L Lin Wood

In the South Carolina federal Court the Estate has filed it’s Reply to Susan M. Brown’s Response in which she states L. Lin Wood charges to much!!! I personally think it was reasonable especially if you look at some filings against attorneys in other venues for Sanctions and Contempt. Which then begs to ask, how much is Brown’s time worth and/or billed to clients?

Jury selection is scheduled to began on January 13, 2011 in South Carolina but I just don’t see this going to trial but rather Brown’s insurance paying and getting damage control under way to restore Brown’s reputation.

Bringing up Brown’s reputation, I am sure most of you read in my 2010 deposition in the Texas case where I was told by a representative for Susan M. Brown, that she was going to sue this site and ME for damaging her professional reputation. I have been very hesitant to write anything about Brown following that. Believe me three plus years of being tangled up in lawsuits with people you have never met, is enough for a life time. That said, if Brown is going to put herself out there with having an Order by a Court to Sanction her for Contempt, then do we have an obligation to cover it as we do all things Anna Nicole Smith? I personally don’t believe this site has ever published anything harmful, [unless you consider the truth harmful], to any of the people in this saga of overlapping jurisdictions and lawsuits. We have stated over and over we know NONE of these people, have little to no contact with these people directly and we have learned to ask both sides for comments on the record.

The rule of thumb here is going to be would I cover the lawyers I “like” if they were brought up on Sanctions and for Contempt, the answer is YES, therefore we are going to cover this using the same criteria as we would if it was say, Wood.

Should Susan M. Brown be worried about what a small time blogger has to say about her? Shouldn’t she be more concerned about her career and trying to restore her reputation as an ethical attorney? IF there is a Georgia State Bar Complaint against her we will never know that, but I would bet money with what two federal courts have said about her in Opinions she is being investigated and if not then the State Bar of Georgia has seriously dropped the ball on Brown.

Here are the latest filings in the Anna Nicole Smith Estate through the Executor, Howard K. Stern’s vs. Susan M. Brown, attorney, and others in recovering Estate property.

I think we can see the writing on the wall as soon as L. Lin Wood moved on to other cases and let Luke Lantta and Nicole Jennings Wade finished up this last major lawsuit involving Smith’s Estate .

November 11, 2010 Susan M Brown’s Notice of filing Affidavit as the Court ordered her to do.

November 11, 2010 Susan M. Brown’s Affidavit stating that none of the Estate’s property or any copies are in her procession. It details the actions she took to double check everything.

December 9, 2010 Susan M. Brown’s Response to Howard K . Stern’s bill as the Executor of the Estate of Anna Nicole Smith. Brown complains about how much money the Estate attorneys charged. Brown asks for a 25% reduction on the bill for $14,000+ but then goes on to really ask for a 50% reduction and that is based on what ? That Wood and team are better attorneys then Brown but still does not deserve to be paid for their work on the level of Wood’s abilities for his clients?… Yea that is going to fly, NOT!!!

December 20, 2010, L. Lin Wood’s Reply on behalf of the Estate of Anna Nicole Smith that basically says, oh Really, want to see the emails? Yeppers everyone keeps emails now especially lawyers trying to reach an agreement on anything, even something as simple as filing a joint status report the Court asks for.

With all of this said, I do hope we get to follow some of these attorneys who do defamation suits on high profile cases like L. Lin Wood and Jackson Walker over the years to come, both of them are the tops in the country and usually on opposing sides.

When I mentioned “All things relating to Michael Jackson, to Ken his first statement was “Rose your health can’t handle being pulled into any more legal wrangling”. Yes but we have great guest writers and what is pulling a few legal papers was my response to him. .

We are going to attempt to have someone in the court on January 6, 2011 for the judges ruling on pending motions filed by Steve Sadow and Brad Brunon to reduce the charges or for a new trial and of course for any sentencing the Court imposes on Dr. Khristine Eroshevich and/or Howard K. Stern.

    Thanks hmm….interesting link. Anything else out there I wonder…. when she threatened Rose by threatening to sue using the O’Quinn LAw Firm was an interesting time….we left her alone. But doesn’t look like she is a Sacred Cow anymore.

    You bet if it was Lin Wood in the same situation everyone would be all over it.

    I think the fee argument is just that, an argument.. she will argue every point and try and delay this case getting to Court. I don’t think she can take the fact finding and evidence in an open Court and still be a Lawyer afterwards.

