It is the picture in this article, see red circle of the car, that spawn the gossip that Howard K. Stern was driving a new Mercedes Benz and how tasteless would that be?

First I have not seen the registration nor even the license plate number and until I do I am not buying this. It could be his parents, a rental car, one for his out of town attorneys, etc. However, what if Stern bought a “new Mercedes Benz”? I just don’t think that, it is not his kind of car and what one drives to court does not mean one owns it. Remember we have all heard the stories of Stern’s like for baseball caps and to dress down, so why a Mercedes Benz? For those of you who know cars look at the hood ornament on this silver car and tell me what kind of car it is? If Stern bought this or any other car big deal, if he got money from some of the lawsuits or contracts he negotiated and he chose to buy a new car with that money, great for him. I don’t get what all of the commotion is about. If you have a copy of a registration please scan it and send it on to us, if you prove to me he does own a new Mercedes I will eat my typed words on this blog.

It appears Stern did have one set back yesterday. Judge Robert Perry after hearing the amount of money that had been made since Anna Nicole Smith’s death from body guards to Larry Birkhead, he did agree that better accommodations should be provided to the Texas crew. So out of what is fondly called the roach motel and into better quarters Don Clark and Wilma Vicedomine were entitled to. Stern’s team had paid the airfare although the duo with their attorney Neil McCabe changed it to a later flight on Monday morning, and Stern’s team had to pay for 2 nights lodging at a classier hotel. It came down to in court who was fibbing to the judge? Chris Smith, Stern’s California criminal attorney, said he had contacted the duo and had offered 48 hours notice before appearing. Mr. Smith argued that Neil McCabe should not be allowed to address the court as he was not licensed in California. In the end the Judge did allow Mr. McCabe to speak on behalf of his two Texas clients, asked what his clients wanted, asked the defense team if they were going to call them and then split the argument in half it appears to me. Stern paid the upgrade for the lodging and McCabe’s clients would be hustled out of town by Wednesday morning.

I talked to one person involved in the fiasco to be in town or not to be in town. They said the communications between Chris Smith and Wilma Vicedomine broke down when she emailed him and told him to talk and handle things through her lawyer, Neil McCabe, and Mr. Smith felt Mr. McCabe was not licensed in California. Is there hostility there on both sides?? YOU BET!!!!

However, the big news in all of this to me is that by Howard K. Stern’s legal team subpoenaing Don Clark and Wilma Vicedomine as “hostile material” witnesses for Stern, neither Clark or Vicedomine will be allowed in court for any of the hearings including the trial. I would think that someone else will have to accompany Virgie Arthur to court each day and set with her during the jury trial. In your opinion was this a good move by Stern’s legal team?

It appears the good Dr. Nathalie Maullin is NOT an EXPERT witness, she is just a witness relaying the facts as she remembered them over two years later. I was told she had the personality of aluminum foil and would be a doctor that none of the patients including Anna Nicole Smith would have felt warm, snuggly, or even comfortable with. I went to work yesterday to find out more about Dr. Maullin with the ever changing “definitions and who she talked to” taking place in court. I can sum it up in one long sentence. She had been a doctor barely two years when she “treated” Anna Nicole Smith, and she has been downgraded from the prestigious Cedars Sinai Medical Center to Kaiser Hospital. Enough said.

The other two witnesses yesterday were two pharmacists, Steve Mazlin and Romeo V. Par; very dry testimony reading their records of what was ordered when and by whom.

There was a brief walk on witness to testify that one of Anna Nicole Smith’s alias names was Charlene Underwood and Ms. Underwood made a cameo appearance as this was not her.

Judge Robert J. Perry did not have a good day and is a tad upset with everyone, by yesterday afternoon he was telling Renee Rose to move the case along. Some in the court house heard her say out of court she could be finished by Friday before noon. Court Observers are betting it will last no longer than next Tuesday, October 27. Several Court Observers also said that all three defendants would be bound over for a criminal jury trial and Judge Perry would be happy to be rid of this mess from everyone. I would imagine he has empathy for the judge that inherits this for trial. BEFORE ALL OF YOU GET UPSET!!! Remember I predicted they would be held for trial on a minimum bond, the district attorney has to basically meet the bar of standards of a ham and cheese sandwich and the pharmacists alone probably did that for the prosecution. Judge Perry wants to be done with this. This preliminary hearing has allowed the defense team to see the assistant D. A. Renee Rose in action as well as some of her star witnesses and you can bet that by trial the defense team for each of the three defendants will be loaded for bear and ready to meet and bring reasonable doubt for their clients to a jury. It was Adam Braun, Dr. Khristine Eroshevich’s attorney, who said if the district attorney’s office could not meet the low hurdle required by California statute in a preliminary hearing the assistant district attorneys should be laid off. I agree and if I was any of the defense attorneys I would just let this round go to the State of California. We will see if my prediction is correct.

