Many times I’ve stated, the real truth of the Anna Nicole Smith case will never be told, at least in a court of law. Howard K. Stern had his entire case thrown out by superior court Judge Robert Perry, this judge made it clear from the very beginning he did not like this case. And in the end he made it even clearer by taking the action that he did.
Dr. Khristine Eroshevich also escaped with her title intact – Doctor – …Dr. Eroshevich and I were to write a book of the “real” Anna Nicole Smith and the shenanigans that were being pulled on and around her. There is still not a question in my mind having discussed this in detail with Eroshevich that it would be “her” telling the story of what she saw that would be a bestseller.
Again as I stated previously, the D.A.’s office did not expect to have to deal with Steve Sadow and what I called the “Sadow Factor.” …
[Three defendants Dr. Kapoor, Dr. Eroshevich and Howard K. Stern], Their reputations will be forever in question, just as was O.J. Simpson, most thought he was guilty of the crimes he was charged with…the difference was that the jury set him free and in this case it was Judge Perry …The Judge saw through what was being done and did not like it, and I agree. I agree with the law as this is what our country is based on. My problem is all those conversations I had with Eroshevich and all the discovery that I read, and every lie has a little truth.
Let me put it this way, what the Los Angeles District Attorney did was try to bake a cake. Yes, try and bake a cake when you had no flour and the eggs were rotten…. …And stink it did, this has to be one of the biggest stinkers the L.A. District Attorney has had to face during Steve Cooley’s time in office…
…Having a judge who is annoyed with the case as charged and who would become even more annoyed at Prosecutor Rene Rose who was prosecuting the case was another element. There was the Sadow Factor and the other element was surrounding yourself (Howard and Anna) with people who at their best were incompetent. We saw the body guard, the wife of the body guard, the nannies (and their families), star-struck government officials, real estate moguls/felons and a galaxy of hangers-on, and it would be their very testimony that would be almost as comical as an episode of the “Anna Nicole Show”…the only thing missing was that flamboyant fruit cake. It was this very, very incompetent and annoying testimony that further pissed off Judge Perry.
…You would have thought he, [Kapoor] would have avoided the Criminal Courts Building at all costs – ahhh, the cameras (I certainly can relate to that). And we should all be happy for them, much of this was a mistake from the beginning on the part of the investigative agencies who participated. From the Bahamas to the United States, it was clowns with badges and guns…

I am so very surprised a doctor who even dare to think to write a book!
How very unethical when they were so personally involved and with the doubt if their participation was moral or illegal to any measure at all…
Has the public forgotten that it is not so much (in my opinion) that the Judge did not like the case but the impression to me was that he was ’duped’ by the prosecution in the first place? At the prelim trial the prosecution seemed to be reading from transcripts of the idiotic defamers who spent months on television with their outright ‘self serving’ lies trying to get HKS out of the way! The same lies that were in Rita Cosby’s book.
Also forgotten was the South Carolina people who blatantly stole Anna’s personal belongings and had her hard drives copied within hours!
I have always wondered about the:
> staged small refrigerator… (conveniently all labels facing towards the camera)
> the clearly edited ‘pieced’ clown tape… (is that ALL Ford Shelley could come up with as a ‘counter’ to his theft? Like try to blame HKS for Ford and his wife who chose to leave their daughter there? Do people not remember his theatrics? >> ‘..how dare you Howard?’ What bullshit! Ford was faced with television cameras at the Florida burial hearing and played them well in trying to continue the outright lies that Jackie Hatten and Anna’s estranged family had started!
Or how can anyone not recall the unethical prosecution’s actions?
> speaking to Larry about eluding to his daughter being affected by meds and to speak more harshly (paraphrasing) about HKS…
> the outrageous amount of money to bring the nannies and their families here?
(were they taking a cue from Cosby in the bribery department?)
> then to have the nannies state they were afraid of CNN’s L. King?
> or to have the nannies say their testimony was not true they got the story from a movie?
> Ford Shelley disavowed the initial lies of HKS when put under oath in a criminal court due to being worried about perjury! Besides, how credible is a thief who was proven to have stolen personal the items by his own admission, then you have the staged refrigerator pictures and within hours had it ‘set up’ to COPY hard drives?
>> Where did he get that courage? Was he paid? What part did the TX people have with this along with the help of S. Brown?
There were many who lied, there were many who wanted HKS out of the position of being Executor for many reasons.
(NOT just control of the Marshall litigation) it was also because others wanted to control the trust of a minor, in my opinion.
There is prior legal transcript of the following facts:
~ Larry stating when and how he was contacted by TX people to lie, to stand with them to try and eliminate HKS from the picture.
~ When Larry told the Judge how the prosecution approached him during the prelim trial.
~ the recanted lies on the stand during this mock of a trial…
~ the outright lies from the nannies…
* THE SERVING OF KAPOOR (1/6/11) WAS BECAUSE THE PROSECUTION FAILED BEFORE~~ (what timing!) what idiots in my opinion~
** WHO FILES 11 COUNTS OF FELONIES AND SUDDENLY DECIDES TO ASK FOR PROBATION?
*** WHO IN THEIR RIGHT MIND SPENDS MILLIONS FOR A TRIAL ON TRUMPED UP CHARGES THAT HAD NO TRUTH? JUST LIES FROM GREEDY PEOPLE TRYING TO GET HKS OUT OF THEIR WAY? >> also, a governor elect’s office of the DOJ wanting some publicity!
The people in the cash-strapped State of CA should be outraged!
It would have taken a fraction of that amount to pass legislation to make the laws clearer!
To work with the Medical Board and legally make it known to the pharmacists, the hospitals, and doctors just how far they are allowed to go with trying to keep public figures medical files private.

