This is a “fun article” and one I have been laughing about since learning of it yesterday.
As Rose Speaks.com had previously said, Don Clark, Wilma Vicedomine and Tom Pirtle were served the night of October 13 to be in the court as hostile defense witnesses for Howard K. Stern the morning of October 14.
They went to a Harris County criminal court the morning of October 14 to fight the subpoenas and the judge gave in a tad or at least the date, the Harris county judge gave them until Tuesday, October 20, 2009 to appear in Los Angeles.
Thus what I call the dance began it seems whoever subpoenas you has to pay your expenses, which brings up Mo Mo again, and how much was he paid?
Anyway back to our article today. The defense team told Ms. Vicedomine that they were willing to do a 48 hour notice “IF” they decided to they wanted her to testify as a hostile witness for the defense. However, there was a glitch in that California was ok with that but the Texas crowd did not want to pay to go before a Harris county judge again. I “think” the defense team for Stern could have faxed the agreement to the Harris county judge that the Texas people were just on stand-by and possibly would not be needed.
However following a barrage of emails of if you want me I am coming Tuesday and Howard K. Stern is paying for everything under the statute for out of town and out of state witnesses.
Thus after a week going back and forth with Vicedomine insisting on Tuesday October 20 quoting the order from the Harris County judge, Stern’s legal team made the reservations and accommodations for Don Clark and Wilma Vicedomine. I am “assuming” that Mr. Pirtle took the defense offer of a 48 hour notice if they need him.
At 3:00 AM yesterday, Sunday morning, the plane tickets and the lodging fell into Vicedomine’s email box.
The accommodations you ask? Well they booked them on a plane leaving Houston at 6 AM this morning, October 19, with several hours lay over in Phoenix. The five star accommodations is a tad lacking per Vicedomine, it is not a five star hotel it is not even a 2 star hotel and it is in the worse part of downtown L. A. It seems like the Stern legal team booked them into the Metro Plaza, see picture above and then one here.

When I interviewed Ms. Vicedomine for this article I have to make a full disclosure that I was laughing so hard I was doubled up and had to keep asking the same questions over and over. Funny I was the only one laughing she was NOT.
I asked her for a quote on the record as soon as I stopped laughing so hard I could get a full question out. Vicedomine was more than happy to give me one; “Thanks Howard for the roach infested ancient hotel, not funny”.
Remember that song Hotel California, I don’t remember the words but could this amusing antidote fit that song?
As one person close to the legal proceedings said to me, ask Wilma Vicedomine if she can spell R-E-V-E-N-G-E. This source also told me that Metro Plaza was raided about once a month to clear out the service industry that most used the hotel; you know that oldest profession known to mankind, which just made me laugh even harder this morning.
With that in mind it makes the Metro Plaza saying even funnier: “At the Metro Plaza Hotel, it’s all about you. You are our guest, our joie de vivre, our raison d’être. Come stay with us on your journeys and travels, and let us take care of you. Let our 80 luxuriously-appointed guest rooms and suites be your home away from home. I agree can you spell R-E-V-E-N-G-E?? I thought that this would be one of the lighter moods and articles through this whole saga. Why is it I have that Aretha Franklin song playing through my head today?

LOS ANGELES—The father of Anna Nicole Smith’s daughter says he was criticized by a prosecutor for his testimony about the role Smith’s former boyfriend had in her medication.
Larry Birkhead was questioned about the incident by a defense lawyer before his testimony resumed Monday in a preliminary hearing that will decide if Smith’s former boyfriend, Howard K. Stern, and two doctors will face trial. They are accused of illegally giving the former Playboy model controlled substances.
Birkhead says Deputy District Attorney Sarah Slice called after he testified Friday and suggested he was taking Stern’s side. He says she also suggested there was something wrong with his daughter because of Smith’s drug use before she died in 2007.
Birkhead has testified that Smith took more drugs than anyone he had seen.

Now they want to drag Dannielynn into this entire mess? “Something has to be wrong with Dannielynn due to Anna’s drug use”? Hey you SOB’s the ONLY freaking drug that was above normal blood levels at the time of Anna’s death was the CH. What part of that don’t you people understand? I have no idea how the DA is going to prove that Anna took all of these drugs and wwas constantly stoned. I wonder if they are happy now that they have begun the process and listened to DC and team Texas.