Now for Mo Mo making over a hundred and fifty thousand with money from interviews which is still probably pouring in from Fox, not bad for five months of work in the beautiful Caribbean with Anna Nicole Smith paying all of his expenses while he was there. His testimony is going to get to when did you lie, at the paid media deals or now at the hearing and on to the jury trial. If Sadow did in fact cause Mo Mo to become angry and agitated then the defense learned a lot from Mo Mo’s three days of testimony and I would bet they are going to go over that transcript with a fine tooth comb so to say. If I was Renee Rose I would make sure there were more people then just Mo Mo that saw what he claims to have seen, if he is the only one I predict that will not get far with a jury.

Next up is Larry Birkhead and the 2.3 million dollars paid since Anna Nicole Smith’s death, well part of it came from NBC contracts to be Tony Potts best paid friend with exclusives for 3 to 6 months back in the spring of 2007, how ever long that contract was for. So the over one million more I would say came from other media like Fox and CBS – Entertainment tonight, and I wonder if Birkhead was also adding up the magazine layouts he has done with Dannielynn since winning the DNA test? If he can make this kind of money GREAT, it means he has the dough to take care of his daughter.

I was sent an excerpt of something that suggested Birkhead was pocketing Dannielynn’s money and cheating Dannielynn trust account, WRONG. If Larry Birkhead is in the interviews or pictures sold, the money goes to him. If the money coming in is for the use of Anna Nicole Smith’s name and/or likeness it goes into Dannielynn’s trust account. IF at a later date Birkhead decides to be in a reality show, which again I heard the first editing was a bomb, then the money MADE by Dannielynn would have to be held for her in another trust account NOT the Estates. The same goes for if she appears in pictures alone or begins to model, that money would have to be held and accounted for, EVERY penny. Since Birkhead testified that he had made that much money there is no reason to doubt him. Birkhead has also become a household name in the last 2+ years as has many in this sad saga.

The big question is did Larry Birkhead lie about the young new assistant district attorney Sarah Slice and his conversation with her. If these allegations floating around the courthouse corridors and the district attorneys office are true and Birkhead did lie what a crappy thing to do to a young assistant district attorney, in my opinion. She was back in court yesterday and all was normal and she has learned to NEVER talk to a witness outside of the courtroom. The reason is because in court it can be spun to look like you did a naughty and the witness is the victim. I do have to say this fiasco got Birkhead international coverage and bumped Mo Mo from the papers, perhaps that was the plan all alone. If Birkhead lied about his conversations with Ms. Slice then shame on him to take advantage of a new and probably friendly attorney. I bet in all future hearings involving this trial, the state of California vs. these three defendants we will see two big burly bailiffs bring Birkhead in and out of court and Sarah Slice will never forget this hard learned lesson in the legal world of the rich and famous.

I have often said this site will close before it becomes a propaganda site for either side in all of these lawsuits. However, if I am told something and I can verify it through at least one and preferably with two other independent sources it will appear here and hopefully start a good dialogue.

I hope we have debunked part of the gossip and put perspective on the rest, and yes it was the courthouse discussion as it was in the offices for the district attorney that the allegations of Birkhead lying is true, I guess we will find out with time won’t we?

There is no court today and I believe the rest of the witnesses are not going to give us the fireworks that Mo Mo and Birkhead provided.

UPDATE: I did forget to mention that there is of course some main media in the courtroom as well as bloggers covering the case. Those bloggers sharing with me or telling me where to look, they are great and neutral…. HOWEVER, there are some bloggers in the courtroom that do not appear to be fair and unbiased, they have been identified as VA bloggers and now their identities are known and they will be dealt with appropriately.

So what is in Howard K. Stern’s hand?

Day six is completed and there is approximately 4 days left until Judge Perry hands this entire mess over to the trial judge for the case. Tell us your thoughts and would someone look up the car in this picture and tell us what the hell it is?

I had court observers tell me over and over again this week, that before this preliminary hearing started they felt it had been a fatal error on Howard K. Stern’s part to bring in an out of state lead criminal attorney, Steve Sadow. It was thought that as many good criminal attorneys as there are in California and especially around the Los Angeles area that any jury would not relate to the southerner in cowboy boots, Steve Sadow.

During the preliminary hearing we have read from court observers that Judge Robert Perry stops Sadow as he is going into a long oratory before asking a question of something like “hold on, this is a preliminary hearing not a trial keep the questions short and to the point”. Then we had Daniel DiCriscio describing in just the morning session that Steve Sadow, lead criminal attorney for Howard K. Stern, was jumping up every few seconds to object to something the Los Angeles assistant district attorney, Renee Rose would began to ask to object.

