Howard K Stern Dr. Khristine Eroshevich and Dr. Sandeep Kapoor

The only consistent thing about Nanny Q and Nanny N is the inconsistencies. The biggest question I have is who thought bringing the “Ninneys” from the Bahamas? Along those same lines did anyone from the DA’s office go and speak to these two people? Now we have nine people, eating three meals plus a day, nine accommodations, and because they are flight risks (my thoughts) there is security assigned to them 24 hours a day! To assure that they don’t get lost on the way to the airport…do they have escorts also? Cha-ching!!! Once again, Judge Perry had it with these Bahamian shenanigans…

From my personal knowledge and not from any of the stooges, Nanny Q was close factually on some of the issues but again, Judge Perry is not going to allow any “sliders” or “spit balls” in his courtroom. It almost seems to me that the prosecutor knows that what she is asking is “wavy gravy,” but what the hell, ask it! And if one of the three barristers doesn’t catch it or the guy in the black robes misses it, Madam Prosecutor wins… …biggest lucky charm was of course the incredible presence of Steve Sadow, Esq. “The Gentleman from Georgia”…and Judge Perry.

The idea that has to gall the defendants is the costs involved in charging them with what was charged. And what about the costs involved for the defendants, for sure if Kapoor is found not… The type of medicine he practices I am not sure if his patients care what his background is. Eroshevich, she is old and will at least… …Howard, who knows, as I said in the past he is very bright on some issues, others, hmm no so much. Did anyone intentionally kill anyone, I don’t think so. Did Dr. Bubbles and Dr. Fabulous try and do the right thing, I think so, and did Howard love Anna not a question in my mind.

…For a law enforcement authority to charge a group or individual, they must have strong evidence that will stand on its own… …Fine-tuning is one thing, but what I have seen so far in the witnesses and experts, fine-tuning, sure like trying to play a piano that fell 10 floors to crash on the street below. …There will always be those who will “really” want to know what happened in the final hours of Daniel and Anna. And the biggest wild card of all, with this being Los Angeles, is the jury pool….

    Quethlie Alexie, who worked as a nanny for Smith in the Bahamas, acknowledged Friday under tough cross-examination in Los Angeles that she signed an affidavit saying she saw Stern, a defendant in the case, inject Smith with a white substance.

    However, Alexie retracted that claim and a number of other statements.

    Stern, Dr. Khristine Eroshevich and Dr. Sandeep Kapoor have pleaded not guilty to multiple charges, including providing Smith with excessive opiates and sedatives. They are not charged with her drug overdose death .

    Quethlie Alexie, who worked as a nanny for the celebrity model in the Bahamas, acknowledged under tough cross-examination that she had signed a sworn affidavit saying she saw Stern inject Smith with a white substance.

    She then retracted that claim and a number of other statements.

    Stern’s attorney, Steve Sadow, asked, “You did not see anyone inject anything into Anna Nicole?”

    “No, I did not,” Alexie testified.

    “And that is the truth?” Sadow asked.

    “Yes, I never said I saw anyone,” the witness said, speaking through a Creole interpreter.

    Sadow then read from the affidavit filed as part of a 2007 lawsuit by Smith’s mother in which Smith is referred to as Mrs. Marshall, her legal name.

    “Didn’t you say, ‘I personally observed a white substance being heated in a spoon by Mrs. Marshall in her bathroom. I then observed Mr. Stern tie a band on her arm and inject the substance into her arm,’” Sadow said.

    At first, Alexie said she couldn’t understand the question, but when Sadow repeated it, she said, “One time I saw something tied on her arm but not the syringe.”

    Sadow tried to ask if she had changed her story because the autopsy on Smith showed no needle tracks on her arms. But the prosecution objected, and the judge barred the question.

    Alexie has testified that she saw Stern, who was Smith’s lawyer-boyfriend, and Dr. Khristine Eroshevich, another defendant, take Smith into a bathroom. When they left, she found a bloody syringe, cotton and burned spoon of liquid, Alexie said.

    Eroshevich’s lawyer Brad Brunon asked Alexie why the witness did not mention the items in her first affidavit provided to an attorney in the Bahamas.

    “I did speak about it, but they didn’t put it in,” the witness said.

