Johnny Lee Cutliff’s Family Quietly Mourns Their Loss While Accolades and Questions Continue to Pour In for John M. O’Quinn

Quietly yesterday and last night family and friends gathered at the home on the northeast side of Houston Texas of Johnny Cutliff to pay their condolences to his wife of twenty-five years, Rosemary Anderson. Johnny Lee Cutliff was described as a modest man by family members who said Cutliff loved John O’Quinn and loved working for O’Quinn.
Relatives describe Johnny Cutliff not just John O’Quinn’s personal driver and attendant but also O’Quinn’s “right hand man” and had been devoted to O’Quinn since 1983 from the first day he worked for O’Quinn. That was before the big wins and the tragic personal and controversial life of O’Quinn unfolded before giant corporations, fellow lawyers with O’Quinn or those on the other side in opposing O’Quinn. It was 1986 when O’Quinn began his own quest of wins to become the most reverend and also the most reviled lawyer from Houston Texas. Mr. Cutliff was one of the few who was in John O’Quinn’s trusted inner circle.
Quite different from the accolades pouring in from around the country for the man described “bigger than Texas”, Mr. Cutliff’s widow sat at her kitchen table and watched the scenes over and over again on her television play out while wondering why. “I really don’t understand how it happened,” she said, staring at the pictures of the wrecked vehicle on TV. Rosemary went on to say, that he, Cutliff, hardly took a day off in the 26 years he had worked for John O’Quinn saying; “He didn’t want to take no vacation or nothing, he really loved his job.”
Rosemary said of her husband that since she first laid eyes on Johnny Cutliff at a Sunday gathering at a friend’s house a quarter-century ago, she loved “just being around him.” Cutliff attended Lakewood Church every Sunday, relatives said. He was “a terrific dad” to his only son, who died in 1993, and a role model for his grandson, his daughter-in-law, Rayna Polk, said yesterday “It’s just shocking for things to happen the way they did today.” Mr. Cutliff was 56 years old.
Our heartfelt condolences go out to all who loved Mr. Cutliff, from his family to friends to those who attended church with him weekly, the pain will remain long after the funeral for Mr. Cutliff as this modest man’s family lay him to rest.