    Prosecutors are urging a judge to forgo prison terms and sentence Anna Nicole Smith’s psychiatrist and lawyer-boyfriend to felony probation, community service and fines.

    The suggestion is in a sentencing memorandum filed Tuesday in the case of Dr. Khristine Eroshevich and Howard K. Stern who are scheduled for sentencing Thursday in Los Angeles. They were convicted of obtaining prescription drugs for the late Playboy model under false names.

    Their lawyers want their convictions reduced to misdemeanors, dismissal of charges or a new trial. They say using fake names to protect celebrities’ privacy is common practice.

    Los Angeles Superior Court Judge Robert Perry has the option to send them to prison for up to three years and eight months.

    I think the prosecution is rather f-ing bold to ask that HKS work the roads for 300 hours, when they (the prosecutors) had the LYING NANNIES up there on the stand quoting under oath made up stories from a movie portrayed as fact!

    I pray Judge Perry takes all of the proven lies that were revealed in the trial in consideration!
    Looks like the prosecution really does not want to lose a felony conviction!
    It never was about punishment in jail for them, it was always politically motivated.

    The money the defendants had to spend defending themselves on the ‘other’ absurd charges is ridiculous!

    I bet Judge Perry will NOT sentence HKS to working the roads! If he does get sentencing it would most likely be to do pro bono work for the poor!
    The CA Prosecutors and DA’s office are really grasping I think!

    So what does everyone make of the Prosecutions suggestions as to how HKS & Dr. E are sentenced? IMO they fear their case wasn’t either convincing/strong enough and they fear the Judge is going to give HKS & Dr. E very light sentencing like misdemeanors! You know like nothing in the way of a felony.

    LOS ANGELES (AP) — A prosecutor has denounced a ruling dismissing the drug conspiracy convictions against the late Anna Nicole Smith’s former boyfriend Howard K. Stern and her psychiatrist and says he will appeal.

    District Attorney Steve Cooley says the decision Thursday by Superior Court Judge Robert Perry diminishes the huge social problem of prescription drug abuse facilitated by unscrupulous medical professionals.

    Cooley also says the ruling denigrates investigative efforts by the state Department of Justice and the state Medical Board.

    The judge allowed only one conviction to stand against psychiatrist Khristine Eroshevich for obtaining a Vicodin prescription under a false name. However, the charge was reduced to a misdemeanor and she was sentenced to probation and a $100 fine.

    Superior Court Judge Robert Perry found that Stern never had the intent to defraud when he used his name and others to protect Smith’s privacy when he obtained prescriptions for her.

    Perry also found that psychiatrist Khristine Eroshevich was acting out of concern for Smith and cited her long career and service to the community in deciding to sentence her to no more than one year of probation and a $100 fine for obtaining one Vicodin prescription under a false name.

    The ruling marked the denouement of a long-running drama centering on the blonde beauty’s troubled life, which was documented on reality TV, in tabloids and in trial testimony. Smith also made headlines in a continuing $300 million court fight with the estate of her oil tycoon husband.

    Both Stern and Eroshevich said later they were pleased and believed Smith would be happy with the outcome.

    “This case never should have been brought,” Stern said outside court.

    “It has been four years of my life,” he added, referring to the span since Smith’s death.

    Stern said he had not had time to grieve in the interim and now hopes to examine his options and move on with his life.

    “I’m very happy,” said Eroshevich. “I can live with the misdemeanor.”

    She added, “I don’t want to be a martyr. Everyone makes mistakes.”

    Perry had said in September that he saw weaknesses in the prosecution case but felt he had to let the jury decide most of the charges. He said that in the past he had changed verdicts when he did not agree with them.

    At that time, he dismissed two charges against Stern.

    “I don’t think there’s evidence that a layperson knows it’s illegal to write a prescription in another name for a celebrity,” the judge said then, noting that Stern is not a doctor.

    Jurors handed a total acquittal for Dr. Sandeep Kapoor, Smith’s primary physician. But they convicted Stern and Eroshevich of conspiring to violate the false name statute to obtain pain killers for the former Playboy model. Eroshevich also was convicted of obtaining Vicodin by fraud.

    Kapoor came to court Thursday for the sentencing of his former co-defendants.

    “I’m here to support them. This was four years of my life and today is finally closure,” he said.

