The Texas Lawyer Web site today said that, “John M. O’Quinn left his personal property — except for his vast car collection owned by Classy Classic Cars Ltd. — to his charitable trust, the John M. O’Quinn Foundation.”
In a will O’Quinn signed in 2008 that has been filed for probate in Harris County, O’Quinn left his ownership of his firm and any client matters to the co-trustees of the O’Quinn Law Firm Trust and directed the co-trustees to “provide for the orderly winding up and dissolution” of the firm by taking steps such as transferring case files and/or engagement letters to other lawyers or firms, and to sell or dispose of assets of the firm.
Once the winding up and dissolution of the firm is completed, O’Quinn writes in the will, any remaining assets shall go to his charitable trust.
Christian Steed, managing attorney of the last 17 lawyers at the O’Quinn Law Firm, says the firm’s lawyers continue to represent the firm’s clients.
He refers questions about the firm’s windup to Gerald Treece, a professor at South Texas College of Law in Houston who is of counsel at O’Quinn’s firm, the executor of O’Quinn’s will and one of the co-trustees of the O’Quinn Law Firm Trust.
However in an interview on Sunday Mr. Treece said all of these matters will be approached and dealt with after John M. O’Quinn’s funeral which is being held on November 4, 2009 It is expected that the dissolution of the firm will go smoothly.
A meeting shortly thereafter with the other co-trustees of the law firm will go through the existing cases and make decisions about which other law firms might be willing to take such cases. Some of the lawyers from the firm are preparing to leave shortly after the announced dissolution of the firm by Mr. Treece the sole executor of the Estate of his life long friend John O’Quinn and one of the trustees of the O’Quinn Law Firm.
The will is said to be written very simply and to the point, showing that John O’Quinn never left anything to chance. In the end all of his mass wealth will go to help many others throughout Houston and Texas both the city and the state he loved.
Those of us involved in adversarial suits with the O’Quinn Law Firm will be contacted them next week to work out any settlement arrangements that might be proposed. At least one of the lawyers is rumored to be preparing to relocate out of state. There are also allegations that the claims from clients, lawyers, and cross claim on exisiting lawsuits will take precedence and the firm will not be taking any new clients.

Some [won’t mention any names] are going on the statement that was made right after Mr. O’Quinn’s death you know where the announcement was made that Christian Steed, O’Q’s Managing Attorney would take hold of the reins and move the O’Quinn Law Firm forward, business as usual. Hmm looks to me they jumped ahead of themselves and had no idea what O’Quinn’s final wishes were in reference to the Law Firm. Sorry everything in that statement conflicts with what is written in Mr. O’Quinn’s Will.

The O’Quinn Law Firm has suffered a profound shock from the tragic deaths of attorney John M. O’Quinn and Johnny Cutliff. We are mourning and will continue to do so for some time. Bet there will be some sad faces this Holiday season (Thanksgiving & Christmas)
Those sad faces will consist of all employees of the firm and any pro bono clients I assume.
Some happy faces may be; ANYONE that the COURT ORDERED that firm or JO’Q personally to pay costs, restitutions, ect…
All of his suits that he was named a defendant and the other lawyers won — put have not been paid yet.
That has to legally be done before any remainder is consolidated with the charitable foundation and is given away to the various charities he supported.
I am very happy for all of the people that will benefit in those charities, no matter what issue they are regarding. Hopefully, most of them are for children.
Bet the ’severance’ pkg will consist of a percentage of the average income each lawyer has pulled in since they have been there.
example: if a lawyer brought in (after costs) a profit of 100,000 for the firm each year for 5 years… the pkg. could be that amount > ($100,000.00)
Of course if it was differing amounts (as most likely it is) the profits would be added for 5 years, then divided by 5 for the average.

Ha-Ha now the haters are thinking that O’Quinn’s meant the Co-Trustees cannot take any of the existing case themselves but the Attorney’s who are handling them, so the haters are thinking business as usual. Well from what I read and Beth posted as well in the Will there is mention of ’severance pay’ uh doesn’t that mean the employees are being paid for their years of service due to the firm is being dissolved.