However, that seems to be evened out by the judge not allowing a lot of evidence in about Anna Nicole Smith, her life, potential sex escapes, tapes etc. that Renee Rose is trying to introduce. One witness blames Stern and Dr. Khristine Eroshevich as Mo Mo did, and then another witness does not know anything about Dr. Khris but did talk to Dr. Sandeep Kapoor and so the “show goes”.

“Show”?? Yea but about a real person’s life and every facet of it more then two years after her death, I keep asking myself why?

Did we need to know about all of her physical ailments? Did we need to know, as one writer, said where even the remote to her T. V. was kept? Did we need the dueling banjos of testimony of Mo Mo followed by Larry Birkhead to dispute that fact? Birkhead explained what seemed to be a far more logical explanation and one I had heard way back in the spring or early summer of 2007. If I could find this why did the “lead investigator” Danny Santiago NOT find this?

Everyone who is a court observer agrees that the most damning evidence to date is Mo Mo, after all he was with her the last 5 months of her life. By the way if he did that because he loved her and never got paid, doesn’t that mean he lived off of Anna Nicole Smith in the beautiful Caribbean as the fingers he pointed at Stern seemed to indicate? Why was Mo Mo willing to lie for months and months and then decided he wanted to set the record straight? For that matter which record is he sticking to finally? I have so many questions about the devoted Mo Mo and so few answers.

I have heard it said that Howard K. Stern better hope that Sadow has a big enough bat to handle Mo Mo or his legal name of Maurice Brighthaupt, and does he? Well I talked to several court observers after the almost 3 days of Mo Mo then followed by the southern voice of Larry Birkhead and here are some things they are saying. First and foremost to date the only damning witness has been Mo Mo, but let’s look at that and what some have not written about.

Under cross examination Sadow was able to agitate Mo Mo, that won’t play good to a jury for Mo Mo to appear like a giant ex bodyguard with an axe to grind with Anna Nicole Smith’s Estate which equates to Howard K. Stern and Larry Birkhead. One court observer told me about this last week that they did not care for Sadow personally but that he was “very likeable” and that is what plays to a jury. If the lawyer is likeable and has some good points and can agitate the top witness to date that does not bode well for the prosecution. One court observer told me, it does not matter if you like Sadow personally he is one hell of a likeable lawyer in court. Here is my own interpretation of what MIGHT have happened between Mo Mo and Sadow in just one question and all of you have posed some great questions here on the blog by the way. Sadow: “So Mo Mo which time are we to believe when you are choosing to tell the truth, now or when you were being paid over a hundred grand for appearances when you said something entirely different”? Mo Mo, gets agitated and glaring at the lawyer and said: “This time I am just now trying to set the record straight”. Now agitated and that lame of an excuse for lying while the money was coming in but not now, how do you think that is going to play to a jury?

I had heard the account given by Larry Birkhead about the AMA show before and have written about it. Allegedly Anna Nicole Smith had a grand mal seizure the night before her appearance. Two doctors were called and both said to give her a double dose of her seizure medication. As hard as it is for most of us to believe the beautiful Anna Nicole Smith had anxiety before a public appearance and especially for this one with her weight loss. She had insomnia and had not slept for thirty six hours straight. I have heard “gossip” that besides the seizures and no sleep she had taken a Xanax several hours before she was to appear to try to sleep. Did Mo Mo have any explanation for that? Another witness who is suppose to give damning evidence is Nathan Collins but even he told me he had asked around and had talked to Kim, Anna Nicole’s personal assistant for years and had been told way back in 2005 the same recounts as Larry Birkhead gave on Friday. So could Mo Mo have just forgotten all of that as the months and years have gradually slid past?

Then there are all of the horrid things we are learning about the health and habits of this beautiful previous playmate of the year turned model. Did any of us really or need to know about everything she suffered from? Did any of us want to really know about her personal habits including liking to drink out of a baby bottle, keeping baby food snacks near her bed and all of the other very personal things we are now finding out? I did not and it kind of makes me physically sick, how about each of you?

