, Don Clark and WV], asked to speak. Susan Brown set it up. … [Meeting] lasted a couple of hours maybe.” … There was nothing to tell. My issue through all of this is just about ownership of the house, not — not being drug into accusing anybody of anything because I have no knowledge of that. My issue is with the house and I don’t want to be involved in the other parts of this thing….on October the 27th of 07, on Geraldo’s show, which — I said it, Anna — when Geraldo referred to Anna in her drunken stupor and those things, it upset me. And I even clarified him and said, “No, she wouldn’t have done anything to her my child ever”, okay? and I know that. …and Howard is — he’s cold hearted. …I’m mad that it’s been drawn out this… My bitch is about the money I spent for the house and I’m being drug into these other things and what I found used against others and I don’t like it. ..No, but I’m going to say this. If she thought it was in our best interest, [Ms. Brown handing over copies of tapes to be copied], or she was served, then she has my authority to release it if that was required. …”

Here are some of the highlights that caught my eye from Ford Shelley’s excerpt of his deposition on June 3, 2009:

(Q) Did you tell Larry Birkhead that you would not return the clown video to him because it showed your daughter Riley on it and so you were therefore asserting ownership of the clown video?

(A) I told Larry Birkhead that — yes, Sir, I did…Because I meant it and I said it. And I turned it over to the California Department of Justice when I was required.

(Q) Have you talked wit her [Susan M. Brown], about why she would have given Don Clark of Neil McCabe or Anna Nicole Smith’s hard drive so that they could copy those hard drives?

(A) I called her yesterday and asked her. …She said it was part of a lawsuit that was in — with Virgie Arthur. And I told her that I don’t know and I don’t remember — I haven’t signed anything agreeing to be a party to a lawsuit. And she said “Well, I have to find out,” I said, “I *wasn’t*

(Q) So this was news to you, what she told you yesterday?

(A) You floored me yesterday, sir. … Your damn right. I didn’t know it. .. I did not know it. …So I had to back up and regroup and say, you know what, he was right to feel what he feels. His feelings are right too. He’s got feelings. And how he is taking this in matters. And I just don’t look at myself anymore. I’ve got to look at how he sees it, how I see it, but what really is the truth, and the truth is in the eyes of the beholder. There’s a happy medium. He wasn’t wrong and neither was I. We both said and did things. Truce I’m ready to go on…”

Is the “he” that Ford Shelley is talking about Howard K. Stern? If it is Howard K. Stern how will this deposition compare with the taped interview with Agent Danny Santiago? If the “he” is Howard K. Stern, how could this deposition and this last statement help or hurt the California criminal charges?

It has been passed around in court filings from last June in California, to Florida, to New York that Mark Speer(s), a/k/a Speer, Spear and Spears, seems to have almost as much connection to all of the lawsuits in differing jurisdictions as does Wilma Vicedomine, which leads to the question of why?

In the California dueling banjos of the Birkhead sues Opri sues Birkhead cases there are a few facts they did agree on. The main one being that a disagreement over money given to Opri on or about March 2, 2007, which ended up in her client trust fund, caused a disagreement on March 13 following a hearing in California.

After that the tale gets hazy, Larry Birkhead has always claimed he fired Opri on March 13, Opri has maintained she fired Birkhead on March 15 and released a statement stating that right before a hearing in the Bahamas on the morning of March 16, 2007.

Court Filings by Opri shows she filed on March 20, 2007 to be released as Birkhead’s attorney of record in California and that the court granted that on April 23, 2007.

We have many allegations if you all remember of whether Rita Cosby secured Opri for Birkhead and if Opri then released confidential information to Cosby as a thank you for the high profile client. That is a lot of he said, she said, except that Cosby does say in her book she did introduce them but did not know of any financial arrangements. Greta of Fox, during a L. A. Times article on the woes of Debra Opri did recount a conversation she had with Birkhead in September 2006 in which she said Birkhead told her Opri was going to represent him free. Opri, Cosby and Paul Barresi all agree they met and became friends during the Michael Jackson Criminal Trial in California in 1993.

Then there are all of those people in all of these suits, especially the lawyers of Cosby, Opri, Arthur tend to keep mentioning the Marshall monies Dannielynn might get one day, which seems to be an ongoing current in all of these cases and with all of these people.