LOS ANGELES — The father of Anna Nicole Smith’s daughter said Monday a prosecutor suggested that the child was developmentally damaged by Smith’s narcotics use and that he should “ramp it up” in his testimony in the drug trial of Smith’s former boyfriend.
Larry Birkhead said the prosecutor’s remarks outside court before his testimony resumed made him upset, but the judge permitted him to take the stand anyway. Smith’s former boyfriend, Howard K. Stern, and two doctors are charged with conspiracy to illegally give controlled substances to the former Playboy Playmate, who died of an accidental overdose in 2007.
Birkhead said Los Angeles County Deputy District Attorney Sarah Slice called him after he testified Friday and suggested he was taking Stern’s side in the case.
“I felt the district attorney was frustrated,” Birkhead said under questioning by Ellyn Garofalo, the defense lawyer for Dr. Sandeep Kapoor. “She said I should bite my tongue. She then went into a long speech about my daughter, and how there was going to be something wrong with her,” Birkhead said.
“She said my daughter is going to be frustrated in learning and I should find something she excels in. She said she had studied the way the brain was made up.”
Birkhead said that after he left court, Slice text-messaged him, suggesting he should read to his daughter to help her in her development. Birkhead said he had not noticed any signs of physical or mental disability in the child, 3-year-old Dannielynn Hope.
Garofalo asked Birkhead how he felt about the prosecutor’s remarks.
“I didn’t banter about it because I felt she had crossed the line about my daughter’s health,” Birkhead said. “It upset me.”
Superior Court Judge Robert Perry asked if Birkhead took this as a negative comment on his testimony. Birkhead replied that he did.
On Monday, as the same prosecutor was escorting him up in the elevator before the hearing resumed, “it was suggested to me it appeared I was taking up for Mr. Stern and Anna couldn’t speak for herself,” Birkhead said.
He added that Slice said “she probably shouldn’t have this conversation” but then remarked that “Anna could not speak for herself and the doctors had exploited her.”
Birkhead said he disputed her statement regarding Stern and tried to correct her but then he had to come into court. Birkhead said he tried to talk to the chief prosecutor on the case, Renee Rose, but “she said she would discuss it with me later.”
“I said, ‘I don’t know if these stories were told to get me upset,’” he said.

In subsequent examination by Rose, Birkhead acknowledged that shortly after Smith gave birth to their daughter, he filed a paternity suit and included a declaration asking that the child be tested for drugs because of Smith’s prescription drug usage.
Birkhead also said that he felt Smith was grief-stricken at the time because of the death of her son, Daniel, and might not be capable of caring for the baby. Birkhead earlier said that Smith took more drugs than he had ever seen anyone take. But he also said she suffered from a wide array of ailments.

So Larry should ‘ramp it up’ and drive home the message that the DA wants to present. What happened to just telling the truth? If he is a State witness shouldn’t they of already worked through the ‘point’s’ they wanted to make? Who would need to remind him that DL’s welfare is in his hands? What a piece of work that woman is! Maybe TMZ will track her down and let her answer on camera.

When I went to Cal I stayed at the Merriden,it was a 5 star Hotel,and to show you,how plain I AM i went to dinner and ordered a salad,with prime rib.well the prime rib was perfect and for a salad I got a slice of lettece with dressing I kept my mouth shut,because I was told that is how fancy places do things.They also had refrig full of goodies,but I already learned it is not a gift to you,any thing you take you pay for.Lord do I MISS TRAVELING AROUND,I love the idea of getting waited on.What happened today,if this goes to trial would be a reason for appeal,I feel Howard charges should be dropped,because there was no conspiracy,and no Malice,or intention of harming anyone.Anna was given the means,by her doctor,and she took a extra swallow,plain and simple.
I predict Slice will have a very short career with the California DA’s office. She’ll certainly make a good scapegoat if their case falters.

The next witness, Dr. Nathalie Maullin, a pscyhiatrist who treated Smith at Cedars Sinai Medical Center while she was pregnant, described her as a difficult patient who was obviously going through withdrawal from multiple medications when she was admitted.
“When I asked her what she had been taking, she blew me off,” said Maullin, who recalled that Smith referred all questions to Stern who was in the hospital room with her.
She said she telephoned Kapoor, and he gave her a long list of drugs he had tried on Smith including Dilaudid, which she said surprised her because it is a powerful drug used in cancer patients and has addictive potential. She said Kapoor also said Smith had problems with alcohol.