>> WHERE ARE THE LAWS to prosecute harshly those instead of letting them keep their thousands from the tabloid media and just losing their job?

~ For heaven’s sake! If they do they should also have to file charges of false names to the hospitals that used aliases for Anna, the pharmacists that used aliases for Anna, and the doctors (years before Anna even had met HKS) had used aliases for Anna!!!
CHANGE THE LAWS TO SET PRECEDENTS!
QUIT WASTING A STATE’S MONEY FOR POLITICAL GAIN!
IMO > Brown should not live in the Governor’s mansion and pay his own rent for this clear blunder so the State of CA can be partially reimbursed for this publicity stunt from the CA DOJ and the CA DA’s office!
I agree with what HKS said in an interview! Can you imagine the defendants who cannot afford legal representation for other unethical charges trumped up for personal political gain or just being star struck like in the shambles of lies in the MJ molestation case?
That too was political! If you add that past trial to this one the needless money spent could have helped so many displaced poor or helped any of the State’s disadvantaged instead of just flushing it all down the toilet!

I agree John. The honesty of witnesses was so much a part of this case and it was obvious from the very beginning that their stories changed as time went on or the size of the check book. To base a case in Law using witnesses like this has to be followed up…

Justice prevailed against these fraudlent charges brought by the prosecution and Jerry Brown. There was no conspiracy, perhaps misjudgment but no conspiracy.
BETH—-The only book a Dr would write on a pt,would be if the pt has a unknown disease,or problem and that would,with the pt permission be written in the medical books,I did want to ask you,why should Vergie have been consulted for the outcome ? which part of Marcy’s law gives her that right?Dr E is a psychiatrist, what would writing a book on a former pt do to her reputation,Her logic I never understood.
Early on in the trial it seemed as though the Judge would throw this case out. I’m just surprised it went as far as it did before he did. I suppose he had believed that the jury would throw it out for him. It seemed as though the jury was trying to find SOMETHING to convict SOMEBODY of, and settled for those charges. Thankfully, the Judge set things right. It was a long time coming, and it’s unfortunate that so many people had to suffer through this non-case for so many months.
#9 Kate the transcript of the Jan. 6, 2011 hearing, Judge Perry states he should have ruled differently on things the D. A. presented during the preliminary hearing BUT DID NOT because the case was to be tried by another judge and he did not want to second guess or rule on things the “trial judge” should. Professional courtesy. Judge Perry in this transcript comes across as doing a lot of reading and research before the Jan. 6th hearing and laid out in simple but a clear record of his decision if the D. A. decides to appeal. There is also some humorous things Judge Perry says in this transcript. I will try to get that up today with my final article on this trial today. I wanted our two guest authors to present their final views since they live in California and knew some of the ppl involved in all of this.
I just wanted to say that as things come to a close on ‘all things Anna Nicole’ here at Rose Speaks that I can’t think of a better ending.
I’m so glad that Howard and even Anna as a chronic pian patient were vindicated. I’m a chronic pain patient too and my husband has to help me with my medication so I get what Howard must have gone through. I’ve always believed in Howard’s love and devotion for Anna. I hope the future will bring brighter days for him.
Beverly I have to say you have a funny streak…….’Blow it out your ear’ ???? That is funny, as the original orifice is a little lower as I recall. Some are confused as to the ‘book’, it would have been from the perspective of what all the ‘players’ did and her observations. Certainly it was not a book on her medical thesis as to what made Anna Nicole tick! LMAO Quite frankly the minion and the ring master would have been a best seller in the world of dark comedy! I am happy as a tick on a fat dog and wish all of these people the best…Howard is going to be fine with his license to practice…..Da Docs on the other hand have an agency called the state medical board……not a nice group! They wanted their licenses a long time ago…..not timely and now it is there turn.

