I had court observers tell me over and over again this week, that before this preliminary hearing started they felt it had been a fatal error on Howard K. Stern’s part to bring in an out of state lead criminal attorney, Steve Sadow. It was thought that as many good criminal attorneys as there are in California and especially around the Los Angeles area that any jury would not relate to the southerner in cowboy boots, Steve Sadow.
During the preliminary hearing we have read from court observers that Judge Robert Perry stops Sadow as he is going into a long oratory before asking a question of something like “hold on, this is a preliminary hearing not a trial keep the questions short and to the point”. Then we had Daniel DiCriscio describing in just the morning session that Steve Sadow, lead criminal attorney for Howard K. Stern, was jumping up every few seconds to object to something the Los Angeles assistant district attorney, Renee Rose would began to ask to object.
However, that seems to be evened out by the judge not allowing a lot of evidence in about Anna Nicole Smith, her life, potential sex escapes, tapes etc. that Renee Rose is trying to introduce. One witness blames Stern and Dr. Khristine Eroshevich as Mo Mo did, and then another witness does not know anything about Dr. Khris but did talk to Dr. Sandeep Kapoor and so the “show goes”.
“Show”?? Yea but about a real person’s life and every facet of it more then two years after her death, I keep asking myself why?
Did we need to know about all of her physical ailments? Did we need to know, as one writer, said where even the remote to her T. V. was kept? Did we need the dueling banjos of testimony of Mo Mo followed by Larry Birkhead to dispute that fact? Birkhead explained what seemed to be a far more logical explanation and one I had heard way back in the spring or early summer of 2007. If I could find this why did the “lead investigator” Danny Santiago NOT find this?
Everyone who is a court observer agrees that the most damning evidence to date is Mo Mo, after all he was with her the last 5 months of her life. By the way if he did that because he loved her and never got paid, doesn’t that mean he lived off of Anna Nicole Smith in the beautiful Caribbean as the fingers he pointed at Stern seemed to indicate? Why was Mo Mo willing to lie for months and months and then decided he wanted to set the record straight? For that matter which record is he sticking to finally? I have so many questions about the devoted Mo Mo and so few answers.
I have heard it said that Howard K. Stern better hope that Sadow has a big enough bat to handle Mo Mo or his legal name of Maurice Brighthaupt, and does he? Well I talked to several court observers after the almost 3 days of Mo Mo then followed by the southern voice of Larry Birkhead and here are some things they are saying. First and foremost to date the only damning witness has been Mo Mo, but let’s look at that and what some have not written about.
Under cross examination Sadow was able to agitate Mo Mo, that won’t play good to a jury for Mo Mo to appear like a giant ex bodyguard with an axe to grind with Anna Nicole Smith’s Estate which equates to Howard K. Stern and Larry Birkhead. One court observer told me about this last week that they did not care for Sadow personally but that he was “very likeable” and that is what plays to a jury. If the lawyer is likeable and has some good points and can agitate the top witness to date that does not bode well for the prosecution. One court observer told me, it does not matter if you like Sadow personally he is one hell of a likeable lawyer in court. Here is my own interpretation of what MIGHT have happened between Mo Mo and Sadow in just one question and all of you have posed some great questions here on the blog by the way. Sadow: “So Mo Mo which time are we to believe when you are choosing to tell the truth, now or when you were being paid over a hundred grand for appearances when you said something entirely different”? Mo Mo, gets agitated and glaring at the lawyer and said: “This time I am just now trying to set the record straight”. Now agitated and that lame of an excuse for lying while the money was coming in but not now, how do you think that is going to play to a jury?
I had heard the account given by Larry Birkhead about the AMA show before and have written about it. Allegedly Anna Nicole Smith had a grand mal seizure the night before her appearance. Two doctors were called and both said to give her a double dose of her seizure medication. As hard as it is for most of us to believe the beautiful Anna Nicole Smith had anxiety before a public appearance and especially for this one with her weight loss. She had insomnia and had not slept for thirty six hours straight. I have heard “gossip” that besides the seizures and no sleep she had taken a Xanax several hours before she was to appear to try to sleep. Did Mo Mo have any explanation for that? Another witness who is suppose to give damning evidence is Nathan Collins but even he told me he had asked around and had talked to Kim, Anna Nicole’s personal assistant for years and had been told way back in 2005 the same recounts as Larry Birkhead gave on Friday. So could Mo Mo have just forgotten all of that as the months and years have gradually slid past?
Then there are all of the horrid things we are learning about the health and habits of this beautiful previous playmate of the year turned model. Did any of us really or need to know about everything she suffered from? Did any of us want to really know about her personal habits including liking to drink out of a baby bottle, keeping baby food snacks near her bed and all of the other very personal things we are now finding out? I did not and it kind of makes me physically sick, how about each of you?
This brings up an email I found I still had from 2007, it is talking to someone else, now remember I have never spoken to Howard K. Stern, Larry Birkhead, Virgie Arthur, Mo Mo and most of the people in this saga and certainly NONE of Anna Nicole’s inner circle. However let me recount in part what this email says. Remember at one time I did do some domestic violence advocacy work and I can say for certain that adult survivors of child abuse are almost impossible to reach out to or help. In this email I say “I have been able to “VERIFY”…. I have no idea who I was talking about when I said “verify”. However, the email goes on to say, “there were at least four different personalities of Anna Nicole and she referred to them as this. Vickie Lynn is the girl that came from Mexia Texas, Nickie was the stripper, Anna Nicole was the model and red carpet walker, and Robin was a little girl”. I believe in the email I am musing could one of the secrets that Stern has vowed to protect in death could be the fact that Anna Nicole suffered from multiple personalities? I don’t know but those of you who have read the last week and followed Anna Nicole Smith in life, could that be true? If it is do we have the right to know all of that now over 2 years after her death?
So in the end as it appears now that all of Anna Nicole Smith’s secrets will come out will Steve Sadow have a big enough legal bat to handle those like Mo Mo as Howard K. Stern dearly hopes so? If a private citizen knew that there was illegal activity on those hard drives and took them to preserve the evidence, how is that not admissible?
Also, the California authorities were not aware of the “alleged” theft when it occurred.
Ford Shelley turned that evidence over to the police in SC.
The SC PD turned it over to the Seminole PD and the California authorities obtained it from the Seminole PD ‘after the fact’.
Not understanding why you are saying it was illegally obtained by California and not admissible.

