It is the picture in this article, see red circle of the car, that spawn the gossip that Howard K. Stern was driving a new Mercedes Benz and how tasteless would that be?
First I have not seen the registration nor even the license plate number and until I do I am not buying this. It could be his parents, a rental car, one for his out of town attorneys, etc. However, what if Stern bought a “new Mercedes Benz”? I just don’t think that, it is not his kind of car and what one drives to court does not mean one owns it. Remember we have all heard the stories of Stern’s like for baseball caps and to dress down, so why a Mercedes Benz? For those of you who know cars look at the hood ornament on this silver car and tell me what kind of car it is? If Stern bought this or any other car big deal, if he got money from some of the lawsuits or contracts he negotiated and he chose to buy a new car with that money, great for him. I don’t get what all of the commotion is about. If you have a copy of a registration please scan it and send it on to us, if you prove to me he does own a new Mercedes I will eat my typed words on this blog.
It appears Stern did have one set back yesterday. Judge Robert Perry after hearing the amount of money that had been made since Anna Nicole Smith’s death from body guards to Larry Birkhead, he did agree that better accommodations should be provided to the Texas crew. So out of what is fondly called the roach motel and into better quarters Don Clark and Wilma Vicedomine were entitled to. Stern’s team had paid the airfare although the duo with their attorney Neil McCabe changed it to a later flight on Monday morning, and Stern’s team had to pay for 2 nights lodging at a classier hotel. It came down to in court who was fibbing to the judge? Chris Smith, Stern’s California criminal attorney, said he had contacted the duo and had offered 48 hours notice before appearing. Mr. Smith argued that Neil McCabe should not be allowed to address the court as he was not licensed in California. In the end the Judge did allow Mr. McCabe to speak on behalf of his two Texas clients, asked what his clients wanted, asked the defense team if they were going to call them and then split the argument in half it appears to me. Stern paid the upgrade for the lodging and McCabe’s clients would be hustled out of town by Wednesday morning.
I talked to one person involved in the fiasco to be in town or not to be in town. They said the communications between Chris Smith and Wilma Vicedomine broke down when she emailed him and told him to talk and handle things through her lawyer, Neil McCabe, and Mr. Smith felt Mr. McCabe was not licensed in California. Is there hostility there on both sides?? YOU BET!!!!
However, the big news in all of this to me is that by Howard K. Stern’s legal team subpoenaing Don Clark and Wilma Vicedomine as “hostile material” witnesses for Stern, neither Clark or Vicedomine will be allowed in court for any of the hearings including the trial. I would think that someone else will have to accompany Virgie Arthur to court each day and set with her during the jury trial. In your opinion was this a good move by Stern’s legal team?
It appears the good Dr. Nathalie Maullin is NOT an EXPERT witness, she is just a witness relaying the facts as she remembered them over two years later. I was told she had the personality of aluminum foil and would be a doctor that none of the patients including Anna Nicole Smith would have felt warm, snuggly, or even comfortable with. I went to work yesterday to find out more about Dr. Maullin with the ever changing “definitions and who she talked to” taking place in court. I can sum it up in one long sentence. She had been a doctor barely two years when she “treated” Anna Nicole Smith, and she has been downgraded from the prestigious Cedars Sinai Medical Center to Kaiser Hospital. Enough said.
The other two witnesses yesterday were two pharmacists, Steve Mazlin and Romeo V. Par; very dry testimony reading their records of what was ordered when and by whom.
There was a brief walk on witness to testify that one of Anna Nicole Smith’s alias names was Charlene Underwood and Ms. Underwood made a cameo appearance as this was not her.
Judge Robert J. Perry did not have a good day and is a tad upset with everyone, by yesterday afternoon he was telling Renee Rose to move the case along. Some in the court house heard her say out of court she could be finished by Friday before noon. Court Observers are betting it will last no longer than next Tuesday, October 27. Several Court Observers also said that all three defendants would be bound over for a criminal jury trial and Judge Perry would be happy to be rid of this mess from everyone. I would imagine he has empathy for the judge that inherits this for trial. BEFORE ALL OF YOU GET UPSET!!! Remember I predicted they would be held for trial on a minimum bond, the district attorney has to basically meet the bar of standards of a ham and cheese sandwich and the pharmacists alone probably did that for the prosecution. Judge Perry wants to be done with this. This preliminary hearing has allowed the defense team to see the assistant D. A. Renee Rose in action as well as some of her star witnesses and you can bet that by trial the defense team for each of the three defendants will be loaded for bear and ready to meet and bring reasonable doubt for their clients to a jury. It was Adam Braun, Dr. Khristine Eroshevich’s attorney, who said if the district attorney’s office could not meet the low hurdle required by California statute in a preliminary hearing the assistant district attorneys should be laid off. I agree and if I was any of the defense attorneys I would just let this round go to the State of California. We will see if my prediction is correct.