In Opri’s filings, and statements made by both Ford Shelley and Ron Rale there was a meeting in Rale’s hotel room between Shelley, Birkhead and Howard K. Stern about funeral arrangements for Anna Nicole Smith as well as attempting to reach agreements on all disputed facts including Horizons and a private DNA test for Larry Birkhead. This meeting occurred the night of the last day of hearings in Florida in February 2007. However, until Cosby’s book was published that is the only meeting anyone has ever talked about other than Opri thanked Stern on the last day of hearings for Stern agreeing to allow Birkhead permission to see Dannielynn during Birkhead’s next visit to the Bahamas.

In Court Filings in California, Opri seems to “believe and states” that Birkhead and Harvey Levin of TMZ.com were “good friends”. Larry Birkhead bragged about that per Opri’s filings, including releasing her bill to TMZ.com, and it does appear that TMZ.com had the exclusive following Birkhead’s ten-hour deposition this week. So perhaps that allegation is true, after all it would appear that possibly TMZ.com might have bought some of Birkhead’s celebrity pictures over the years to me, what do y’all think?

Then comes the surprise why did John O’Quinn’s law firm claimed “privilege” on all third party correspondence that ended up with Wilma Vicedomine to “check out” but not those that ended up with the rest of the firm including Don Clark. Thus, the law firm released the long rambling email of Carolyn Herring, which several thought was hiney einy of Florida only after reading that email it is clear that Ms. Herring lives in Texas in the Dallas Fort Worth area. There is a long rambling correspondence with a Howard Lynn, which is just that. Then there are emails from a Joyce Cornwell of Florida that is interesting, as well as a nurse from Denton Texas offering her service “pro bono” to Virgie Arthur. Many of you have pointed out the interesting email from someone claiming to be with the Montel Williams show, which is interesting only in that Cosby ended up on that show with Don Clark and others selling her book in the fall of 2007.

There is a fan email from Marilyn Williamson of Fenandina Beach Florida, dated March 28, 2007. Ms. Williamson is proud to say she figured out John O’Quinn’s strategy in getting Howard K. Stern to file a slander suit against O’Quinn for the “m” word so O’Quinn could get jurisdiction over Stern in Texas, now that is an interesting email since it now appears to have a ring of truth to it.

However, I found three emails of particular interest, one from Virgie Arthur’s Bahamian lawyer, Debra Rose. That email states to Don Clark the following:

“Debra Rose wrote:

Don,
We are aware of the Bahamian connection; add to that the son of Roger Gomez, Roger Gomez, Jr., was recently an associate of the law firm of Lockhart and Munroe, Howard Stern’s attorneys.

DEBRA”

You have to wonder why O’Quinn did not claim attorney-client privilege on that one for Virgie Arthur.

But then there are some interesting letters and two very interesting emails, the letters are to and from Brian Cavanagh in Florida as well as the FBI in Miami asking for a more thorough investigation into Anna Nicole’s death.

The letter to the FBI states in part the following:

Dated April 16, 2007

“[A]n expert, Mr. David Liebman, a two time president of the National Association of Document Examiners, says the signature appears to be a forgery is also enclosed. Additionally I [Clark] have enclosed a copy of a magazine article that identifies the expert who says he believes the signature of the Will is a forgery.

Based on the investigation conducted by this law firm, the media and private citizens, we strongly believe that Anna’s death was anything but an accidental overdose. We believe that there should be a thorough investigation into Ms. Smith’s death, which would not be complete without including the circumstance surrounding the death of her son, Daniel smith, who died in the Bahamas on September 10, 2006 under almost identical circumstances…

Don Clark then names both DEA agents and telephone numbers in California that are conducting an investigation, Lisa Troncoso and Alma Tongson, as well as Jon Genens an “investigator” for the State of California Medical Board, are investigating the methods of procuring prescription drugs”.

Clark thanks SSA Patrick G. Brodsky, for taking the time and meeting with him [Clark] on “April 11, 2007 to discuss what I [Clark] believe to be severe mis-steps and incomplete investigations conducted by the Seminole Police Department”, (OUCH!), “surrounding the death of Anna Nicole Smith. I am available to provide you with any assistance I can to ensure justice is done as it relates to Ms. Smith’s death and the death of her son Daniel. I can be contacted at any time at the below numbers…”

Don Clark sends a CC to Valerie Parlave, Assistant Special Agent In charge, FBI, Miami Division.