THE US COURTS (all of them from small claims up to the Supreme Court) HAVE LAWS THAT EVIDENCE CANNOT COME INTO COURT AND BE HEARD UNLESS IT HAS BEEN *SPECIFICALLY* SUBPOENAED. (that means a good reason put down on paper as to why the LE (Law Enforcement) wants to take someone’s property and search through it.)
When the reason is put down and explained to a Judge, then the Judge makes the determination to sign the warrant to get the private property.

ET (Entertainment Tonight) HAD VIDEO OF HKS COMING BACK TO HORIZONS AND SEEING ALL OF ANNA’S PAINTINGS, PERSONAL PAPERS, COMPUTERS, TAKEN ILLEGALLY FROM THE HOUSE HER NAME ALONE WAS ON. (Does not matter that FS still thought he had a right to it, that had not been settled in the Courts on the title of the House; Horizons) It ended up that FS and his father-in-law gave up the title in the end.
ET COVERED THE THEFT, THE THEFT WAS TALKED ABOUT ON LKL, FS HIMSELF WITHIN DAYS ADMITTED ON GERALDO TAKING ANNA’S ITEMS. OF COURSE FS SAID HE DID IT FOR SAFE KEEPING.
Question: The computers were found out by experts to have been copied within hours of the theft!
WTH KIND OF SAFE KEEPING IS THAT?
THERE IS STILL TIME FOR THEFT CHARGES TO COME IN SOUTH CAROLINA.
STILL TIME FOR THE TEXAS FIRM TO BE CHARGED WITH RECEIPT OF STOLEN PROPERTY ALONG WITH THE LAWYER FOR FS. (pending case also now in N. GA) On a multitude of illegal acts done by Officers of the Court.

BESIDES THESE ITEMS, FINDINGS NOT BEING ADMISSIBLE, THE PEOPLE THAT HAD THEM AND GAVE THESE ITEMS TO OTHERS COULD FACE SERIOUS CONVICTIONS AND LOSS OF LICENSES IF APPLICABLE. Example – Loss of Legal Licenses.
Everyone puts down HKS, but some of these BLATANT ILLEGAL CRIMINAL ACTS the opposing side has done in trying to take HKS out of the picture is far worse because it can be proven to be premeditated malicious acts.
In the end, the ones who have worked so hard and spent so much money trying to take the place of LB and HKS will be the ones who are taken out of the picture and possibly behind bars for a very long time.

