In South Carolina where the Estate of Anna Nicole Smith is suing Ford Shelley and G. Ben Thompson in anticipation that the court will allow the adding of Gina Thompson Shelley, Gaither Thompson II, Melody Thompson and Susan M Brown, Ben Thompson has now turned in an affidavit supporting Brown’s release from that suit.
The pending Motion for Leave to add the four additional parties is still due for filing Answers no latter than November 16, 2009 at which time the Court will set read any Responses and then issues any appropriate Orders.
The Court canceled the “In Camera” hearing for the release of both of G. Ben Thompson’s attorneys that was scheduled on November 3. No reason was given by the Court of who requested or why the hearing was canceled.
The latest filings in that case is the filing again of the same conflict of interest and request to be released as counsel of Susan M. Brown and an Affidavit by G. Ben Thompson acknowledging that Brown would probably be added to the suit and stating due to that reason Thompson had no objections.
November 5, 2009 Susan Brown second filing to be released as counsel for G. Ben Thompson after hearing on November 3, 2009 was canceled by the court.

We are expecting filings by Elizabeth McNamara on behalf of Rita Cosby and L. Lin Wood on behalf of Howard K. Stern to be filed in New York by tomorrow, November 9.
We also expect a filing in the Texas State Court tomorrow or early this week in Response by Virgie Arthur to CBS’ request for Summary Judgment we will be adding that as soon as we receive that filing.
New filings in California in the Bankruptcy of Bonnie Stern and the Adversarial Proceding of Virgie Arthur vs. Bonnie Stern. that we will be adding today and a new section for the latest case to spring up over all of this in Texas and listing those papers as we receive them.
September 17, 2009 The Bankruptcy Court in California discharged Bonnie Stern’s bankruptcy except of the adversarial case filed by Virgie Arthur.

September 22, 2009 In the Adversarial Proceeding of Virgie Arthur vs. Bonnie Stern this is a joint status report asking for the next status hearing to by January 12, 2010. The Appeals Court in Texas has issued a Stay on the January 27, 2009 Order appointing the Special Master Craig Ball which his report on Stern was the reason a default judgment was issued against Stern. If that is overturned by either the three cases pending in the First Court of Appeals or in the case before the Supreme Court of Texas, then there is the question if that in itself will make the striking of Stern’s pleadings to be thrown out. Then there is the big question with the October 30, 2009 filing of John M. O’Quinn’s Will which states that the three trustees in place to dissolved his firm The O’Quinn Law Firm, how will that impact the current case in both Texas as well as California. Normally the conditions of the Will are resolved within nine months of the filing of the Will in all matters so the Estate can file a final inventory and pay Estate Income Tax.

Yes Bewildered I am sure they are sifting blame kind of like musical chairs…
I expect Brown to be added on Nov. 16 and I expect her to then do a designate third party of members of are the law firm that she gave that tape too… I would also bet she is probably fighting an ethics charge in Georgia… I would think she is in deep trouble in more than one place over giving Estate Property and then keeping copies on her computer in violations of the Court’s Order last Jan. Things are not looking good for Brown IMO.

That quote was from the transcripts/McC. But yes I gather that SC will try to ‘lessen the impact’. Since Wood was rather adamant about having all things back, even with SBrown’s admission that what she had was stored in client files, she didn’t exactly appear forthcoming. What a blow to her career.
I happened upon a rather unsavory site awhile back. Just how does Wood deal with images that were of the estate and now are in the public domain?
Yea that is like closing the gate after the horse is out… how do you figure the price that it cost the Estate and ANS image?

“• SB tries again to be removed as counsel for G. Ben
To continue the update; the day after the above Hearing was cancelled; SB had G. Ben sign an affidavit for the Court. G. Ben declared that due to a ‘conflict’ becoming apparent with his continued representation by SB and Joye (SB was pro hac vice with the sponsorship of SC lawyer Joye) he asked that the Court allow both to withdraw as his counsel of record in the SC case. The ‘conflict’ was of course that SB was added as a defendant in the SC case. On 11-5-09 SB and Joye filed a joint Motion as Doc 82 with the attached affidavit of G. Ben. SB and Joye had separately filed Motions 9-30-09 to be relieved as counsel and asking for a hearing in camera to discuss the matter – without explanation or supporting materials.
What happened in between 9-30-09 and the cancellation of the hearing 11-3-09? SB was finally brought to a depo 10-5-09 (after asking the Court in SC 10-2-09 to stay her depo ordered by the N. GA Court which the SC Court denied the same day) and HKS filed a first Motion for sanctions against SB and G. Ben 10-28-09.
Recall, SB was found to be holding electronic and printed materials in her Office at the time of her depo that were copies of the stolen items from ‘Horizons’. That was in continued defiance of the SC Court as was the case when SB refused for months to hand over the USB drives containing all the files from ANS’s computer that she had ‘shared’ with the O’Q Law Firm.
What ever will happen with SB?