Then we have the letter dated August 2, 2007 from Brian T. Cavanagh to Don Clark that states in part:

“August 2, 2007

From Brian T. Cavanagh

“…letter dated July 23, 2007, and our follow-up telephone conversation this week with a “representative of your firm”.”

No date but in response to the August 2, 2007 letter Don Clark makes some interesting statements.

Don Clark says in part “…However, I and others in the law firm do believe that the investigations was not conducted in sufficient depth to determine actual motives and more detailed actions of the individuals surrounding Ms. Smith from prior to her travels between the Bahamas and the Hard Rock Hotel on the Seminole Reservation. I [Clark] believe that a more detailed look into individuals associated with Ms. Smith and the actions of each of the individuals prior to her clinical time of death will produce different results.

…Frankly sir, we don’t question the coroner’s conclusion that Ms. Smith died of an overdose of various drugs, but we do question that her death was accidental. We find it extremely unbelievable that a person in Ms. Smith’s mental and physical condition, which has been established by witnesses and according to Howard Stern, was never left alone, could have the quantity of drugs found in her body as a result of ingestion or by using a syringe herself.

Below, is a partial list of individuals and what information they should provide. Some of the witnesses may require subpoenas. However, I believe their information is key to developing the whole truth surrounding Ms. Smith’s death.

Witness number 1 is Mark Speer.

Now in August of 2007 we seem to have a different story from Tas including “information regarding computers and cell phone activities”, as well as Moe, [which goes to Moe Moe tell us it ain't so did you sell out prior to Cosby's book], Dr. Khris and the Bahamian nannies…”

Don Clark goes on to say he is, “now prepared to meet with you and your staff for the purpose of providing you with additional information, names of potential witnesses and some pertinent documents, which I believe will provide sufficient probably cause to re-open the investigation into the death of Anna Nicole Smith.”

My question is if Mark Speer was so crucial to the investigation into the death of Anna Nicole Smith why throw Mark under the bus now in July 2008?

We have Mark Speer, connected to all things California, Florida, the Bahamas, and New York as a source for Cosby’s book and now when it appears he is not needed tossed under the bus to fend for himself. You ask why we know this happened to Mark? I suggest you pull the 2 emails from Mark Wilson dated March 20, 2007, the date that Opri filed to be removed as Birkhead’s lawyer in California, very interesting timing. Both emails from “Mark Wilson” are desperate to reach John O’Quinn to tell him he worked free with Opri and Birkhead and that he has important information for O’Quinn about a “SECRET MEETING”. In the second email dated the same day the “SECRET MEETING” is added as occurring at “HORIZONS” and that Dannielynn might be in danger and what he is willing to do and for free… WOW so many working free here. However, it is that secret meeting at Horizons, which found its way into Cosby’s book. Not to mention at her New York book signing party there was Mark Speer with Don Clark, John O’Quinn and Virgie Arthur all big smiles for the photo ops.

What is interesting is Mark Wilson also goes by Mark Speer, a/k/a Mark Wilson Speer etc., and that Mr. Wilson/Speer has been a member of Rose Speaks.com from almost the beginning or Rose Speaks.com. Even after we were hacked into in November and December 2007, Mr. Speer joined quietly again on January 22, 2008 under the name of Marcus, Ooooooopppppppppss we need to add that name to the many names of Mark Speer(s). On another interesting note, it appears we had or have a pending member that is actually Wilma. These things make you all snuggly to know these people want to be close to us including trying to join our new forums, doesn’t it?

Therefore, with this article the main site member list is NOW CLOSED to all except admins. That said we welcome both Mark and Wilma. Although I must say I would have more respect if you had joined with your “real name” like John Nazarian did, just my opinion. Patrik Simpson and Pol’ Atteu reveal more about their friendship with Anna Nicole Smith as they answer your questions below. Patrik thinks maybe I sent the virus I had through the phone lines, he and Shelby were pretty sick and Pol’ was taking care of them both as Pol’ never seems to catch what is going around. Pol’ is super at multi-tasking going from fashion to cooking for the family. Patrik has been playing catch up this last week and that is the reason behind the answers to your questions taking awhile coming from them, also, they wanted to take their time in the answers to you … our members. Yes, they have read the site and appreciate the support from Rosespeaks.com for the interviews, covering all the lawsuits and the support from YOU our members.

They come across as wonderful parents and they both have a mighty big heart. I’ve really enjoyed getting to know them and being able to be ourselves while chit chatting about all things from Anna Nicole Smith to haircuts to sharing stories and proud moments about our daughters.