#2 Beth, not only copied during that FIVE days from FS and company taking the computers and hard drives but also I believe I remember that certain files had been deleted… if that does not make it fruit of the poison tree then what does?? Add to that Santiago was offered and declined to EVER talk to HKS for over 2 years… why???? Did he already know about the contaminated evidence???
As far as I can see the ‘chain of custody’ was broken on those items as soon as FS stole them. Not only did he brag about copying the hard drives, he also bragged about having Anna’s passwords. It was also proven by an expert that files had been deleted and who knows what other files, emails etc had been altered in some way.
From reading all accounts of the hearing,I find this Judge is on the right track.I finding all he cares about is like Sargent Joe Friday used to say on ” Dragnet” ”just the facts”.No one likes to hear Anna’s medical history,but it is extremely important to hear WHY all those drugs were needed.I pray Sadow gets to tell of Anna’s drug use before Howard as to show when her dependency started,Larry did tell the judge Moe was out to get him and Howard,and that no one forced meds on Anna.This is what the judge needs to know,was anything forced on anna,or was there was a reason for giving her meds.Moe to me has no right to remark on what anyone actions were,His and his wife actions on the day Anna died are inexcuseaable.and if his concern was so great WHY did he not take tha package sent to him to the police if he thought it was drugs that Anna should not get.I am of the belief Howard had no motive other than to care for Anna and obey Dr. orders WHAT does Jerry Brown want,a pound of flesh from a man who only want was to love Anna,But I will say ,I in NO WAY approve of Dr E handling of Anna.

Rose reading the personal stuff about Anna is really sad and I have to wonder if this is what Virgie wanted, to pull Anna of her pedastal, or as we say here Tall Poppy syndrome, so lets mow them down.
But with all that I think that with the prosecution doing this to a dead person really does show they are after revenge not legal justice. They are slaughtering the victim here if that was true. A jury would be just like we are and very uncomfortable.
But even if it all goes to nothing they have won the media war and maybe that is what they are after. So many peoples reputations ruined so that the Marchall money can be carved up.

how we tell how Sadow did with Mo we did not read about it all we know what DD said about Mo and left the room .I saw Mo in TV so many time and he change his story him and his wife to the highest bidder.The same with Collin I still think that some one do not like HS layers for one way or other and put them down all the time with the investigation the said DR E is the one ordered and put the name she made most of them up so why charging HS .
I just read at TMZ Moe statement,he saw Howard ready Valium to give to Anna in a injection,but he did not stay to see what Howard did,Now would you all like a BODYGUARD like MOE,Whose body was her guarding,If you think something is wrong,first thing you do is walk away,I wonder if that is in the bodyguard handbook?
Just like the balloon boy the family was so believable and they were not telling the truth but they got caught .

“TAINTED” is an excellent word for everything that CA prosecution has!
They have the so called evidence that has no legal chain of custody AND they have gotten subpoenas on many other things connected with the doctors on the word of people like a former FBI guy and lawyers who are so transparently bias and who had no problem showing the world on TV that they made false allegations against people on purpose with INTENT TO HARM them!
I am still in awe that anyone in this day and age is ‘charged’ with some of the things he is charged. Even the AP writers say they have not seen this before…
WHY? The only answer to that question for me after following the news stories, reading the filings and watching them in person on television is because the DOJ/DA was fed whopping fairy tales of wrongdoing by the people with their own greedy agenda!