    The case was launched last year amid much fanfare by then-California Attorney General and now-Gov. Jerry Brown who denounced the defendants as conspirators in over-prescribing prescription drugs to Smith, whom he called “a known addict.” He accused the defendants of being lured by Hollywood glamor. After a three-week preliminary hearing and a nine-week trial, jurors essentially rejected those claims and convicted on few of the 11 charges. Witnesses said Smith was not an addict but a woman struggling with chronic pain.

    This week, prosecutors advocated sentencing both defendants to five years of supervised probation, 300 hours each of community service, with Stern working for Caltrans, California’s highway maintenance department. They suggested Eroshevich’s community service be directed by the California Medical Board and that each defendant pay a $5,000 fine.

    Their sentencing memo also asked that Eroshevich, 63, be barred from prescribing controlled substances, which would severely limit her ability to continue practicing medicine. Her lawyer argued she has already lost her reputation and much of her practice and nothing is to be gained from further pillorying of her.

    Both Eroshevich and Stern, 41, could have lost their professional licenses if their felony convictions stood.

    Stern had been Smith’s lawyer, manager, lover and friend since they met in 2001. His lawyer argued that Smith was the love of his life and he would never do anything to harm her.

    Eroshevich was described as a caring doctor and friend who flew to her side in the Bahamas after Smith’s son died of a drug overdose and she went into an emotional decline.

    Smith died after suffering a drug overdose in a Florida hotel room in 2007. The death was ruled an accident and the California defendants were not charged with causing her death.

    Los Angeles (CNN) — A judge Thursday set aside the convictions of Anna Nicole Smith’s lawyer-boyfriend Howard K. Stern and all but one against her psychiatrist.

    The multi-million dollar, two-year prosecution of Smith’s two doctors and Stern resulted in a $100 fine and one year of unsupervised probation for Dr. Khristine Eroshevich.

    The charges were pushed two years after Smith’s death by then-California Attorney General Jerry Brown, just before he launched his successful run for governor.

    “Today, a judge has told him ‘You know, you should’ve kept your mouth shut to begin with,’” Stern defense lawyer Steve Sadow said. “There wasn’t a case here and you shouldn’t have brought it.”

    A third defendant, Dr. Sandeep Kapoor, was acquitted by a jury in October.

    Stern, Eroshevich and Kapoor, who are not charged in Smith’s February 2007 death, were accused of conspiring to feed the drug addiction of the reality TV star and Playboy model and using false names to obtain the drugs.

    The court concluded that their “overriding purpose was to protect her privacy,” and there was no evidence Stern knew using a false name for a prescription was illegal, Perry said.

    The only remaining count out of 23 charges was against Eroshevich for using a false name to write a Vicodin prescription for the actress.

    “There is no doubt Dr. Eroshevich acted out of heartfelt desire to help her friend,” Los Angeles County Superior Court Judge Robert Perry said as he reduced it from a felony to a misdemeanor.

    Eroshevich was by Smith’s side much of the time when she was grieving over the death of her son Daniel Wayne Smith in the Bahamas, six months before her own death.

    She said she felt “completely vindicated” by Perry’s decision to drop all the charges but the one misdemeanor.

    “I can deal with that,” Eroshevich said. “It’s not going to be the end of the world. It’s not a felony. It’s not jail.”

    Los Angeles (CNN) — Some boots are made for walking — just ask In Session correspondent Beth Karas.

    Moments before being interviewed live on “In Session” on truTV, Howard K. Stern’s attorney, Steve Sadow, walked off camera after a paparazzi made a “disgusting” comment about his boots.

    “What kind of skin is that on your boots?” asked the paparazzi. “Uh, dead,” replied Sadow.

    After a beat, the paparazzi asked, “Like Anna Nicole Smith?”

    Visibly upset, Sadow yanked off his microphone and led Stern off camera, just as “In Session” host Vinnie Politan prepared to toss to them live.

    “You know, that is a disgusting statement … that was just terrible,” said Sadow.

    Sadow then leaned into Karas’ shoulder to apologize before walking away with Stern.

    Karas was set to interview Sadow after a Los Angeles County judge set aside Stern’s conviction, saying there was no evidence he intended to break the law by using false names to obtain drug prescriptions for Smith.

    The paparazzi who made the comment has not been identified.