Now for Mo Mo making over a hundred and fifty thousand with money from interviews which is still probably pouring in from Fox, not bad for five months of work in the beautiful Caribbean with Anna Nicole Smith paying all of his expenses while he was there. His testimony is going to get to when did you lie, at the paid media deals or now at the hearing and on to the jury trial. If Sadow did in fact cause Mo Mo to become angry and agitated then the defense learned a lot from Mo Mo’s three days of testimony and I would bet they are going to go over that transcript with a fine tooth comb so to say. If I was Renee Rose I would make sure there were more people then just Mo Mo that saw what he claims to have seen, if he is the only one I predict that will not get far with a jury.
Next up is Larry Birkhead and the 2.3 million dollars paid since Anna Nicole Smith’s death, well part of it came from NBC contracts to be Tony Potts best paid friend with exclusives for 3 to 6 months back in the spring of 2007, how ever long that contract was for. So the over one million more I would say came from other media like Fox and CBS – Entertainment tonight, and I wonder if Birkhead was also adding up the magazine layouts he has done with Dannielynn since winning the DNA test? If he can make this kind of money GREAT, it means he has the dough to take care of his daughter.
I was sent an excerpt of something that suggested Birkhead was pocketing Dannielynn’s money and cheating Dannielynn trust account, WRONG. If Larry Birkhead is in the interviews or pictures sold, the money goes to him. If the money coming in is for the use of Anna Nicole Smith’s name and/or likeness it goes into Dannielynn’s trust account. IF at a later date Birkhead decides to be in a reality show, which again I heard the first editing was a bomb, then the money MADE by Dannielynn would have to be held for her in another trust account NOT the Estates. The same goes for if she appears in pictures alone or begins to model, that money would have to be held and accounted for, EVERY penny. Since Birkhead testified that he had made that much money there is no reason to doubt him. Birkhead has also become a household name in the last 2+ years as has many in this sad saga.
The big question is did Larry Birkhead lie about the young new assistant district attorney Sarah Slice and his conversation with her. If these allegations floating around the courthouse corridors and the district attorneys office are true and Birkhead did lie what a crappy thing to do to a young assistant district attorney, in my opinion. She was back in court yesterday and all was normal and she has learned to NEVER talk to a witness outside of the courtroom. The reason is because in court it can be spun to look like you did a naughty and the witness is the victim. I do have to say this fiasco got Birkhead international coverage and bumped Mo Mo from the papers, perhaps that was the plan all alone. If Birkhead lied about his conversations with Ms. Slice then shame on him to take advantage of a new and probably friendly attorney. I bet in all future hearings involving this trial, the state of California vs. these three defendants we will see two big burly bailiffs bring Birkhead in and out of court and Sarah Slice will never forget this hard learned lesson in the legal world of the rich and famous.
I have often said this site will close before it becomes a propaganda site for either side in all of these lawsuits. However, if I am told something and I can verify it through at least one and preferably with two other independent sources it will appear here and hopefully start a good dialogue.
I hope we have debunked part of the gossip and put perspective on the rest, and yes it was the courthouse discussion as it was in the offices for the district attorney that the allegations of Birkhead lying is true, I guess we will find out with time won’t we?
There is no court today and I believe the rest of the witnesses are not going to give us the fireworks that Mo Mo and Birkhead provided.
UPDATE: I did forget to mention that there is of course some main media in the courtroom as well as bloggers covering the case. Those bloggers sharing with me or telling me where to look, they are great and neutral…. HOWEVER, there are some bloggers in the courtroom that do not appear to be fair and unbiased, they have been identified as VA bloggers and now their identities are known and they will be dealt with appropriately.
So what is in Howard K. Stern’s hand?
Day six is completed and there is approximately 4 days left until Judge Perry hands this entire mess over to the trial judge for the case. Tell us your thoughts and would someone look up the car in this picture and tell us what the hell it is?