This brings up an email I found I still had from 2007, it is talking to someone else, now remember I have never spoken to Howard K. Stern, Larry Birkhead, Virgie Arthur, Mo Mo and most of the people in this saga and certainly NONE of Anna Nicole’s inner circle. However let me recount in part what this email says. Remember at one time I did do some domestic violence advocacy work and I can say for certain that adult survivors of child abuse are almost impossible to reach out to or help. In this email I say “I have been able to “VERIFY”…. I have no idea who I was talking about when I said “verify”. However, the email goes on to say, “there were at least four different personalities of Anna Nicole and she referred to them as this. Vickie Lynn is the girl that came from Mexia Texas, Nickie was the stripper, Anna Nicole was the model and red carpet walker, and Robin was a little girl”. I believe in the email I am musing could one of the secrets that Stern has vowed to protect in death could be the fact that Anna Nicole suffered from multiple personalities? I don’t know but those of you who have read the last week and followed Anna Nicole Smith in life, could that be true? If it is do we have the right to know all of that now over 2 years after her death?

So in the end as it appears now that all of Anna Nicole Smith’s secrets will come out will Steve Sadow have a big enough legal bat to handle those like Mo Mo as Howard K. Stern dearly hopes so? TMZ.com had a picture of Dr. Kapoor and Dr. Eroshevich arriving but Howard K. Stern had already arrived and was inside out of the TMZ.com camera spot light.

Court started at 8:30 AM, Virgie Arthur is not there but Neil McCabe is there and Don Clark WAS there…

The first thing to happen is Don Clark was handed a Subpoena as a “Hostile Witness” by Howard K. Stern’s legal team WHY??? It has barred him from the court room as an observer, now that is NOT going to play well. However Neil McCabe is able to observe and is there by himself.

The first witness up at 8:30 AM was Danny Santiago, first they are going through each pill, number and type which is very Boring we are told and as of 10 AM PDT, Mr. Santiago was still on the stand.

Update following lunch, now Steve Sadow, the attorney from out of town that many said might be a mistake on Howard K Stern’s part is now having his turn cross examining Danny Santiago and is making this lead investigator for AG Brown and the state of California, look like “Bozo the clown”, it would appear Mr. Santiago should have been prepared a tad better by the assistant D. A. It is not Santiago’s fault and he juggles multiple cases and court appearance but on the side of Santiago, I would be a tad upset at the Assistant D. A. for this case, if not after 2 years then when??? I have been told this is the most interesting part of this first day. It WILL NOT change the outcome but is interesting is what I have been told.

Last update tonight. I won’t be calling Steve Sadow the ride him up cowboy in the future, I have been told by one of our court watchers that he meticulously “sliced and diced Danny Santiago”, not my words but a court watcher’s opinion who felt sorry for Santiago. Then he, Santiago, was handed off to Adam Braun who has a different style but gets the job done. This is not the place or the time to pick a fight or show your cards. I have been told by one of the court watchers that Agent Danny Santiago would look at his notes for up to 3 to 4 minutes with NO ANSWER. One observer told me he, [Santiago], could have been looking at a blank piece of paper trying to figure his way out of the questions.

The AP in it’s final reporting tonight that “under cross-examination by Sadow, Santiago recounted a conversation he had with Arredando about her impressions of Smith. Reading from Santiago’s report, Sadow quoted Arredando as saying, “She was always the boss. She was in control of everything and everyone, everyone that traveled with her. When Sadow asked if that included Stern, Santiago said he believed it did. Santiago acknowledged that Arredando was also asked if Smith’s “ditzyness” was an act and that Arredando said yes”.

Here are some facts from today: 1. Anna Nicole Smith was sick when they left the Bahamas, she was already very ill which is why the baby bottle was brought to keep her hydrated. Fact: 2. The private plane was suppose to go to Fort Lauderdale per testimony at the burial proceedings, why did the plane end up in Miami instead? As Ken said in this day and age to go off course without filing a flight plan with a private plane is just NOT DONE any more. So why was Anna Nicole Smith taken to Miami first was it because she was so ill? Why would she not go to the hospital in the Bahamas or in Miami or in Fort Lauderdale that statement by Ms. Gibson of feeling she was seeing Anna Nicole leave for the last time might have more meaning as this case begins to fit together like a puzzle, what to you think? Fact: 3. Anna Nicole was driven over an hour in a limousine from Miami to the Hard Rock Hotel on the Seminole Indian Reservation. Fact: Dr. Dr. Eroshevich knew she needed a local doctor on the night they arrived, February 5, 2007, and call the Hard Rock front desk for guest relations and spoke with Lisa Arredando and asked her to find one discreetly and have him come look at Anna Nicole Smith. Fact: 4. Howard K. Stern called and canceled calling in a doctor stating fear of leaks to the media.

People I end up with more questions then answers. So my question to all of you who followed Anna Nicole Smith, could she have been this sick before leaving the Bahamas and still be calling the shots because she wanted to pick up that BOAT, I believe back in February 2007 that Howard K. Stern and she had canceled one or two times what made this trip different? Do any of you remember that and/or know anything from your own research?

