Court started at 8:00 AM this morning, October 16, 2009 on day four of the preliminary hearing in Los Angeles California. First up is the re-direct examination by assistant D. A. Renee Rose for the state of California of Maurice “Big Mo” Brighthaupt. That has been scheduled by most to last about one and ½ hours by many court observers. It did come to light yesterday that “Big Mo” made $100k on one interview following Anna Nicole Smith’s death.
Mid-morning will begin the direct examination by Renee Rose of Larry Birkhead, he is expected to be pro Howard K. Stern but might be hostile to Dr. Kapoor and Dr. Eroshevich. Adam Braun, attorney for Eroshevich, he had just received an audio tape from the state of Birkhead’s interview with them and had not had time to fully examine it on Tuesday of this week.
The state is keeping their cards close as to what witnesses will be appearing on which days. There are hints around the courthouse that Superior Court Judge Robert J. Perry may shut down the preliminary hearing early next week. He is showing some impatience often heard saying, “This is not murder trial” and “Whose fault is it that somebody takes too many pills?” However yesterday during the cross examination by Steve Sadow of “Big Mo” the judge said they could keep this going for six months if the attorneys really wanted to do that.
I keep going back to why a public preliminary hearing which is a basic walk through preview of what might come up at trial, in lieu of a Grand Jury which the outcome would have been a finding of enough evidence to go to trial. They both, I am told, end up at the same place so why this, and not the close door hearing?
Don Clark is not in California as a “material hostile witness” for Howard K. Stern, he is expected back by next Tuesday, October 20 with Wilma Vicedomine and Tom Pirtle, I would think Stern’s legal team might reschedule that for after Wednesday October 21 since there will be no court on Wednesday.
UPDATE ONE: The redirect examination of Maurice “Big Mo” Brighthaupt has been completed by Assistant D. A. Renee Rose. Larry Birkhead is on the stand now and is expected to defend Howard K. Stern and point the finger at the two doctors, he is under going direct examination by the D. A. right now. Big Mo also testified not only did he see Dr. Eroshevich inject Anna Nicole Smith ONLY once in those 5 months but he also saw the bottle of B-12 and stated that was what Dr. Eroshevich used.
UPDATE TWO: Larry Birkhead is being very polite to Renee Rose showing his good southern manners but on a lot of questions he is answering either “I don’t know”, or “I can’t remember”. He should be a huge boost for Howard K. Stern after 2 days of Big Moe.

Good Morning Everyone—-Beth,I do not think Jerry Brown is going to come out of this case smelling like a rose.In the first place,the judge is sharp(thank God) not a Judge Lindsay,he wants facts of the case not tabloid gossip,second,and that pure fact is,with Howard there was never any crimminal intent.Did he allow his name on bottle’s of meds for Anna,yes,all Hollywood was doing the same thing,it should fall on the doctor,NOT Howard,So far I have seen a Judge Chin,and I love it,I myself need to see,the judicial system working the way I believed in the Law all my life .Howard has paid a very high price for his love for Anna,it is time to leave this man to grive in peace.Moe was painting a picture of Dr E as concerned about Anna drug use,well,there is a BIG PROBLEM HERE,A Doctor who has a concern for a depressed person,and meds she is taking,WOULD NEVER prescribe CH to her pt that was tying to be like MM.There is with me another problem. Howard put his trust in Tas as a RN,AND Moe as a EMT,I would assume that is why Dr E left and went back to Cal,there were two medical personal to watch Anna,touble is THEY DID NOT.and I TRULY BELIEVE DON CLARK is pushing Jerry Brown,
So Moe admits he lied for over $150,000.00 but is telling the truth now? How about the fact that he could have helped Anna after her death if he would have told the TRUTH to Perper and everyone else.

