June 24, 2009 rehearsal (Michael Jackson’ s last rehearsal:
…KO: He was bold, active, and participating in the entire production. Had a conversation with Michael. We had two wonderful days of rehearsals. (He was?) feeling good, confident. (One) could feel it everywhere in the entire room. (I) Asked Michael if he was happy. He said he was very happy. Said he felt very good there in the room and appreciated (everything and) to tell the crew and everyone that he really appreciated ( everything).
(For the following day, the 25th) He was very excited since he was going to rehearse an illusion.

He was excited about the illusion trick they were going to rehearse the next day. That concluded the rehearsal. Michael said goodnight and they finished shortly thereafter.
June 25, 2009 the Day Micael Jackson died:
6/25/2009: At some point he learned that something happened. He received a telephone call while he was rehearsing. Earlier, he had spoken to Randy Phillips and was on his way to rehearsal. I asked him to, “Please let Michael know how excited I am and how much I look forward to rehearsals.”

The judge has also set aside several felony convictions against a doctor who

Judge Robert Perry dismissed all but one conviction against Dr. Khristine Eroshevich. He reduced the remaining conviction to a misdemeanor, fined her $100 and ordered her to serve a short time on probation.

DA to appeal Anna Nicole Smith drug case

LOS ANGELES (AP) — A prosecutor has denounced a ruling dismissing the drug conspiracy convictions against the late Anna Nicole Smith’s former boyfriend Howard K. Stern and her psychiatrist and says he will appeal.
District Attorney Steve Cooley says the decision Thursday by Superior Court Judge Robert Perry diminishes the huge social problem of prescription drug abuse facilitated by unscrupulous medical professionals.
Cooley also says the ruling denigrates investigative efforts by the state Department of Justice and the state Medical Board.
The judge allowed only one conviction to stand against psychiatrist Khristine Eroshevich for obtaining a Vicodin prescription under a false name. However, the charge was reduced to a misdemeanor and she was sentenced to probation and a $100 fine.

Superior Court Judge Robert Perry found that Stern never had the intent to defraud when he used his name and others to protect Smith’s privacy when he obtained prescriptions for her.
Perry also found that psychiatrist Khristine Eroshevich was acting out of concern for Smith and cited her long career and service to the community in deciding to sentence her to no more than one year of probation and a $100 fine for obtaining one Vicodin prescription under a false name.
The ruling marked the denouement of a long-running drama centering on the blonde beauty’s troubled life, which was documented on reality TV, in tabloids and in trial testimony. Smith also made headlines in a continuing $300 million court fight with the estate of her oil tycoon husband.
Both Stern and Eroshevich said later they were pleased and believed Smith would be happy with the outcome.
“This case never should have been brought,” Stern said outside court.
“It has been four years of my life,” he added, referring to the span since Smith’s death.
Stern said he had not had time to grieve in the interim and now hopes to examine his options and move on with his life.
“I’m very happy,” said Eroshevich. “I can live with the misdemeanor.”
She added, “I don’t want to be a martyr. Everyone makes mistakes.”
Perry had said in September that he saw weaknesses in the prosecution case but felt he had to let the jury decide most of the charges. He said that in the past he had changed verdicts when he did not agree with them.
At that time, he dismissed two charges against Stern.
“I don’t think there’s evidence that a layperson knows it’s illegal to write a prescription in another name for a celebrity,” the judge said then, noting that Stern is not a doctor.
Jurors handed a total acquittal for Dr. Sandeep Kapoor, Smith’s primary physician. But they convicted Stern and Eroshevich of conspiring to violate the false name statute to obtain pain killers for the former Playboy model. Eroshevich also was convicted of obtaining Vicodin by fraud.
Kapoor came to court Thursday for the sentencing of his former co-defendants.
“I’m here to support them. This was four years of my life and today is finally closure,” he said.
The case was launched last year amid much fanfare by then-California Attorney General and now-Gov. Jerry Brown who denounced the defendants as conspirators in over-prescribing prescription drugs to Smith, whom he called “a known addict.” He accused the defendants of being lured by Hollywood glamor. After a three-week preliminary hearing and a nine-week trial, jurors essentially rejected those claims and convicted on few of the 11 charges. Witnesses said Smith was not an addict but a woman struggling with chronic pain.
This week, prosecutors advocated sentencing both defendants to five years of supervised probation, 300 hours each of community service, with Stern working for Caltrans, California’s highway maintenance department. They suggested Eroshevich’s community service be directed by the California Medical Board and that each defendant pay a $5,000 fine.
Their sentencing memo also asked that Eroshevich, 63, be barred from prescribing controlled substances, which would severely limit her ability to continue practicing medicine. Her lawyer argued she has already lost her reputation and much of her practice and nothing is to be gained from further pillorying of her.
Both Eroshevich and Stern, 41, could have lost their professional licenses if their felony convictions stood.
Stern had been Smith’s lawyer, manager, lover and friend since they met in 2001. His lawyer argued that Smith was the love of his life and he would never do anything to harm her.
Eroshevich was described as a caring doctor and friend who flew to her side in the Bahamas after Smith’s son died of a drug overdose and she went into an emotional decline.
Smith died after suffering a drug overdose in a Florida hotel room in 2007. The death was ruled an accident and the California defendants were not charged with causing her death.

