< We learned yesterday that in the Anna Nicole Smith conspiracy to give drugs to a known addict case that Bonnie Stern testified for the prosecution about her brother Howard K. Stern. You think a prosecution witness would be for the prosecution however that is not the case with Bonnie Stern.
In what must have been a powerful moment in court, Steve Sadow, Howard K. Stern’s attorney had Bonnie Stern described her brother’s love for Anna Nicole Smith by asking “Did you believe your brother was in love with Anna Nicole Smith?” Bonnie Stern’s answer was; “”She was his everything,” I only wish I would meet someone that loved me as much as he loved her.”
Stern’s sister did authenticate and identified emails that Deputy Attorney Renee Rose had stated on August 6, 2010 was the only way to get these emails on the record with the taking the position that Bonnie Stern and Anna Nicole Smith were uncharged conspirators. It appears from the AP report of LINDA DEUTSCH that there were in fact several emails between Anna Nicole Smith and Bonnie Stern where Smith was requesting “the shipments”. Stern’s sister, Bonnie, did not deny the emails but said she couldn’t remember having the items sent to Smith or her brother, Howard K. Stern.
The AP reported, in one e-mail, she wrote she “gave Chris everything” from a doctor in Beverly Hills to bring to Smith. She acknowledged the reference was to defendant Dr. Khristine Eroshevich, but said she didn’t remember giving the doctor anything…
We have to wonder if Dr. Levy was a common doctor used by both Stern’s sister, Bonnie and Anna Nicole Smith. If he is since he is on the prosecution list will his records reflect Bonnie Stern picking up multiple prescriptions for shipment to The Bahamas for Smith. Did Dr. Levy make a deal with the prosecution so as not to be sitting where the other two doctors are today at the defense table?
The AP also said that the e-mails admitted into evidence revealed tensions between Smith and Howard K. Stern. They said in part; “I hurt so much and it seems Howard don’t care,” Smith wrote. “I’m so angry all the time, so sad and mad what can I do. I don’t want baby Lynn to see me so upset. I feel that Howard hates me. All he does is raise his voice and back talk me.” This email was written in late 2006 after Daniel Smith’s death while visiting his mother and new baby sister, Dannielynn. I would bet there has to be more than just this one email and my take is that this was part of the normal grieving process, nothing more unless the prosecution produces other documents and witnesses who say the same thing at different times then this one email.
Anna Nicole Smith expressed in another email to Bonnie Stern that; “She, [Smith], said she felt a need to get away from the Bahamas but couldn’t leave “because of our situation.”
Larry Birkhead testified after Bonnie Stern stating that Anna had many prescriptions around the house and that he felt Howard K. Stern had tried to interfere with his relationship with Smith and even admonished him once when Birkhead hid Methadone from Smith out of worry of the amount of prescriptions in the home and the amounts Smith was taking.
Birkhead returns to the stand today to complete his testimony, what is the bet that Sadow will be able to turn Birkhead’s testimony into that Anna Nicole Smith was However K. Stern’s “everything” and will Birkhead also paint a picture of love between Smith and Stern during the two years he lived off and on with Smith. In a TMZ.com article today the headline says in part; “Do You Swear to Tell the Truth…? That article is already being picked up by sites like Fox News.
Virgie Arthur sat in the courtroom for both Bonnie Stern’s and now Larry Birkhead’s testimony.
My prediction is that even though the Deputy Attorney Renee Rose continues with her building blocks to make her case, is that Stern is going to be found not guilty. As I continue to say, if we convicted and put every enabler in jail there would not be enough room. The love that Howard K. Stern had for Anna Nicole Smith is as predicted by Sadow being attested to by even prosecution witnesses.