Ok folks I have had an eye infection since last Thursday, rubbed my eye with the same hand I handle the chemo with… DUH not smart.
It was really bad on Monday and Tuesday of this week but after washing it out, resting my eyes and using warm cloths several times a day it is MUCH better today.
If you have a big problem please email Heath, Roxanne or Ken… I do check the blog and my emails several times a day also.

Re Larry I think he would have the messages etc. It was taken up in Court as well. I think some arse covering is going on as this caused the DA some damage.
I would hate to be them depending on MO with so many different statements out there and holes in the Valium being injected theory…all they need is doubt.
Re the car, Howard should have stood next to Naz’s Bently and really given them something to talk about. That car doesn”t look like the latest model.
ANd I think willy and clarky being miffed is precious. Do em good , build character.

LOS ANGELES — A pharmacist testified Tuesday that he warned Anna Nicole Smith’s psychiatrist against prescribing a powerful sleeping medication to the celebrity model after she had given birth to a daughter and endured the death of her son in 2006.
“I said, ‘Unless you want your picture on the cover of the National Enquirer, I wouldn’t give her (chloral hydrate) because it’s a powerful respiratory depressant,’” pharmacist Steve Mazlin said he told Dr. Khristina Eroshevich.
Mazlin said Eroshevich purchased chloral hydrate and also asked for a rapidly acting anti-anxiety medication, and he recommended lorazepam.
An autopsy showed Smith died in February 2007 of an accidental overdose of chloral hydrate combined with other controlled substances.
Eroshevich is charged along with Dr. Sandeep Kapoor and Howard K. Stern, Smith’s lawyer-boyfriend, with conspiring to provide controlled substances to Smith. All have pleaded not guilty.
The testimony came at a preliminary hearing to determine if they should stand trial.
Another pharmacist, Romeo V. Par, testified that Eroshevich came to his pharmacy in October, 2006 and obtained the drugs Xanax, Valium and klonopin for a patient named Charlene Underwood. Valium and klonopin also were implicated in Smith’s overdose death.
The prosecution maintains Underwood was a pseudonym used for Smith, and they called to the stand a woman by that name who once did business with Eroshevich.
The judge, expressing impatience at the length of the hearing, hustled her on and off the stand and told prosecutors to begin moving their case along.
A hospital psychiatrist who treated Smith for drug dependency concluded two days on the stand saying the former Playmate fit the legal definition of an addict.
However, under questioning by a judge, Dr. Nathalie Maullin said she never used the words “addict” or “addiction” when discussing the celebrity model’s problems with her, Kapoor and Stern.
Before leaving the stand, Maullin said she once asked Kapoor if he thought Smith was addicted. She said he chuckled and mentioned she had problems with alcohol.
The charging document in the case states that Stern, Kapoor and Eroshevich “acted with knowledge that Anna Nicole Smith was an addict.” Prosecutors are trying to prove the defendants had that knowledge.
Maullin, who treated Smith during a brief hospital stay when she was pregnant in April, 2006, was quizzed by Superior Court Judge Robert J. Perry on the addiction issue.
“She was never trying to get high?” he asked.
“I never thought she was trying to get high. I think she wanted to tune out,” the psychiatrist said.
The preliminary hearing will be recessed Wednesday, a mandated state furlough day for the court system.

Sammy1 – The TMZ Live Show is located on the same page as the reruns for the night show. When you click the “missed the show” button it is automatically the TV show but look below it and in the tabs it says TMZ LIVE and you can rewatch them! I just found it a few days ago myself. I am wondering if Harvey’s mention of the DA and cops getting a search warrant on his cell phone # in a different case (Mel Gibson tirade) is exactly what happened in the Anna Nicole case?? He says he is going to fight it and did say he believed it happened again so wondering if that is what he was referencing the day before regarding something going to happen in the ANS trial and predicts HKS and Kapoor will get off.

Why should Howard have to pay for an upgrade because Moe and LB made money. What’s the big deal about how Howard got to court did some of these people think he would come in a rattle trap rusted out vehicle. Personally I hope he made as much as LB did and those who think the money is Dannielynn’s.Take note that LB is in the pictures so it is his money and he is using it to care for his child..IMO the District attorney or rather assistant one should have know better than to say anything to LB and if she text-ed him he has proof otherwise the judge would not have let it be bought out in court,you would think.
Really does not sound like the state has a good case.They seem to be trying it in the media and I am sure that can be traced back to the texas gang.
Why would VA even be at this hearing other than to harrass,She knew nothing about her daughter and her life,just as she knew nothing about her grandson.and It sure seems she had and showed no interest until she thought she could get some money out of it.Seems to me I remember reading where she complained about Anna buying her a red car because she did not like red !!!!!!JMO

All I see in the picture is HKS standing in front of a car that appears to be silver or white and does appear to me to be a Mercedes. I don’t see HKS driving the car or getting out of the driver’s seat of the car. I don’t see him with “any” keys in his hand that have identification on them that show that they belong to this car.
I do see something black in HKS’s left hand which could be a cell phone (I have seen cell phones that are that small. My husband use to have one that was that small). Look closely at the black item in HKS’s left hand. Notice how it is big enough to reach from between his thumb and forefinger all the way back to the heel of his hand. It looks like if it may even be touching the cuff of his shirt sleeve. A close up of the pic of his left hand might show if it is actually touching the cuff of his shirt sleeve, if it’s a cell phone or something else. The reference to the item touching the cuff of his shirt sleeve is just an attempt to determine the size of the item. I guess it could be a keyless entry control device but I’ve never seen one that big. I still don’t see any actual keys. Do really expensive cars not have actual keys these days??? I don’t see a registration, title or purchase contract that shows that this car belongs to HKS.
If someone snaps a pic of me standing in front of a car in a parking lot does that mean that I own that car?

The only people that speak of drugging a known addict with ‘no known medical problems’ to further their own purposes are those that never knew her and have no facts now or ever; VA and her nefarious group have created this defamatory fantasy on TV, other media and in court cases of their own –

Other than the Doctors charged, Dr. Maullin was the last to treat ANS for drug related problems in CA. Dr. Maullin didn’t diagnose or discuss with the patient ‘addiction’. The ‘known addict’ phrase is an unsupported and insulting ‘legal’ term created by non-physicians to incite lay people who may serve on Juries.
Nobody is interested in Renee’s version of what happened in FL or The Bahamas – competent authorities have determined accidental deaths with no criminality involved. Eye witnesses to events in CA have stated clearly nobody forced drugs on ANS. Eye witnesses have said HKS sought treatment in CA for ANS and that ANS determined that ‘conventional’ treatment was better for her and unborn DL. Eye witnesses have detailed multiple ‘known’ medical problems (including Dr. Maullin). Eye witnesses have detailed how all members of ANS’s ‘inner circle’ were concerned for her and did their best to look out for her.
The prosecutor has not had any witnesses that can definitively speak to any of the CA related elements of the crimes charged; the contrary in fact.
The prosecution has not presented any eye witnesses that speak to a California-based conspiracy to illegally furbish drugs to a known addict for no legitimate medical purpose – and those are the charges at hand. Enough with the tabloid presentation of irrelevant innuendo; stick to the State of CA and bring on the proof.
Just to underscore the wastefulness of this whole stunt, today is a furlough day for the Courts; an effort to save CA during its critical budget crisis.