I have not pulled up the Will of O’Q yet. I tried but this connection is too slow, I put it in favorites when I get the faster connection on this computer.
So, the Will even mentions the severance pay… HMMmmmm—> I am anxious to read it, even if it is straight forward like some of the posts and articles have mentioned.
Very interesting no long time employee got a percentage of the firm’s ‘ending assests’ after deductions of costs… I mean if he had 3 or 4 people with him 20 years then they actually helped the firm to become as strong as it was. Well, I am guessing because I have not read it yet, but no one has mentioned that so far in any posts.

I honestly do not see ANY firm wanting a case that has cost this much money with no clear return in sight.
VA is NOT a compelling plaintiff, I mean the skeletons in her closet… like David Leigh trying to drum up money off the deaths of her kin and all,
not to mention how Anna felt about her, and what Anna said about her childhood in the Mommy Dearest tape.
Man! ANS was dead serious and stone-cold sober when she was talking to her estranged mom looking into that camera! That was NOT ACTING!
I hope this means that Bonnie is also off the hook! How absolutely RIDICULOUS was it for TX to try and hold up her case in B.R. Court!
I have always felt ALL of those moves were made to try and FORCE HKS to say enough – I give in. He was stronger than TX thought! Him & LB both!

I have a strong feeling that the Marshall case will end with little to nothing coming to Anna’s estate… I hope I am wrong, but if not at least I hope they get compensated for all of their fees… because Pierce REALLY did DISOBEY the law! TX pulled a bunch of illegal crap on Anna, whether you agree or disagree if she should get a penny more from the Marshall estate > They (TX Courts) did not even give Anna a fair hearing and Pierce BOUGHT his way in those Courts! IMO anyway!

JMA The Texas Lawyer is normally right on the money in articles because Texas lawyers read them daily…
NONE of the co-trustees whose job it is to place the cases or get other firms to take cases, letters of engagements for future cases etc. are lawyers for the firm so they will become pragmatic… how long will it take to get rid of what they can, anything they are in with other firms I would think those firms will take over… if an engagement letter is signed but no case started they attempt to call around and get a lawyer or law firm to take it… if a case is a no money maker or cost more then what the co-trustees think it is worth to pursue then I would think like “bean counters” they will try to settle those with no loss, as in NOT paying the other side legal fees and walk away… that is my opinion only… dissolve is a pretty easy word to look up, now how long they are instructed to do that in, 9 months or 9 years, I am not sure how that works but the firm IF it lasts will not have “The John O’Quinn Law Firm on the letter head” and without that, the brilliance and the power to persuade judges look to me as if it is gone…
If you notice Christian Steed who pays the bills monthly for the firm is passing off questions to the executor of the estate and co-trustee for dissolving the firm. That no comment speaks volumes I think

In law, dissolution has multiple meanings.
Dissolution is the last stage of liquidation, the process by which a company (or part of a company) is brought to an end, and the assets and property of the company redistributed.

I know this does not mean the end of all case that were being handled by the O’Quinn Law Firm it means they will not be handled by the Attorneys that were employed by the O’Quinn Law Firm. Virgie Arthur’s case most likely will be handed off, sold, transferred or whatever to another Attorney/Law Firm that is IF there are any takers. Seriously, what other Law Firm not only wants to carry VA’s expenses but also wants to ruin the reputation of their Law Firm by taking on a damn blogger case.

I have a new article up with the excerpts from the Will and the whole Will itself… I think all of the defendants pro se in the “blogger suit” feel surreal today. My opinion that suit was brought not in hopes of making money, but as a personal vedetta against HKS and Wood…. I truly think as the new article says, O’Quinn has smiled, winked and walked into history books wanting to be remember for his good deeds, and his cars and wanting no firm to have his name as part of it.
Now the Estate I am sure is going to be sued by a lot of people including Cutliff’s family… The VA suit was losing money with little hope of recovering more than some of the loss incurred since 2007 representing her… I really doubt any law firm is going to “buy that case”, as the article says I expect them to meet filing deadlines but without the O’Quinn backing the budget is going to be ramped down to minimal IMO

Beth considering that I used to get 2 or 3 emails a day with papers or asking questions… it is now 0, and has been since one email sent on the 29th and one on the 30th but both of those had to do with filings completed before O’Quinn’s death… it is really eerie feeling… I am sure ppl will regroup next week as the trustees for the law firm can meet and then meet with the lawyers and staff