Judge criticizes prosecution in Anna Nicole case

LOS ANGELES — A judge delivered a harsh assessment Friday of the evidence and charges against two doctors and a lawyer in the ongoing Anna Nicole Smith drug conspiracy case.
The criticism came as Superior Court Judge Robert Perry reluctantly agreed to let jurors see a videotape of Smith on an awards show in a performance her former boyfriend Larry Birkhead said was considered “loopy, wacky and crazy” by many people.
Perry, however, said outside the jury’s presence that he was concerned about the prosecution’s case.
“It’s the people’s position that Anna Nicole was kept in a drugged state,” Perry said. “They claim she was a pawn in the hands of her handlers and doctors who kept her in a drugged state to control her and her money.”
The evidence so far does not support that, he said.
“I’m seeing a strong-willed person who ordered people around and was her own boss,” Perry said.
Deputy District Attorney Renee Rose protested that she could understand the court’s rulings if the case was going to be decided by a judge.
“But this is a case for a jury.” she said.
Perry said he likely would bar most further video evidence because he has a responsibility to prevent the presentation of misleading evidence such as snippets of edited video designed to show that Smith was drugged.
“It is not our contention that she walked around drug addled for two years,” Rose said.
The judge told Rose he saw the issues in the case as limited to whether Smith was an addict who was getting too many drugs and whether prescriptions were obtained under false names.
He said he was unable to tell whether Smith’s demeanor in the 2004 American Music Awards videotape was the result of drugs or her normal acting style at staged events. He pointed out that a second video given to him by the defense showed Smith making statements four days later that the appearance helped her career.
“She’s fairly entertaining and at her voluptuous best,” Perry said. “It is, in the court’s view, a very strong representation of the Anna Nicole personality … My question is, is any of this real.”
Perry went on to say, “The problem I have with this case is we have a very public figure …. We are a movie-watching, TV-watching nation. And as the defense has said, what we see on television is not always real.”

Heath #22 In full agreement, we are all familiar with edited video … snip … snip. Anna used the baby/whining voice all the time whether it was her reality show, B/C list movies or interviews. Anna wasn’t a top-notch actress, to me, the MD interview was the most honest. Rage and honesty or at least Anna’s honesty poured from every part of her.

Stern have pleaded not guilty to prescribing to an addict as well as conspiring to provide excessive opiates and sedatives to the celebrity model. They are not charged with causing her 2007 overdose death in Florida.
The judge told Rose he saw the issues in the case as limited to whether Smith was an addict who was getting too many drugs and whether prescriptions were obtained under false names.

When jurors returned to the courtroom, they were shown the AMA video as well as a pre-interview in which Smith touted her weight loss on a product she was promoting. In both segments, she waved her arms and was speaking with a slight slur.
Jurors also heard testimony from Birkhead, the father of Smith’s daughter, who fought back tears when he described Smith’s problems with seizures and other ailments.
He said she suffered a seizure the night before the AMA Awards and he had tried to convince her to cancel the appearance, but she refused.
“She was headstrong and she wanted to do it,” he said.
He acknowledged that during the pre-interview, “she came across as being really loopy.”
“Did you feel she was affected in part by drugs?” Rose asked.
“Yes, in part,” he said.
Birkhead became emotional as he described Smith’s health issues.
“She had tons of things wrong with her,” he said. “But she also wanted to be babied. She liked people to cater to her.”
Perry refused to let Rose show a video of Kapoor nuzzling and kissing Smith at a party after a 2005 gay parade. But the prosecutor was allowed to show still photos of the events.
In one picture, Kapoor was bare-chested. In another, he was standing with Smith and wearing a T-shirt with the inscription, “Trust me. I’m a doctor.”
At day’s end, another conflict erupted outside the presence of the jury, when the prosecutor sought to present pictures implying Birkhead had given a piece of Smith’s jewelry to another woman. Perry said the images were not convincing that the other woman was wearing Smith’s necklace.

#41 Heath, Thanks… WOW.. I have a question.. Just because a AG wants to bring charges for whatever reason (wink wink). ( sorry, not really) but does the assigned DA or DDA ( Maybe DA and DDA are one in the same, I don’t know) have a call to say that they will or not prosecute depending on the evidence??.. I guess my question is just this. Must a DA/DDA bring charges because the AG told them too??.. This so sounds like another career killer at the hands of.. ( We all know who ) ..
Good Morning,–while I can see on this computer,I want to say a few things,Howard was correct,and I do wish TV reporters would stop trying to make rating,Larry should NEVER hide Anna ‘s methadone,and she could have died,that has to be done very careful under Dr’s supervision.I do love this judge,Wait till FS, starts with the lies.I do wish the defense would call Vergie,the jury would then know Anna’s most outstanding problem .