Hmm (13) My question exactly! How does larry’s and Moe’s earnings enter into granting an upgrade and furthermore, why was it a mattrer for the judge to agree that an upgrade was in order? If it had been me that got relagated to a flea bag hotel, I would have been furious. But, since it wasn’t me, I am laughing!

Beth #28 – Totally agree. They are the detectives. There’s this mental picture of these two highly intelligent individuals sitting in a large room going through every document, making notes on large movable easels, drawing lines to connect the dots and yelling “bingo, I’ve found it”. You’e correct, they could and probably should write a book explaining how all this came about and the effect on private lives. From what I have read Anna had many different ailments and what doctor would not treat them when told about them.The way things are set up in this country a doctor has no way of finding out if you already are treated by another doctor unless you tell them.The same with Pharmacies if you pay cash.When you have insurance you can’t get away with that.Perhaps if her mother had cared enough she would have known this also.

Pharmacist says he warned against drugs for Smith
LOS ANGELES — A pharmacist testified Thursday that he refused to provide drugs prescribed to Anna Nicole Smith, telling a doctor the prescriptions would be “pharmaceutical suicide” for the former Playboy model.
Ira Freeman said a fax requesting several drugs came from Dr. Sandeep Kapoor on behalf of Smith’s psychiatrist, Dr. Khristina Eroshevich, five months before Smith died of an accidental drug overdose in a Florida hotel in 2007.
“I called Dr. Kapoor,” Freeman said. “I said, ‘This is crazy. This is pharmaceutical suicide. The dosages are way out of whack.’ I said I wouldn’t fill it and no pharmacy in California would.”
The hearing, which is in its second week, will determine whether Kapoor, Eroshevich and Smith’s boyfriend-lawyer Howard K. Stern will stand trial for conspiring to illegally provide Smith with controlled substances. All three have pleaded not guilty.
Freeman said he had been dealing with Smith for years through his pharmacy, usually issuing prescriptions to her under the name of Michelle Chase, a pseudonym used to protect her privacy.
She always sent others to pick up the prescriptions, and when he first knew her she was dealing with a doctor whose practice was later taken over by Kapoor, he said.
Under questioning by Deputy District Attorney Renee Rose, Freeman gave a long list of painkillers that had been prescribed to Smith over the years.
He said the one prescription he refused to fill was a request on Sept. 15, 2006, for six drugs, including opiates and the painkiller methadone. He said Eroshevich had passed the request to Kapoor, who faxed it to Freeman.
Freeman said he recalled thinking that “if she got a hold of these medications, it could have fatal consequences.” He said he called a friend, a drug expert named Gregory Thompson, and asked him to speak with Eroshevich, who was with Smith in the Bahamas.
Kapoor kept prescribing drugs to her after that but in smaller doses, Freeman said.

A Valley Village pharmacist testified today that he refused to fill a drug order for Anna Nicole Smith the year before her fatal overdose because the quantities of medication requested by her psychiatrist amounted to “pharmaceutical suicide.”
“If she got ahold of these medications, it could have fatal consequences,” pharmacist Ira Freeman told a Los Angeles County Superior Court judge hearing evidence against the psychiatrist, another doctor and Smith’s boyfriend.
Freeman recounted being stunned by the handwritten list of a half-dozen painkillers, muscle relaxants and sedatives faxed to his store Sept. 15, 2006 – just four days after Smith’s son had died.
Dr. Khristine Eroshevich, a psychiatrist who had flown to the Bahamas to treat the model, signed the list and Smith’s Studio City internist, Dr. Sandeep Kapoor, forwarded it to the pharmacy, he said.
“This is crazy. This is pharmaceutical suicide,” he recalled telling Kapoor in a phone conversation. He said he was so concerned that he tracked down Smith’s boyfriend, Howard K. Stern, in the Bahamas and arranged through him for Eroshevich to consult by phone with a respected toxicologist.
The toxicologist, Greg Thompson, later told him that he had urged Eroshevich to “forget about the paparazzi and get [Smith] to a hospital,” Freeman recalled.
He said Eroshevich seemed unfamiliar with the medications she was ordering, prescribing eight times the recommended dosage of the hypnotic sedative Dalmane.
“She is way out of her league on this,” he recalled Thompson telling him.
Freeman is among several pharmacists who have testified at an ongoing preliminary hearing for Eroshevich, Kapoor and Stern on charges of illegally providing prescription drugs to Smith. All three have pleaded not guilty.
Eroshevich has said through her lawyer that the drugs she prescribed were part of a well-meaning attempt to care for a difficult patient grappling with grief, postpartum depression and an oppressive media spotlight.
Freeman said that doctors had used a pseudonym – Michelle Chase – to call in orders for methadone for Smith for five years because of her celebrity status. “People go through her garbage,” he quoted one doctor as telling him.