“FOXNews Channel, ‘Geraldo At Large’, 10 pm ET & PT, w/ repeats, 10-18-09
• Geraldo discusses the ANS related criminal case in his 0:47 segment
Geraldo goes to commercial teasing the segment: The hearing WE all were not sure would ever happen …
JB was on the show about 20 minutes earlier discussing health care legislation. Geraldo asked him to hang on after the end of that interview to discuss the upcoming segment dealing with the HKS/K/E criminal case; JB disappeared though and without further mention from Geraldo.
(Actual) Guests on panel: (former) Judge Seidlin, Big Moe, (former) Judge Jeanine Pirro – Geraldo refers to HKS as the ‘manipulative boyfriend’ and ANS as a ‘junkie’ as he proceeds with the interview (just to provide context).
Geraldo asks Big Moe if he lied to him 2 years earlier when Big Moe was on the show saying he never saw ANS take illegal drugs. Big Moe, as in Court, explained he was trying to protect ANS just after her death and during the media storm that ensued. Geraldo is concerned about the ‘are you lying now’ aspect of dramatically changed recollections and how defense lawyers might treat that fact. Big Moe assures him he takes the oath in Court seriously.
Geraldo questions and Big Moe answers (closely paraphrasing or in quotes):
1- Did you see ANS ‘chug’ CH from the bottle like Gatorade? Yes.
2- Did you see HKS/Dr. E shoot up ANS with narcotics? Inject her yes, but I don’t know what was in it (the syringe). Geraldo adds ‘it wasn’t Gatorade’.
Commercial Break
3- Do you assert you walked in on HKS “with a spoon with ‘something’ in it and him burning it like junkies do heating up heroin or other”? Yes
4- What did HKS do then? Drew it up in a syringe (Geraldo demonstrates with elaborate hand gestures)
5- Then what did he (HKS) do?
Big Moe stops and asks if it is OK for him to say what happened next outside of the hearing? Geraldo assures him he can repeat his testimony. Big Moe never answered #5 above, instead he said he was told by them at the time that “whatever they pulled in (to the syringe)” would work faster if injected (i.e. he never said it was injected or by whom).
5- Did LB change his story about HKS administering drugs from the FL case to the CA case? I believe he did.
6- Are you saying LB lied in CA or in FL? Big Moe talks indirectly about testifying under oath before this (the CA) or Judge Seidlin (sitting down from him on panel) and that not telling the truth is perjury.
Judge Larry says JB (not LA Prosecutors, JB) should look into the ‘burial hearing’ transcripts; “it’s all in there”. Judge Larry stated emphatically, HKS admits he gave ANS drugs, he gave them under different names, “and he gave drugs to a known addict”, “he gave drugs to a woman who was pregnant”, “he thought she was carrying his baby, which sort of blows your mind” and “that’s what he’s left with now, all that negativity” (huh, all that negativity?).
Big Moe says I wish him (HKS) no ill will “but you know you have to pay for it”.
Judge Pirro is over the top as usual. She screams “criminally negligent homicide’ all of a sudden. HKS should be charged with more than drugs, “he was injecting her, she OD’d, she died, end of the story”. Judge Larry pipes up that CA does not have jurisdiction “as our good Judge (indicating Pirro) knows”. Pirro replies “well indict him in FL”. Well, Geraldo pressured Big Moe to say HKS personally injected ANS with narcotics (which Big Moe didn’t) and to say LB is a liar now (which Big Moe didn’t). Judge Larry used the language of the CA charges to assert he personally had placed in his Court’s transcripts all the evidence the ‘learned’ AG of CA would need to make his case. Pirro is suddenly of the notion that it’s a fact that HKS injected ANS with drugs that killed her and she wants FL to indict him! Wow … what the power of persuasion with a biased host can get two former Judges to say so passionately on TV.

Santiago (and his ‘advisors’ from FS/SB/McCabe, etc.) exploited a non-fact: Santiago is walking the thin line of thinking that since ANS was dead at the time, that no one ‘owned’ the electronic materials that were being traded about by various government agencies. Broward County, FS and the Seminoles did not ‘own’ ANS’s EM, her Estate did. Santiago took possession from people who couldn’t legally give the materials to him without consulting ANS’s Estate and presenting its opinion to the Judge. Goodness. Just kinda been hanging back and seeing what info comes out from the prelim. Also found a series of books that’s holding my interest. I’m on #3!
So far..no smoking gun as far as I can tell. Dear ole Moe. How long has he been the ’saving grace’? No wonder he feels pressure and is ‘trying to do right’. What’s that old saying? If it’s the truth, you don’t have to keep changing your story?
The first couple days of the prelim I was thinking I needed to buy stock in brown paper bags. There were so many hyperventilating on T’s site.