It’s stunning that Renee Rose would enter a Court to rhyme off the McCabe/Clark B.S. that JB and others were sold (and campaign with) without having taken the time to catch a clue. A preliminary hearing in a criminal case is the norm. In California anyways. In some cases where the prosecution feels that they do not have enough to indict, or where the witnesses need protection, a Grand Jury could be called. This is not a Grand Jury case. The state has already filed its information, and feel the charges are warranted. There are no witnesses that need protection (lol) and all this bs is already out in the public. It is too late for secrecy.
According to the California Grand Jurors Association, the district attorney much more frequently bypasses the grand jury and uses the process known as a preliminary hearing. A 1954 survey of California district attorneys listed the following factors as influential in the decision to seek a grand jury indictment rather than using the preliminary hearing:
1)
High public interest in the case;
2)
The fact that a preliminary hearing would take more time than a grand jury hearing;
3)
The necessity for calling children or witnesses who would be subject to cross-examination at a preliminary hearing;
4)
The existence of a weak or doubtful case which the district attorney wishes to test;
5)
Cases involving malfeasance in office; and
6)
The fact that witnesses are in a state prison.
A more recent study adds the following reasons for using the grand jury:
1)
Cases where the defendant cannot be located and the time limit under the statute of limitations is about to expire,
2)
Where the secrecy of the grand jury may allow defendants to be charged and taken into custody before they can pose potential danger to a witness’s safety or flee from the jurisdiction,
3)
The need to protect the identity of undercover agents,
4)
And the ability to test a witness before a jury.

Larry Birkhead is on the stand in the preliminary hearing involving Anna Nicole and the defendants who allegedly fueled her drug habit.
Birkhead just testified between August, 2004 and May, 2006, he saw Anna take the following drugs regularly: Topamax, Lasix, Klonopin, Valium, Xanax, Potassium and Methadone.
He has not talked about whether Howard K. Stern or the two other defendants — Sandeep Kapoor and Kristine Eroshevich helped facilitate Anna’s drug use.

Under cross-examination, Smith’s bodyguard testified that it hurt Smith that people thought Stern was forcing her to take drugs.
“I don’t think that he purposely forced her to take any drugs, no,” Brighthaupt said, while saying under later questioning that Stern treated Smith “like his possession.”
Stern’s lead attorney, Steve Sadow, has said Smith “believed in her doctors and relied in good faith on their medical judgment,” adding that they “prescribed her medicine for valid and legitimate reasons” while respecting her wishes to protect her privacy.”

Moe and Tas are medical professionals,Moe thinks Dr E is such a nice person,well that tells me I would not want him near me in a ambulance,We and the court are not going for a nice person.but was this Dr correct in her prescriping of Meds for Anna,and did she handle her pt correctly.The answer is NO,Did she not think,Anna in her depressed state would not swollow that CH?,and if she had such a close relationship with Anna,she most certain could have talked Anna into a hospital or ordered it.Tas sure as hell could care less weather Anna was getting taken of,she had to be told to check Anna,There is a long list of people that destroyed Anna,and Howard K Stern is not one of them.Dr E let friendship get in the way of her medical judgement,If she did not admit Anna to Hospital,she should have stayed with her,sick and depressed she takes off on her pt.

LOS ANGELES—Larry Birkhead, who gained fame in a custody battle over Anna Nicole Smith’s daughter, testified Friday that he regularly saw the ex-model take prescription drugs, including methadone.
Birkhead took the stand in a preliminary hearing to determine whether two doctors and Smith’s lawyer-boyfriend should stand trial on charges of conspiracy to illegally provide her with controlled substances.
Birkhead told a Superior Court judge he saw bottles of Valium and other narcotics after moving in with Smith in 2004.
Birkhead testified that defendant Dr. Sandeep Kapoor was Smith’s regular physician at the time and identified Kapoor seated across the courtroom.
The testimony was the first to name Kapoor as one of Smith’s key doctors.
Prosecutor Rene Rose sought to show a video of Kapoor socializing with the former Playboy model at a gay pride parade and party. The video shows the doctor nuzzling and kissing Smith, Rose said.
However, Kapoor’s attorney Ellyn Garafalo objected that the video was irrelevant to the case.
Garafalo previously told The Associated Press Kapoor is openly gay and never had a sexual or social relationship with Smith.
Superior Court Judge Robert J. Perry said he would review the video before deciding whether to allow it as evidence.
Kapoor, Dr. Khristine Eroshevich and Smith’s lawyer-boyfriend Howard K. Stern have all pleaded not guilty. They are not charged with Smith’s death in a Florida hotel in 2007, which was ruled an accidental overdose.
Birkhead fought Stern for custody of Smith’s daughter, Dannielynn. Stern lost that battle when Birkhead proved by DNA evidence that the little girl was his.
In his testimony, Birkhead described a whirlwind romance that began when he met Smith at a charity event before the Kentucky Derby in 2003. Birkhead said he became Smith’s personal photographer and moved into her home, sharing it with Stern.
Birkhead said he lived there until the fifth or sixth month of Smith’s pregnancy.