Last FINAL REAL LAST update tonight. Don Clark, Wilma Vicedomine and Tom Pirtle were all served today and tonight the last one has just been delivered to Houston to the home of Wilma Vicedomine “stating” in the Subpoena that all of them are to be in the California court on October 14, 2009 for the defense as hostile witnesses. Folks this is going to get GOOD as for as court room theatrics goes…

One observer today had this Prediction, that Renee Rose will be replaced by the L. A. D. A. office by Thursday, we were not able to reach Miss Rose or a get a statement from the court spokesperson this late in the day. At this point the big question for me is why is Jerry Brown via the L. A. D. A. going for such a public preliminary hearing? As I said before you can get a grand jury to indict on a ham and cheese sandwich so why go this way and allow the defense to get a “feel” for the witnesses? That is the $64k question for tonight?

Is it Déjà vu of Anna Nicole Smith who is rumored to have loved clowns and to dress up as a clown, we all remember the now infamous “Clown Video”? This is a Preliminary hearing and I doubt the bar of proof to hold over to trial is much higher only public as opposed to a Grand Jury. That said, it does give AG. Feel good Jerry Brown another go at the free advertising of a very public hearing, and right before the kick off of his 2010 guberernatorial bid. The only better camera opportunity for Feel Good AG Jerry Brown is if cameras were going to be in the court room and him sitting with the assistant D. A. Add that with a possible indictment of one of Michael Jackson’s doctos by the grand jury in Los Angeles this week and Jerry Brown must be in euphoria.

Per a comment from the AP: “Attorney Adam Braun, who represents Eroshevich, said the evidence disclosed at the hearing may be surprising, but the outcome of the proceeding before Superior Court Judge Robert Perry is predictable. Preliminary hearings represent the lowest possible hurdle for a prosecutor to clear and are virtually impossible for a prosecutor to lose,” he said. “If the prosecutors in this case somehow can’t make it past the preliminary hearing, they should be laid off.” Braun said he was unlikely to call any witnesses of his own. “Given the general futility of the exercise, Dr. Eroshevich will listen intently to the prosecutors’ allegations and reserve her defense for maximum surprise at trial,” he said.

Howard K. Stern’s ride them in cowboy attorney also gave a statement to the AP in the same article of: “Steve Sadow, the Atlanta attorney representing Stern, said he had not yet decided whether to call defense witnesses but would try to make his case through aggressive cross-examination. He expects some colorful witnesses, including the investigators.”

No cameras and lots of first and maybe second day interviews is what I expect at lunch breaks from the colorful Sadow. Expect Adam Braun to keep his head down and make notes while talking to his client and I expect the same from Dr. Sandeep Kapoor’s attorney, Ellyn Garafalo, of keeping her cards close to her chest as well, however I hope Sadow gives us some colorful commentary of this hearing on behalf of his client, Howard K. Stern. I wonder if Virgie Arthur with her attorney Neil McCabe and top investigator Don Clark will also be present, if so except a couple of news nuggets from them.

Then we have Larry Birkhead’s friend, Harvey Levin and the TMZ staff giving Birkhead more face time with the story entitled: “Birkhead Star Witness In Howard K. Case”. So is Birkhead going to sink Howard K Stern or save him? No matter how it goes it is going to give Birkhead a lot of face time in front of cameras again.

Then if this is not strange enough for everyone here is the cake topper; Reuters News reporting that: “Mark ‘Hollywood’ Hatten Now Under Protective Custody From Jax Desmond Worldwide”. That would be the company Mark Speer works for or worked for. The article goes to say; “NEW YORK, Oct. 12 “The Jax Desmond Worldwide Corporation today announced that Mark “Hollywood” Hatten is now under their protective custody. Hatten is a former boyfriend of Anna Nicole Smith who recently spoke with national media concerning allegations he claimed transpired between Anna Nicole and him while they were dating. “Hollywood” claims Smith begged him to help her in a “Murder For Hire” plot to kill her stepson E. Pierce Marshal.”

Jax Desmond Worldwide states that it “is a diversified private military company that provides protective security solutions to government and civilian clients… The Company offers a broad range of innovative services to customers, helping them to safeguard their biggest assets – their people.” Now how much is an interview with Mark Hatten worth after the old recycle FBI plot from 1999 or 2000 suddenly appeared last week? Wonder if Mark Spear’s still works for them?

Hatten’s interviews seem to be about the story the AP ran with last week where someone asked them to do a Freedom of Information Act Request from the FBI and ran what was obvious old and debunked news.

Is this going to be enough to bring the three ring circus back to town but this time in the Hollyweird Criminal Justice courts or is it going to fizzle as most of the public wait for what might be the indictment of Michael Jackson’s former doctor, Dr. Conrad Murray.?