Difficult could mean in control and demanding???
Dr. Maullin needs to take some refresher courses in pain management. In 1995 my daughter was under the care of a pain management specialist and was put on Dilaudid to control abdominal pain.
I wonder if they will ask Dr. Maullin how many patients are in the hospital and prescribed under fictitious names?

29-Rose, or just an average patient in duress while undergoing questioning about her medical history when they’re first admitted for care to professionally monitor withdrawal symptoms? The term “difficult” is vague. Does it mean complicated, arbitrary, confused, combative? “Difficult” is not a medical term so perhaps it only means Dr. Maullin is being purposely vague to allow the prosecution some leeway to define it to support their case. We’d need more context to know.
Thanks for the story Rose, I REALLY enjoyed it…so who was awake at 3am to send the reservations and the joy of a 6am flight and the stopover.

Why aren’t the HIPPA laws protecting Anna’s health records? I would have thought this was a given.

One important thing I learned when writing reports,was never make a positive statement,whatever you write put (APPEARS) A pt benefits.and Insurance can be cut off by what you put in a report.If I can read into what the Doctor is saying is Anna was uncooperative,tense,and had a attitude problem,steming from withdrawal of meds.Lets face it folks,Anna was spoiled rotten,and usually got what she wanted,now she has to put her needs aside and think of the child inside her,even though she wanted this child,Anna was not a happy camper.To my way of thinking it is a plus for Howrard,he was trying to get her to detox,not do her any harm.Also showing the trust she had in Howard,what is wrong with him giving her meds,she trusted him,he lived with her,they can questions the doctors intentions,as far as drugs are concerned,but Howard was doing everything he could with a difficult woman.

I have never doubted that HKS will come out of this CA “persecution” clean. Good to hear Harvey Levin say the same thing. So I wonder if DDA Slice really used the term Team Howard? Weird if she did.
89. Addition to last update for the AP
When court resumed after lunch, Slice was absent. At the end of the day, an employee of the district attorney’s office collected Slice’s briefcase from under the counsel table.
Asked if Slice had been removed from the prosecution team, district attorney’s spokeswoman Sandi Gibbons said, “The matter is being discussed, and no decision has been made as to her further role in this case.”
A state bar database shows that Slice was admitted to the bar last February.

Hi everyone….I come in and read a lot and I don’t post as much. But I had to comment on Larry making 2 million dollars. I hope he make another 2 million, because it most burn Virgie a** to think he is doing so well and she hasn’t gotten but a few thousand in the mix. Since money is her only concern, well Larry is doing just fine and good for him. JMO….And the Deputy Dog hitting on Larry in the hallway she should be fired. Anna Nicole Smith walked away from drug intervention, psychiatrist testifies

A psychiatrist who treated a pregnant Anna Nicole Smith for drug withdrawal in 2006 testified today that the model said she was willing to “do anything” for her unborn daughter, but ultimately walked away from a program to break her dependence on prescription medication.
The 39-year-old former Playboy playmate died from a drug overdose 10 months after the hospitalization described by Dr. Nathalie Maullin.
Prosecutors are pursuing charges against Smith’s boyfriend, Howard K. Stern, and two physicians accused of conspiring to illegally provide Smith with prescription medication.
At a hearing to determine whether there is enough evidence to try the defendants, Maullin recalled Smith’s weeklong stay at Cedars-Sinai Medical Center in April 2006.
Smith, 15 weeks into her pregnancy, had symptoms of acute drug withdrawal following what she told doctors was an attempt to go “cold turkey,” Maullin said.
“She said, ‘I’ll do anything for my baby,’ ” recalled Maullin, an addiction specialist. The hospital staff gave Smith methadone and the sedative Ativan to ease her symptoms and start the process of weaning her off the drugs, Maullin said.
Several days into her stay, Smith angrily rejected a treatment program that included a psychologist and a complete cessation of sedatives and methadone.
“She was very hostile. It was, ‘Give me my medications and leave me alone,’ ” Maullin testified.
The psychiatrist said she told Smith and Stern that if she wouldn’t comply with the hospital’s outpatient program, she needed to check into a rehab center. Smith’s reply was a stony glare and Stern questioned whether that was truly necessary, Maullin testified.
The father of the baby, Larry Birkhead, previously testified that Smith smuggled a bottle of methadone into the hospital and was using it with Stern’s knowledge to supplement the gradually smaller amounts given by the hospital.
Maullin said she never knew about the bottle. She also said she was unaware that Smith’s primary physician, Dr. Sandeep Kapoor, wrote her a prescription for Ativan the day after her discharge.
Stern, Kapoor and a third doctor, Khristine Eroshevich, have pleaded not guilty.