I intended to say that I am interested in why Judge Perry buzzed right by the mention of the photo’s of Anna and Dr. E as though they were not important, but finds that he wants to see the video of Anna and Dr. Kapoor. Why is that?

Raven, that was the question I was going to ask…that makes no sense at all, to me. It was not important or worthy to see the photos of the ladies(which I do agree, no importance at all, just gossip), but thinks he needs to check out Kapoor and Anna. Whatever was on the video was for ’show’ since he is admittedly gay! Sounds strange to me.

Meanwhile, prosecutors tried to pull out what they claim is a smoking gun…
They have petitioned the judge to allow them to show in court a video capturing of Kapoor kissing Smith at a nightclub and talking about her prescriptions.
A ruling on that matter could come later today. If the request is granted, such footage suggesting she and Kapoor had an inappropriate sexual liaison could do significant damage to the defense, as it could lend strong credence to the view that Kapoor (who says he is an out homosexual) abused his position and helped fuel Smith’s addiction.
This is why the judge might allow the Kapoor tape in IF he was in fact heard on camera talking to ANS getting “prescriptions” from him while at a night club… not a good image for the doctor

Well just as we expected, Moe did receive money but the question is, is he telling the truth about the exact amount and who all he received it from! IMO, no he is not.
raven [24] since you mentioned Judge Perry wanting to view the video of Anna and Kapoor I was wondering if other video’s were going to be viewed by him, say like the video ET showed last night. Remember the video where Anna is saying she is her own person and makes her own decision among other things. I just wonder if Judge Perry will have interest in that one as well.

In Memory of Our Dearly Departed Inflatable Halloween Decoration Friend…Tigger the Vampire
Today I am sad to report tragedy struck in the JMA household last evening, yes this unforeseen tragedy was discovered around 7:45pm last night when hubby went to put the recycling [yes we are recyclers ;-) ] out by the road. While setting the recycled cans and bottles to the road hubby noticed one of his oldest most prized inflatable Halloween decorations 6 foot tall Tigger the Vampire laying face down on the ground. Now Tigger the Vampire had done this often especially during those windy days. Well like many times before hubby walked over to give Tigger the Vampire assistance but to his horror, Tigger the Vampire could not stand, no not this time even with help. While attempting to assist Tigger the Vampire hubby noticed something very devastating, poor Tigger the Vampire had blown his top [hole in his head] yes folks he literally blew his top. Well hubby was horrified, he franticly picks up Tigger the Vampire and rushes him into the house [yeah got water all over the floor, it rained all day], to which he attempted to revive Tigger the Vampire by using gorilla glue and tape. Once hubby thought Tigger the Vampire was well-rested [glue dried] after his ordeal [blowing his top] he returned him to his spot in the yard.
A half hour had passed since Tigger the Vampire had been mended so I decided to check on his progress myself only to find him once again laying face down on the cold wet ground with a new blown-out spot at the top of his head. I returned into the house to break the bad news to hubby and after a little comforting, I got him to come to terms that his most prized inflatable Tigger the Vampire was defiantly a goner this time, nope no amount of gorilla glue or tape is going to save him.
Tigger the Vampire’s Memorial Service will be held today before sundown and all who knew of him are welcomed to attend. Tigger the Vampire will be laid to rest in the original box he came in along with his cape and faithful friend Mr. Spider who had dangled from Tigger the Vampire’s paw only to endured the many cold windy rainy days and nights right along with his friend. The spot in the yard that has been occupied by Tigger the Vampire for the past 11 years will now be taken over by an 8 foot tall Grim Reaper, ironic is it not. Tigger the Vampire’s resting place will most likely be in the shed, yes folks hubby has trouble parting with his Holiday decorations, you see he is my Clark Griswold of both Christmas and Halloween decorating.
Now may I ask for a moment of silence in remembrance of hubby’s beloved Tigger the Vampire? We will always have our memories [pictures] of Tigger the Vampire blowing in the wind as if he were waving to all that rode/walked by. We will also remember Tiger the Vampire for the smiles he brought upon the faces of the neighborhood children the very first Halloween he was put out on display.
RIP Tigger the Vampire our inflatable Halloween decoration Friend, you will be missed but never forgotten.