    He asked if she began making those statements when she learned she could sell her story for a lot of money. She denied doing that.

    Alexie also testified that Smith was virtually unconscious from drugs for most of the three months she worked for her.

    There was confusion, however, about Alexie’s claim that Smith slept for two days at a time after drinking from a bottle of medicine.

    “When I say sleep, it’s wake up, talk, laugh, go to sleep again,” Alexie said

    Stern, Eroshevich and Dr. Sandeep Kapoor have pleaded not guilty to multiple charges, including providing Smith with excessive opiates and sedatives. They are not charged in her overdose death in 2007.

    Brunon also quizzed Alexie about an explosive claim that Bahamas immigration minister Shane Gibson had a sexual relationship with Smith and gave her preferential treatment in obtaining resident status.

    The claim, along with a picture of him in bed with Smith while fully clothed, led to his resignation.

    Asked if she had said Gibson visited Smith in her bedroom frequently, Alexie said, “No, I didn’t say that … He never went in Anna’s bedroom.”

    To think they used witnesses like this to build a case against 3 people that would ruin their lives. Anna has had a very thorough autopsy, she had Doctors everywhere. She died with the proper levels of her meds except the one she swigged from a bottle… blaming 3 people for her own actions will not bring her back.. enough this is just a painful bullshit and a total waste of money. I don’t know how as practisers of law they can even hold their heads up amongst their peers.

    I would sack the DDA for being a knuckle head for starters.

    Is Virgie still in Court to see this? Did she believe these people? How much did she believe Ford Shelley? Or did she know it wouldn’t hold up. How much has the statements from these 3 alone affected the media, books and the Public.

    I would be looking to recover costs in Texas from a blogger case. Can they do that after being non suited before this case was shown to be a load of crap.

    Harassment and they used the Courts to do it…The South Carolina case should be a good one…..but this has gone way too far and for what???

    #14 Sammy1 I remember this affidavit this is the one that Ford Shelley paid her to do for the paternity suit California in Nov. or Dec. 2006, the one that she said on Mr. Controversy TV that the Ferguson woman prepared and paid her $100 to do, I just watched the video on that where she had recanted it once to Lincoln Bain… what is GOING on in California that NONE of these inconsistencies where checked before paying ALL of this money for 9 ppl, rooms, meals, air fare, etc. and now back to the Bahamas and new apartments???? HELLO can we say a MAJOR conflict here????

    Sadow asked Alexie to explain the pictures.

    “Everything she got they put in her hands to hold up,” she said.

    LOS ANGELES (KABC) — A key witness in the Anna Nicole Smith drug conspiracy case was called into question Friday as defense attorneys dismantled earlier statements by Smith’s nanny.

    Quethlie Alexis had originally testified that Smith slumbered for days, unable to get out of bed because she was so medicated. She portrayed co-defendants Khristine Erosovich and Howard K. Stern as keeping Anna Nicole in a stupor.

    But upon cross-examination by the defense she began to contradict herself, saying, “When I say sleep, I mean wake up, go to bed, wake up.”

    The defense also poked holes in statements she made about a three-day stretch of time when Smith was so out of it she had to be carried out of bed and propped up at a party for her new baby.

    Defense attorney Steven Sadow displayed 20 photos from the baby shower depicting Smith beaming, holding the baby and embracing Stern, Erosovich and the nanny.

    Alexis was also asked about a confidentiality and retainer agreement she signed days after Stern fired her which gave a law firm exclusive rights to sell her story about Anna Nicole Smith.

    The defense questioned whether she had an agreement to get money. She answered no through her Creole translator, explaining that she signed the document without fully understanding it as she did not know how to read.

    According to Alexis’ first affidavit, she was concerned about Anna Nicole’s suitability as a mother, and her “flagrant” sexual relationship with a Bahamian official who promised to give Smith legal residency and allow her to keep her mansion.

    According to the document, Alexis was also seeking papers herself and complained that her processing was delayed because the official was spending so much time with Smith. The defense attorney pointed out that the nanny had not mentioned any concerns about syringes, needles, burned spoons and drug paraphernalia that she later mentioned in testimony.