Did anyone see when McKenzie Phillips was on Larry King talking about her life? Dr. Drew was on also towards the end. *check out the transcripts*. One of his comments was how common it was for addicts to have underlying childhood physical or sexual abuse issues that they were trying to come to terms with.
I don’t know if Anna had multiple personalites, but the issue of being stunted in emotional growth is maybe something that those that repeat Anna was a 39 year old woman who could of made different choices, could check into.
And since I seem to be writing my own book
there was a bio done on Anna years ago. She mentioned that when she heard that JHM had died, she had a seizure. Now I can’t find that bio on Anna when I look for it. Had lots of interesting info. The prosecution case is that Anna was prescribed med’s “OFTEN” for no legit reason right? So how can they narrow down when her ‘condition’ warrented taking med’s or when the ‘addict’ was having a craving? Medical need or a junkie? Guess we’ll find out.

~Anyone can get a medical marijuana recommend in Calif with $130 and proof of a doctor visit. And it doesn’t keep you from getting arrested, but can be used as a defense to the charges. Obama’s new legal guidelines will only effect suppliers. They are the ones taking the heat from the feds.

~valium pills would have to be mixed with something more than water to make them liquid. Like some sort of alcohol or something. The problem is separating the pure drug (diazepam?) from the fillers (talc and other gunk) that hold the pill together. You got to filter all that stuff out. Or all you would have is a clumpy mess. Who else has talked about a spoon and liquefying pills? Is Moe the only witness to this?? I think that state is trying to get around the FACT that the H&S Codes were written for doctors in relation to the word “administer”. They are trying to turn ANS into a junkie. Very sad.

Ok folks here is a funny BUT true.
1. Mo was suppose to be on GR’s Saturday night show but got “BUMPED” for the hellium balloon, boy family story… that shows alone how much ratings ANS is worth to Fox these days and then only on a nut case like GR’s show and you can bet that was taped AGAIN for any future testimony.
2. Mo was paid rather nicely for that interview… he flew first class (by Fox) from California to New York on Friday, put up in a 5 star hotel, paid nicely for his “information” and is flying back to Florida today, first class again by Fox with a nice tidy amount of money in hand.
3. Mo is SO for sale that while sitting in his first class seat on Friday, he ran into another first class passenger, one of the producers from ET… they introduced themselves to Mo, asked if he remembered them, Mo said “yes”, they begin to talk to him………… BUT they offered him no money so he asked them not to say another word to him… he did not want to talk…
I guess his dance card had already been paid in full…. Mo Mo tell us it ain’t so… he lost me in his dramatic Feb. 2007 confession that his lips were the last to touch ANS lips… it was at that moment I went YUK who is this guy..
Moe will be on every show that will put his big mug on…..I say let him talk, he will hang himself in the end. I was not impressed with him on GR at all, don’t get why so many reports about him being such a good, sincere sounding witness.
I have heard of many people using valium for recreational use, but never have I ever heard any of them saying anything about ’shooting it up’. My question to those who used valium for ‘fun’ was why since they just relax you(yes, I take them, and no, I do not abuse them for the nuts elsewhere), the answer I got was that taking valium and drinking alcohol ‘enhanced’ the effects of the alcohol. I am just not buying the ’shooting up of valium’. I take mine at bedtime to help me sleep.
By the way, when I worked, I worked amongst hundreds of people and as long as you don’t spread their business or are judgmental, they will tell you all about things like that. I do tell them how harmful it is on their bodies, though.
Rose I know you can relate to this,I get very sick to my heart and stomach,when a person you trusted turns out to be a Judus,I had that happen to me,and you better believe,I have changed,Howard and Anna trusted the wrong bodyguard and Doctor.no wonder Anna got depressed,if it was not for Howard,Anna would have been dead long ago,Moe is a pure Liar,and it showed,I would like him to explain away his action on the day Anna died,and his non action as a bodyguard.Also I am dead set Marijuana being legalized,There is no way,I would allow Marijuana stores,because there is no way to keep control.If a person is terminal they should be able to get marijuana at Hospice for free,or visiting Nurse to bring to pt,free.I am ashamed to admit this,when I had the kidney out,and got home,I TOOK PAIN MEDS SO i could do my food shopping,and houseworkand I am afraid Pts will smoke as much as they want when they want and go out.and maybe drive,