When I first read on the 6th that the BS was set aside by the judge, I was a very happy camper. It made no sense in the very beginning. It made no sense! It will be hard, but hopefully Dr. E and Howard can move forward with their lives. I feel they both will be alright. This is justice, and how sweet it is.

Hope this will be the end as California is bankrupt.I friend from the Northern part of the state told me the other night that I would be surprised at the subdivisions that are empty of people.beautiful homes but no one lives in them now.She told me it was really bad out there.She shares a home with her daughter and grandaughter and their children to make ends meet.It takes all of them to keep things together.She is 75 now and has heart problems(stents put in),At least she doesn’t face Jan Brewers death panels in AZ.
I wish good luck to both Doctors and especially HKS and his family may they all get on with their lives.

Morning All just wanna give an update on my Son… well as of this morning he is on his way to Parris Island SC, so now I’m waiting for the call that he arrived and from what I’m told it’s an early am call. He will be there for the next 13 weeks and let me tell you all… this is gonna be the longest 13 weeks of my entire life, UGH!!! I’ve never gone so long without talking to or seeing him. Actually the next five years is gonna be hell for me but an adventure for him. I’m very proud of him for wanting to serve and protect our Country. The only thing that keeps my mind at ease are the words my Dad said to me before my baby left… “He’s a smart and intelligent man and he’s gonna be OK!” I wish my Mom could be here to share this experience with me but I know in my heart she is and that she will be watching over him when I can’t.
OK now time to read these new articles.

JMA [21] Not sure bout the Marines, but when I went through basic training for the army, they made sure you wrote home at least once a week, and after the first phase of it (the first 3 or 4 weeks of basic, not including processing) you got to use the payphones on sundays.
Ken [23] he will only have an hour a day of free time and as far as I know besides the call I will be getting after his arrival I may not get another until close to graduation
I guess I’ll have to wait and see what he writes me.
I guess his Recruiting Officer didn’t know how close I lived to the Hotel [it's about a half mile] cause around 9:30 [curfew was at 10:00pm] last night my boy came walking in to tell me goodbye one more time

John, they may have served papers, but where does this go? They will be able to keep their licenses. Why doesn’t the MB take the hospital license away for treating celebrities? They do the same thing.
Why not other doctors that the MB knows do it? I think the MB will have a problem. By the way, you tickle me to death with your statements and/or questions.

With Dr. E being a psychiatrist she can still practice as a counselor if they investigate her and decide to take her license or even her script writing privledges…… As for Dr. K. there are still things he could do as well but I don’t see them taking his license. He may be fined or reprimanded in some way but it doesn’t automatically count him completely out.

Last week, two conspiracy felony charges against Howard K. Stern in the Anna Nicole Smith drug case were dismissed. Now, Stern sits down exclusively with ET’s Mark Steines to share his feelings about the experience.
“I feel vindicated,” says Stern. “I feel Anna’s vindicated. The truth about her came out, as opposed to the fiction and the lies that the prosecution was trying to show.”
Stern, along with doctors Sandeep Kapoor and Khristine Eroshevich, was accused of illegally providing drugs to Smith. All pleaded not guilty to the charges. On Thursday, a Los Angeles judge ruled there was no evidence that Stern intended fraud or deception when he got drugs for his former client/girlfriend under fake names. Smith passed away of an accidental overdose in a Florida hotel in 2007 at the age of 39.
“This case should have never been brought [to trial]. It was brought for improper reasons. It was brought for publicity, for politics, at any cost,” says Stern. “The toll that this has taken on my parents, there’s no way to describe the damage, it’s irreparable. You can’t get back these years, and the lies that we have lived through.”
Of the picture the prosecution painted of Anna Nicole’s state of being in the days leading up to her death, Stern comments, “I was angry. Extremely angry with the way that they wanted to portray her as basically cowering, locked up in a room. It’s so far from the truth, and they essentially discounted entirely the effect of [her son] Daniel’s death on her, and how emotional she was, and they discounted her pain, her real pain. And they just basically said … she’s just an addict, and the whole story they were trying to put on was a lie.”
Now that the judge has dismissed the conspiracy felony charges, Stern contemplates his next movie.
“I kind of have to let it all sink in, and then see what’s left, but one of the things I’ve been thinking about is doing some criminal defense work, because I see how prosecutors can be,” he says. “When it comes to a person’s life, there should be an objectivity, and it shocked me that there wasn’t. What [my lawyers] did for me, I’d like to do for somebody else.””

I believe we all have a guardian angel who watches over us.They may not be able to stop everything but so many times in my life I could have been killed and wasn’t by the grace of God.
