Teresa Stephens vs. Stephens, Neil McCabe, Don Clark, Wilma Vicedomine and O’Dell Cross Complaint Update!!

I was just notified that Stephens vs. Stephens, Neil McCabe, Don Clark, Wilma Vicedomine et. al and O’Dell Cross Complaint was DISMISSED with Prejudice today in Tarrant County. No immediate information as to a possible Appeal or being able to refile on the parties that were never served in this suit is available yet. As soon as I receive a copy of the Order I will post it.
As soon as I get more information as in a summary of the hearing or any comments on the record I will be updating the article.
Bloggers I will also be giving credit where credit is due on who was able to accomplish this by entering the case. We will also reveal who was the lead lawyer in today’s hearing. We report facts even when we owe a thank you to someone we would never think we would.

How it’s time to see the VA vs. The World lawsuit DISMISSED
I want to be the first to say……………..EINY’S CASE WAS THROW OUT ON IT’S BUTT.

Darn, I wasnt the first. Oh well, her case was dismissed. Einy’s is the only one I will refer to. Her counter claim and case was THROWN OUT.

I too have some celebrating to do. They are in a rage at the Hangout. OUCH
Einy’s counter claim had nothing to do with TS case at all. She was tossed on her ass! Wilma and her lawyer get total credit for tossing out the stupid counter claim.
Afternoon, I just stepped in and I honestly have not been keeping up with these blogger cases…
So, now I am confused.
Rose, JMA or someone…
Could you tell me if this is a cross on TS’s suit that you are in? If so, was she trying to sue back?
I mean, I have even forgotten who Odell is (the moniker they use)…
Beth Einy was cross suing TS and EG, her case was dismissed today also
I have not seen an Order yet so don’t know if TS can narrow her filing and refile it minus those that were dismissed today.
I truly hope that she can get her records expunge and concentrate on those who really harmed her on TMZ in the beginning of this mess in 2007.
It was one of Einy’s co-posters at the Hangout that sent the information about what Einy had said about wanting video depositions and what she wanted to do with those… Sometimes you can be amazed by the human spirit that does step forward and simply want the field to be level and to that person AND YOU KNOW WHO YOU ARE a BIG thank you. I think that was a major change in all of this.

I too hope that TS can get her record expunged, try and to forget the lowlifes in ’07 who gave her such a hard time…
If she can’t get along w/ her mom, then maybe she can keep her away like ANS seemed to do… it is just a thought.
Then she can concetrate on her health, happiness and her children… then just try to be happy, HELL! That is all any of us can do in this day and age.
Oh Rose, I forgot to tell you that the heart surgery is set for this Sat morn. I am on pins and needles for this close family member!

do you think this is why Einy’s was dismissed too or is it just part of the proceedings today, you know cause TS was dismissed so Einy being the Cross Complaint had to be also.

Lucky you are right the Court could have severed the two cases, and allowed Eniy to go forward and the TS case gone… or the Court could have dismissed only those of us in the Harris County case and let Einy and TS battle it out there… a lot of scenarios
I am going to put up later a very personal interview I have had with WV today and some insights into all of us have a good part and no one is totally “evil” as some want to say… we just all approach life very different… In my interview and article about the personal interview with WV, I am going to take a chance that the bloggers here understand how this affected me and how more than one person in all of this came forward for no other reason then my health was going down very fast and Ken and I hid that for the last several months to most people…
No one knew unless you go to the articles written and come forward in Nov. – mid Feb. and you can see I was hardly writing at all and allowing and thanking guest writers for keeping new content on this site.

Please stay positive on the close family member and the surgery. It s a hard thing to do as a love one is under going such surgery but it can be done. I know someone who had a quint by-pass and felt like a new person after the healing was over.
#16 Noni thank you, you have no idea how hard it has been to get up in the mornings and try to go on and ignore what the blows to my health was… I am the type to see the cup as half full, but for the last few months I could barely get out of bed and it is Ken that has been telling me this would be over and just hang tight… I think most of you noticed when he became more hands on with the posters… he as are all you amazing ppl
I want a hanging basket for the computer room, to watch the pear tree bloom, I saw some red cardinals today and thought WOW how beautiful… I want to rejoice in once again the earth showing a rebirth of plants, flowers, the green green trees… I have always love the spring but I love it more right now…
I am hopeful that I am going to get through the HC suit now that is the only one I have to concentrate on