Very different from the around the clock coverage of the wreck that claimed Mr. Cutliff and John O’Quinn’s life yesterday morning on Allen Parkway during rush hour traffic. The police have recovered the black box from O’Quinn’s SUV and confirmed that O’Quinn and not Cutliff was driving when O’Quinn lost control of the vehicle and it became airborne landing impaled on a tree that had to be cut down to remove the wreckage. There are whispers from the Houston police department that O’Quinn was driving way too fast for Allen Parkway, which has claimed more then it share of Houstonians’ lives and left many to recover from other wrecks on this winding treacherous road. Perhaps one of the lasting tributes to O’Quinn will be that one of Houston’s most famous died on that road, and therefore it will finally be fixed as those who lived near the road said they had been begging to have something done to fix the road before something like yesterday happened. One of the witnesses to the wreck described the road as a “waiting time bomb”, perhaps now that it has gone off, the road will be fixed and no one else will be injured or killed traveling Allen Parkway.
John O’Quinn was having Accolades pour in from those who loved him, those who feared him and those still in litigation on adversarial roles. For yesterday, October 29, 2009 those in litigation pending with the O’Quinn Law Firm were quiet and respectful. L. Lin Wood one of the lawyers who had been in an adversarial and contentious battle with John O’Quinn since the spring of 2007 yesterday sent a note to Patti Lampton, a paralegal at the O’Quinn law firm. In answer to Ms. Lampton’s request for prayers for both men, Mr. Wood was one of the few who responded with, “Patti, I am in Washington, DC. I heard the news this morning and sent Neil an email. My deepest sympathy to you and the other members of John’s firm, and yes, to his family and the family of Mr. Cutliff.” it was signed simply “Lin” Even though we also are in an adversarial role with one of O’Quinn’s last big clients, Virgie Arthur, Anna Nicole Smith’s mother, we also stopped yesterday and sent one of what was probably thousands of emails to Ms. Lampton, Mr. McCabe, Don Clark and Wilma Vicedomine offering our deepest sympathy at their loss and offering any help we might be able to give as blog owners.
In interviews John O’Quinn described him and his law firm as a “Benevolent Tyranny” saying no one doubted who was in charge. O’Quinn had said in interviews he took his percentage of the lawsuits off of the top and paid the lawyers who worked for him an hourly rate with a bonus for incentive to win lawsuits. He described it as letting them taste blood like shark infested water by handling the firm in this manner. Some lawyers who knew him like Richard “Race Horse” Haynes said he, O’Quinn, never seemed to find real happiness in his life. Others in O’Quinn’s tight inner circle disputed that saying that might have been true at one time but not recently with Ms. Darla Lexington who was seen as a stabilizing influence on O’Quinn during the last years of his life. He had two failed marriages and had made it clear even as a young lawyer he did not want to have children of his own. He knew in his quest to be the greatest plaintiff litigator of all times he did not have time to be a father.
Now the questions start. Why was John O’Quinn at the Hobby airport in Houston to catch a Southwest airline flight to San Antonia for a mediation meeting at 7 AM to leave and die before 8:15 AM? It was eerie said one lawyer as the Southwest Airline counter began to page John O’Quinn at 9:30 AM to please report to the gate for boarding his flight. The airline did not know that O’Quinn had been killed in a horrendous accident over an hour earlier.
One person close to O’Quinn told us on condition of anonymity that many had been worried about his health lately and problems he was having with his diabetes, time will tell if that played a part of the crash that took his life early Thursday morning. This person said many of the almost 25 lawyers and over 100 support people employed by the O’Quinn Law Firm had worried about what would happen to them and their jobs if something happened to O’Quinn. Not only was he the heart and soul of his firm but also the driving force of brilliance of the firm. O’Quinn was known by his public persona of “Big Bad John”.
Neil McCabe appeared at the scene of the accident to see where his boss had been killed for himself. Mr. McCabe could not hold back the tears choking his throat as he said simply to the press, “That those who worked for O’Quinn were devastated”. McCabe added; “John was not only the head of our firm, he took care of all of us”. McCabe then looked over his shoulder at the wreck scene as if he could not take it all in and with tears no longer hidden said simply, “he will be missed, he will be missed”.
What will happen to this man’s firm that he built with hard work and a zealous need to win and be the best? Ken and I talked quietly about that last night and Ken said, “Rose, whether you loved or hated the man, he was a perfectionist and when the Estate is opened after his funeral next week we will find he left specific instructions for his O’Quinn Law Firm family”. John Maurice O’Quinn never left anything to chance.
Now back to today, yesterday as the death of John O’Quinn was blazing across wire services like the AP, Ms. Lampton on behalf of Mr. McCabe filed papers with the First Court of Appeals that had been prepared the day before.

I feel everyone with wealth and power always have accolades after death.As with Anna Nicole I feel a higher power,decides when enough is enough.How many people can one Law firm destroy.I am not from Texas so I do not have the same feeling a lot have about OQ.I only know what I saw and read of this man,and I for one did not like him.In the first place I HATE LIARS,and just to impress the public OQ gets on TV and states he was raised by his grandmother,I read his was raised by his father,I also dispise deceit.It is up to the man upstairs to balance the good he did with the harm he has done,

Rose ~~ nice article with that said, well Ms. Lampton was business as usual yesterday now today back to business as usual for everyone else. In reference to the last paragraph of this article that is one of those nagging questions, I have and hoping we will be able to see how this unfolds. One of my biggest questions I guess is did Mr. O’Quinn make any sort of preparation for his Law Firm meaning what does the future hold for his employees and also how are judgments against him to be handle in the case of his premature death. So many questions!

Boy, did I get lost in the timeline. He was suppose to be at a meeting at 7am? Was killed in a car accident after 8am? And the airline was paging him at 9:30am? This was all in the same time zone? And I though he had his own jet?
I do have a question though (ok maybe more than one) how does a black box tell who was driving the vehicle? By the looks of the pictures, someone was going a lot faster that 50-60 miles an hour.
I am still stunned.
#6 DG I think they determined who was driving by the placement of the bodies in the tangled wreck. Yes he was seen at the airport at 7 AM yesterday CDT, died at about 8:15 AM CDT in the SUV wreck, and Southwest Airlines was paging him for a flight at 9:30 AM ALL IN THE SAME TIME ZONE
Wonder if he was speeding to get something he forgot at the office???