Lawyers have a certain personality trait imo, and yes I think we need Lawyers for both sides absolutely, They are adversaries in the court room but they are still human and should know decorum. Every case they take on is because they are in it to win it, IMO the Blogger case was a vendetta case and the plaintiff did not care who or what lives he destroyed and in that quest a grandmother and mother of a young child was jailed, their liberty was taken away without regard and the only reason the bloggers were even in it was because of jurisdiction. I doubt a respecting Law firm in TX. is going to pay and take over O’Q’s vendetta, Imo they will be no takers. IMO I think next week or shortly there after the lawyers for the other defendants will start taking action to dispose of this matter and it will be business as usual for them.

pixiemom50, IMO, I think it started right after Daniel died, I think imo that they knew that would crush Anna and from then on the plan was put into action imo.
We are just finding out how deep this all goes and how many states it runs, (As we all always thought ) But Wood is doing a great job in uncovering it I think.
I think that VA would not have gone on TV after Daniel’s death and tried to goat Anna ( so to speak) if she did not have backing and Anna refuted with the ( bring it on mom- the mommy dearest on ET from Anna), Imo this was a plan long before Anna died. How F*ucking evil is that???, One who does not care what casualties they leave in their wake is not one imo that deserves to be honored in death imo, no matter if one goes to church on Sunday but right after church their real life begins, it is for God imo to sort it out, and I am referring to the man behind the the curtain.

I mean, do you think one possibility is the COA might actually contact McC and ask do you even want us to proceed with this Motion from the Defendant? I mean not *ask* if they can proceed but inquire if McC is even going to continue this farce?
That still did not come out the way I meant, lets see – who do you think will make the next move? One of the Defendant’s lawyers or McC? I wonder if TX drops the case, if TS can still keep her case going to have all that crap she (and LH) went through expunged and then reimbursed for anything? Maybe it would be better to have the case tossed by the COA, and the O’Quinn Law firm pay everyone’s defense costs, pro se also!
I do hope that something will be done before the first of 2010.
If not, do the hearing dates just continue? Crazy case, should have never got this far. There is no actual proof of any defamation to this limited public figure VA.

Well, I’ve always seen this ‘bloggers’ case as a data-mining operation meant to harass and impoverish people along the way as more false witness or more false evidence was ‘developed’ against HKS and LB. It’s never been a legitimate suit that any other usual and customary lawyer would have contemplated.
I would expect O’Q’s Executor is the one who would order the dismissal of this disgraceful case; the same person tasked with letting go and providing severance to mere employees like Clark and McCabe. I would also expect a dismissal with everyone assuming their own costs would be proposed; otherwise severely damaged people like LH, TS and Bonnie would be thrown into Harris County Probate and have to argue damages against the Estate and against all odds.
The costs of the 1st COA and the TSC continue to accrue as long as the trial court case remains on the books. It’s likely too much to hope that the 80th Court would award even Attorney fees since that would require a ‘bad faith’ finding against VA’s people. Judge Lindsay propelled the case forward; that pretty much negates the argument of ‘bad faith’ on the part of VA/McCabe.

I have been watching the races that are and have gone on and the amount of money spent,Can you imagine how that money could be used to help people if it wasn’t spent the way it was .The way money buys an job in any of our government state or federal is a disgrace.It is no wonder we have trouble getting trustworthy individuals into our government,It seems you have to have the money like Meg w. and Mitt R or the rich backers like Brown what a shame.

In a lot of the other States it is the big Medical Insurance Corps…
We as the ‘little people’ should in essence be stronger if we would all organize like the big corporations.
We may not have the big bucks, but we are the ones who vote. It is so frustrating!
I agree about securing the Borders, and get the money from the Fed. Gov’t to reimburse this State on
what we have spent on illegal immigrants. (prison, medical, schooling, state programs,ect..)
It costs this State twice as much to ‘house’ a prisioner than other States? That is BS. She is not for ‘early release’