I “think” that HKS still has a Motion for “Leave” to add the new 4 defendants with answers do by Nov. 16… perhaps the court has already indicating that it is prepared to grant HKS Motion for Leave to add defendants… it was done before Oct. 30 and had some pretty strong documents to support it.

I bet RC settles in the next 2-3 weeks, there is no-way she will want her name dragged in the mud more with a trial and (lol) having to answer why she tried to bribe the nannies, and just how much stolen materials did she and Opri ‘cackle’ over? Rita worked with Texas it looks like, I actually do wish they could all be exposed for their actions. But alas, it’ll probably be a ’sealed’ settlement that is paid to HKS for the malicious defamation they (TX, SC, DO,RC, JH, DC, McC, ect…) conspired to do.

To be frank about that picture of anna and daaniel. No one can put a price on it. While it was a hell of a picture to have taken, it certainly made me understand the hell that Anna felt when Daniel died. A picture can say a thousand words. That one particluar picture spoke a million words. To those people who are ALL involved in it’s releasse to the public, In my case it backfired on you. It made me understand the depth of despair that Stern was dealing with. So to those people who invaded Anna’s privacy, I hope you see that picture in your minds eye and remember what you made happen. I hold you in no higher esteem that any of the people who used Anna’s grief to further your own agenda. Karma will bite you in your ass. And I hope it leaves a big red hickie.

I was wondering about the cases with O’Quinn winding up his company…..is it normal to do that to a florishing law practice???
To do so, does it benefit them some how with lessening liability etc. Especially the breast implant cases or are they going to have to whistle for the money now because of probate… like sue estate.

Beth I predicted last week that they would still meet filing deadlines… and this one was due because of the pending Submission only docket for Nov. 16 with the new court and judge.
14..Heath..I would assume with the liquidation of the firm (cases/office furniture/the building??) that those items would be sold and listed as assets and then the creditors would file their claims. In time all will be known just to what the firm was worth and who the creditors are just as Anna’s has been. Anything left after the claims are paid, should go into the trust. I don’t know, but’s that what I think would happen. And then there’s the IRS that has to be settled. Probate can stretch out for quite awhile depending on the estate. It’s also probable that the vehicle was a corporate asset and was insured under a license and bonding situation. And non of that takes into account of his home or personal assets unless the designation letter that was implyed in the will,is found. There could be since even mineral rights were accounted for which I’m assuming pertains to his ranch.
Ole Bad Bad..Mr. Brown…how kind of him to take Ms. Linda R. to Africa and imply that he had a more colorful life than Ms. Clinton. I wonder if the employee’s transcripts are available concerning Mr. Browns thoughts on Anna.
How many times has the same rambling motions been filed ? Now backed up with Art and Havana…yep..hmmm…oh yeah…she should be a joy for a jury to listen to. And the ET interview or Art’s will be a hard sell to a normal jury. I read the motions and think that McC seems to think that only one side is going to be presented at a trial and the jury will only be sympathetic to his client. His exhibits just do not read that way. Hope he has better witnesses than what’s he’s presented so far. I’d rather it would all be a housekeeping motion than ever going to trial but if this is the jist of the case, as has been repeated for so long, all I can say is Good Luck.

#31 JMA not really very little has gone on with TMZ and the CBS fight could extend again if CBS now asks for an oral hearing and not just a submission only which I don’t know if they can do that…
Remember it is TMZ and CBS with money not the rest of us and LB has not be found to have jurisdiction in Texas, and HKS has been tied up in the First COA since May with no movement.
It depends how long the 3 trustees have left the remaining 15 lawyers and staff to settle things, make sure O’Quinn’s Estate gets every penny he is due from cases where this firm co-works with other firms (like the Overstock.com lawsuit where O’Quinn was working with another firm), they may not need all of that money in the coffers but they have to account that it is going to still be paid to O’Quinn. Then you have the engagement letters, those should be easy to either have another law firm take them or a no go if they are not money makers… now the existing cases, how long have they gave them to place them? While they are working on this they will continue to meet deadlines with filings, trials, appeals, etc. But in the end no I don’t think CBS or TMZ is going to suddenly settle this they smell a wounded law firm and it is business to them to tie it up and make sure the clock runs out much as football teams do.