    I thought Quethlie last name was Alexis. And Nadine was Alexie. In Dec 2006 NQ said she was married with 1 child. And NQ worked days and NN worked nights. NQ also said that Mrs. Gibson was at Horizons a lot. As well as some friend of the Gibson’s named Shirley. NQ sounded jealous and said that the DL was bonding with NQ and the other ladies were confusing the baby. And that ANS threatened to shoot NQ if the baby ever called NQ momma. Anyways in 2006 NQ last name was Alexis.

    Looks like they will back? the defense still has to do the cross with Nadine? I’ll have to read up on NN’s earlier testimony. She worked from 10p.m. till 8 a.m. 7 days a week. And was the last to be fired. My guess would be that after NQ was fired, NN went into espionage mode.

    And about Stephens. From the document I read, the COA has rescinded their earlier ruling to give Stephens an extension. Stephens reason for the extension was flawed. Not supported by law. So that would be the end of it? MOO

    DDARose would be expected to know full well that the nannies were going to testify falsely; more evidence for dismissal of this fraudulent case and a referral of DDARose to the CA Bar.

    Agent Santiago provided false information at the preliminary hearing as he reiterated information he claimed he had heard directly from the nannies – that being the only thing that tipped the balance toward sending the defendants forward into this malicious prosecution.

    Judge Perry called the nannies’ testimony crucial based on the sale’s pitch for it from the government. Now he has heard first-hand that he was lied to repeatedly by agents of the government.

    JB needs to answer for having used the people’s money to pervert Justice and promote his candidacy. He should be impeached and removed from the AG’s Office now to prevent further harm to the people and the State of CA.

    Why would DDA Rose have any problem with the BAR? She is a prosecutor and a very qualified and highly trained prosecutor, she dont get to pick and choose, she has a job to do. And has done the best that she can with bullshitters, liars, grifters, cons, Star Chasers, thieves and the list could go much longer…..and this goes for ALL involved in the life of Anna Nicole Smith. Come on, I agree that this trial has been a disaster for the defendants, but they did not get to this point in their ‘lovely’ lives by attending, church and temple!
    Remember this, ‘all’ of this ( the life style ) was just ducky and would have gone on forever, that was the plan folks……and I am not going to get into this much deeper, all anyone has to do is to look at the ‘Plan’……and what tactics would have been used to dice and slice those that were seen as a ‘problem’.
    Rene Rose is a class act and I promise you that here career will be fine……….

    What I am about to say may sound harsh and I’m sorry if it does but…… I don’t sit around and think of these people everyday. I do not know them personally. I’m sure if they were family then I would have no problem remembering a birthday or the date of some ones death. Honestly, everyday life is hectic enough right now and I don’t make a point of writing this stuff down on a calander. If I had read and seen it mentioned somewhere else then I would have commented but I don’t go to the other sites so I didn’t see it.

    That it wasn’t mentioned here, I think shows, regardless of what we have been accused of in the past, we are not obsessed at this site. For myself, I have followed this for so long that I simply want to see it to the end and I believe the end is very near.

    I am in total agreeance with you Liann. Assuming, of course, that the Los Angeles DA’s office actually had a choice as to whether, or not, to file charges. JBrown gave HIS investigation to the DA’s office and basically washed his hands of it. Or so JB said. At that point the DA’s office became responsible for ensuring that the criminal charges were in fact provable. And to do their own investigation. I would think that the credibility of witnesses would be top priority. And background information on each of them would be necessary to see that everything was checking out. Which would have revealed a whole lot of nonsense going on, imo.

    Putting my biases aside, I have yet to hear one media report of a State’s witness that in any way proves the charges. Where are these 1000s of documents and 100s of witnesses that JB spoke of? What was found during the search of the defendants’ computers? And what point was made with that handwriting expert? Where is the testimony from CURES? Are they holding that off till the end? Big mistake, in my way of thinking. I would think the CURES testimony alone would prove the charges. And that would have been a good place to start, and then build the case from there. But now whatever remains to be heard from the prosecutor is going to be overshadowed by witnesses that recanted, rescinded, were mad at HKS, etc., etc. This criminal trial is wrong in so many ways, but the most obvious is that the whole situation SHOULD have been handled FIRST by the CA Medical Board.

