A young assistant D. A. by the name of Sarah Slice may not be back in court again. After Larry Birkhead testified that he felt like Slice had been inappropriate and wanting him to “ramp up” his testimony is Slice gone? Sarah Slice did not return to court after the lunch break and at the close of court another employee from the District Attorney’s office came in and picked up Slices papers and brief case. Slice did not answer her phone or return calls after court on Monday.

Sandi Gibbons the spokeswoman from the district attorney’s office said, “The matter is being discussed, and no decision has been made as to her further role in this case.” Sarah Slice has been an attorney less than a year… OUCH what a way to learn on the job.

On a break later, outside of the courtroom, Dr. Kapoor’s attorney Ellyn Gerafalo, said, “We’re distressed to learn of this attempt at witness intimidation.”

Birkhead finished up his two day testimony yesterday and before he left the stand Larry Birkhead answered Superior Court Judge Robert Perry questioned Birkhead, about if “he took this as a negative comment on his testimony”, Birkhead answered that he did.

Renee Rose a Los Angeles assistant D. A. pressured Larry Birkhead to reveal that since Anna Nicole Smith’s death he had been paid over $2 million dollars for interviews.

Rose went on trying to pressure Birkhead to get him to say Anna Nicole Smith was an addict of which Birkhead would not go there with Rose. Birkhead again clarified his testimony by recounting how Anna Nicole Smith would tell him, “I’m not a drug addict.” At that point again Superior Court Judge Robert J. Perry turned to the Birkhead and asked if he ever had a conversation with Stern in which he used the word “addiction.” “No,” said Birkhead.

Assistant D. A. Renee Rose continued to press Birkhead on multiple issues, until the judge told her he had heard enough. “I think you’re done,” he said as she continued to raise new issues.

Next up was Dr. Nathalie Maullin an addiction specialist psychiatrist who has been practicing for six years which mean she had been a “specialist” for less than three years when she saw Anna Nicole Smith at Sinai Medical Center in the spring of 2006.

Where are these young guns ho “expert” witnesses coming from and did Maullin qualify as an “expert” or just a doctor/witness?

Dr. Maullin described Anna Nicole as a “difficult patient who was obviously going through withdrawal from multiple medications when she was admitted.” Maullin continued by saying that Smith came to the hospital in distress, sweating, having spasms in her arms and legs and with her eyes dilated. She said the symptoms showed that Smith had decided to “go cold turkey” and stop all drugs when she became pregnant, resulting in withdrawal. Maullin said she treated Smith for Methadone and Xanax addiction.

Maullin went on to testify that she talked to Smith and her companion Howard K. Stern to try to set up a program to wean Smith off of these two medications but found Anna Nicole Smith to be “uncooperative and hostile”. Maullin said the new regimen would have included hypnosis and acupuncture but Smith wasn’t interested. Smith angrily rejected a treatment program that included sessions with a psychologist and a complete cessation of sedatives and methadone.

Dr. Maullin testified that Anna Nicole would not “engage with her, would not make eye contact and was very hostile. She described Smith as saying; ‘”Give me my medication and leave me alone.” The psychiatrist said she told Smith and Stern that if she, [Anna Nicole Smith], wouldn’t comply with the hospital’s outpatient program, she needed to check into a rehab center. Smith’s reply was a stony glare. “When I asked her what she had been taking, she blew me off,” said Maullin.

Maullin said she contacted Smith’s physician, Dr. Sandeep Kapoor and learned he had prescribed seven different drugs to Smith during the time she was seeking relief from pain. Maullin said that when Smith was asked questions, she would reply: “Ask Howard.” Maullin went on to say that during Smith’s hospital stay, Maullin tried to regulate the former model’s use of methadone for pain and remove her from a number of drugs known as benzodiazepines.

Muillin ended Monday’s testimony by saying that Anna Nicole Smith was very hostile with an attitude of “Give me my medications and leave me alone”.

“Smith had said, ‘I’ll do anything for my baby” Dr. Maullin recalled and that the hospital staff gave Smith methadone and the sedative Aptiva to start the process of weaning her off the prescriptions.

Dr. Nathalie Maullin was to continue her testimony Tuesday under direct examination by Renee Rose and then would be handed off to the defense for cross examination.