Different but common points, Heath. For 5 years while he filled scripts, he didn’t see anything unusual and acknowledged the scripts were for Anna only under an alias. Did they go thru her garbage or the pharmacies? Since I read last night, paps, had run into a car following MJ’s children in another car, I wouldn’t put anything past the paps.
So only after that list of drugs was requested, following Daniel’s death, that he had any concerns? Isn’t the State, taking this back to 2004? And if this was so unconventianal, why weren’t the doc’s licenses pulled then?

a couple of posts from Anchorage Daily News about a man that tried to get Oxy because he did not have access to a way to get it like some we all know.He was shot because he would not put down his weapon after being caught.The Police did their job as they should have but these posts show what some people either addicted to or in pain will do to get relief.It also in one of the posts tells that the VA gives Methadone for pain relief(go figure)
I beat you by three surgeries. Oxycontin is no more addictive then some of the opiates that I am sure you have had after your surgeries. It’s not about the drug it’s about the person. PHYSICAL dependance is different from addictive craving. Chronic Pain is worse then the short term hard pain of surgery. It wears you down. I go to the VA. It’s third world medical care. For the 100 plus million they are spending on the new building they could have given us all BC/BC and let us find quality healthcare for many years. My VA doctor only prescribes Methadone for chronic pain. Cheap but one of the hardest withdrawals. Ironically I pay out of pocket for much less addictive meds that allow me to think and function on less pain for rose speaks

So quick to judge on the ADN. This man was serving his country and a very unfortunate series of events happened to bring him to this sad point in his life. As Americans who sent him to Iraq, we have a responsibility to help him not judge him. Drug addictions do crazy things to people. Like another poster suggested. perhaps doctors shouldn’t hand out this drug like it was candy when they know how addictive it is. It is a fixture in US medicine cabinets these days and the youth know it. A 14 year old died of overdose last year in my community, thanks to it being readily available in Grandpa’s medicine cabinet.
This is the same drug Rush Limbaugh was(is?) using only he has more money to buy it and better connections to find it. I bet many commenters attacking this man still listen to and support Limbaugh.
t is amazing that he was able to survive being in Iraq, but not living in Eagle River.
He came home because he got injured while in Iraq and needed surgery. He got addicted to oxy after the surgery, and it was all down here from there…it is a very sad story.
What he did was completely wrong, but for the record he came from a good family, with high standards, and strong morals. Matt knew better, some people just can’t kick their addiction. In this case it looks like his addiction got the best of him.

“Earlier in the day, the defense asked to remove a member of the prosecution team, Sarah Slice, who had been accused of trying to influence the testimony of witness Larry Birkhead.
Without comment, the judge declined to order her removal.
District attorney’s spokeswoman Sandi Gibbons said Slice was no longer functioning as a deputy district attorney on the case and was returned to her previous role as a law clerk for this case only.
Slice had been in charge of organizing files for the hearing and “to lose her now would be detrimental,” Gibbons said.
After the hearing, Slice will return to duty as a deputy district attorney elsewhere in the county, said Gibbons, who declined to comment on any contacts between Slice and Birkhead because it was a personnel matter.”

Yes, the 3-19-07 email from Vice to Clark is the smoking gun. It lays out the TX cabal’s plan to implicate HKS and/or LB in any crime as the ONLY way for VA to get her hands on DL (speak of déjà vue). This preceded closely the appearance of the O’Q/VA paid bloggers on TMZ harping about VA and this and that AFTER VA was entirely irrelevant to the story.
Anyway, Clark going to great lengths in his depo to deny knowledge of particulars and the email itself, as well as the chorus of b.s. objections from the bad guys’ lawyers all points to the guilt of Clark/Vice, O’Q and his Law Firm and VA has having hatched this malicious defamatory strategy to lie, lie and lie and rope in as many gullible LE people and others as possible (speaking of JB and Judge Lindsay as the only two on earth who bought into it).

Yes, I recently discovered this in Clark’s NY depo and was totally shocked by it. WV apparently finds a Bahamian statute to put in her email to DC in which she infers that VA’s denied complaint to the Court/Social Services as an unfit person is disastrous. She goes on to say that now they will have to criminally punish Howard in some way in order to get the baby. I WAS SHOCKED.
Wood says in the depo transcript to DC–’The O’Quinn Law Firm PRODUCED this email for us’ and Clark doesn’t even respond.
BTW I don’t see why on earth DC got McC to represent him–he is PART OF THE SAME FIRM! I would think they would have obtained a different lawyer outside the O’Quinn firm. Also, McCabe has pro hac vice status in ‘a specific case’ …the Bankruptcy case of BS. It was granted as per his application on 3/12/09 and I just read the application and the order.
I wish I knew what the other two exhibits were and I wish I could see that March 19, 2007 email.
BTW I happened to stumble across (while readings Clark’s depo) the story of how he and WV came to Ft. Lauderdale to meet with Tas and Moe and Porter, the agent at a hotel. He says it was early April 2007.
I read that before Moe ever testified and immediately remembered that Santiago was in Florida on Aug. 10, 2007 talking to Det. Frank, then meeting with Dr. Shueler and Dr. Perper who ’showed’ him (and Doss) the vials found in the HardRock. Two days later he transported the pc’s. to CA.
During Moe’s testimony he was asked by Sadow WHEN did he return DOJ’s phone calls and meet with them.
One last thing–Clark talks about Pirtle trying to deal with Larry DURING the Seidlin hearing and later takes an O’Quinn jet to the Bahamas to try and cut a deal with Larry to no avail. THIS confirms Larry’s account–
It’s like a puzzle trying to fit all this information together AFTER the fact and in face of the torrent of lies and abusive condemnation flung at anyone who questioned the media/bloggers stories.