    I have been thinking about the Pro Se defendants that5 have a hearing on the 13th.If McShame won by default could he in any way use this to go after the others in a new way.We all know how sneaky he is.     John [42] I agree with Liann [43] apparently DARR did not do her homework cause if she had she would have chosen not to put a few [actually all] of these people on the stand. No one [exception of the Doctors or so called experts] she chose as a witness for the State has told the same story twice, each one has told at least 2 or 3 different versions. If she was that damn good she would have went back and read what these witness’s had told either to the media or in other affidavits in the beginning, middle and then end.

    What I would really like to know is who’s paying for the accommodation of those Witness’s who have to travel there from other States or Country’s. Is the DA’s office footing the bill or are the people of the most bankrupt State paying for these people to be put up in what is probably nicer living than what some CA’s are accustom to.

    IMO, DAA was handed a case and told to do whatever…… What was a surprise to me was that most of these charges that were filed was based on a law that had been changed in Sept 2006. Anyone with half a brain knew that the stories would change by these witnesses. The experts that she had testify either looked up their information on the net… (OMG)or placed their “expert opinion” on dealing with Smith for 45 minutes.

    It will be intersting to see how the investigator testifies, since in her depo she admits she is not experienced or trained to perform such a job. I wonder if DC will testify and which version of the story will be stated this time. When will Santiago testify?

    There were shots of Smith feeding and kissing the baby, posing family-style and in a bikini.

    A nanny who testified to Smith’s semiconscious state identified most of the photos and was seen posing with Smith. The prosecution responded with photos of a disheveled Smith sitting on a toilet holding her dog.

    Jurors in the Anna Nicole Smith drug conspiracy case were shown a photo slide show Tuesday of Smith appearing healthy, active and involved with her baby during three months when a prosecution witness claimed she was drugged and barely able to function.

    The prosecution responded to the slideshow by showing a few poor quality photos, including one of a disheveled-looking Smith lying in bed with what appeared to be a medicinal drip apparatus in her hand. Alexie said the picture was taken when Smith was sick and Dr. Khristine Eroshevich, another defendant, installed the device to give her serum.

    Stern, Eroshevich and Dr. Sandeep Kapoor have pleaded not guilty to providing Smith with excessive opiates and sedatives. They are not charged with causing her overdose death in 2007.

    Alexie previously testified she had signed two affidavits about the case in the Bahamas that were untrue.

    With jurors dismissed from the courtroom several times, Superior Court Judge Robert Perry voiced his frustration with the witness and said, “The court sees serious credibility issues.”

    “The state of the record is the witness is claiming to have signed two documents which are not accurate,” he said.

    Perry also reiterated his previous concerns about the case.

    “I think this is a very unfocused prosecution,” he said. “I have problems with the way the evidence is coming out.”

    LOS ANGELES — Howard K. Stern’s lawyer angrily accused a prosecutor Tuesday of encouraging perjury by a key witness at the Anna Nicole Smith drug conspiracy trial.

    Defense attorney Steve Sadow was red-faced as he asked the judge to strike the entire testimony of Nadine Alexie, a former nanny for Smith.

    “I’m considering it,” Superior Court Judge Robert Perry said without making a ruling.

    The dispute involved testimony by Nadine Alexie that she had taught her sister-in-law Quethlie Alexie to recognize Stern’s name on prescription bottles, even though Quethlie Alexie reads no English.

    Sadow suggested prosecutor Renee Rose had encouraged Nadine Alexie to fabricate the story to explain her sister-in law’s statements on the witness stand that she had seen Stern’s name on the bottles.

    When the judge left the bench, Sadow shouted at Rose: “In my whole career I’ve never seen a prosecutor do a stunt like that. You ought to look in the mirror and think about what you’re doing. It’s outrageous.”

    Rose did not respond to the accusation.

    Asked later if Rose would have a comment, district attorney’s spokeswoman Sandi Gibbons said, “Whatever statement she has she will be making in court.”

    Before Sadow spoke, Perry dismissed jurors from the courtroom and appeared to predict what Sadow was going to say.

    “Let’s take a deep breath before we go on,” Perry said. “I don’t want to say something I will regret, so I’m not saying anything.”