Judge tosses all but a misdemeanor in Anna Nicole Smith drug case

Los Angeles (CNN) — A judge Thursday set aside the convictions of Anna Nicole Smith’s lawyer-boyfriend Howard K. Stern and all but one against her psychiatrist.
The multi-million dollar, two-year prosecution of Smith’s two doctors and Stern resulted in a $100 fine and one year of unsupervised probation for Dr. Khristine Eroshevich.
The charges were pushed two years after Smith’s death by then-California Attorney General Jerry Brown, just before he launched his successful run for governor.
“Today, a judge has told him ‘You know, you should’ve kept your mouth shut to begin with,’” Stern defense lawyer Steve Sadow said. “There wasn’t a case here and you shouldn’t have brought it.”
A third defendant, Dr. Sandeep Kapoor, was acquitted by a jury in October.
Stern, Eroshevich and Kapoor, who are not charged in Smith’s February 2007 death, were accused of conspiring to feed the drug addiction of the reality TV star and Playboy model and using false names to obtain the drugs.
The court concluded that their “overriding purpose was to protect her privacy,” and there was no evidence Stern knew using a false name for a prescription was illegal, Perry said.
The only remaining count out of 23 charges was against Eroshevich for using a false name to write a Vicodin prescription for the actress.
“There is no doubt Dr. Eroshevich acted out of heartfelt desire to help her friend,” Los Angeles County Superior Court Judge Robert Perry said as he reduced it from a felony to a misdemeanor.
Eroshevich was by Smith’s side much of the time when she was grieving over the death of her son Daniel Wayne Smith in the Bahamas, six months before her own death.
She said she felt “completely vindicated” by Perry’s decision to drop all the charges but the one misdemeanor.
“I can deal with that,” Eroshevich said. “It’s not going to be the end of the world. It’s not a felony. It’s not jail.”

Attorney objects to paparazzi’s ‘disgusting’ Anna Nicole Smith comment

Los Angeles (CNN) — Some boots are made for walking — just ask In Session correspondent Beth Karas.
Moments before being interviewed live on “In Session” on truTV, Howard K. Stern’s attorney, Steve Sadow, walked off camera after a paparazzi made a “disgusting” comment about his boots.
“What kind of skin is that on your boots?” asked the paparazzi. “Uh, dead,” replied Sadow.
After a beat, the paparazzi asked, “Like Anna Nicole Smith?”
Visibly upset, Sadow yanked off his microphone and led Stern off camera, just as “In Session” host Vinnie Politan prepared to toss to them live.
“You know, that is a disgusting statement … that was just terrible,” said Sadow.
Sadow then leaned into Karas’ shoulder to apologize before walking away with Stern.
Karas was set to interview Sadow after a Los Angeles County judge set aside Stern’s conviction, saying there was no evidence he intended to break the law by using false names to obtain drug prescriptions for Smith.
The paparazzi who made the comment has not been identified.

