May 21, 2010 Art Harris Response to Virgie Arthur Motion for Rehearing. NOTE FROM ROSE: OK I was wrong here, I thought that Harris would let this be ruled solely on the Court Abusing its Discretion violating Rule 171 on appointing a Special Master. This shows how we can all still learn. I did not know that an exhibit to a Motion was in fact a Motion. The Response for Request for Production to Arthur was things that attorneys send out to just the other parties. I did not know because a Protective Order was requested in a Response that once it was filed with a Motion to Compel that part then of itself becomes a Motion for Protective Order once filed as an exhibit to the Motion to Compel. I continue to learn from all of these filings. Looks like the First Court of Appeals got it right the first time around.

“ Howard K. Stern has been accused of threatening a man whom South Carolina police call a “witness” in the Anna Nicole Smith drug trial … this according to a police report obtained by TMZ.
In the report, it says Hatten opened up Stern’s alleged MySpace message on one of the officer’s laptops, which read: “You are in over your head. You are being watched. Keep a look out before everything comes crashing down, do you understand me?”

• Only the second-hand testimony of Agent Santiago regarding his alleged interview with one of ANS’s nannies carrying the day (a nanny who barely speaks English and only briefly worked in the house)
It is no surprise that Renee Rose is associated with Hatten, a violent felon the FBI knows is certifiable in his wild previous claims against HKS. Her desperate case apparently calls for desperate measures – she already is in bed with the riff-raff of the TX cabal, why not one of VA’s favorites.

OMG it says in the police report that…”Officer White was informed that anyone that is a potential witness or is writing a book about Anna Smith in some form is getting Email or something from Stern” he also tells the Officer “he [HKS] has attempted or is suing another Author in New York for his book about Ms. Smith”

What I would like to know is when Hatten went to jail what was the evidence that convicted him? Who was it that file the complaint back then? Was it Anna, Howard or the neighbor? By Hatten’s claim HKS is responsible for him spending time in jail!

A report in the Wall Street Journal indicates that the Facebook, along with MySpace, Digg, and a handful of other social-networking sites, have been sharing users’ personal data with advertisers without users’ knowledge or consent.
The data shared includes names, user IDs, and other information sufficient to enable ad companies such as the Google-owned DoubleClick to identify distinct user profiles. Some of the sites in question, including MySpace and Facebook, stopped sharing the data after the Journal asked them about it. The surreptitious data sharing was first noticed (PDF) by researchers from Worcester Polytechnic Institute and AT&T Labs in August 2009, who brought it up with the sites in question. It wasn’t until WSJ contacted them that changes were made.
Not surprisingly, Facebook appears to have gone farther than the other sites when it comes to sharing data. When Facebook’s users clicked on ads appearing on a profile page, the site would at times provide data such as the username behind the click, as well as the user whose profile page from which the click came. “If you are looking at your profile page and you click on an ad, you are telling that advertiser who you are,” Harvard Business School professor Ben Edelman told the Journal. Advertisers contacted by the paper said that they were unaware of the additional data and did not make use of it.
Facebook has tweaked its privacy policy throughout its history, with the most recent moves to open up more user information to the public drawing heavy criticism and FTC complaints. Users have also had a tough time navigating the site’s often-Byzantine privacy controls, which has led to a trickle of user defections. I only read so far HKS Reply and Motion to Clarify, L.Lin Wood is concise always to the point he makes reading legal documents interesting, he is not one to stoop to ridiculous repetitiveness filled with insults in his filings, he does not get caught up emotionally. I think that his professionalism is outstanding!

Art Harris is a very important link between HKS and RT, especially for jurisdiction over HKS. The plaintiff’s attorney has not yet been able to connect that link, evidently, seeing as the Plaintiff’s attorney continues to fight/delay Special Appearances and a jurisdictional ruling. I look at it in context of the Fed TX suit and how VA got her jurisdiction over HKS in that case. HKS and ANS were directly associated with CBS and the TV interview. No kingpins, conduits, or cabals, or gangs, etc. as in this TX state case. I think McC knows that he doesn’t have enough to keep HKS in the suit. And without HKS what is the point?