LOS ANGELES — A prosecutor who was accused of trying to intimidate one of the star witnesses in the Anna Nicole Smith drug case was absent from the courtroom Monday afternoon, and the district attorney’s office said her further role in the case was under discussion.
Larry Birkhead, father of the celebrity model’s daughter, disclosed from the witness stand that Sarah Slice, the young prosecutor who had been escorting him to and from court, had given him advice about his testimony and warned that his daughter might have problems in later life because of her late mother’s drug use.
“I felt I personally did my best and I was being chastised,” he said under questioning by defense attorney Ellyn Garofalo.
Birkhead said Slice told him prosecutors were “frustrated” because he appeared to be taking the side of Howard K. Stern in the preliminary hearing which will decide whether Stern and two doctors stand trial.
Stern — Smith’s former boyfriend — and two doctors are charged with conspiracy to illegally give controlled substances to the former Playboy Playmate, who died of an accidental overdose in 2007.
Birkhead, who ended his two-day stay on the witness stand, said he felt he was being pressured by Slice to “ramp up” his testimony against the defendants.
He said the prosecutor’s remarks — followed by a text message after he got home — made him upset, but the judge permitted him to continue his testimony when he said the exchange would not affect his account. He said he was being truthful.
Outside court, Garofalo said, “We’re distressed to learn of this attempt at witness intimidation.”
When court resumed after lunch, Slice was absent. At the end of the day, an employee of the district attorney’s office collected Slice’s briefcase from under the counsel table.
Asked if Slice had been removed from the prosecution team, district attorney’s spokeswoman Sandi Gibbons said, “The matter is being discussed, and no decision has been made as to her further role in this case.”
A state bar database shows that Slice was admitted to the bar last February.
In subsequent examination by the head of the prosecution team, Renee Rose, Birkhead acknowledged that shortly after Smith gave birth to their daughter, he filed a paternity suit and included a declaration asking that the child be tested for drugs because of Smith’s prescription drug usage. Birkhead also said he felt Smith was grief-stricken at the time because of the death of her son, Daniel, and might not be capable of caring for the baby.
Birkhead earlier said Smith took more drugs than he had ever seen anyone take. But he also said she suffered from a wide array of ailments.
Birkhead said Slice talked about his daughter after he testified Friday and suggested he was taking Stern’s side in the case.
“I felt the district attorney was frustrated,” Birkhead said under questioning by Garofalo, who represents Dr. Sandeep Kapoor. “She said I should bite my tongue. She then went into a long speech about my daughter, and how there was going to be something wrong with her.
“She said my daughter is going to be frustrated in learning and I should find something she excels in. She said she had studied the way the brain was made up.”
Birkhead said that after he left court, Slice text-messaged him, suggesting he should read to his daughter to help her development. Birkhead said he had not noticed any signs of physical or mental disability in 3-year-old Dannielynn Hope.
Garofalo asked Birkhead how he felt about the prosecutor’s remarks.
“I didn’t banter about it because I felt she had crossed the line about my daughter’s health,” Birkhead said. “It upset me.”
Asked by Superior Court Judge Robert Perry if he took this as a negative comment on his testimony, Birkhead replied that he did.
On Monday, as the same prosecutor was escorting him up in the elevator before the hearing resumed, “it was suggested to me it appeared I was taking up for Mr. Stern and Anna couldn’t speak for herself,” Birkhead said.
He added that Slice said “she probably shouldn’t have this conversation” but then remarked that “Anna could not speak for herself and the doctors had exploited her.”
Rose later got Birkhead to describe media deals he made after Smith’s death. He said he was paid a total of more than $2 million for interviews.
The next witness, Dr. Nathalie Maullin, a psychiatrist who treated Smith at Cedars Sinai Medical Center while she was pregnant, described her as a difficult patient who was obviously going through withdrawal from multiple medications when she was admitted.
“When I asked her what she had been taking, she blew me off,” said Maullin, who recalled that Smith referred all questions to Stern, who was in the hospital room with her.
She said she telephoned Kapoor, and he gave her a long list of drugs he had tried on Smith including Dilaudid, which she said surprised her because it is a powerful drug used in cancer patients and has addictive potential. She said Kapoor also said Smith had problems with alcohol.
Among the allegations against the defendants are dispensing controlled substances to an addict and dispensing them by fraud by using false names.