Stay updated throughout today as we have court observers who will tell us what is going on in court. I wonder if Don Clark and Wilma Vicedomine will be called today as tomorrow is a full day off for the court.

UPDATE: Wilma Vicedomine, Don Clark with their attorney Neil McCabe appeared briefly as court began this morning. The Judge said they were not needed in court so they all three left. Our court observer said they did not know how long the judge might keep Clark and Vicedomine on hold.

UPDATE: Judge Perry has decided there was some type of communication problem with Stern’s lawyers and Don Clark, Wilma Vicedomine and agreed with their lawyer Neil McCabe that they be released from testifying in the preliminary hearing. The three Texans will be heading back to Texas to perhaps be called if and when this goes to trial.

    Good Morning Every One——From what I have read so far,Howard’s point.of Anna being her own boss,and doing what she wants is very plain for anyone to see.To me,maybe the judge will think different,it appears Howard has tryed everything in his power to help Anna,Anna was her own worse enemy,MY OPINION .Her mothers actions and lack of concern and love,was the root of all of Anna’s problem,then she just plain got a (big head) with money came power.No matter the age,we carry through life the desire for ma and dad’s love.To me a GREAT part of Anna’s problem.I could never, never, never forgive Vergie for the hateful way she treated in daughter,and she can stop trying to blame Howard,Looks to me like the state of Cal has NO CASE AGAINST HOWARD

    Well, if WV takes the stand, I hope she can maintain her composure. From reading her deposition, it seems that she can be a bit of a hot head. And I do not think the Judge will let her walk out to blow off steam. JMO

    Btw, Larry sure made the most out of the conversations he had with Slice, lol. Bet she is steaming. The media made it sound like she kind of confronted him in the hallway. But the truth is she was assigned to walk with him. Larry was the State’s witness. Wonder how much is spin and how much is truth?

    Well it is a very good recap of what has happened. Started out with the DL stuff and video of LB outside the courthouse. And then switched to commentary of the prosecutor (with LB still on the stand) saying that Rose was annoyed and that LB had made stronger statements in the past that ANS would pop vicodin several times a day and wash pills down w/ booze And that in LB’s own words “Sometimes I didn’t even know if she was going to live, and they kept bringing more and more drugs into the home (we have read that at some point I’m sure) .”

    ~So Renee Rose got LB’s earlier statements before the judge, BFD, imo~

    Then some legal annalyst came on and said that giving testimony advice is close to the ethical line. Telling someone to “ramp it up” is what you do to your star shortstop, not your star witness.

    Does anyone know if the Judge had all of the lawyers and the prosecution in his chambers?

    Is someone in the Court, Rose that can tell you if they will be testifying at a later time, per the Judge’s comments?

    Oh, so many questions…

    My guess > if those three had no first hand information, those three did not know Anna and her lifestyle while she was alive… WHY TESTIFY AT ALL?

    What the heck are they going to get up there and say on the stand?

    How they (those three) conspired to take down HKS?

    How those three contacted Larry and tried to get them to get rid of HKS, so he would be ’set’ for life?

    How those three tried their very best to iliminate HKS from being Executor per ANS’s wishes in her Will?

    Very interesting indeed!

    Seems to me Opri, as a good lawyer, wanted LB to emphasize certain things. That doesn’t make LB’s testimony in Florida less than truthful, it was just the strategy Opri used to further her representation of LB. LB’s current testimony seems to be sticking to the facts without pointed emphasis or drama. It’s a good lesson in the strategies lawyers use to keep their clients within the truth while encouraging the impressions they wish to instill.

    As I am reading the articles,comming out of the courthouse,I have noticed the judge keeps asking if Howard said at any time”addict”,If he did,Howard would have known he was giving meds to a addict,because he did not,say ‘addict”Howard’s main purpose was to give meds to Anna for medical problems,the state CANNOT PROVE Howard had anything less than honorable intentions as FAR AS GIVING ANNA MEDS.

    Yes, I remember DC’s untrained assistant stating in a few of her posts awhile back, how they (all of the TX gang) would be there everyday at the prelim!

    What? Afraid they would get BOOed for their lies and unethical procedures in starting this case to begin with??