    He urged Sadow to consider doing the same, but the lawyer said he felt he had to speak.

    “That was suborned perjury,” Sadow said, using the legal term for encouraging a witness to lie. “The people know this is perjurious testimony.”

    The uproar came after former nanny Quethlie Alexie concluded three days on the witness stand. Under questioning by defense lawyer Brad Brunon about her literacy in English, Quethlie said through a Creole interpreter that she could not read or write English, even though she could speak it.

    Brunon took her through an English language affidavit she had signed trying to determine her skill. She said she couldn’t read the document but had signed it anyway after it was read to her.

    Earlier, she had testified she saw pill bottles of medicine in Smith’s home and read Stern’s name on many of them.

    When Nadine Alexie took the witness stand later, Rose asked how Quethlie was able to read Stern’s name on the bottles. Nadine said she began teaching Quethlie how to read and write English after they went to work for Smith.

    She said she specifically showed her Stern’s name and told her how to read and write it “so if she saw things in his name she would know who they belonged to.”

    Nadine Alexie said she went through two years of college and reads and writes English perfectly. But she insisted she did not read a one-page legal affidavit attesting to her sister’s truthfulness before she signed it.

    “I just didn’t read it,” she said.

    “So you’re in a lawyer’s office with a notary public and they ask you to sign a document and you don’t read it?” Brunon asked.

    “I didn’t read it,” Nadine Alexie said with a shrug but no explanation.

    There has been confusion about the two women’s surnames. Both were originally given as Alexie, but Quethlie later said her surname was Alexis, which is how she signed the affidavit.

    Stern, Dr. Khristine Eroshevich and Dr. Sandeep Kapoor have pleaded not guilty to providing Smith with excessive opiates and sedatives. They are not charged with causing her overdose death in 2007.

    It would be a major blow to an already staggered prosecution case against Smith’s boyfriend-lawyer Howard K. Stern and Drs. Khristine Eroshevich and Sandeep Kapoor. They are accused conspiring to provide drugs to an addict and using false names on prescriptions for Smith.

    “The People (prosecution) know this is fraudulent,” defense attorney Steve Sadow said at the end of the direct testimony of Nadine Alexie.

    Alexie and her sister-in-law, Quethelie Alexis, worked for Smith in the Bahamas for several months after the birth of her daughter in September 2006. They were fired two months before Smith died in a Florida hotel in February 2007.

    Judge Perry acknowledged a problem and advised Sadow to “take a deep breath.”

    “I think we just have to think about this thing,” Perry said. “Just remarkable.” The judge said he would not comment further because he might say something “I would regret.”

    The dramatic exchange came at the end of Alexie’s direct testimony, when prosecutor Renee Rose asked if she taught Quethelie Alexis, her sister-in-law, how to recognize any written words. She said she had taught Alexis, the other nanny to testify, how to read Howard K. Stern’s name.

    This is significant because the defense questioned how Alexis, who is illiterate, was able to read Stern’s name on prescription bottles as she had testified.

    “That is suborning perjury… It’s outrageous and should not be tolerated,” Sadow told the judge.

    Sadow’s attack on prosecutor Rose’s credibility grew more angry and personal when the judge left the courtroom for a recess.

    “In my whole career, I’ve never seen a prosecutor pull a stunt like that,” Sadow said, pointing toward Rose who was still seated at her table. “You ought to take a look in a mirror and figure out what you’re doing. It’s outrageous.”

    Rose sat silently looking away from Sadow.

    When court resumed a few minutes later, Sadow asked the judge to strike Alexie’s entire testimony from the record — and order the jury to ignore it. Perry said he would not do that yet, “but I am thinking about it.”

    Judge Perry had already ordered part of the Quethelie Alexis’ testimony stricken from the record after he said he found it unreliable last week.

    The two nannies, both Haitians who live in the Bahamas, were supposed to be star witnesses for the prosecution. But each has recanted key portions of affidavits they signed concerning Smith’s drug use when she lived in the Bahamas in the last months of her life.

    The defense has also highlighted the financial benefits the Los Angeles District Attorney has given the women in order to convince them to fly to the United States to testify.