Look for them on Extra this week in an exclusive interview with Carlos Diaz. They met Carlos Diaz while in the Bahamas, so it was a very comfortable interview. They will be in the studio with Carlos and at the Pol’ Atteu Boutique showing off some of Pol’s one of a kind dresses’ made for Anna. We only know at this time… the interview on Extra will be on one day this week, during “sweeps week”, when they find out for sure what day…. They will let us know first!

Here are the questions and answers by Pol’ Atteu and Patrik Simpson from our members.

1. Though I knew the why’s of Anna Nicole going to the Bahamas I’m wondering if once there, before Daniel died, if she was happy? She was happy to be away from the tabloids/paps and those that wanted to intrude on her every move? I know she made her living in front of cameras and I think that’s where the idea came to plug the new show. She could still do her thing and make a living and then escape it all. We never saw paps climbing the walls, or sitting in trees trying to get the money shot while she was there. If Daniel Smith hadn’t died, I envision her to finally have found some peace and comfort where she could have raised her daughter. Am I off the mark or just wishful thinking.

Answer: Yes. Before anyone knew Anna was in the Bahamas, she had a little time to get some much needed R & R. The Bahamas was going to be her safe haven. A place where she could “let her hair down” and relax and have her baby without the prying eyes of the paparazzi. She told us before she left we should buy a house next to hers. We had looked at a few properties there. Sadly, her safe haven turned out to be her worst nightmare. If Daniel Smith had never passed away, Anna would have been able to find the peace and solace she so desperately sought.

2. I wonder if Pol’ and Patrik have thought about doing a line of classy dresses for women 12 and up?

Answer: Two things. First, Patrik is the owner of Network International Models & Talent in Beverly Hills. Pol’ is the Couture Designer. Pol’ made many dresses for Anna when she was plus size & when she was thin. He fits women of all shapes and sizes. His specialty has always been high fashion couture, but coming soon will be a contemporary line of clothing. The new casual line will be affordable and mainstream. We are both excited about it’s upcoming debut. Plus both of us are creating a men’s line coming soon. Our daughter Shelby is getting into the design business, too. Shelby and Pol’ are working on a new teen line that they are designing together.

3. Did they see more then friends when it came to Anna & Howard’s relationship?

Answer: Yes. They were more than just friends. The commitment that they had to each other exhibited the true nature of their relationship.

4. How did Daniel Smith feel about Howard K. Stern and what do they think of the PI that said Daniel was scared and concerned about Howard, or was it more like Daniel was worried about Anna’s friends Ford Shelly and G. Ben Thompson?

Answer: Daniel and Howard were like brothers more than a father-son relationship. They hung out together many many times.

5. Did Anna Nicole Smith talk about her childhood with them?

Answer: Yes. Many times. The stories and intimate details that Anna confided in with us about her childhood and her relationships with her mother, brother and step-father are a complete book in itself. We printed the email in our book in which Anna describes her mother as a monster only to show everyone what Anna thought of her mother. Those were NOT our words, but Anna’s.

6. I have a question for Pol’ and Patrik did they know either of the Hattens?

Answer: No. We had not heard of Jackie Hatten until after Daniel died. She came to the Bahamas house while we were there, and Anna told “Big” Moe, Anna’s bodyguard and friend, to tell her to go away. We spoke to Jackie after Anna passed away. Patrik spoke with her on the phone when she reached out to offer her condolences. They have spoken on the phone a few times. I’m sure one day they will meet face to face.

7. I actually have a question for Pol ‘and Patrik. What is their secret to balancing their careers and raising the beautiful daughter they have? It’s hard with working parents as sometimes my own husband is putting in double shifts.

Answer: The key to success is the balance of mutual love and respect we have for one another and our family unit. We maintain an unprecedented commitment to each other. Our daughter is always first no matter what we do. She comes even before us or our businesses. NO matter how busy we all are, we ALWAYS have a night every week that we spend the ENTIRE evening togther. Pol’ is an exceptional Fmother (we explain that in our book) and keeps Shelby pretty well-grounded.

8. First of all, if you don’t mind me asking, why do you spell it ‘Pol’?

Answer: Because of the way it is supposed to be pronounced. My mother had a strong Armenian accent and that’s way she said my name. It’s pronounced POLE not Paul. Out of respect for my deceased mother I honor the way she pronounced my name.