Sammy1 (20) on about the part 11:05 when Harvey is talking about what Steve Cooley said and about the part were Mr. Sadow explains what Judge Perry said.
Sadow said about Cooley considering retrying Howard on the charges on which the jury was hung, He said he can’t do that and maybe he should read what the Judge said, The Judge has not only thrown out the two guilty verdicts he has decided that there is insufficient evidence on the hung counts or hung targeted offences as well and dismissed those as well, there is no retrial for those they are all dismissed, they are gone. If he wants to take it up on appeal, more power to him. etc…
~Now I understand that Cooley can appeal but I highly doubt he will, I really like Mr. Sadow, I like his attitude, he seems like a NO BULLSHIT type of man, I have not heard any mention of Rene Rose today, I wonder if she was there, iirc I thought she was the lead prosecutor in this case, I look forward to reading Daniel’s article about what he heard today. As TMZ first reported in November, Katherine Jackson told Alejandra and the kids — fathered by both Jermaine and Randy — not to return to the residence. Alejandra is refusing to move herself, her kids, and her stuff out … so the estate has gone to court.
As TMZ also previously reported, the house is scheduled to be renovated — but sources tell us Alejandra is holding the remodel hostage by refusing to leave.”

I am so glad for Howard that this fiasco is finally over! Look at the hell so many people have been put through!
If any good is to come from this – people should look long and hard at the corruption of power that is going on in our judicial system! That an Attorney General allowed himself to be influenced to prosecute someone by “big-shots” from another state (with a lot of money and a personal vendetta) and to also use the that publicity to run for Governor should have people running scared! We had a front row seat to witness the abuse of justice that goes on all over this country but usually never gets the exposure that this case did. Sadly – so sadly – that Jerry Brown was elected Governor BY THE PEOPLE! I hate to say it but if the majority of people in California are that ignorant they deserve the troubles their politicians have brought on them. No wonder so many people are moving out of that state.

For those who want to (and did in Anna’s situation) jump to conclusions – stress greatly increases chronic pain (I know from experience). I have total sympathy for what Anna must have been experiencing with the heaps and piles of stress she had to endure during the final part of her life. I too lost a son and that alone was nearly unbearable! I pray no one ever has to endure (physically and emotionally) what that poor woman went through.
I know this will be beyond some people’s ability to understand but those Doctor’s and Howard were desperately trying to keep Anna alive. Too bad the person they left her with when they had to leave her at the hotel for awhile was chose to watch the computer instead of watching Anna!
I hope Howard and the other’s who endured this witch hunt can now begin to heal and find some way to pull their lives together. Thank heaven’s for a wise judge who did the right thing!

All this time she has been riding on the coattails of Michael Jackson and Janet Jackson. Even Jermaine new wealthy wife won’t give a dime towards the support of her hubby’s first children. Tell-All Book At the Root Of Jackson Family War

“Katherine Jackson’s war with Jermaine/Randy’s baby mama Alejandra Jackson is all about a tell-all Alejandra is working on … sources directly connected with the family and the dispute tell TMZ.
We broke the story … the Michael Jackson Estate has filed legal papers trying to evict Alejandra and her kids, Jaafar, Jermajesty, Donte, Randy Jr. and Genevieve from the family home in Encino, which was owned by MJ and now the Estate.
Now TMZ knows what has lead to this legal showdown.
Katherine and her lawyers asked Alejandra and her kids to leave months ago, following the stun gun incident with Jaafar. Alejandra lawyered up, and the Estate put an offer on the table — the Estate would give her a condo, but in return she’d have to sign a confidentiality agreement and promise, among other things, not to write a tell-all book.
We’ve learned Alejandra refused to sign a confidentiality agreement and is in “active negotiations” for a tell-all.
When Alejandra was in Japan last month with her kids, everyone assumed she was going away for good and Katherine temporarily moved out to remodel the house.
But Alejandra came back, moved back in, and refused to leave, stalling the remodel.
Sources say Katherine’s lawyers called the cops last week to forcibly evict Alejandra, but the police said they couldn’t do anything without an eviction order … which is why the Estate is going to court.”

Thanks Beth, didn’t see that about a book deal. JMA… she writes book, prolly will tell all sorts of lies and it will bite her in the ass like it did so many others. She had kids with the Jackson brothers, had kids and expects the Jackson Family Trust to take care of her lazy ass and her children’s.
Maybe the estate should file for child support from her and make her prove just how much she has contributed to her childrens care.
I did know that Katherine wanted her and the children out ever since that stun gun incident which one of her unsupervised children had ordered. Some mother there huh?