Most of us expect that Wilma Vicedomine or her alias of Wilma Vice is present in a deposition today. However, I have some questions and would like to have your input.

Who is there today, we know Lin Wood is there and any lawyer that Mr. Wood picks to be there to represent Howard K. Stern. We know that Rita Cosby’s lawyer is there, Elizabeth McNamara, and Hachette Books lawyer Douglas Maynard is probably there as well. Wilma Vice is being represented by Neil McCabe now as an “agent” [employee and therefore a party in the Florida lawsuit], of the O’Quinn Law Firm and Neil McCabe can invite any other lawyer that is listed to be there for the deposition from The O’Quinn Law Firm.

However is Robert Klein there, since he is not representing anyone in the New York case? His September 29 letter to Lin Wood said he would be in Houston this past weekend to prep for Don Clark’s deposition on October 14, but if that deposition is ONLY about Cosby’s book will Mr. Klein be allowed to sit in on these depositions.

The main parties have a right to be present also, that would be Rita Cosby and Howard K. Stern, would they show up? We know that Howard K. Stern loves Texas, NOT, so my bet is he is not there and would not step foot in Texas not even to look the woman in the eye that spent over a year trying to destroy him. My bet is that he will watch the video of this deposition to “meet” Wilma and not be there today. However, will Rita Cosby be there to support Wilma Vicedomine and Don Clark? Why did Cosby who fought so hard to keep everything she said and all of her documents in the New York suit to be held as confidential and never shared with anyone else or in any of the other lawsuits, suddenly changed her mind about handing all of that over to The O’Quinn Law Firm? The fact that her lawyer was willing to do that, addresses the Amended Complaint that Stern filed in Florida in which he alleged in part that people in The O’Quinn Law Firm “conspired” with Cosby on her book. Did Cosby and her lawyer prep for this deposition over the weekend with Wilma Vice? Was Wilma shown the video deposition of Cosby and all of Cosby’s confidential documents to prep for today? I am still amazed that Cosby would take a chance of handing over everything to the O’Quinn Law Firm in regards to her suit in New York, could this end up biting Cosby.

What are your thoughts on is Cosby there today to encourage her source for her book? Did Cosby hand over everything to help her sources? Who do you think are in that room today during the deposition?

Then there is the question all of us would love to see the answer to, will Wilma throw any of her alleged email, chat buddies, or blogging buddies under the bus today? Will she hand over those that Wood alleges she gave instructions to post certain things on TMZ.com? Will we know their names as the Florida Suit and New York suit goes forward? How did those excerpts of Cosby book find its way to TMZ.com before the book was even released?

Rita Cosby has filed her “Disclosure 26 witness list” but NOT in the New York Federal Court where she has been able to get the court to agree to a gag order on almost anything Hachette Books and she feels is going to expose her to embarrassment or public ridicule. The court did issue a new “Consent Amended HIGHLY Confidential Order” as the lawsuit goes forward and while asking some witnesses to, now after the fact of the book, give Rita Cosby and Hachette Books very sensitive and personal information as the objection filed in California by Larry Birkhead’s lawyer, Michael Trope shows. The Order also allows Howard K. Stern to play by the same rules. Again, I would add it would have been nice if Cosby had tried to vet her sources before the book instead of after the book, in what now appears allegedly as an attempt of saving her Azz so to say.

We had to dig to come up with the papers in California but come up with them we did, as well as a subpoena served on CNN in Atlanta Georgia by Howard K. Stern. Yes, we have to prowl through the national databases occasionally but as with these papers we found filed in California it is well worth it.

Now what does the witness list tell us about Rita Cosby’s defense? First, we noticed she has many of the same witnesses as Howard K. Stern. However, Cosby now tells us that Bruce Littlefield of New York, alleged friend of Cosby’s good pal; James Edstrom was her “ghost writer”. James Edstrom, whom by the way is NOT on the witness list, I wonder why when he brags about being Cosby’s official photographer for years. Perhaps he will be added to the gang of Cosby’s defenders, as the trial gets closer, isn’t that what good friends are for? Perhaps James Edstrom was never a long time good friend and like so many others in this tragic tale, just hung onto the coat tails of Cosby for a bit to get his own publicity. Any of you know how long Edstrom has been Cosby’s “good buddy”? I continue to say this book read so bad that you have to wonder who wrote it and how quickly, you would think an “award winning journalist” would have taken some writing classes to get her degree. Who is Bruce Littlefield anyway, did he do some garage sale shopping books?

Back to the witness list and who are on it and who is NOT on it which can be, I predict very telling about this blond ambitious “who dunnit” novel passed as fact to readers, in my opinion. We now know that many of the allegations of sure fire, yeppers we know it, stand behind it 120% no 200% is not quite there, it now appears.