I will try to make chat tomorrow, it has been such a very sad week. My oldest daughter 23 has lost her very best friend, he was
just 25 and a year ahead of her in school. I have cried for days… He was just here at my house about a year ago and put my front
porch wooden bench together for me. It was sudden, throwing up for two days, then stopped breathing… the ambulance paramedics
got his heart started but no brain function. Then he passed in the hospital, I have tears still flowing as I am typing this.
It happened on Wed and he died the next day (Thur) of this week. They found his blood sugars to be 15,000, I do not know that much
about diabetes, but maybe a undiagnosed case? There is still more info to come out. Just breaks my heart. He was like a older brother
to my girl, he loved her so much like a little sister and they were the best of friends. Well, my eyes are so blurry I cannot type anymore.
Just honestly hurts us all down to the core

Oh thank you so much… it is just so sad. This is the first ‘close’ loss for her, she is beyond comforting. I do not know what to do.
The entire house is just so saddened by this, the younger girl said, mom I don’t want to go to the funeral.
You know over the last few years when life has been tough… I always found solice in coming here, discussing the latest in the cases
to help my mind go somewhere else. IYKWIM
With everything quiet on the cases now, it is like I am looking for another avenue to get my mind off of the devastations of
reality and the heartache of daily life events. Not to say that these cases were not real to all of those intimately involved…
It is just not the same anymore with the ‘threat’ of TX being gone. I truly cannot wait until the Executors of the O’Q law firm toss this
stupid case w/ VA… but I cannot even find too much interest in the CA one. I believe I have used up all of my strength of protest for
justice to all. Just so frustrated with the Courts, the Judges, the government, everything.
A losing battle, why bother being pissed off about their actions.
Beth [47] you know it is always hard to know how to comfort those who have lost someone they loved or cared about but I feel it is even hard consoling our own children when they suffer a loss. My oldest daughter went through something similar two years ago but this was someone she thought was her true love, of course she was a teenager when she thought he was the one. Any way long story short he took his own life [hung himself] two years ago this month leaving behind a teenage son and two young daughters. After his viewing my daughter asked me, do you think if it would have worked out between him and me, he would have still done it? Sadly, I could not give her an answer because I did not know why he did it; matter of fact neither did his family.

Oh JMA how very sad for your daughter. I do think not knowing why must be very difficult. Very tragic for his children to have to go through that too.
I do not know why this beautiful young man, (I mean really handsome – inside and out) did not get taken to the hospital before his system shut down.

Really sweet of you to discuss this with me, it has been difficult for me to ‘verbally’ state my sadness and all the other emotions to go along with it.

(I am not used to there not being any news on the ANS saga) Strange feeling… my escape to other ‘thoughts and causes’ is forever gone I believe.
OK I have happy news to share. Do you all remember last year when I was telling how my brother who lives in Germany was going to come home for Christmas but when he went to purchase his airline ticket’s he had an issue with his passport and could not get it resolved until this past May? We were all so disappointed cause we had so many plans. Well I talked to him last night and he said they are [him & sis-in-law] coming for sure this year. He has not been home for a visit since August 1994 :-( and boy does he have a lot of new little people to meet.
OK so now we are back to the plans we made last year and the biggest is keeping it a secret from my parents. Last year we were thinking of putting him in a big box [of course no idea how to get it in my parent’s house] with a bow on top and have him jump out. After discussing that plan my other older brother and I were not sure it was a good idea due to our parent’s ages, we did not want to give them heart attacks.
I am so excited due to this Christmas my parent’s will have all their children there.

Beth, I just logged on and read your post, Damn, I wish I had words to express my feelings, I just know that our children no matter how old they get are still our children and ones that are so close to our children feel like our own too, I know you are doing this but all I can say is just love and comfort her and let her express herself and all emotions she has, I am so sorry to hear of her and your loss, Such a tragedy at such a young age, God Bless you all and his family, The ones that die I believe are at rest and the ones that loved them are the ones that suffer and I know that suffering all to well, Especially when it is so unexpected, I do believe in God, and when my time comes I hope to have answers because I have so many questions as to why and I am hoping that I will know then because so much sure a hell does not make sense now. I am sincerely feeling for you all.

OK peep’s now I’ve read/seen it all, some VAS are sorta insinuating that O’Quinn’s vehicle may have been tampered with. Now I wonder which parts they missed concerning what police said and witness’s accounts that O’Q was speeding past them, slick roads, no seat belts and possible talking on cell phone while driving.