Rose, spring is coming. The sun has shown itself the past few days resulting in snow melting and warmer weather. Looking closely, one can see buds and the beginning of shoots in the ground. Walkers and their dogs are taking advantage of fairer weather. Rose, please take care of your health and know that we here love you and want only the best for you.
BETH—Surgery,when mentioned to anyone is worrysome,but when it is in your own family it becomes frightening,Knowing the doctor .and trusting the doctor,is a big part of feeling somewhat at ease.MY prayers are for you and all you family,just know,the man upstairs has it covered.
BETH–ROSE—When I was young,I got very sick,and my family was very worried,my grandmother bought me a plant,and put it in my bedroom,she watered and took real good care of my plant and told me(She called me a lithuanian name) as the plant grows and buds,so will I ,i looked for the bud every day,and she was right.I NEVER WILL FORGET THAT.always keep and give a growing plant to someone,you will be surprised how it helps.
Sorry I haven’t been around much…But have had some very serious Death and Health issues…within our Family…..

Oh my goodness, thank you all so much! I know these procedures are done pretty much everyday (triple heart bypass)…
This is the first time it has touched anyone that my family has known, it is very scary when you hear of people going in
for just routine procedures (even in a doctor’s office) and it not turning out alright. We are all just really frightened.

#24 Pollyne It is nice to hear from you, I too am so sorry that you have had to deal with a death and health issues in your family, they are very draining and yet we love those so very much that we go through it out of that love with them. Take care of yourself.
Beth I told a friend once I had a real phobia of hospitals and she was a nurse and said “that is a good phobia to have with some of the mistakes and infections in hospitals”.
That said I am a firm believer in having an advocate (family member or close friend) to be there to make sure everything is done according to what the patient needs and wants… family who will stay as long as they are needed and trade times to get rest is the best any of us can have going in to those scary procedures…
I truly expect only good news from you about your family member, there is so much love and concern in your posts, that alone will help IMO…
#30 Beth despite what any Order says you can’t force a judgment in Texas if the person has no money. In Texas the only time you can be garnished is for child support and student loans, your wages can’t be garnish if you are on SSDI or SSA that can never be garnished and you can’t make anyone sell belongings to pay off a judgment. Texas is one of the best states to protect those that live here from being harassed through a judgment. I think TS is judgment proof under Texas statutes in both lawsuits in Texas.

Also, that is very good to hear about the State’s judgment proof laws… however, I have a feeling that the other blogger might try to file
suit just to add fuel to the fire; sort of speaking… [the one (blogger) who 'contered' in this suit that was dismissed] I hope not though,
TS should be dismissed immediately from the HC suit and just left alone so she can concentrate on her health and her children,
as should all of the defendants in that ridiculous suit that many from that damn law firm sucked them into under false pretenses of
two nut’s sworn statements! That’s my opinion and nothing will ever change it, that I am sure! Shame on McC and his cronnies! I honestly
do not know how they can even look in the mirror at themselves. They make me sick! They really should all be called out for the damage
they have done, and I pray that S.C. case does exactly that!

I hear H.Stern’s response has been filed in reference to the motion of sanctions in the COA by Arthur. They have not been downloaded yet so I am unable to read the response.
The summary almost sounded like this judge was actually thinking this was a case? Sure hope he rules by law and not who the Plaintiff’s legal firm knows in town. ;)

The ‘Special Appearances’ must be heard or HKS and LB are not part of the case. Without such successful Hearings, they must be dismissed as named defendants. The 1st COA and the TX Supreme Court will rule at some time based on their own schedules and without regard to the needs of the ‘bloggers’ case. It is clear that computers are off limits to lawyers (like McCabe) who can only express skepticism about what a defendant says they have in their possession during discovery. Ignorant people are not rewarded for being slugs. We know McCabe has a nefarious purpose behind wanting HKS’s computers in the hands of his boy, Ball.
McCabe must put up VA and her ‘witnesses’ for depos. Wood has said repeatedly (to the dark vacuum of Lindsay’s Court) that HKS has always used web-based applications. The computers subterfuge exposed the nefarious purpose of the lawsuit. HKS has been ready, willing and able to be deposed from Day One, same as for all of his own civil cases. McCabe must show up for ‘Special Appearances’ hearings with stacks of incontestable facts and depositions that show his b.s. all this time has a preponderance of truth somewhere in it. We recall VA in the ‘Mommie Dearest’ case had to admit in her depo that she had no proof of any of her allegations.
Lindsay should have managed this situation back in 2008. Put up VA or shut up. Just learning that the ‘Mommie Dearest’ case was withdrawn by VA should have keyed Lindsay into knowing it was highly unlikely that the ‘bloggers’ case had any merit.
If VA could not come close to proving that, a globally broadcast ET interview of ANS affected her public persona and chances of prevailing in any Court case, how any sane Judge could buy the silliness that bloggers defamed her defies common sense.