Looking at the witness list we see that “grouping of people” we have suspected will tie this up with a Los Angeles, Houston, Florida and into New York of people with similar interests and agendas, in my opinion. After you read it be sure and give us your opinion on this “grouping of people” and if you think they were “reliable” sources for Cosby’s ambitious book. You can do that here on the blog or on the new forums, named “Stern Vs Rita Cosby, Hachette Books, et al”.

Let’s start with the Texas connection: We have some that both Rita Cosby and Howard K Stern listed including, Virgie Arthur, Don Clark a private investigator for the O’Quinn law firm and the biggest surprise, per Cosby list, once again Wilma Vicedomine listed as a PRIVATE INVESTIGATOR. She is listed on Stern’s list as just a “witness”, not as a private investigator as she ranks on Cosby’s list. So all of you out there that said, she is not important and never passed herself off as a private investigator when we interviewed Pol’ Atteu and Patrik Simpson, they seem to be vindicated here. Why might you ask, simply because Cosby and Hachette both have listed Wilma as just that, a private investigator? I did not know Wilma had a Texas PI license, they are hard to come by. However, per Cosby and Hachette’ list we now know that in fact she claims to be just that, a private investigator; however as the O’Quinn law firm continued to state in December 2007 only for the cases of Virgie Arthur. Can one now get a P.I. license in Texas by the mere fact of knowing a “real” P. I.? Of course, she could be a “P. I.” in training “studying under” Don Clark. I bet some of you can check into the requirements in Texas to claim that special title and get back with us on when Vice accomplished this feat. However, it does appear Wilma is in fact a Private Investigator if Cosby is to be believed.

Then we have a surprise witness on Cosby’s and Hachette’s list, John O’Quinn, was he a source or did he only loan Cosby Wilma and Clark as sources? Is Cosby going to hang these Texas people out to dry so to say if it comes down to “outing” them as prime sources for her book? Did John O’Quinn ever meet Anna Nicole Smith or Daniel Smith? What could he have been a source for in Cosby’s book, other than then what he now claims? If you believe Rita’s past now cancelled show, just like Greta’s On the Record, you have to know that is not real news, and no one believes what is on those shows, called “infotainment. Wonder if he told Cosby that no one watching her now cancelled show on MSNBC would ever accept that as anything but “infotainment”. O’Quinn has gone on to continue to say that Greta and Cosby should never be believed, that has to make both women feel warm, snuggly and loved, NOT. If you doubt that about John O’Quinn’s opinion of Cosby just read the latest filings in the federal court in Florida. None of Anna Nicole Smith’s other family members or friends are listed on Cosby’s list, although some are listed on Howard K. Stern’s list filed publicly with the New York court back in November 2007. Which by the way is when Cosby filed this list, she just chose not to make it public, must have been one of those “confidential documents”.

Then let’s swing out to California, and we have Mark Speer (only now we “think” his name is Spears, or Speers, or Spear), he was “the security person”, working for Debra Opri, the long time good friend of Rita Cosby. Then as we peruse the list we see, some more interesting people on Cosby’s list, some that did and some that didn’t make it on Stern’s list. Cosby and Stern both agree that Mark and Jackie Hatten as well as Jack Harding are all important to this case. I wonder what Jackie Hatten said in her deposition and watching her in court during the trial should be great entertainment. We have all now had a good look at jailhouse Mark Hatten; did Cosby ever look into who this guy really was before interviewing him via phone in prison for her book? You would think that “award winning journalism” might have caused her to stop for a second or two to determine his “believability scale”.

Now getting back to the ever changing tales of Jack Harding the P. I. who did talk to Daniel Smith but only briefly met him for coffee at Starbucks with Ray Martino; Jack Haring whom as the weeks following Anna Nicole’s death “story” grew and evolved kind of like Pinocchio’s nose. Jack Harding, remember him, the P. I., whom we were able to debunk on this site, using his multitude of ever changing interviews. Jack went from saying there was “one brief” meeting to having “several meetings”, from being told Daniel Smith had a previous prescription problem to saying that Don Clark had contacted him and offered to pay his expenses to the Bahamas for the Inquest. Which brings up the question, why didn’t someone as important as Jack Harding not make it on the Bahamas officials “main” people who needed to testify list, but did make it on Don Clark’s list? Jack Harding ended up, it appears, being a major source of information for Cosby’s book, did she not pick up that this guy’s story kept changing? She based almost a whole chapter on what Jack Harding had to say, including having to save John Nazarian from being treed, ah I mean fenced by Harding’s dogs.