“I was concerned that Anna was taking too many medications,” said photographer Larry Birkhead, who moved in with Smith in 2004 after a romance that began at a Kentucky Derby party.
Birkhead said he raised the drug issue during a visit to Dr. Sandeep Kapoor in mid-2005 about a minor ailment. Kapoor was Smith’s physician at the time.

JMA same goes for me RIP Tigger.We had several moving deers for Xmas and after I got a thousand dollar bill the end of Jan we never used them again.It took my entire tax refund to pay the bill.That was in 2007 and the only difference was those deer with movable heads.

“Larry Birkhead was cross examined by Howard K Stern’s legal ace attorney Steve Sadow, Friday, about the bodyguard, Maurice Brighthaupt’s allegation that Birkhead gave Anna Nicole ectasay before the AMA’s.

“No, I never gave her that or any controlled substance,” Birkhead insisted. He also said he had a conversation with Brighthaupt close to the two year anniversary of Anna’s death in which Larry demanded Brighthaupt return a videocamera that he had that belonged to Anna. “He [Brighthaupt] told me he was going to go after me, and Howard K Stern. He said I’m going to get Howard,” Birkhead said.

Sadow asked Birkhead why Anna took Klonopin and Topamax, and he said, “Because of seizures Anna suffered from.”
Judge Robert Perry was very interested in Anna’s seizures and asked Birkhead to further elaborate about her seizures. Birkhead said the seizures were usually induced by stress, and the first time she suffered from one in front of him, “I was very scared and I didn’t know what to do.” The seizures started in 2000-01 because of the stress related to on going court battles in Texas over her late husband’s estate.

Birkhead also recalled Anna suffering from a very bad seizure the night before the American Music Awards, in which she was slated to introduce Kanye West. Both Stern and Birkhead didn’t want her to attend but she was insistent about following through. “The only thing she took that day of the awards were Klonopin, Topamax and Red Bull,” Birkhead said.

Have been gone for several hours and now trying to catch up. Max and I are both tired. Max spent time in the car alone (with vented windows in 39 degree weather) and found all sorts of things to play with. I believe what it says about the meds she took that day. Ecstasy, or X for short, is a upper. It was obvious whatever Anna had taken that day had a “knock out” effect on her as would a downer. X makes a person really really hyper active.
JMA #56 – Max is a 9-month black and white Shih Tzu, very energtic and absolutley the cutest puppy I’ve seen. Maybe I’m partial but he is cute. He loves car rides, door bell ringing, shoe laces, house slippers, treats and freely shown affection. He’s adapted to the invisible fence so he can now go outside on his own which I appreciate with the coming cold weather over the next several months. Oh yeah, he has enjoyed himself chewing up my throw rugs. Yes, he has plenty of toys and chew toys but like any other child enjoys getting into trouble. Always testing my patience. This too will pass and he will learn to calm down.

Today finally saw the end of bodyguard Maurice “Mo Mo” Brighthaupt’s testimony for the prosecution. A massive figure somberly dressed in a blue shirt and cobalt slacks, Brighthaupt (pictured at left, at Smith’s wedding to Howard K. Stern) regaled listeners in his deep, narcotizing voice.
He told how he prevented a distraught Smith from jumping onto the casket of her son, Daniel, as it was lowered into the earth one month after the 20-year-old had died of a methadone overdose; and how Smith’s lawyer-lover, Stern, would take pictures of Smith when she was blotto.