    Both women testified that they have been promised two months rent, utility payments and moving expenses so they can move into new homes when they return to the Bahamas after their testimony.

    “I tell them (if) I come to testify I’m going to need to move from where I am,” Nadine Alexie said Tuesday. She said the publicity surrounding her testimony would make it dangerous for her to remain in her current home.

    The prosecution not only paid for the two witnesses to travel to Los Angeles, but they were allowed to bring seven other family members at taxpayer expense.

    “I tell them I would not leave my family behind,” Alexie said. A nephew tagged along with her three children and her husband. Quethelie Alexis brought her two children with her.

    Prosecutor Rose worked to convince jurors that the taxpayer-funded trip has been no luxury vacation, given as a reward for testimony.

    The children have not been taken to Disneyland or even a movie in the eight days they’ve been staying in a Los Angeles hotel, Alexie testified. They’ve stuck close to the hotel watching television and swimming in the pool, Alexie said. The only outing was for two hours to a “little park” on Sunday, she testified.

    The trial is in its seventh week and could extend into October, lawyers said.

    Judge Perry has suggested several times in recent weeks that the prosecution had fallen short so far in proving the core of its case, including that Smith was a drug addict.

    The defense contends that Smith suffered chronic pain, justifying the drug prescriptions in question.

    “If she’s being treated for pain, it’s not illegal,” Judge Perry said Tuesday.

    She was asked by Eroshevich’s lawyer, Brad Brunon, if she told police in the Bahamas that she got the idea from a movie. She confirmed she saw it on TV.

I don’t see any of us asking that this Motion be denied do y’all??

I did learn how to try to comprehend legal papers and without McCabes numerous filings and Rose/Ken’s generosity of posting them, I would not be so informed. Too bad that it had to take these actions tho for that to happen. I started out by saying that I hope the ones that perpetuated this madness, sleep well at night. I still wish the same.

    The prosecution offered the photos to bolster their claim that Eroshevich crossed the line between being Smith’s psychiatrist and her friend when she prescribed medications for Smith.

    Two pictures shown to jurors depicted Smith and Eroshevich naked in a bathtub together. The judge had a black box placed over intimate parts of their bodies.

    In one photo, the women are hugging and smiling for the camera. The second picture was difficult to see because of lighting.

    There have been no indications of a sexual relationship between the women, and the judge previously characterized the photos as appearing playful.

    I must say that I am not surprised at the words that are being said at Topix since the blogger case is now over and it looks like soon the CA case against Stern and others will be over.

    I have read where some have wished harm to innocent children and it sickens me to know that I have posted with some people that are so vile and so full of hate that they won’t even consider the possibilty that they were a tool to be used by a certain law firm. You were played, the sooner you realize that the better off you will be. There is no halo shining brighly above virgie’s head. That law firm used everyone that they could and some refuse to see it. And we wonder what is wrong with todays children… wow. If some of the “adults’ that have been posting their horrible wishes are any influence over today’s youth, we as a nation are doomed. If you believe that it is a morally right thing to do to wish harm on innocent children, then you need some serious help.

    If a court case does not go the way you want to, then the judge is crooked. I doubt that Perry will be overturned on any ruling that he makes. However the same cannot be said about the judge in Texas that granted every little whim that was filed for by McCabe.

    It really is something to witness. I only hope that people would have learned something out of all of this. Sadly they have not.

    KABC7 news just said that defense atty reprimanded by Judge, The Judge said he was disappointed that the defense for Dr. Sandeep Kapoor failed to turn over important notes to the prosecution, notes involved testimony of a expert witness who was prepared to say that the medication Dr. Kapoor prescribed to ANS were appropriate.

    LOS ANGELES (KABC) — A startling photo and expert testimony from a pain management expert marked a series of new developments in the Anna Nicole Smith drug conspiracy trial.

    There were strong suggestions from the judge Thursday that some charges may be dismissed. This comes with testimony from an expert witness going to heart of the case: How much medication is too much?

    Anna Nicole Smith complained of pain in her back, her legs, her abdomen. How bad was it? How does a doctor determine pain levels?

    “There is no objective test, no laboratory test, no imaging study that can be used to determine either the presence or absence of pain, or intensity of pain,” said Dr. Perry Fine, an expert witness in the trial.