    They should REIMBURSE the fine accommodations and the first rate air fare they received for doing nothing then? ;)

    I myself never read about Anna’s involement with another phychiatrist untill now,and the more that is being said the more you could see Anna was boss over everyone.I like Dr Maullin idea of inhouse treatment.Anna needed a workup from top to bottom,and her systoms carefully watched.With all this ,how can anyone say Howard did not care,Like I said before Vergie could not and did not do anything for her Daughter,Howard got the result,so now,Vergie wants to come out squeaky clean,and dump on Howard.I cannot get TMCon my computer,when I try the computer shuts down,but I sure hope he said it,

    I would think people should remember that LB was doing as his attorney DO told him to do and say skirting a very fine line.He was trying to make Anna come back and face him in his quest for custody of dannielynn and you certainly can see why Anna resented that fact. DO put a lot out their that I don’t think LB wanted outafter all he would not want the mother of his supposed child.So far LB did good and seems to be straight forward.

    I think I’m beginning to see/read a trend.

    VA Supporters: There’s something wrong with the Bahamas courts, the Florida courts, the Florida COA, the Texas COA, the Texas Supreme court, various Federal District courts and now early grumblings about the SC court and now Judge Perry in CA.

    ANS/HKS Supporters: There’s something wrong with the Harris County court.

    If one wished to use this “psychic input”, I believe it may show HKS and ANS/DL/Estate are in pretty good shape.

    “.. The nature of opiates and benzos is that any one could become physically dependent on them when used AS DIRECTED through no fault of their own. Example, someone taking Percocet for a few weeks with a broken leg might very well experience withdrawal symptoms when the medication is stopped; hardly an addict except in the eyes of Renee and her sick crew.

    That’s just the nature of the drugs, and the human system. This careless tossing about of terms like addiction and withdrawal is dangerous – heavens knows how many LE people are listening to this and will improperly harass, disrespect or even charge citizens out there thinking this crap prosecution represents the real law.

    Drag the miserable TX crew in there to explain to the Judge where Renee got her silly notions and false information.

    Ok, Just looking at that picture of DL, I am a grandma and I would never never in my life give up any days that I could spend with my grandchildren! Not for money or a rich lawyer or just the fact trying to prove something, To me whatever VA is after is not worth it, imo a child’s love and understanding is comprehended in a child’s mind by time spent with that child, Imo if VA really wanted to be in DL’s life she would walk away from the TX cabal and know her years are limited on this earth (as us all are) and do whatever she could to know her deceased daughter’s child (DL) and not knowing her daughter’s deceased son ( Daniel) over many years imo would compel normal grandparents (it they cared). . No matter what rift she had with the mother, no matter what. Time is to short and you can never get any time back. imo

    Beth #40 – thank you for your kind words. TMZ runs what they call Live Chat at 4:30pm est Monday through Friday. One can submit questions by clicking the comment box prior to the Chat. Harvey and crew review the questions in advance and answer those that are of general interest. I too prefer the Chat vs their televised program. Since HL is an attorney, I like his perspective on the legal issues. Repeat of the Chat is not always posted and if it is it never stays online for any duration. So glad that several of you had the opportunity of viewing the Chat before it was dropped into the “never to be found black hole”.

    Lizzie #44 LOL Loved the “Bingo” comment. How appropriate. DC, WV, McC had a choice of 48 hr notification. Why not take it, Pirtle did. Oh well, what does one expect.

    Well, looks like maybe the work hours will not be cut (for now) due to litigation by the company.
    (per mail received anyway) Hope it lasts through the Holidays if so… LOL you have to be a lawyer to understand
    anything in print almost from the ‘higher ups’ – sometimes I wonder if THEY even understand what is printed out!
    I know they are always familiar w/ their ‘fine print’… ;)

    In regards to TMZ’s Chat, I don’t see past Chats listed however I do see replays for their TV show.

    It’s a beautiful day here just like yesterday. It’s great after all the rainy/cloudy/chilly days we’ve had. I’m getting all the shrubbery trimmed and other plants cut back for Winter. Leaves are changing to their Fall color and then they fall to the ground which becomes another issue. Oh well, the lawncare guy can take care of it.