Now do I have a cause of action against Art Harris, yea probably… However if LB wants to come to Texas and sue me, let him get in line… Please also note that Harris’ attorneys are saying there are OVER 3,000 emails I HAVE turned over between Harris and me… yet in other filings they say Harris has turned over a total of 4,000 DOCUMENTS… it does not take a math wizard to put together what I have been saying and that is without Harris’ correspondence with and between all of the defendants the “perception under Texas law as in most states now and in federal statute that to destroy doucments is an admission you have something to hide, thus the conspiracy theory when in fact if the documents had not been destroyed the court would have the whole picture”… Many many courts have now ruled that destruction of documents that are recovered through a third person thus proving the documents exist is VERY serious and CAN lose a lawsuit when in fact the doucments might have proved excatcly the opposite… I also note that the fact of what Wood feels about the total contents of my deposition kind of explains I have not deserved to be bashed over a few pages released to date… which goes to tip of an ice berg theory I have stated over and over again, before you pass judgment on any of the defendants in this case or that I threw any of the defendants under a train by complying with court ordered production which VA and others certainly deserved if it was from and to other defendants or addressed ANS, VA or the defendants… Which is what Lindsay should have granted without the list of 40 names… However sadly Harris had already destroyed large volumes of documents which makes all of us look guilty. It feels to me in Wood’s latest filings he is kind towards me because I have not lied and appears to be moving away from Harris (I. E. not supporting his objection to me adding Busystreet to get those things Harris is shuffling ownership between him in a shell game of hiding evidence that relates directly to this suit).

Beth and the rest of the story on that is that any defendant can block me from being released, and the only one to date that has indicated they may try to block my release is none other than Harris
BTW have you read what Wood said about me??? There is no basis for any of the defendants to sue me for me telling the truth, being cross examined so attorneys can ask me direct questions that clear up the record, and for turning over documents between the defendants which is all VA should have ever been entitled to… it is now “perception” as in you think I am going to be sued by the other defendants, and yet don’t see the perception of legal opinions by multiple courts with regards to a party deleting evidence… Perhaps you will have a kinder feeling for me after you read Wood’s filing from Friday.

All of these insinuations about AH’s emails, IMO that HAS NOTHING TO DO with WHY you are in this FAKE CASE!
The reason WHY you are in this FAKE CASE has to w/ only one thing IMO >> conversing on your own (without a lawyer) to McC and falling for his unethical actions, believe me it will be shown to the Court at how the Motions filed by you have appear to have the TX law firm ‘influence’ written all over them.
That IMO is NOT a good place for anyone to be in… it can open a person up for follow up suits against them for these actions that cannot be substantiated.

Beth thank you for the compliment of my ability to write Motions, Responses and Replies, that means a lot to me that you respect my ability to research and do that… you made me blush, that is a big complement coming from you and I appreciate it…
Byzantine… yea this case is a very complex case with a lot of BS, however I still say it is not complex enough to fall under Rule 171 for a Special Master, I feel it is complex for other reasons but not one that would justify Judge Lindsay to appoint a Special Master… I wondered why Harris opened up that can of worms with this filing when he is saying this is not such a complex of a case that the average Judge can rule on Motions for Production, the production, if all is there, I do not think the case has so much complexity to justify that the Court would need the help of a Special Master.
Oh and Beth one of the other things I did was after we lost Ogden I researched and suggested to Bonnie Stern how to file her Motions, Responses and Replies in Texas and which exhibits I would use if I were her… I also helped her lawyers in California because they did not know Texas statute and Bonnie did not have a lot of extra money for research and such…
That said I probably will never again offer to be a Good Samaritan or reach out to anyone I think is getting a raw deal… the ANS saga and lawsuits has taught me a lot about not volunteering to help others…

