Late last night, at midnight I received the filings by Richard W. Hess of Susman – Godfrey Law Firm; the Motion for Summary Judgment by TMZ Productions Inc. and Harvey Levin in the Virgie Arthur vs. Howard K. Stern defamation suit pending in the 80th District Court, Harris County.
The hearing for the Motion has been set before the Court for Friday, May 5, 2010 at 8:30 A. M. before the Honorable Larry Weiman in Houston Texas.
In the filing for Summary Judgment TMZ and Levin state that the April 19, 2007 article that Arthur and her stepbrother had a child together is literally true, substantially true as a matter of law and that the unpublished details of Virgie Arthur’s stepbrother relationship are far more damaging than what TMZ published. They also state that the Cause of Action of Conspiracy to Defame is not true and as such should be dismissed.
TMZ.com and Levin state that the stepbrother story was a NON-TMZ publication that the Summary Judgment should be granted on a non-evidential Motion as Texas Statute allows.
Attached to the Motion for Summary Judgment is a sworn declaration by attorney Richard Hess with the following:

I agree and anyway you twist it, it is true and a matter of public record. She married him had child by him and some time down the road he became her stepbrother.
It’s just like when she married her cousin, that was also a matter of public record, though McCabe tried to sugar coat/lie
about that one by claiming there was no sexual relationship between them. OH please 
if there was no attraction between [eww, blood relative] them then why did they [again eww] get married!

“Corey Haim collapsed in the bedroom of his mother’s apartment and four prescription bottles were found nearby … law enforcement sources tell TMZ.
We’ve learned Corey had been sick the last couple of days with flu-like symptoms. The medications recovered, however, were not related to his illness, sources tell TMZ.
We’re told no illicit drugs were found in the apartment.
Sources say Haim got out of bed just before 1 AM and collapsed in front of his mother. She called 911 at 12:53 AM and Corey was taken to the hospital where he was pronounced dead at 2:15 AM.
Corey’s mom told authorities he had been battling prescription drug addiction for years.
Authorities believe — though are not certain — Corey died of an accidental drug overdose.”

I posted a link in reference to Corey Haim’s death in the previous thread. Did you ever catch the show “The Two Corey’s” on there they showed how Haim’s struggled with addiction. On one of the episodes they tried to do an Intervention with him but he refused.
Yes Beth…I always wondered how the Firm was going to present facts to dispute their so called conspiracy.

I believe McC made the no sex comment in either Baker or Waddle’s statetments. McC posed it as a question, iirc.

Now regardless whether the guy/cousin was sick or not, one it is disgusting to marry a blood relative and two, if the marriage happen due to illness then that means they married under false pretense and fraud was committed.
IMO VA’s closet of skeletons were reveled to the world by Anna during her ET interview and because VA cannot go after her own daughter she is trying to go after everyone else. Furthermore, IMO McCabe is trying to portray his client to the courts as a Saint/Mother of the century

The only thing I can think of is there was hope that this would never go to trial and a settlement would be offered. As I remember the cheerleaders saying, why take a settlement if you want to clear your name? Maybe you do if you want to help ‘save face’ for the other party.
I wonder how many emails and such TMZ gets a day? Maybe there’s another sleeper witness just waiting for their 15 minutes.

IMO Baker was not taking that deposition. She did not use proper grammar while answering McCabe’s questions and was acting as though it was just another get together amongst friends. Definitely a lack of professionalism there.
Reading this Deposition again leads me to believe McCabe was guiding/leading her with answers especially what the relationship between Rose and Barth may have been. Ha-Ha he is like her cheat sheet for a test. To me it looks like McCabe is putting words/answer’s in Ms. Baker’s mouth. First he asked what does the phrase “kissing cousins” mean to her and before she can answer he comes off with “mean to you that they were engaged in incest” and of course Baker has to agree with McCabe.
OK I see where McCabe throws in the sex card. He ask [IMO already has VA's explanation/story in reference to this marriage] “wouldn’t there have to be sex between the two persons to have it be incest?”
Rose~~ in that deposition McCabe goes in a round about way claiming no sex was involved in that marriage but I would have sworn he said it publicly there was NO sexual contact between VA & Sanders.

Yes, I so agree about the sworn statements…
Remember the Courts hold MORE WEIGHT with a Depo that is given with BOTH SIDES PRESENT, then they do for ONLY ONE SIDE to be there
and ask specific questions to get specific answers with no ‘counter questions’ from the other side.
Again, I do not think this will ever go to trial, but if it moves towards that then all of the Defendants have a right to haul those two bloggers
in (a Court Ordered Subpoena) to take a deposition from both sides.