“She relied on him for everything — picking up food, picking up drugs,” the bodyguard recalled, as Stern smiled malevolently from the defense side of the court.
The hearing before Superior Court Judge Robert Perry could become a reliable curtain-raiser to a trial, if Perry decides that what he hears is enough to put Stern and doctors Khristine Eroshevich and Sandeep Kapoor in the dock on charges they conspired to illegally supply Smith with a breathtaking spectrum of sedatives and pain killers.
Again and again, however, an agitated Deputy District Attorney Renee Rose found herself talking to Perry’s hand as the judge cut off her attempts to introduce results of the tox screen that coroner’s officials produced following Smith’s February, 2007 death.
“Time out! Time out!” Perry ordered. “Miss Rose, calm down!”
Brighthaupt’s appearance had produced some sparks during cross-examination by Stern attorney Steven Sadow.
The testimony of Stern’s onetime romantic rival for Smith, Larry Birkhead, had been highly anticipated, but the photographer-paramour’s appearance proved as soporific as the chloro hydrate Smith favored.
Defense lawyers Sadow and Ellyn Garofalo spent hours attempting to establish that not only did Smith have legitimate medical needs for the pharmacopia of downers prescribed by Eroshevich and Kapoor, but that she possessed a “natural” slur in her speech that only made her seem high to outside observers.

If this case even goes to trial it must be proven beyond a reasonable doubt, Fruit of the poisonous tree ( that JB said he was going to look into :LOL:), witnesses that their credibility is questionable, hearsay is not allowed at trial must be first -hand witness to cross, I hope this goes to trial, but for Anna’s sake and Howard’s and DL’s in the future I hope it is dismissed. What a sorted cast the prosecution has and the first days of RR shows that this Judge wants the facts and not the glory, if this Judge passes this case to trial it sounds that he is glad that he is not going to have to hear the trial. imo

Some are always stating that the Florida case has been reopened. When all the O’Q/Cosby/Estate/CA drug cases are completed, perhaps Florida will decide to look at Moe, Taz and a few others a bit closer.
I don’t know of any reason that Moe couldn’t be added to the CA case. Perhaps Renee Rose will add him after the Prelim since things don’t seem to be panning out smoothly. It would seem Moe could be charged with overt acts (procuring, transporting, delivering) and he’s already admitted to that under oath and others might find themselves having to deal with providing “fruit of the poison tree” information and other comments to intentionally mislead an investigation. Could get interesting.
Good point about concentrating on the quotes instead of the puff in the articles. Reminds you of playing telephone when we were kids. Quite a change when it got around the circle.

Newser) – More sad details about Anna Nicole Smith’s drug use emerged during the Howard K. Stern hearing yesterday, as babydaddy Larry Birkhead testified that she took methadone while pregnant with daughter Dannielynn out of fear that she’d go into shock and lose the baby if she stopped.
As to why she was taking methadone in the first place, Birkhead said she was trying to alleviate back pain caused by her large breast implants, the New York Daily News reports.

My humble opinion—–I do not believe there was a medical reason for the baby bottle or food.I do believe Anna was a “‘VERY TROUBLED WOMAN”.You would need a good phychiatrist for this one,but it all goes back to her childhood,Anna is looking for love.She was looking for someone to take care of her,I hope the court see’s,what I am seeing,.

Ot for a minuet JMA I should have said the electric bill was for both electric and heat as they are both on one bill where I live but it was still almost 500 for electric that month and I called and the could find nothing to explain the high jump from about 120 to that amount.They even came out and reread the meter. sure was a shocker to me also.I will say Our electric has gone from maybe 90 a month,electric only, to 160 a month. we do have an electric dryer and stove so that could account for some of it but our water heater is gas as are our furnaces. Hmm—–My question was answered this week with Moe’s testimony.I had wondered why Vergie,seem to be suing everyone,but the very one’s that could have saved her daughter’s life but did not,MY opinion–Vergie could care less about Anna’s life,she needed Moe to go against Howard,her only aim is get that child and her money.A good phychiatrist,even court appointed would look at the whole mess,and know what damage Vergie did to Anna,and now trying torment and harrass Larry to death,although,I think Larry has shed her and is going on with his life,I thought he was looking good and put on some weight.This is the last stop for Vergie to get Howard,and so far the state case STINKS,AS FAR AS hOWARD IS CONCERNED.