9. What did you think when you saw Ford Shelley trash your $5,000.00 dress?

Answer: I didn’t know that happened. If it did, it doesn’t matter. I know how beautiful my designs are. I put love and devotion into everything I create no matter what their social scale is. If my name is going to be on that dress I make sure it’s the best in fit, design and quality. The key is to make sure my clients walk away from me feeling like a million bucks. Any woman that has worn one of my dresses can tell you from firsthand knowledge what an amazing experience it is to wear a Pol’ Atteu.

10. How did you get involved with that sketchyass publisher in the first place?

Answer: Ms. Gibson came to Pol’s boutique for a dress. Our publicist referred her to us. We are very kind and generous people, and sometimes a little to trusting. She said she had a small publishing company and she really made us believe she cared about the project and would make sure a beautiful tribute book was put together. It was important for us to make sure the book had a certain level of class and elegance to it, and that it would be a “must-have” for all of Anna’s fans. We wanted a book that was easy to read, had some very beautiful pictures and showed the intimate friendship we shared with Anna. When it became CLEAR to us that the “convicted felon” could NOT accomplish this, we terminated our agreement and published the book through Kings Road Publishing.

11. In your book you said that right before Anna died she was cramping with a lot and bleeding- do you think she could have been pregnant?

Answer: We knew Anna had wanted another baby after Dannielynn. If you remember, she kept teasing about that. Anna had wanted to start a new family in the Bahamas. She said she wanted another girl. I don’t know if she could ever had a boy, it never would have been the same without Daniel.

12. Do you think that Anna is proud of Howard now? (For getting her buried next to her son and doing everything he can within his power to keep her baby girl safe)

Answer: Yes. I’m sure Anna is proud of all of us who fought tirelessly to make sure that HER wishes were carried out. Patrik sat right next to Anna Nicole when she picked out the burial plots, and was very CLEAR that there had to be enough plots for them all to be buried together. She was also VERY CLEAR about wanting J. Howard Marshall’s ashes placed in the casket with her. I know that she is looking down on us from heaven, smiling and happy, that we were able to honor what she wanted. Anna was so stubborn when she was alive. We had to make sure HER wishes were followed after she was gone.

13. If you are willing to, explain the effect Anna and Daniel’s Smith death has had on Howard K. Stern.

Answer: Anna’s death was completely devastating for all of us that loved her. I don’t think Howard has ever been the same since she passed away. I know we haven’t. Anna was like this “light” in our lives that always knew how to make us smile. We loved each other with no conditions and no boundaries. As we said in our book, we maybe didn’t always agree with the choices she made, but as her friend we gave her our love and support. It’s never been the same without her. I miss her funny little text messages, her blatant statements and her undeniable charm and appeal she had on us.

14. Do you think that Larry Birkhead feels any guilt towards Anna’s death? (i.e. Debra “Anna and Howard are dying Dannielynn’s hair” Opri)

Answer: We never knew of Anna dying the baby’s hair?!? I can only say that people don’t change. If there was an agenda before Anna died, I’m sure there is an agenda now. When Anna was alive, she protected her children. Any parent does.

15. Years ago, Hollywood was known for its glamour. The red carpet was a place for the stars to shine and be portrayed as royalty. Now it seems that tabloids have tainted that image. The Oscars and Globes ratings have fallen. Is it due to lack of interest or are the stars no longer on a pedestal as they once were? The human frailties that everyone has are now splashed across websites and magazines for fodder to snark over. Are people more interested in the train wreck aspect than the fan aspect? Has it changed the atmosphere in Hollywood from years gone past?

Answer: We don’t think anything has changed. Maybe the year, maybe the face..but, it’s always the same. Let’s face it. People reading the magazines and clicking on those celeb websites don’t want to read about something good. They want DIRT. Why do you think these magazines sell like hotcakes? Were not sure the ratings have fallen? It’s more like there is MORE competition. It used to be just the National Enquirer and The Star, now you have over 10 solid rag-mags published every week. But, it’s no different from day one in Hollywood. We have learned Hollywood loves to build you up, only so they can tear you down, and then build you back up again. That’s why it is so true that ONLY the STRONG survive this business. But, for us, it’s something we love to do. Pol’ takes great pleasure in making a woman feel her utmost sexy in one of his gowns. Patrik gets a personal high from taking a model and grooming and molding them, and then putting them in a magazine. We don’t think we could do anything else.