108. I am talking about what Sarah Slice said about Dannielynn–the judge knows she tried to intimidate a witness about his testimony, which is bad enough. However, nagging him personally about his child is over the top, and is extraneous commentary from an opinionated idiot. I am not talking about the redirect by Renee Rose and the issues from the paternity suit, other than to mention the originally sealed doc uments from it that Cosby had and Rose has now.
If a witness was tampered with by a prosecutor during an actual trial, it would be grounds for mis-trial. I’ve seen less than that halt a trial and/or end it.
Judge Perry didn’t seem to be the least bit shocked by Sarah Slice’s actions. The reporting doesn’t suggest it.

Oh, I get you. I agree, if this was a criminal trial underway, a mistrial would have been declared. The ‘mafia style’ persuasion of a witness to say the ‘right’ thing by going after the baby is sick stuff.
I’m sure the junior member of the team got her head handed to her in private. Slice’s ignorant remarks and behaviors does shed light on the weakness of the case and the desperation of the prosecutors.

Records obtained by TMZ show the Internal Revenue Service filed a $125,112.86 federal tax lien against the Vickie Lynn Marshall Estate in Los Angeles County earlier this month.
The tax assessment took place in December 2008 — Anna died in February 2007.

Maullin took the stand Monday after a disruption in the testimony of star witness Larry Birkhead resulted in the disappearance from the courtroom of a member of the prosecution team.
District attorney’s spokeswoman Sandi Gibbons said the future role of Deputy District Attorney Sarah Slice was under discussion after Birkhead, the father of Smith’s daughter, testified that she tried to influence his testimony. He said the young prosecutor suggested he was “taking the side” of Smith’s former boyfriend, lawyer Howard K. Stern.
Birkhead said Slice also warned him his daughter might have future problems because of her mother’s drug use.

She said Smith came to the hospital in distress, sweating, having spasms in her arms and legs and with her eyes dilated.
Maullin said she contacted Smith’s physician, Dr. Sandeep Kapoor, one of those now charged in the case, and learned he had prescribed seven different drugs to Smith during the time she was seeking relief from pain.
Maullin said she suggested a new regimen including hypnosis and acupuncture but Smith wasn’t interested.
“She wouldn’t engage. She didn’t make eye contact. She was very hostile,” Maullin recalled. “It was, ‘Give me my medication and leave me alone.’”
Maullin said that when Smith was asked questions, she would reply: “Ask Howard.”
She said she told Stern that Smith should be in a structured rehab program and discussed with him and Kapoor her belief that Smith was addicted. Maullin said that during Smith’s hospital stay, she tried to regulate the former model’s use of methadone for pain and remove her from a number of drugs known as benzodiazepans.
Rose suggested that after Smith’s release, Kapoor continued to prescribe one of those medications.
Kapoor’s attorney, Ellyn Garofalo, has said the doctor gave Smith “sound and appropriate” treatment. Attorney Steve Sadow, representing Stern, has said his client shouldn’t be blamed for Smith’s death because he was relying on the doctors to treat her.

Kapoor’s attorney, Ellyn Garofalo, has said the doctor gave Smith “sound and appropriate” treatment. Attorney Steve Sadow, representing Stern, has said his client shouldn’t be blamed for Smith’s death because he was relying on the doctors to treat her.

Honestly, I wouldn’t have noticed the change in your name if I hadn’t read what you said about it on the blog.
I just went in and corrected the name on those 2 post but they showed the name like that because you typed it in there. Next time if you aren’t logged in just type the first name and that should take care of the problem.