I look at the heading of this article and wonder why so much open-ended questions in it and why questioning like this in a lull time to even respond to this kind of stupid stuff like BS of cars and is Larry lying, Who Knows and who cares, Just the facts. #57 Liann, is this email an exhibit of WV’s depo or DC’s depo… you have to remember there were thousands of pages to download, upload and code in for all of you and many I have not read the full thing… I have all of 149 zip file and it is loaded and I would love to read this email if I can figure out or one of you who reads Swims on Howard Supporter can give me a context in which lawsuit (Florida or New York) this email was filed as being turned over the the O’Quinn firm to Wood???
Ok Desert Walker it says it is exhibit 7 of DC’s deposition but I can’t find the exhibit in those things filed by Wood nor is it listed in Wood’s declaration as filed separately… a very interesting email though and one I would love to read… I will continue to look through everything up filed by Wood on 9-28-09 and see if I can find this email, it does appear that it would be very significant in all of this if it was laid out on March 2007 exactly the turn these plans were going to take…

I have been unable to locate exhibits 15-18 attached to the WV deposition, as referred to by Lin Wood in the Clark NY deposition excerpts. One is a WV email to DC from March 19, 2007 and the other is the infamous nanny affidavits–I have yet to figure out what the others are.
I searched and searched–spent $2.00 again for a doc I already own and see that Wood’s Declaration lists each exhibit in the particular order they are attached to a depo, or whatever. The marking of Ex. 15, 16, 17, 18 doesn’t necessarily correlate with his Declaration listings. I have WV’s excerpted depo from the Cosby case but it has no attachments that I can see. That doesn’t mean they aren’t there–I just can’t find them.
The discussion with Clark about that WV email in particular is shocking (to me) and even McNamara says to Wood”you have already asked him about this THREE times’ and Wood responds, ‘I’ll ask him about it 100 times until I get an answer.’ LOL
Wood pretty much (holding the email) quotes from it but never gets a straight answer from Clark about how he felt about it–only a grudging acknowledgment that it bears his email addresses. At first he says he can’t remember the email.
Same for the nannies’ affidavits. Are these what Det. Frank showed to Santiago? I got the feeling he was reading an audio transcript of an interview Frank and Chief Tiger did with them, not those infamous ‘FS affidavits.’ McNamara refers to the affidavits as ‘filed affidavits–’ then says ’strike that-’not filed.’

The email was titled ‘HKS is unfit’. I read about it in Don’s depo. That seemed to be the point that Swims and HSupporter were making. If there is an exhibit I wonder if it is sealed? The best part of reading Swims and HS’s thoughts is how they present the info. I have the same questions and thoughts sometimes but not articulate to present them and trying to get used to typing on a laptop. Everytime I do get a good idea the stupid thing screws up and I lose it and don’t want to try to type it all over again
As far as the prelim..still can see how as you stated Rose, LB and Moe cancled each other out. Neither presented the ’smoking gun’. Freeman’s testimony shows that steps were taken to ensure Dr E was trying to do the right thing. Those drugs prescribed were not in her system when she died? All the ones that were listed in the autopsy were at theraputic levels except for the CH right? So next on the list is Ralphs pharmacy where the drugs that were in her when she passed?
To me, the prosecution’s case is weak so far. And I see rumblings of hope of murder charges or culpibility somewhere. So even the ‘dark side’ doesn’t have much faith as what is presented at this time. The blogger in the courtroom…wonder who lives in CA who has free time? Even with the scrubbing of old posts it sure is handy when some are quoted and carried over. I love transparency. Especially if people’s futures are involved.

Agents detail prescription record in Smith hearing

LOS ANGELES — Investigators are testifying about prescription and travel records of two defendants in a drug case involving Anna Nicole Smith.
An agent from the Department of Homeland Security testified Friday in Los Angeles that there were many trips made by Dr. Khristine Eroshevich to the Bahamas while the former Playboy model lived there.
Another agent from the California Department of Justice pharmaceuticals task force identified records from several pharmacies detailing drugs issued to Smith’s boyfriend Howard K. Stern.
The dates of the prescriptions often coincided with the trips Stern took to visit Smith.
The testimony came at a preliminary hearing to determine if Stern, Eroshevich and Dr. Sandeep Kapoor should stand trial on charges of illegally providing Smith with controlled substances.
Smith died of an accidental drug overdose at a Florida hotel in 2007.