Both Cosby and Stern continue to agree in California that Ray Martino is important; Larry Birkhead whose lawyer is trying to reign in the broad reaching subpoena with Cosby and Hachette’s lawyers to see if the new “Consent Amended Order” is enough for Cosby to be able to go through all things concerning Larry Birkhead. If I had the money to make a bet, I bet that “fishing expedition” into Birkhead’s life will be severely limited by the federal court in California if Birkhead and Cosby’s lawyers cannot reach an agreement. I might add here that Cosby and Hachette are “beefing” up their list of Pro Hac Vice lawyers to appear if a court hearing is needed in California.

Stern and Cosby both have Anna Nicole’s ex-assistant, Kim Walther on this list; as well as Ron Rale, Anna’s lawyer and ex-law partner of Howard K. Stern and still friends with Howard K. Stern. On Cosby’s list he is just listed as a friend to Howard K. Stern. Is Ron Rale the attorney close to Stern and Birkhead that Rita said in interviews that she had several conversations with before and during her writing of the book? Everyone in all lawsuits, in all states wants the ET employees, especially Bonnie Tiegel and Mark Steines; it appears they are listed in this lawsuit as well as the Houston Texas federal suit and the Florida federal suit. Am I the only one here seeing overlapping players in all three federal suits?

Both lists have Dr. Kapor and Dr. Khris listed. However, with Cosby bragging about how her book got all of the investigations kicked back into high gear, Florida and the Inquest in particular, I wonder if she can get either doctor to appear. I know we continue to lose our Constitutional Rights, but last I heard if these doctors are still being investigated by anyone then I doubt Cosby is going to get any “good and spicy” testimony from them to back up her and Littlefield’s books claims.

Now we have some interesting developments in all of this: First Pol’ Atteu and Patrik Simpson, they are listed on Stern’s witness list but NOT on Cosby’s witness list. However, we might note that making a full disclosure to us for their deposition that stated they had dinner with Cosby, her lawyer and her lawyer’s assistant in New York in mid-March and then received a subpoena in April by Cosby’s people. Remember that Pol’ and Patrik swears to us in their “full disclosure” that they only talked about raising children, and Pol’ and Patrik were “curious” about Rita so decided to take her and her lawyer up on an offer for dinner. Second, during our interview with Nathan Collins, he said up front that Hachette’s private investigators had interviewed him; he is on Stern’s list as possibly having information about Cosby’s book but not on Cosby’s list.

Then we have two surprises on Cosby’s list, John Nazarian, again why didn’t she talk to him while writing her book she put his email addy in the book so we all could email Mr. Nazarian? By the way, thanks Rita for doing that, after your book came out we emailed him and he ended up writing about the Anthony Pellicano trial for us. However, I have to wonder how many idiots emailed him thanks to you putting his email address in your book. Bottom line is that Cosby really could have contacted him if she had wanted. He would not have talked to you about any clients, like Birkhead and Stern, but I bet he could have talked to you about being treed (ah fenced) by Harding’s dogs and then saved by Harding himself. However, if Cosby had done that homework about vetting her sources that “intimidation chapter” about Mr. Nazarian would have probably had to end up on the editor’s floor.

Drum roll here, we then have Debra Opri listed as a witness. Am I the only one seeing a pattern of lawyers or ex-lawyers as key players end up on Cosby’s list of people who can vouch for her “who dunnit” book? Can Opri discuss an ex-client like Birkhead? I mean she did that June 6, 2007 filing that became almost the entire bases for chapter 12 of Cosby’s book. It is just a “minor fact” that the June 6, 2007 filing by Opri had been stricken by the California Court before the book was published, perhaps she can testify as to why she filed that in the first place. I am willing to bet that little filing has cost Ms. Opri some television appearances, some clients, but she did get a new Hollyweird term named after her, the “I’ve been Opried”.

The South Carolina, Florida and the Bahamas list of people are also overlapping in the lawsuits. However, Cosby gives us two surprises here, it appears we now know the name of the boat handyman she based so much of her book on, Todd Smith. The other person that seems to be very absent from Cosby’s list is the “male employee confidante” from the Bahamas that so much of Cosby’s book about Stern mistreatment of Anna Nicole was based on. Which brings up my next question, is it cool to put a character who is perhaps fictitious into a “non-fiction book” even though it reads like a “who dunnit” novel? Perhaps L. Lin Wood and Howard K. Stern were right in their interviews about saying this guy never existed.

I suggest you pull Stern’s witness list and the Cosby and Hachette witness lists and compare them side by side. For me it was all of the same people gathering in all of the different jurisdictions from sea to sea and to foreign countries. It seems to be a close-knit circle of “friends-enemies”, and a lot of “who dunnit” alleged theorists.