DiamondGirl [6] I was wondering about the black box to. Exactly what do they expect to find on it, is it supposed to be like the black boxes on airplanes, does it record conversation, etc? I for one have never heard of a black box in an automobile. Well could be I never heard of it due to I could not afford the kind of vehicles that the rich and famous can afford.
OK Everyone I just received confirmation that the judge in L. A. has of course found probably cause to bind HKS and both doctors to trial… Remember just like a grand jury a preliminary hearing bar of proof is so low you can almost bind over for trial a ham and cheese sandwhich
JMA [10] The black boxes in vehicles (all have them if they were built after the 80’s or early 90’s) record the speed you were going, when and/or if you applied the brakes, how the vehicle was handling, etc. It’s what they (the insurance and PD) look at to determine what happened during crashes and such.
OK just showed hubby the video where we all said it looked like a face on the door, ha he did not think I was crazy he said it looked like there was.

LOS ANGELES — A judge ordered Anna Nicole Smith’s boyfriend and two doctors to stand trial on charges of illegally funneling prescription drugs to the former Playboy model.
The ruling Friday followed a three-week preliminary hearing to determine if there was enough evidence to try lawyer Howard K. Stern, Dr. Sandeep Kapoor and Dr. Khristine Eroshevich. The charges included providing drugs to an addict.
All three pleaded not guilty.
“I think you’ve proven (Smith is) an addict,” Superior Court Judge Robert J. Perry told prosecutors before making his ruling and setting arraignments for Dec. 11.
Defense attorneys contended their clients did not know Smith was an addict and were trying to help her.
“Criminalizing a doctor’s efforts to help a difficult patient is problematic,” Kapoor’s attorney, Ellyn Garofalo, told the judge in court. “A doctor’s even poor judgment is not criminal. Good faith is involved.”
The hearing delved deeply into Smith’s troubled life and the role the defendants allegedly had in feeding her drug addiction before she died of an accidental overdose in 2007.
Larry Birkhead, the father of Smith’s young daughter, said he never saw anyone take as many medications as Smith.
Prosecutors also tried to show the doctors blurred the line between being physicians and friends to the celebrity model.
Kapoor once rode with Smith in a gay pride parade and worried in a diary excerpt read in court that she might ruin him because he had kissed her.
Attorney Adam Braun, who represents Eroshevich, said his client was Smith’s friend first and then her psychiatrist.
“The weight of testimony is that my client cared deeply for Anna Nicole Smith,” Braun told the judge in court. “She was well intentioned.”
Stern’s attorney, Steve Sadow, said the drug charges should not apply to his client.
“Mr. Stern is just a layperson,” Sadow said. “He is not a doctor, and he is being charged with doctor-related activities.”
The judge said at one point in the hearing that he was convinced all three defendants cared deeply for Smith and tried to help her.
The defense lawyers also objected to charges involving the use of pseudonyms on Smith’s prescriptions. They said the practice was common and noted that Smith had even been checked into a hospital under an assumed name.
The hearing included testimony from a bodyguard who provided a searing description of Smith’s final days and his futile effort to revive her when she stopped breathing.
There also was testimony about the effects of methadone and a heavy duty painkiller called Dilaudid also known as “hospital heroin.” An expert witness said there was no legitimate medical reason for Kapoor and Eroshevich to give Smith the amount of sedatives and painkillers they did.
A pharmacist said he refused to fill an order for drugs written by Eroshevich and submitted by Kapoor because he said taking them would be “pharmaceutical suicide.”
Possibly the most powerful witness against Stern was never seen at the hearing. A nanny who worked for Smith in the Bahamas was interviewed by an investigator who read her comments from the witness stand.
The nanny claimed Stern kept Smith in his thrall by persuading her to take excessive amounts of drugs that sent her into a stupor. The nanny, Nadine Alexie, said Smith sometimes slept for three days at a time after she was given drugs by Stern.
Although the judge reminded lawyers repeatedly that this was just a preliminary hearing, it had the feel of a mini-trial. But defense lawyers, who challenged testimony on cross-examination, presented no witnesses of their own, holding back their evidence for trial.