“Brittany Murphy’s Husband Found Dead

Simon Monjack, widower of Brittany Murphy, was found dead late Sunday night at his home in the Hollywood Hills — the same home where his wife Brittany Murphy collapsed and eventually died five months earlier … and both bodies were discovered by the same woman.
Law enforcement sources say Brittany’s mother, Sharon Murphy, found Monjack unconscious in the master bedroom around 9:30PM, and then called 911.
Monjack was pronounced dead sometime after paramedics arrived … when resuscitation efforts failed.
Monjack reportedly died from cardiac arrest, though nothing officially has been determined.
The similarities are remarkable. Murphy was found unconscious by her mother Sharon. Sharon found Simon unconscious as well. Murphy was found in the master bathroom. Simon was found in the master bedroom of the same home. Paramedics administered CPR to Simon. Simon administered CPR to Brittany. And they may have both died from cardiac arrest … five months apart.
A death investigation is underway.
UPDATE 5:15AM PDT: Law enforcement sources tell us prescription bottles were found in the house (as they were when Brittany died), but there were no illegal drugs. There is no sign of suicide or foul play … as a result LAPD has closed their investigation. It’s all in the coroner’s hands now.

Law enforcement sources tells TMZ there are signs Simon Monjack may have died from an accidental overdose of prescription drugs.
One well-placed source says, “There were a number of pill bottles on the nightstand in the bedroom, and some were empty.”
There is, obviously, an eerie similarity to the death of Monjack’s wife, Brittany Murphy, just five months ago. In her case an array of prescription drugs were found on the nightstand of the same bedroom where Monjack died. Many of the drugs on Simon’s nightstand were the same as the ones found after Brittany died.
One law enforcement source says the two causes of death that seem most plausible at the moment are “natural” and “accidental drug overdose.”
Monjack told TMZ recently he had suffered a heart attack during the incident last November when he had a medical emergency aboard an airplane.
Brittany’s mother, Sharon Murphy, discovered Monjack’s body last night. She is also the one who found her daughter, Brittany, unconscious and on the floor of the bathroom five months earlier.
UPDATE: TMZ has learned Simon was scheduled to have bypass surgery in September.”

Here is something really scary, If anyone has ever used a public copier like at Kinko’s etc or at your local grocery store that information is stored to the hard drive as of around 2001 and It was on I think 60 Minutes or something recently but I just heard on talk radio that those hard drives are bought and sold as a commodity and 60 Mins or something bought 3-4 at 300.00 each and the information stored has so much info on people that is used for I.D. theft. Most of the copier companies have a lease with the host establishments and can remove their equipment at anytime. I have heard also that even having a magazine subscription your information is shared it is just scary all around if you ask me.

Well we know that a doctor cannot even discuss medical information with a spouse unless that spouse allows it. What was done was not only legally wrong but morally wrong as well. Beth I saw a beautiful show today about Section 60 at Arlington National Cemetery on HBO, it was moving.. I cried thinking of all the lost young lives… Kind of puts this BS as it should be BS… yes the records will come down, and yes the posts will be deleted on other sites… but the families who have lost sons and daughters and shared their feelings while visiting their love ones graves, was heart wrenching and put the world in a “right place of what is really important today”… The BS can be handled legally…
BTW are the papers up on more than one free site that Sizzles (kind of sound like cooking an egg on a hot street or bacon frying to me). If so we will need that link also to show the Court this slip up caused in…. Yes there are laws in Texas that mirror the federal laws… You know I downloaded some papers that were suppose to remain confidential that related to filings in the paternity case about DL in California… I bought those records read through them and no one will ever see them on this site… just because you can “get it quick before it is gone” does not make it right… personal integrity of knowing this was wrong has to be a guiding factor in life.

My rather lengthy post was in moderation and I was not the one to release it to be viewed and I cannot delete it either.

Beverly thanks for the kind words… the lawyers of course have all agreed that this is covered by the Protective Order and of course it is also protective under HIPAA. The O’Quinn law firm (they noticed the deposition and paid for it) have taken the lead in getting the paperwork to the Court today ASAP… however even though all of the attorneys agree this needs to be off the court site ASAP, the pro se defendants have not responded and so it will be up to the judge if he takes it down today or schedules a hearing to if the pro se defendants have an opportunity to object and make a case as to why it should be public. I have asked that the Motion asked the Court to take it down and seal it to prevent any further damage to me personally and legally if the judge requires a hearing and that the hearing be expedited and conducted by phone.