Anna Nicole Smith doctor subpoenaed by med board

LOS ANGELES (AP) — Anna Nicole Smith’s primary doctor, who was acquitted in the late model’s high-profile drug prescription case, has been subpoenaed in a separate investigation, his attorney said Friday.
“It’s outrageous,” said Ellyn Garafalo, who represents Dr. Sandeep Kapoor. “This shows that this is a vendetta.”
She said Kapoor was standing outside the courtroom where a judge dismissed most charges against Kapoor’s co-defendants on Thursday when he was handed a subpoena by a process server representing the California Medical Board.
Garafalo said the board is investigating cases unrelated to the Smith case.
She said Kapoor has treated many severely ill patients and has written numerous prescriptions for them.
Kapoor was tried with Howard K. Stern and psychiatrist Dr. Khristine Eroshevich on charges of excessively prescribing opiates and sedatives for the former Playboy model. A jury acquitted him of all charges.
After a long and costly trial prosecution, Superior Court Judge Robert Perry threw out conspiracy convictions against Stern and Eroshevich, allowing one charge against her to remain but reducing it to a misdemeanor.
Garafalo said she has learned that official costs of the prosecution are close to $4 million, that the defendants each spent up to $1 million on their defenses and that their reputations were severely damaged. Proceedings before the medical board could increase legal costs.
Both Kapoor and Eroshevich face potential problems with the medical board.
A spokesman for the medical board did not respond to an e-mail from The Associated Press.
Kapoor came to the hearing in support of the others, he said, and because he wanted to experience closure of the case. He said he had returned to a busy practice and his patients had remained loyal to him.
A number of doctors and lawyers said Friday that the fallout from the trial could discourage doctors from taking celebrity cases.
“What doctor wants to put himself through this?” said attorney Harland Braun, who has represented physicians in other high profile cases.

Good Morning all—-For those on the other site having a problem why Judge Perry said one thing at the preliminary and gave a different verdict,for one the preliminary was to show if there was enough evidence to bound over for trial,For another at trial Judge Perry got to hear, what a liar moe was,a liar the nannies were,after getting trip paid for for there entire family moving done by taxpayers of Cal,and then the paid off nannies recanted there statement which they so often did. Then the recanting oF FS/GBT.And I think the judge saw what the whole sorted mess was about,What a miscarraige of justice to convict on the testimony of LIARS.Yes,Howard is a lawyer,which poves to me,and it must have proved to the Judge,Howard had NO ILL INTENT,otherwise he would not have lent his name on those bottles of meds.If you want to harm someone ,sure as hell,you would avoid,the obvious.

“Jermaine Jackson cannot come back to the United States of America … because he owes a fortune in back child support … TMZ has learned.
Jermaine is currently in Ouagadougou, Burkina Faso, Africa. We’ve learned his passport has expired and he can’t get a new one, so he’s waylaid there.
Here’s what we know. n May 2008, Jermaine’s baby mama Alejandra got a child support order, requiring him to pay $3,000 a month. Jermaine went into arrears almost immediately and, as of last month, he owed $91,921.
Under California law, when someone owes more than $2,500 a month in child support, the State Department of Child Support Services automatically informs the feds of the delinquency, and the feds then flag the person’s passport. Once the passport expires, it will not be renewed until the person becomes current on child support obligations.
Our sources say Jermaine’s passport expired during his trip, he can’t get a new one and he’s stuck overseas.
If Jermaine doesn’t clear up the debt, it’s unclear if the American Embassy will come to the rescue … though we’re told in these situations the Embassy will often issue temporary papers so the person can return to the U.S.”

Wonder if she told the CA Courts she had to pay no rent when she got that order?
They usually base the order on both parents’ income, then have a formula for the support…
’07 must have been a good year for his earnings if she got the order in early ’08, if he has not made
as much his lawyers should have filed for a modification of amount…
*most people do not bite the hand that feeds them! I have a feeling Alejandra will be sorry she has stepped on Katherine’s toes.
It also could be a big jealousy of MJ’s kids moving into the house. I was thinking awhile back when I heard about the stun gun incident,
what a culture shock for those three kids to go from one lifestyle to another and in the mix you have unsupervised kids they can learn
some habits maybe you’d not want them to know! Bet, this has been hard for Katherine too!