Howard K. Stern and Anna Nicole SmithA judge today ordered two of Anna Nicole Smith physicians and her onetime boyfriend to stand trial on charges of conspiring to illegally furnish the 39-year-old with prescription medications.
Superior Court Judge Robert J. Perry said the legal standard for the defendant to face trial was “very minimal.”
“I do find the people have met the task of convincing this court there is strong suspicion that the defendants committed the act.… I do find the proof is sufficient to bind them over for trial,” Perry said in a downtown Los Angeles courtroom.
Arraignment has been set for Dec. 11 and will be overseen by another judge. [Updated at 2:30 p.m.: A previous version of this post said trial was set for Dec. 11.]
During court proceedings that began Oct. 13, it was revealed that Smith spent the last days of her life drifting in and out of consciousness under the pale blue comforter of a king-sized hotel bed, too weak to walk, sit up or drink from anything other than a baby bottle.
The supermodel died in 2007 from an overdose of a sedative and other drugs at a hospital in Hollywood, Fla., near the Seminole Hard Rock Casino, where she had been staying. A medical examiner ruled her death an accident.
But a multi-agency task force spent two years investigating how she obtained opiates, sedatives and other drugs — 44 different medications — before her death.
Prosecutors ultimately charged two Los Angeles doctors who wrote her prescriptions, Khristine Eroshevich and Sandeep Kapoor, and her longtime companion and attorney, Howard K. Stern, with offenses that include prescribing controlled substances to an addict and obtaining prescriptions under a false name. All three have pleaded not guilty.
During testimony earlier this month, Special Agent Danny Santiago of the California Bureau of Narcotics Enforcement summarized an investigation that stretched from pharmacies in the San Fernando Valley to the casino hotel lobby in Florida. When Smith arrived at the reception desk Feb. 5, 2007, accompanied by Stern and Eroshevich, a psychiatrist, there were already signs that Smith was ill, Santiago testified.
The hotel employee who greeted the group recalled Smith, a repeat customer, leaning on Stern to walk and seeming “out of it.”
“He just stated she wasn’t her normal vivacious self,” Santiago testified that the employee told him.
Many of the dozen pill bottles found in the hotel suite where Smith died were prescribed by Eroshevich and were filled the month before at a Studio City pharmacy in the names of aliases, Santiago said. Eroshevich was Smith’s next-door neighbor when the model lived in Studio City and had traveled to be with Smith in the Bahamas after the death of her son, Daniel, the detective testified.

I wish there was a seperate thread so as not to sully the deaths of two individuals. But I guess it is what it is.
Easy to take the ‘eye for an eye’ scenerio and lump them together. Mr. O’Quinn’s death and Anna’s. Both controversial figures. And for the life of me, I just can’t go there. So I won’t. At this juncture anyway.
The news is the CA case is going to trial. After reading the latest filing and the mention of the funeral (Anna’s), it’s hard to differentiate between each case any more. The lines are so blurred. In essence, they all are the same. So maybe now answers will come. One or more jury’s will dictate someones fate. No more hiding, no more lies. I hope everything comes out in the open.

Fourteen years ago, Mr. O’Quinn appointed attorney Christian A. Steed as Managing Attorney for the firm. Mr. Steed will continue in that position as the firm moves forward to service its clients and cases. The attorneys and staff who have handled this firm’s cases will continue to do so as they have in the past, consistent with the proud traditions of this firm. Our heads are bowed in grief. But we know John O’Quinn would not want us to waiver in our commitment to our clients. We will not do so.

How does that black box determine who was driving? Don’t get me wrong, I think OQuinn was driving since it had been reported at first that the LE wasn’t sure who the other dead passenger was.
DG [21] They probably determined who was driving by where the bodies were in relation to the wreckage. The black box will tell them how fast the vehicle was going, when (and if) the brakes were applied, and how they were applied, of any trouble the vehicle was having (mechanical, computer, etc) and other such data.

My personal prediction is that a lot of employees at the O’Quinn firm will be brushing up resumes this weekend.. Without O’Quinn I predict the firm will dissolve in less than 2 years…

I forgot to say that Roxanne has called a few times today and says thanks for the outpouring of love and support for her right now. She is spending a lot of time with her friend’s family helping them with arrangements. The viewing and funeral both will be held on Monday… She is still in shock then cries, then is angry and then is just there like we all know Roxanne will do for anyone she cares about… Keep her in your thoughts and prayers…
Beverly, I think they will look into all avenues of what may have caused this accident. He no longer has to fight the daily demons that he fought for a decade, may he finally find peace.