As far as I know the AG can or does not have to be involved in every case the Prosecutors bring to Criminal Court.
In the CA case I do think JB was interactively involved! Political posturing for his run for Governor.
Maybe huge donations to proceed in a first time charging of a lay person as an enabler, and so on…
The DA files the complaint or the case can be heard by a grand jury and indictment can be done there.
Depending on how theatrical the DA is on all of this hearsay in this specific case charges can stick and then the defense has to wear away at the charges by proving there is no basis for them or true untainted evidence to prove that the charges are substantiated.

To add to that, I wonder, since they had the evidence they are using from the stolen hard drives…. why did they not present any return emails from any of these people and ONLY the one’s Anna sent? Where are the “answers” to these emails? Where are the mail reciepts for these packages that were sent to the Bahama’s? Things like that are kept track of by the delivery company whether it’s USPS, UPS or FEDX.

Beth VA sits on the same row as the news people (would you expect any different for her to do then seek the news?) I think perhaps Bonnie Stern was nervous and as the pictures recently of VA shows she looks nothing like the last time Bonnie Stern saw her in 2007. I don’t think any of us would have recognized the AP picture of VA entering the court room on August 4, if they had not been clear about who it was. VA is also traveling with David Leigh of Splash at times, I would think as her agent he would encourage her to make sure the AP knows her and watches her…

With prosecutors focusing on Stern, his sister, Bonnie Stern, testified Thursday under a grant of immunity from prosecutors. She identified e-mails in which Smith pleaded for her to have drugs sent to her in the Bahamas. But Bonnie Stern said she didn’t remember sending anything.
Howard K. Stern’s lawyer, Steve Sadow, asked about the personal relationship between his client and Smith.
“She was his everything,” Bonnie Stern said of her brother. “I only wish I would meet someone that loved me as much as he loved her.”

Larry Birkhead, the father of Anna Nicole Smith’s daughter fought back tears in a Los Angeles courtroom today (Aug. 19) while describing the late model’s ailments, including seizures that appeared to be triggered by the dangerous prescription drugs she was taking.
Virgie Arthur, Smith’s mother, also has been in court. She also sought guardianship of baby Dannielynn when Smith died.

You know, I feel sorry for the DA. She got handed a piece of shit case and I would bet she really doesn’t believe in all those charges that were filed. I tend to think she was told to handle this case. So far she has not scored one point in anyone that she questioned, at least in my view.

If the jury decides in favor of the prosecution, how likely is it that the Judge will set aside the verdict? He sure doesn’t sound like he thinks the prosecution has the evidence they need.
When I asked what her response was to the questioning and answers I was told that she WAS NOT THERE. Go figure. hmm, I believe they have the right to set it aside or modify it. I know they’ve done it during sentencing phases of trials (ie, given harsher terms than the jury)
So how far does a Judge let a case go on if he doesn’t believe the case is being made??? It is Anna’s life being pored over to make this case and she is dead and can’t speak for herself.
#63 Ken also I know of a case that a Judge reduced what the jury recommended or the verdict in a famous dog mauling case in San Francisco but the Judge was overruled on appeal, and that was a manslaughter/ second degree murder case. That was such a weird case and the defendants were lawyers and adopted a 39 yr. old prison inmate, it was so nuts.. but I think a Judge has the power in California to go either way.. That was the Lacrosse teacher that was mauled in her hallway and I saw it on Court TV or reports about it. Judges are to make sure what is presented is legal fair and to be impartial for both sides and that the letter of the law is followed. Judge Perry seems to be doing just that.
What cracks me up in this case is that I am doing alot of reading and the spin from the darkside is that Linda Deutsch is biased to the defense and a lousy reporter and the Judge is unbiased because things are not going their way.
My favorite part of this week..
“Ms. Rose, you are overreaching,” he said. “Time and again you are grasping at straws. I’m very concerned about the way this case is charged and being prosecuted. If you’re going to accuse someone, you should have some evidence.”

Don’t I remember reading somewhere that there is such a thing as a directed verdict in California, where at the end of the pros case if the judge doesn’t feel that the pros have shown the evidence to make their case, he can direct the jury to bring in an acquittal?