16. You mention a talent agency. You’re not like Donny Bonaduce? are you? Looking for the next child star? Does Shelby want to be in the biz?

Answer: Patrik has the model and talent agency, Network International Models & Talent. http:www.network-models.com. The agency is licensed and bonded in the state of California and has been open for over 16 years. It’s not an easy industry to be in, let alone for over 16 years. Network International Models & Talent is ALWAYS looking for its next star, but I think the media misrepresents a lot of what goes on in this industry. It all boils down to the parents. If the parents of a kid in the entertainment industry were bad parents before their child starting doing commercials, they are going to be bad parents afterwards. Plain and simple. Shelby is a model and an actress. She recently booked her first cover. You can see her on the cover of Zodi-Habit magazine. http://www.zodihabit.com She also just competed in New York City in the MAAI’s (Modeling Association of America International’s annual modeling convention, and won a Summer scholarship to The New York Conservatory for Dramatic Arts. We are very proud of her. She sings, she dances, acts and models. It was a natural thing that Shelby would be in this business because she has been around it all her life. She was on the Anna Nicole E Special “Anna Goes To Camp” and she’s starring in “Designer Family” with us. However, we are STRICT parents. There are auditions we have NOT let her attend because she didn’t have her homework done. That’s the key to making sure your child grows up healthy and happy in this industry…KEEP THEM GROUNDED and well adjusted. We would have supported Shelby in any career choice she wanted. That’s what good parents do.

I HAVE TWO QUESTIONS——-

17. What was Anna’s relationship with DR E, where they good friends?

Answer: She loved Anna and Anna adored her. She, along with us helped take care of Dannielynn, and gave unconditional support and friendship to Anna. All these bloggers that want to blame Dr. Khris for Anna’s death don’t know the real story. If Khris Erosovich could trade places with Anna, she would, in a heartbeat. We love Khris and will always support her. She was Anna’s friend. Again, as we have stated many, many times a true friend will love and support you no matter what. That’s what Khris did.

18. Was the doctor there with Anna a lot of the time, did Anna ever go on dining alone with Howard?

Answer: We were all there with Anna & Howard. Khris, along with us made many frequent trips to the Bahamas. But, there were many times that none of us was there and it was just Anna & Howard. One of Anna’s favorite places to go with Howard was the “Poopdeck”. It’s in the central part of town, and quite well-known.

19. The gowns that were designed for Anna Nicole Smith are beautiful. Is there anything in place to protect them in the future so that they are not damaged? A exhibition of these beautiful dresses would be lovely. When everything settles down of course. I think that Anna is firmly in the history books and the dresses you designed are a part of her public life.

Answer: Someday they will be unveiled and showcased. Right now we are considering many options to make that possible. Anna is a part of history and will always be an ICON of our time. We may hold an auction for charity, or possibly open a museum. We want to make it possible for Anna’s fans to see all the beautiful gowns Pol’ created for her.

20. What did Anna and Howard say to each other in their vows??

Answer: The universal language of their love and commitment to each other was revealed in the look of their eyes staring into each others.

21. Could you elaborate about why Ford Shelley and crew couldn’t be stopped from taking things from Horizons?

Answer: That’s one of the hardest things Pol’ ever had to do: stand there and watch them pillage Anna’s home. At the time, there was NO establishment of residence in place. Technically, there was no LEGAL way to stop Ford Shelley and crew from doing what they did. While that was going on, an attorney for Howard, Wayne Munroe, was in court to get a court order to get the house back, which would have prevented Ford and crew from doing what they did. Pol’ was outside with the Police waiting, so even if he wanted to do something, he couldn’t. It was the most helpless feeling. And, to make it even worse afterwards and walk in to see what a disheveled mess was left behind. Once those court orders were in place, Pol’ had the locks changed to prevent them from coming back and then immediately went to the Bahamas Police Station to file the theft report.

22. & 23. What was the mood in the house the day the dna test revealed that Howard K. Stern was not Dannielynn biodad? What was the mood in the house when Larry Birkhead left with Dannielynn? How was Howard? (If you don’t want to answer those last two questions cause you don’t feel like it would be appropriate I would understand. I don’t know if it was appropriate from me to even ask them)

Answer: All of us were devastated. Dannielynn was the last real connection to Anna Nicole Smith. When Larry took Dannielynn out of the Bahamas, he had taken her from everything she had ever known. Her safety, security and her home. And, if Anna were alive today that NEVER would have happened.