Not just due to the tragic death of Mr. O’Quinn and the dissolving of the firm but also before all that a new Judge was/is going to be hearing this case. If I were the deep pocket Defendants, I would take my chances and wait to see what the new Judge thought of this ridiculous mess that Team Texas calls a Defamation case.

It’s rare that you get to hear what’s in the brain of a powerful politician because his phone conversations were taped.
Listening to Jerry Brown opine, berate and spin reporters about their age, his age, what they should and should not be reporting on, and his superiority to other gubernatorial candidates and figures like Hillary Clinton reminds you exactly why telephone conversations should be confidential. Here are the transcripts of the tapes, in pdf or scribd, produced by the Attorney General’s office in response to Consumer Watchdog’s Public Records Act request.
This is some pretty embarrassing stuff for the attorney general and former governor who wants to be governor again. His tone, arrogance, and obsession with his own image as it’s seen in the media are anything but gubernatorial.
A sample. Brown on Hillary: “She doesn’t have the scope. She didn’t work with Mother Theresa. She didn’t spend six months working in Zen Buddhism. She didn’t take Linda Rondstandt
to Africa. She didn’t have her own astronaut.”
Brown had to release the transcripts because his own communications director taped the phone conversations with reporters surreptitiously and, I believe, illegally.
The whole affair only came to light when my colleague and mentor at Consumer Watchdog Harvey Rosenfield complained that Brown had rewritten the official title and summary of a proposed ballot measure to exclude any reference to insurance premium increases after the measure’s sponsor, Mercury Insurance (a donor) pressured Brown’s office.
Brown’s team went apoplectic over the charge, and, as the transcript show, leaned heavily on editors for the San Francisco Chronicle to keep the story out of the paper or rewrite it. Brown’s press flack e-mailed the editor a transcript of a conversation between top attorney general officials and the Chronicle reporter Carla Marinucci. That led Marinucci to question whether Scott Gerber, Brown’s communications director, had been taping conversations with reporters. Indeed he had, which gets us back to Brown’s demeanor on the transcripts.
The public should judge for itself the appropriateness of what Jerry Brown says.
A few public policy issues must be dealt with as well:
First, Brown shouldn’t be allowed to investigate his own office’s actions in this matter. He issued a white wash report yesterday blaming only the rogue P-R flack Gerber (fired last week) for the surreptitious taping and claiming the conduct was not illegal because the conversations were “on the record.” That just doesn’t comport with a reasonable reading of California Penal Code 632. A person talking to a reporter may not have a reasonable expectation of privacy, but the reporter had a reasonable expectation that her comments wouldn’t be recorded.
Also, in one of the e-mails released with the transcripts, Brown’s top deputy is informed that Gerber wants to tape the conversation with Marinucci. Chief Deputy Jim Humes claimed not to remember reading the e-mail. That just doesn’t appear credible. Another independent law enforcement agency needs to investigate and depose key participants, including asking whether anyone outside the Atty. Gen.’s office, like top political aides to Brown, saw these transcripts.
Then there’s the issue that Brown is clearly running for governor in April if you read the transcript of the conversation with Associated Press reporter Beth Fouhy. He even says he has “two jobs.” Yet Brown hadn’t opened up a committee to run for governor. The Fair Political Practices Commission needs to look at this because it appears that Brown was campaigning for office and should have opened up a gubernatorial committee in April, when the conversation with Fouhy took place. If Brown spent or raised money for the office, he should have created a committee, and the interview suggests he was doing both.
Lastly, there’s the original matter of Mercury Insurance Company’s anti-consumer ballot initiative. Brown rewrote the official title and summary for the measure that will allow insurance companies to lower or raise rates based on whether a motorist has had continuous insurance coverage. The measure has not changed on this point, yet Brown struck from the second summary, which appears at the head of the initiative and on the ballot, any reference to premium increases. He only mentions discounts. That’s one sided. More here for a deeper explanation.
Mercury Insurance, the initiative’s backer, gave Brown’s Attorney General campaign committee $13,000 the day before it poured $500,000 into a campaign committee for the ballot measure. Brown needs to return the money and give the responsibility for an accurate title and summary over to an independent third party.
All of Brown’s laudable spiritual, charitable and political growth has clearly inflated, not deflated, his ego. Yet to govern California with its present woes Brown will need to check that ego at the door and dig in.