NONI—–OQ and McCabe put the brain aneurism defence whereever it is needed.I will tell you,I went back to listen to all Vergie’s interviews.everything she said and how she said it.On Greta show,Greta asked when did you become aware of Anna drug taking,Vergie was smart enough to say when Howard entered the picture,making sure she left out before Howard she was drinking heavy and took meds,Vergie was always very careful with her words as not to incriminate herself for doing nothing to help her daughter.this way it is all Howards fault.On the stand in Florida,the only time Vergie got upset is when she was asked about money.Whenevershe is asked to explain about not getting in touch with Anna,there is always the excuse,Howard hung the phone up,Howard would not let her family see or talk to her,ALWAYS TRYING TO COVER HER NON ACTION TO HELP HER DAUGHTER .Would you expect to take a child away from her father if you felt your brain was injured and you were not well,SLEAZEBALL OQ thought a child abuser(hair pulling ) and handcuffs to a bed,was a good place for Dannielynn,ALL VERGIE’S actions are deliberate,well planned,and meant to make herself look good/

JMA is correct. EXCEPT… “Family friend” is how VA described him on the stand in FL Probate Court… In reality he worked for Splash
and was trying to sell VA’s story, replies, photos whatever they could to make her money. Least that’s what it appeared to look like

It does tell what it is. It goes into all those marriages and ages and things like that. At least that is what I got out of it they meant because they basically say “for instance”……… then list all that stuff. Which I don’t see how that could be defamatory either. She did it. She married them all.

OK, here is my 2 cents worth… on the last Virgie article I had asked if Virgie was expecting an apology. I figured I would offer mine:
Virgie
1. I apologize that no one know who you were until you went on TV and did interviews on Daniel’s death and who MURDERED him.
2. I apologize that no one really believes that you did this in Anna’s best interest.
3. I apologize that people looked into what you were claiming the facts to be and found out the truth.
4. I apologize that you are ashamed that you had a child with your future step brother.
5. I apologize that you made money off of your dead grandson.
6. I apologize that when you visited your grandson’s grave, had pictures/video taken, that you could not find the time to contact the Bahama police because you were concerned about your daughter’s safety.
7. I apologize that some people don’t like you because of your ACTIONS towards your daughter, your grand-daughter and her father.
8. I apolgized that some people think a lot less of you when you and your lawyers tried to use a mentally handicapped person for your own gain. (Daniel’s father at the body custody hearing)
9. I apologize that some people don’t like the fact that you attempted to split up a mother and her son after their deaths.
10. I apologize that your actions appear to so many to be, self serving and money grubbing actions.
11. I apologize that your smiling picture at Daniel’s inquest makes people sick to their stomach because some do not understand how one can be HAPPY and SMILING when attending a hearng about how and why a (beloved) grandson died.
I could go on and on but you get the gist of things. I apologize because it is YOUR actions that has created my opinion of you. It was not whom you slept with, married or even had children with. It was not the fact that in your carelessness, your son shot himself and somehow you don’t remember which side he got the bullet in.
Maybe in accepting my apology, you should look into yourself and see the damage that YOU created by your actions or lack of. Maybe you should judge why Anna and Daniel wanted nothing to do with you or the family, in the decade prior to their deaths, instead of trying to blame everyone else for your misery.

WELL everyone,my bet is the day in Febuary in London,when the opera for Anna Nicole comes out,you will find Vergie ready and able to walk up the red carpet to be the center of attention,but by then all would have come out,you know,to my way of thinking Houston and mexia should throw Vergie out,and remember Anna, maybe a opera is correct (a real tragedy)My interest has never been who or how many times Vergie married,I DO NOT CARE.My interest was Anna,and all the young adults like her.ANNA WAS BEAUTIFUL,but her mothers cold and rigid ways along with using her daughter for money,made Anna life a tragedy in the making,My skin crawls,when I read Vergie warned Anna,I am angry at the people that do not understand what Vergie was doing,NO MOTHER,and I MEAN NO MOTHER,would use the TV in time of Daniels death,to accuse her own daughter and friend of having something to do with Daniel dying,SHE WAS WARNING ANNA ABOUT HERSELF.Vergie chose the right time,to hurt her daughter (get her and kick her while she is down)There is One big difference how Anna felt about her son and Vergie handled the death of Anna and Daniel.ANNA WENT TO PIECS,AND vERGIE WENT TO PARTY DOWN AND BE CENTER OF ATTENTION.