LOS ANGELES (AP) — With a preliminary hearing in the Anna Nicole Smith drug case nearing its end, prosecutors are focusing on the opinions of a pharmacist and his associate who say the celebrity model was being prescribed enough drugs to kill her.
Pharmacist Ira Freeman testified Thursday he refused to fill a request for medications from Dr. Khristine Eroshevich, Smith’s psychiatrist. Freeman said the dosage amounts requested were so high they would constitute “pharmaceutical suicide.”
Freeman said he was so concerned that he asked for help from a former associate, Gregory Thompson, the retired director of the poison control and drug information center at the University of Southern California. He said Thompson agreed the doses being requested for six drugs were “outrageously high.”
Prosecutors displayed an enlarged, handwritten letter sent by Eroshevich to Kapoor introducing herself and asking him for six medications: Dilaudid, Lorazapam (also known as Ativan), Soma, Dalmane, Prexige and methodone.
Freeman said Eroshevich was seeking to prescribe Dalmane, a sleeping medication, at eight times the normal usage. She also wanted Soma, a muscle relaxant, in high dosage, he said.
The request came just after Smith had given birth to a baby and witnessed the death of her son, Daniel. Eroshevich, also a friend and neighbor, had been visiting Los Angeles pharmacies collecting medications to take to Smith in the Bahamas, according to testimony.
Kapoor forwarded the message to Freeman by fax without comment, the pharmacist said. The doctor’s lawyer said outside court he did not know Eroshevich at the time and had nothing to do with the requested prescriptions.
After Smith died five months later at the age of 39 of an overdose of at least nine different medications, a California Department of Justice investigator talked to Thompson about the drug list Freeman had received.
“He said they would work on an addict under supervised care, a dying cancer patient or if you were gong to kill someone,” investigator Danny Santiago testified.
Thompson told him one of the drugs, Dilaudid, was known as “hospital heroin,” Santiago said.
On cross-examination, Santiago said Thompson told him Eroshevich was trying to do the right thing for Smith but was not familiar with the drugs she was prescribing.
The preliminary hearing for Eroshevich, Kapoor and Howard K. Stern was to conclude its second week Friday. Prosecutors have indicated they are nearing the end of their case but it is expected to continue into next week.
Superior Court Judge Robert J. Perry will decide if there is enough evidence to order the three defendants to stand trial on charges of conspiring to provide Smith with controlled substances.
Prosecutors also called other pharmacists to say that Stern, the model’s boyfriend-lawyer, often picked up prescriptions for Smith and some may have been written in his name.
On another issue, the defense asked to remove a member of the prosecution team, Sarah Slice, who had been accused of trying to influence the testimony of witness Larry Birkhead.
Without comment, the judge declined to order her removal.
But District attorney’s spokeswoman Sandi Gibbons said Slice was no longer functioning as a deputy district attorney on the case and was returned to her previous role as a law clerk for this case only.
Slice had been in charge of organizing files for the hearing and “to lose her now would be detrimental,” Gibbons said.
After the hearing, Slice will return to duty as a deputy district attorney elsewhere in the county, said Gibbons, who declined to comment on any contacts between Slice and Birkhead because it was a personnel matter.

All of the negative information people have ever heard about HKS has been fabricated by VA and O’Q, two people who never knew HKS. They and their employees have been docu_mented in many Courts as having deliberately and maliciously lied for the purpose of snatching DL and her anticipated fortune. O’Q/VA even ensnared FS/G. Ben, two grifters who planned to flip properties (and were barred from ownership of anything in The Bahamas due to G. Ben’s criminal record for drug crimes) and massively profit on ANS’s celebrity. No eye witnesses support the VA/O’Q/JB/Renee view of the facts – no one. And no one ever has; no one, not ever.
People might notice that MSM ‘talking heads’ do not subscribe to the TX cabal/JB view of HKS/K/E as this disgraceful prelim progresses.
Summary: no one has ever supported VA except the lawyers who sought to profit along with her for her lies.
No one has ever supported Cosby who tried to cash in with O’Q/VA’s lies and avarice.
As I said in March, no holds barred. Criminal trials cannot be pussyfied like civil trials.

#78 Lizzie I would suggest some volunteers go through the Stern vs. O’Quinn documents on the site downloads.. I remember a Motion to compel by Woods on that one with a bunch of emails attached, a privilege log by O’Quinn and then some more emails released that is how we found the original Mark Speer info. that he was a member of THIS site… All of these would be listed the summer of 2008 before the Magistrate handed down her Omnibus Order for discovery in Aug. 2008, perhaps it is in those documents.

196. Testimony about heating drugs to inject is false
Prescription drugs in tablet form contain a tiny amount of the actual drug but a lot of filler materials. Grinding a pill into powder and ‘heating’ it, does not provide an ‘injectable’ form of the active medication.
Filler materials can be dissolved in water to precipitate the active drug that is rarely water soluble. Isolating and ‘suspending’ the active drug in a safe injectable medium (not plain water) is a time consuming process. Most homes have the substances and filters to do this process, but it takes a great deal of time.
Anyone testifying that someone crushed pills and heated it in a spoon to inject is lying. Someone crushing Valium as an example to inject would be missing in action in the bathroom for hours.

DID i just read the Office of Homeland Security stating Howard picked up meds to take to the bahamas,which would mean,Anna was there byherself,Howard did not have her drugged and a prisoner.and if Anna wanted to ,could call her mother.?