This falls into the ‘why bother’ category; a lackluster and incorrect presentation of VA’s baseless case.
The primary argument is res judicata concerning the already decided ‘Mommie Dearest’ interview/case and the ‘prison’ interview done by AH on behalf of a CBS show. The AH interview only came about because of the ‘Mommie Dearest’ interview. In Houston’s Federal Court, VA could have argued CBS was responsible (which it is) for both the ‘Mommie Dearest’ and the ‘prison’ interview and both were defamatory(which they are not, both are true); VA didn’t make such an argument.
CBS has already argued correctly that both interviews are related to each other and VA couldn’t meet the burden of proof for one of them; too bad; no second bite at the apple in a different Court; not now, not ever.
VA on the other hand tries to spin a tale that RT emailed AH and blah, blah, blah – the ‘prison’ interview happened; that is, RT’s involvement is a key factor (as attested to by the non-witness to anything QV) and thus the Federal Court could never have heard a case with both interviews involved since RT as a TX resident destroys diversity. Well, news to what’s left of the O’Q Firm; RT, QV, emails, gossip, ‘they said-they said’ stuff has nothing to do whatsoever with the ‘prison’ interview. CBS produced both, both are fruits of the same tree; the matter has already been judged. Whether or not the ‘prison’ interview is defamatory doesn’t depend on any bloggers’ involvement. Just because VA cares to present the ‘prison’ interview in a different way to the State Court than the ‘Mommie Dearest’ interview was presented to a Federal Court doesn’t mean the two scenarios are actually different.

- It’s a continuation of ‘we deliberately made this up on the internet so we should know who said what’ syndrome.
I don’t know why CBS doesn’t just hand over the materials from the Federal case; VA’s depo where she admits that not a single word of the ‘factual background’ of the “Mommie Dearest’ and ‘bloggers’ case is true (she of course made it all up being a stranger to all whom she implicated) and McCabe saying in Court that the ‘step-brother’ story was substantially if not literally true; VA’s ‘friend’/agent/provocateur’s statements, etc. Enough is enough; just shut it down.

The lie of the VA people is clear here. In VA’s First Amended Original Petition, wherein AH is brought into the ‘conspiracy’ nonsense, AH’s ‘prison’ interview is referred to as a ‘replica’ of the ‘Mommie Dearest’ interview; which it clearly is and which CBS says it is also.
By the Fourth Amended Original Petition, the wording has changed and the ‘prison’ interview is detailed much differently. Suddenly the ‘Mommie Dearest’ interview which VA couldn’t prove was defamatory, is an alleged watered-down (by CBS) version of ANS’s full interview; ‘leaving out’ rape allegations. The ‘prison’ interview is described as a ramped up and alleged ‘different take’ whereby bloggers and HKS/Bonnie ‘urged’ AH to delve into the rape allegations to a greater degree than CBS was allegedly willing to go with the ANS interview. The preposterous notion is that without the TX connection AH would not have done the ‘prison’ interview. Another preposterous notion is that CBS was hesitant once but not twice.
McCabe is also aware that VA gave a declaration for Cosby wherein VA made it clear she couldn’t know for a fact if ANS was sexually abused; VA could only say she didn’t witness any such thing.
- This is a continuation of the ‘tell one Court one thing, tell another Court something else’ syndrome.
Let’s hope the new Judge is one who reads docs before holding hearings.

There are many reasons why a woman has to have a C-Section at child birth, I never knew or if it was discussed why Anna had a C-Section with DL, if so I must have missed that. I have never heard that a woman has to have a C-Section because of drugs, ( pelvis not spreading, breach baby, baby not dropping, age of mother, etc. but never because of drugs that I heard of), I wonder what more can be thrown at Anna?? Sad. If DL needs a psychiatrist in her life imo it will be because she needs help to cope with greedy family members trying to get their hands on what is rightfully hers.

My daughter was induced with first child and ended up having to have a C-Section due to her size also 1st GD was facing sideways. With her second, the doc scheduled a C-Section along with a delivery date early in her pregnancy little did we know my second GD had already had her mind set when she would enter the world which happen to be 2 ½ months ahead of schedule. All this with my daughter was due to her size she is very small and even while pregnant she was lucky to weigh in at 115lbs when she delivered both GD.