The thing that really bugs me is the attitude of ‘lets get back to the latest gossip and whose throat can we rip out next’. And that’s what really touched me because I didn’t see that attitude HERE. As to the Firm, I’m sure he has measures in place. That was his field. I’m older, so is my hubby. My children are grown. I have grandkids. And we have never had a will. I guess it’s something to look into. Because for a split second, life can change quickly, forever to change the life of those who loved you.
Oh…and for any kind of self control I may possess at times, is thrown to the wind, as I try to quit smoking or at least slow down. So excuse me when I turn MORE into a bitch.
I think it was all a power play, or a game, to John O’Quinn, may his soul rest in peace. Other peoples lives should not be toyed with. Period. It is unfortunate that John O’Quinn did not live to see justice served, imo. Just think of the high-fives that would have been going on today in the O’Q Law Firm. Malice aforethought, imo. Intentional tort. Civil Conspiracy. And death changes it all, or does it?

Bewildered we have never been about “lets get back to the latest gossip and whose throat can we rip out next” There has been times when we were given a ’scoop’ so we could be the first and we declined and waited… it is about learning and growing from what each of you share with us for me… not beating some “rag site” at “we are first with the gossip”.
I see the autopsies of both men show multiple blunt force injuries was the cause of death… and they are investigating whether O’Quinn was using his cell phone and speeding both at the time of the wreck.

I have often wondered why when someone dies people only remember or at least only tell of the good.There were two sides to MR O’Quinn and they were not all good.Only one article gave the unvarnished truth about him and the many problems he had.Rose is right what about the other man wasn’t he just as important as Mr O’Quinn?IMO Yes and he should not be shoved aside by those praising mr O’Quinn and after listing to some from his firm it seems like that is what is happening.

Yes hmm and Bewildered I know you both were talking about other sites and not this one and I feel so fortunate that those who post here are like that and yes we ALL get angry. I have made a lot of mistakes since the site opened in 2007 and most of the worse ones were anger when I should have walked away and cooled down…
I saw a right on quote from one of O’Quinn’s past law partners it said something like “full of faults and thought he could make no mistakes”… O’Quinn’s arrogance and I’ll show you hurt a lot of people and his intent on taking what he viewed as enemies down no matter how many millions he had to throw at the situation… That kind of anger must eat someone up no wonder many of his friends said although rich he never found true happiness… That is the sad part for me… money is shallow, it can buy you luxury in your days of fighting internal demons but it never brings anyone peace or happiness. Like DG said I hope he has found that now.

Beth, I just saw that and I am not even going to read that BS, I posed a question to Harvey yesterday why he is not posting on the site that O’Quinn died and I looked in TMZ’s search box and anything that relates to O’Q is gone, I am not sure if it is because of the blogger case in TX but it seems that Harvey had alot of info a few days ago and is major backing-off and TMZ is running with the tabloid propaganda that has no insight as they all do that are in the business of tabloid sensationalism, What pisses me off more then anything is that Harvey knows the truth. The SC trial begins long before CA. I believe a few of those “living” this saga may be in for a surprise. A Court of Law in SC will have ruled on evidence admissibility and legitimacy by then. We’ll all begin to see what evidence may or may not be allowed in CA after that, come Dec 11.

Good morning Everyone—-My quess is Howard’s Attorney already knew they would be going to trial.so he brought no witnessess to court,It bothers me to see all this lynch mop mentality again.Also,it is hard to swollow,watching all these Hollywood (stars) who are admired so much by TMZ The young reporters,that work for Harvey Levin,party down,drunk,being praised.We have a big problem in the US,when a person is put down,make sure you kick him the rest of the way down,then if your wrong forget it,I have noticed Harvey Levin puts down anyone over the age of 25,his reporters make fun of the older stars,I think the trial is the best move,then they can use Don Clark aand WV depos along with FS and GBT.

Bewildered [29] offering you a helpful tip for cutting down on smoking, OK do you smoke while on/at your computer? If so stop at as though your computer is your child/grandchild cigarette smoke is not good for either one. I do not smoke in my computer room and I am here to tell you it has helped me cut down a lot. Hope this helps in you quest to cut down on smoking.