LOS ANGELES (AP) — Anna Nicole Smith was using multiple doctors, pharmacies and associates to obtain prescription drugs under false names, according to testimony at a preliminary hearing Friday.
Jennifer Doss, a special agent with the California Department of Justice pharmaceutical task force, showed a judge how she traced prescriptions issued in the names of Smith’s boyfriend-lawyer, Howard Stern, an assistant of Smith and a series of fictitious names used by Smith over more than two years.
In addition, Homeland Security agent Kenneth Krause described travel records showing multiple flights by Stern and Smith’s psychiatrist, Khristine Eroshevich, to and from the Bahamas at times when prescriptions were picked up in California for the celebrity model.
Doss identified documents detailing the movement of controlled substances including Demerol, Dalmane, Lorazepam and methadone.
She said bottles bearing Stern’s name were later found in the home of Eroshevich, who is charged with Stern and Dr. Sandeep Kapoor of conspiring to illegally provide Smith with controlled substances.
All three have pleaded not guilty. A judge will rule after the preliminary hearing whether they will stand trial.
Stern’s lawyer Steve Sadow suggested in cross-examination that some of the medication was legitimately issued to Stern for a back problem and when he had botox injections.
But the prosecution contends that Stern told an agent early in the investigation that his name was used on prescriptions destined for Smith. The California attorney general has described Stern as “the enabler” of drug use by the Playboy model.
Superior Court Judge Robert Perry stopped Doss as she tried to draw a correlation between the dates that prescriptions were picked up and the dates that Stern and Eroshevich left for the Bahamas.
“I’m supposed to be making a decision whether a crime was committed,” he said. “I don’t want her saying that she thinks a crime was committed.”
Doss identified multiple pharmacies used by Smith and offered a list of pseudonyms including Michelle Chase that were frequently used.
The defense contends that celebrities often use fake names on prescriptions and hospital records to protect their privacy.
Testimony in the hearing has shown that doctors and pharmacists cooperated in the ruse by Smith, even though they knew her true identity. Prosecutors say the use of fake names on prescriptions amounts to fraud by the defendants.
Smith died of an accidental overdose of at least nine prescription medications at a Florida hotel on Feb. 8, 2007. She was 39.
The hearing is expected to end next week.

What bothers me with drug enforcement,is why did they not find out what pharmacies,and drug Anna was on before Howard met Anna,who was the enabler then,WHY, DO A HALF ASS,job,if it is not political.If you want to prosecute a person for being a enabler,then why just,Howard,hell,Anna was having a party before she met Howard,why should all the blame fall on him.?Anna’s HABIT was formed (before Howard).LONG BEFORE.

ROSE,if Howard has to go to trial,it would be the highest miscarriage of justice ever seen.and a political blunder.As everyone has seen and heard in the past two weeks,there are lies flying all over the place.Howard believed in Anna’s illnessess.and what he did or did not do,was NEVER TO HURT ANNA.YES the pharmacists are 95% responsible for dispensing the drugs.but if I can remember right,they got on Jerry Brown right away,and after all,Brown is looking for votes.I feel every person that put names on other stars med bottles while brown was in office should also face the same as Howard,that means every person in Hollywood,also Michael Jackons (enablers) that state of Cal will be over there heads in trillions of dollars,investigating all they call enablers,As I had said before with Anna,her own mother is the chief enabler,she did nothing to help Anna cope with rape,or any real problems Anna had and let her daughter suffer,not only abuse from the man that raped her,abuse from her own mother,as now anyone can see ,so she would look good,that all she cared about then and now,ALso no one mentions Tas,who if she cared at all could have saved Anna;s life.
ok my weekly 2 cents worth:
Anna– Yes her doctor is responsible for prescribing a lethal mixture of drugs. I am fully aware that the majority of the drug levels in Anna’s system were within normal limits. It was the mixture of drugs, the low resistance of her system and another fatal swig of CH. I still have not heard anything about when the drugs were in Stern’s name. After Daniel’s death? Prior to Daniel’s death or years before Daniel died. If one wants to charge each enabler, then many more people have to be charged than just those 3. From the doctors, family members, pharmacisits right on down to the friends that allowed the drugs to be delivered at their house. I can’t say that I lay all the blame on Taz or Moe head for Anna’s death. I just don’t appreciate the fact that their stories changed from what was told to LE and Dr. Perper. I think Taz and Moe decided what to say so that they would have a united front. I am torn about the release of one picture. Ansd that is the one that had Anna holding a dead Daniel. Seeing that picture made me realize the depth of Anna’s despare. But what a horrible thing to do to the memory of a “friend” The others pictures we have found to be released in a certain context to imply a drugged out Anna. So bad that she was throwing up on herself. IIRC, this was suppose to be her death picture until it was fully analized. Thank God Stern still had a copy of the original. Virgie is no saint either. When she couldn’t remember which side of her son’s head was shot, I just shook my head. I think that woman was a mother and never knew how to be a mommy. I also think she was jealous of Anna. For the life of me, I can’t understand any mother accepting her young daughter marrying and old old man. And at least in my opinion, it shows to what depth she is willing to let things go in order to gain money. If I had been Anna, I would have been pissed off also. How dare she have a memorial service for Daniel and to get paid for it to boot! Sell his pictures… cha…..ching. Again, IMO, Anna walked away from her family because she kept getting used.
Jackson: Talk about a doctor being responsible for a death. This idiot inserts a freaking IV line into his patient arm, gives him a dose of this drug and then leaves the room. For 2 minutes? I don’t know. It doesn’t matter. Jackson is dead. His death ruled a homicide. And caused by the hand of another. Then spends 47 minutes on his cell phone BEFORE 911 is even called. Sound familar? I want JB to go after these doctors and charge them for everything he can. I have to back off for a bit.