Brooks and Dunn were there together and preformed, they didn’t win anything this year again (Sugarland duo has been picking up the best duo award for a few years now) they (Brooks and Dunn) are splitting up and going to either go solo or retire, not sure.
Not too sure about future of their careers, just know it was announced they would no longer be a duo.
On the View this morning they said that Darius was only the second black artist to win New Artist in Country Music.
I think the first was Charlie Pride. Oh, the memories! LOL I was a country and oldies fan when all my friends were into rock years ago.
It was also stated on the View that Mike Tyson was a victim in that confrontation too. He was at the airport with his 10 month old child and his wife.
Though I haven’t been on anywhere yet today to hear the details, which really doesn’t matter – you can’t hardly believe anything completely anymore.
Doesn’t matter if you read it or hear it reported, you almost have to see it with your own eyes to know what really happened.

“..Lindsay followed no known TX law in her rulings compelling production. She repeatedly made it clear that she rarely read lawyers’ paperwork submitted to her court. The conduct of the ‘bloggers’ case has never been acceptable. The 1st COA will ensure no one’s personal computers will be turned over to VA; whose people are well documented to use such information for nefarious purposes.
VA dropped her Federal case just before the big CBS hammer was about to drop (a Motion for Summary Judgment) and reworded her baseless claims for Harris County (and Lindsay actively solicited the case). Every word of the ‘bloggers’ case is a lie and VA and McCabe both admitted such in Federal Court (in as many words) before burying that case and lying again to a very receptive County Court.
A request for a continuance is an effort to bide time to wrap up this disgusting case and appropriately compensate the many people harmed physically and financially. Imagine McCabe telling the Court that THREE Writs of Mandamus amounted to ‘delay’ tactics by those defendants. This would be an excellent time for a new Judge to demand a prima facie showing and dump this case before it embarrasses Houston anymore than it has.

“Well, the 1st COA is certainly going to force some hard decisions on the trial court as it explains TX law to it. With no more fishing expeditions allowed based on ‘blogger rumors’ and McCabe fantasies, what to do, what to do.
The core allegations of the ‘bloggers’ case were already made and decided against in and by the Supreme Court in Nassau, The Bahamas.
VA never did and never will have any legal standing to be ‘harmed’ by usual and customary comments directed her way when she sought out paid media and highly offended most people who witnessed her public statements and behaviors.

Beth [96] tonight is Survivor, CSI and the Mentalist. I did not see the interview but happened across the woman’s picture that is horrible. You would think with the technologies these days someone somewhere should be able to do some sort of reconstruction for her.

JMA and Beth – I enjoyed the CMA’s last night as well. Taylor Swift was up for 4 awards and won all 4. Heard on th news earlier tonight that Taylor has carved out her own niche in Country which in turn has brought the young people in. CMT is running a Dateline special on Taylor this week. Excellent – the next airing is Saturday at 9:30pm est on CMT. Try to catch it. It really is worth watching. The young record producer that signed her had left Universal with the intent of starting his own recording company. At the time of signing, he told Taylor he had great faith in her and was starting his own company and would she give him a chance. She liked him and said yes. The rest is history. If you watched the Country Duet shows back in the summer he was sitting in the first seat of the judge’s panel. He was jumping with pure joy last night with every win for Taylor.
Brooks and Dunn were great last night. Sorry to see them split the team but all good things come to an end at some point.

Beth – the DVR is a wonderful invention. It can be rented monthly from your local cable of satellite company. The DVR with dual receiver is capable of recording 2 programs at the same time while watching a previously recorded program. Recording time varies depending upon the company’s preferred DVR. Some record 35 hours, others record 70 and Dish Network records 100 hours. A lot of viewing hours.

Big Kenny and Big Machine Records president and CEO Scott Borchetta will join Naomi Judd as judges on the second season of CMT’s Can You Duet, it was announced Thursday (May 28). Hosted by CMT’s Lance Smith the weekly music competition series from FremantleMedia North America, the producers of American Idol, seeks to find country music’s next great duo and award them a record deal with Big Machine, label home to Taylor Swift, Trisha Yearwood, and Jack Ingram, among others.

Ok folks 2 new articles are up and some papers are up still not feeling very good today yes Beth and JMA and I tell Ken he better not bring anything home for me to catch… but yea I am starting round two of chemo and there is some new meds they put me on that might be affecting my “taste” and we all know how much I love my morning coffee….
I am going to lay down for a bit and tomorrow will have a big expose on Michelle Braun, the Hollywood Madam and just who all was involved in her call girl service including her brother a California attorney…