2349. I figured the computers and hard drive are still in the possession of DOJ, but it took me so long to figure it all out, I had lost track after Dr. Perper and Sanchez went through them. I never realized Santiago transferred them to CA on April 12, 2007.
I didn’t realize that he was appointed to the case to investigate Dr. E on March 30th, four days after the Seminole Police and Dr. Perper had announced the conclusions and it was over.
BTW I went back just now and found Exhibit B from HKS filings in the Susan Brown matter in Georgia–this is the Cosby subpoena to FS dated Aug. 4, 2008 which reads (as you stated) ‘All doc uments, including but not limited to hard drives, videotapes, photos and contracts removed from the Nassau, Bahamas home referred to as Horizons in Feb. 2007.”
As far as following the law, all these Texas inspired cases always seem to glide right past the normal rules of due process. One would think that a criminal case would have followed every letter of the law and crossed all their t’s, dotted all their i’s.

Yes, indeed, and the TX cabal has arranged fall-guys all along the way intended to absorb most if not all of the blame should the truth come to light.
As you have said many times, the SC case has (and will be) proven pivotal. We see in the Cosby depos/docs that the bad guys are still obfuscating their extent and timing of interaction to defame HKS and others, but the SC case has already provided solid information sufficient for a prima facie showing of the crime-fraud exception to Attorney-Client privilege. Just another few days wait to see who is added to the SC case to replace the John/Jane Doe placeholders.

Hence also the employment by HKS of the (white collar) criminal attorney Lilly Ann Sanchez in FL during this time.
If FS hadn’t stolen the materials from ‘Horizons’, LE would have had to gain access to them through due process and in the light of day; not this highly questionable ‘agency-to-agency’ transfer path where the basic integrity of the materials is not known or protected.
Cosby/McNamara even tried to subpoena FS for the HD’s, naming images and videos specifically, in an effort to cover the fact that they had the materials already.

Did HKS ever receive the two stolen laptops and hard drive from CA DOJ? According to the search warrants for same and the agency-to-agency transfer from Seminole Police to Los Angeles then impounded by DOJ these are being held (or were) as evidence in the commission of two felonies by Dr. E…the laptops and hard drives ‘used regularly by HKS and ANS’ according to THE NANNIES who first clued Santiago in about the laptops.

HKS had access to the actual HD’s long enough to determine that they had been copied immediately after their theft from ‘Horizons’. HKS/Wood have been chasing the ‘copies’ ever since. This was back when we saw Dr. Perper announce he would delay issuing his autopsy results for two weeks as the Seminoles and his people examined ‘potential new evidence’ (words to that effect).
Santiago paints an interesting picture about how he came into possession of stolen materials in an effort to make it look like they weren’t ’stolen’ (by him at least) in the first place – but they were and still are. Hence Wood’s admonition way back to JB that the HD’s were stolen materials.
As yet unknown numbers of copies of the copies have been circulated to various people. SB’s role in the distribution to the TX cabal and Geraldo has already been laid out in the SC case.

JMA they did come out and read and I was on the phone for almost and hour while they went over past bills when My dad was alive.She determined it was caused by something continuously running and that was the only thing at that time that was left on sometimes all night..So was our own fault.Now they just somehow get the numbers electronically.I probably should check when it is over 100 but the kids do a whole lot of laundry and leave the dryer running a lot longer than I think is necessary.meaning they don’t check they just turn it on and leave and sometimes i notice they leave the stove oven on and leave also.Not much I can do in that department

Good Morning Folks,As I was falling asleep last night,something came on the tv,which woke me up,and made me angry.I do not know if it is me,but,I am having a hard time understanding the logic,in this world today.what I heard was Los Angeles–There are more marijuana stores here than public schools.Signs emblazoned with cannabis plants or green crosses sit next to dry cleaners ,gas stations,and restaurants.You know,these are supposed to be for medical purposes,who are they kidding,Now you will have half of LA walking around stoned out of there minds,and they are in court with Howard Stern,who was seen giving a woman he lives with meds,and by the way has ‘’so many medical problems you cannot count them all, “and the term (ENABLER) is being used,Would someone mind telling me what the hell the great Jerry Brown or the Dea,and Law Enforcement,(ENABLERS)only there are enabling a hell of a lot more people than ANY ONE i can see.