    Fine is president-elect of the American Academy of Pain Management, an advisor for medical boards across the nation.

    Fine’s testimony defends Smith’s doctor, Sandeep Kapoor. The internist prescribed high doses of sedatives and pain medication for Smith.

    Now, along with two codefendants, he faces six felony counts for supplying excessive medication to an addict.

    Yet Fine says some patients need a lot of drugs for pain treatment.

    “It is hugely variable,” said Fine. “There is tremendous variation from one individual to another, even up to 50, even 100 times in some circumstances.”

    That assertion is part of the California Medical Board’s standard of care.

    Outside the presence of the jury, the judge referred to the document from the state legislature. It says that the California Intractable Pain Treatment Act was created to protect physicians from being disciplined solely because of the amount of controlled substances prescribed. It called some terms of the act outdated and confusing.

    “The more I read this, the more difficult it is to proceed in this case as a criminal prosecution,” the judge in the case said Thursday.

    As he plans hearings to review the matter, the court released photos of Smith that raise another issue about medical standards. The photos depict psychiatrist Dr. Khristine Eroshevich in a whirlpool tub with Smith.

    The prosecution says it shows a violation of professional boundaries. Eroshevich’s defense attorney says it happened when Smith was suffering from mood swings, and that it was innocent play.

    Prosecutors are not alleging a sexual relationship.

    More is expected about the possible dismissal of some of those charges in the coming weeks.

    So much for SB’s two-bites-at-the-apple argument: SB says essentially in her Motion to Dismiss that she should be not be a defendant in the case itself if HKS/Wood want to proceed with separate contempt allegations and request for sanctions based on her actions as an Attorney. After all, in SB’s mind she complied with Court orders as best she understood them and all this talk of being a moving force in a civil conspiracy (and computer crimes with McCabe) is just crazy.

    News for SB: the many allegations against you are not mutually exclusive. You lost the Attorney-Client privilege long ago due to the crime-fraud exception. Step up and admit your guilt; the TX cabal can now longer help nor harm you.

    “The defense is accusing the prosecutor in the Anna Nicole Smith trial of coaching the nanny of Smith’s infant daughter. The nanny in question denies the allegations. The trial is getting ugly as the judge allowed the release of photos of Anna Nicole with her daughter and boyfriend Howard K. Stern. The purpose was to show how happy and healthy Smith looked. The defense claims she used drugs during much of her last months of life, but the prosecutor wants the blame to fall on Stern.

    “The trial, in its seventh week, took a dramatic turn Wednesday when defense attorney Steve Sadow accused prosecutor Renee Rose of knowingly having Nadine Alexie, a former Smith nanny, lie on the stand,” according to CNN.

    The judge is considering striking the nanny’s testimony, and that would be huge blow to the prosecution. The prosecutors are trying to prove that Smith was given drugs that led to her death. The nanny is a key witness for the prosecution, and if the judge throws out her testimony, the case may be lost.

    Stern may actually walk after one of the nannies recanted her story that Stern melted pills into Anna Nicole’s soup, and then, injected Smith with the melted pill and soup mixture.

    It just doesn’t ring true, and the prosecution is floundering. The nanny has lied before, and her credibility is low with the court. So Howard K. Stern is looking pretty good right now. How do feel about this? The judge is not buying what the prosecution is selling.”

So many lawsuits for one man to experience in a matter of 3 years and for what reason – false accusations, lies for money or for anger and hate. After this case is dropped, there will be a civil case until the court decides that VA is not the next of kin and then maybe HKS can get some peace knowing he kept his promise to Anna. The truth that they knew.

    Sammy1, I could not agree more. Howard did and has kept his promise. The truth as they knew. Every lawsuit Howard engaged in and all BS thrown his way he has never wavered and that alone imo deserves respect. I don’t understand all the ugly. I concur Howard did enable Anna ( whatever one wants to depict enable as) I think Anna was no saint by no means but all this and every lawsuit had a reason and all leads back to the firm imo and Howard defended himself and Anna in every case and I think this is not done for him. I pray one day the ugly goes away and maybe some or most of it has this last week imo
