Well, there is no need to inform a Court of settlement details (or even if one was reached) when you are not requesting that the Court enforce the provisions of such. When a settlement is reached, you are obligated to tell the Court that the case is now officially dismissed and have the Court ‘terminate’ proceedings.

Hachette and Cosby have the same insurance policy (the details are in the unredacted filings). Hachette receiving Summary Judgement did not remove its financial obligation for Cosby’s misdeeds. Insurance Companies do not require Court supervision.

Recall when O’Q settled, he dithered with the paperwork until Judge Dimitrouleas demanded it. Moreover, the Court in FL was asked (wisely) to enforce the settlement agreement.

Wouldn’t it be interesting if the SC civil suit could conclude before the CA trial began. Can a defendant in a criminal trial request the start of that trial be delayed if the witnesses who would be called to testify in each were the same? If it’s allowable, is the request likely to be granted?

I think there are two many opposing forces for any one person to affect (significantly) the scheduling in LA.

Criminal Courts are choking with cases, many on a constitutionally guaranteed fast track. In the case of HKS/K/E, there is no special hurry since the defendants demanded a preliminary hearing. The prosecution is now scouring two countries looking for someone to testify (legitimately) to their fantasy allegations after having had their own live witnesses refute the key elements of the charges. Moreover, the prosecution’s ‘insiders’ and ‘sources’ failed to show up and bail out their author (Cosby) in her time of need (recanted, hid out, called her a liar and fabricator in fact); no one but the ‘media-whore fairies and elves’ to support the narrative of the criminal charges now.

So, if the prosecution thinks it is time to strike, it will. Minor delays due to lawyer scheduling conflicts and the coordination of live witnesses can play a role but the criminal Court’s own need to find a Judge and a Court room in an orderly fashion trumps all. Renee Rose clearly is foaming to present a sick and twisted tabloid case despite what the facts and common sense would direct. Any one willing to waste taxpayers’ dollars on her shameful act during the prelim is not likely to consider requests from defendants regarding scheduling. The prosecutor must be aware by now that her preposterous tabloid view of HKS/K/E was not able to be defended by the very people who made it up; Opri, VA (Federal Court), O’Q and Cosby all folded just before it was time to take the oath and sit in the witness box.

The SC case in Federal Court is under tight guidelines. Magistrate Rogers has indicated discovery will end by 1-29-10. He has also ordered parties not to start throwing paperwork his way regarding discovery issues unless the parties have tried to work it out among themselves and they have his permission after a telephone conference beforehand. SB for instance was denied within minutes of filing her Motion for a Stay of her depo made to the SC Court. Rogers also ordered mediation to be completed by 3-4-10 by which time pretrial disclosures must also be in. Judging those Court deadlines by HKS/Wood’s successful record of accomplishment, the SC case will likely settle before the criminal trial is likely to begin.

Upcoming in SC you have G.Ben, Ford Shelley, Susan Brown, and “Does” (& all of their personal and professional liability insurance coverage), as well as The Estate finally being able to recover all of the stolen property.

In some ways the criminal charges in CA were advantageous for The Estate of ANS, although personally and professionally disadvantageous for the defendants. The publicity that would be generated by a failed or dropped CA prosecution would have a very positive financial and public relations effect for The Estate.

Of note, I think, is that in agreeing to bring and prosecute all these suits, HKS has agreed to allow himself to be publicly dragged through the mud. It is of absolutely no surprise to me that he would distance himself as forcefully as possible from his siblings and everyone else. It’s certainly what I would attempt to do were I allowing a course of action such as this.

It’s heartbreaking the amount of personal information, outright lies and hatefulness that had already been (an continues to be) slung around on the Internet and in the media. If the suits and court cases hadn’t been brought, DL would have had only those horrific versions of her Mom and the people she cared for. Perhaps, just perhaps, at the conclusions of all the trials and suits, the final, truthful version will bring some to comfort DL. And that’s what it’s all about for me. The adults, all the adults, involved in these cases will have to do the best they can with the aftermath — for DL is the only truly innocent bystander.

The ‘GOOD REASON’ in this NY case is because Rita settled with the plaintiff for her wrongdoings…. IMHO anyway.

(With Prejudice) Will NOT be filed again in the future because; there was a joint statement by BOTH parties’ lawyers stating there was a STIPULATION.

My pc has been infected with viruses (mostly Vundo) for thee weeks now. I woke up one morning and 175 emails were gone from my inbox and all sent email, as well as sever saved folders with emails. After that all the ads came on (never before). Tonight I uninstalled Yahoo toolbar. Believe it or not, TMZ toolbar was fine. Phishing took over from Yahoo and used a photo from my computer–but the site warned of phishing and said not to register or sign on with a photo I had not chosen. That site is a secured site.

It is driving me crazy.

A few months ago their yahoo mail hd been breached and a hacked message had been left.

Yes. “THEY” are at it again. As I review the current H.C. postings here, I realize that this nightmare is not over.

Rita is paying a fortune in legal fees. If McNamara had a case it would go all the way to trial that is what she does best, but when your case falls apart you settle and walk away… Do you really think Wood would settle for NO MONEY????
