In a stunning potential horrendous defeat Georgia Attorney Susan M. Brown has been Ordered to turn over documents and sit for a deposition in the Estate of Anna Nicole Smith vs. G. Ben Thompson, Ford Shelley and others.
It appears at first read of the papers that Brown must give up all information involving any third person conversations she had with anyone else about giving the Estate property to the media and having it copied by other parties involved with other lawsuits as well as Danny Santiago of the California DOJ, although she, [Brown], sent multiple letters to the Estate stating she had the hard drives and would turn them over.
The court’s Order also would appear to open the door of federal criminal fraud against Susan M. Brown Esq. in some of the actions she allegedly took as not being protected under the client-attorney privilege.
The Estate of Anna Nicole Smith lost its attorney fees in pursuing Brown. The Court also tightened up subpoena with subject matter by the Estate in four (4) of the requested production of documents, but definitely Ordering Susan M. Brown Esq, an Atlanta Georgia Attorney to sit for a deposition. However, it opens the door for a wide variety of questions concerning how that Estate property ended up in other people hands and/or copied by others with Brown’s knowledge.
Brown must comply with the request including contracts, bills etc. within twenty (20) days from today which is September 19, 2009.
Is the South Carolina Federal Suit the beginning of the end of all of these cases?
How damaging is it for Susan M. Brown Esq of Georgia and her clients with the federal court saying she with her client, Ford Shelley made have committed federal criminal fraud?
In South Carolina the Court has Ordered a new scheduling Order to be submitted by the Estate, via the Executor Howard K. Stern, and Ford Shelley extending deadlines currently due to accommodate what the Georgia Court Order entails. It also appears to once again open the door for additional depositions from many of the same people we see entwined in these multiple over lapping lawsuits in multiple federal and state jurisdictions and allegations by Howard K. Stern and/or the Estate of Anna Nicole Smith.

So this means if Susan Brown allowed let’s say O’Quinn law Firm to have or burn copies of Anna Nicole’s computer hard drives then she has to show it correct.

Yes JMA, did you notice how many times in the #’s of the requests granted McC, O’Q and the PI and his assistant’s name were listed?
This Judge in GA said SB has to divulge all pertaining to them in the requests that were granted! HOLY COW!!!!
I searched for charges of receipt and dissemination of stolen property. The theft was not in TX but the receipt and dissemination was done from Texas!

The “Common Interest Agreement” AFTER THE FACT of disseminating STOLEN PROPERTY, NO CONSENT by the thieves who did the act. Just their attorney who had something in common with that Law firm in TX. Would that be a Conspiracy to Harm?

Beth [2] IMO this does not look good for the O’Quinn Law Firm as stated in #2 “the property is stolen and the actor appropriates the property knowing it was stolen by another” so is the “actor” Susan Brown? If so then that means whomever willing received the stolen property from Ms Brown is an accessory to stolen property right? Did they knowingly receive/accept stolen property? My opinion is yes. This is just what I am getting out of this but then again I do not have legal knowledge.

What am I missing on Exhibit A filed with Arthur’s Response – it states “The Panel shall determine whether the complaint dismissed or should proceed.” If this the case then the request is not dismissed or at least – not yet.
According to the State Bar of Texas – The summary disposition docket is an opportunity for the Chief Disciplinary Counsel to present a complaint to a panel of the grievance committee — outside the presence of either the complainant or the respondent — and explain why the matter should be dismissed. The panel’s sole function is to decide whether or not to dismiss the complaint.
If the complaint is not dismissed, it goes forward. The respondent attorney receives a description of the factual allegations and rule violations and has the option to select either an evidentiary panel or district court proceeding.

Lizzie [9] That’s what they are saying, but we do not really know for sure. This is the first time we’ve seen the color picture.(it came in a big bundle of filings that all parties…pro se and lawyers..got today)
LOL I had occasion once to print out some 8000 emails (don’t ask!) and the stack wasn’t that big.
I though there was a picture with a yard stick or something showing how tall it was. Regardless though if it is really 3′ I do not believe it is all just e-mails from Rose & Art, that being my opinion of course.

These were on the DVDs that ALL of the litigants, lawyers and Pro Se Defendants received from me in the over 13,5 gigs of documents I turned over between Jan – May 2009.
I am sure we will get a huge stack from other litigants after the Special Master completes all of his work.
BTW, Ken will be taking all of our hard drives down tomorrow night and getting them ready to ship to the Special Master on Sept. 2.
I have a new hard drive to put in after that so we should be down 12 – 36 hours ONLY from our end… Roxanne and Heath can still help with any questions here on the blog. Diamond Girl in the forums and Liann and Sammy1 in chat. Roxanne and Liann will have current updates on how much we have done and anticipated down time.

You know why Team Texas put in Harris “Motion to Reconsider” not to destroy or alter anything not ordered to be turned over and stipulate it may be needed at a later date? Cause IMO they know they will not find what they feel defames their client in what is already being handed over so they need more for their fishing expedition. It’s their pattern, they find nothing that defames their client so they keep digging in hopes there really is a pot of gold at the end of the rainbow.
I am so sick of hearing about this case and I can’t imagine how Rose,Ken and the other defendents especially the other pro-se ones can handle all of this..It is just one big mess and Texas just caught a few bloggers in their clutches and won’t let go. Well,this evening I saw a replay of the “TODAY” show,and I was struct on how,Joe like Vergie,never takes any blame for there childs demise.I have been waiting for either one to say I wish I did things different,I wish I would have shown more compassion and love,It is a shame the very two that demanded all these drugs and all the attention,have to take down a whole lot of people with them.In Florida,when they were looking to bury Anna,the Judge asked Vergie,what she would have done different,Vergie answer,”I would have kept her off drugs”NOT,I would have been there more for my daughter,showed her more attention and love,and guided her more.MY OPINION AND FEELING—FS has a lot more to answer for than just stealing Anna personal items,but I do find it strange,Howard has to fight for Anna’s belongings,NOT VERGIE,Anna mother,could it be she has some of those items?hOWARD IS FIGHTING TO GET BACK ANNA BELONGINGS(NOT MAMA),which again tells me the slime,that took Anna things and mommie are all together.
I am here now and Rose I will help anyway I can, you know that., I have not really read the new docs yet, Beth I have read this thread comments and I must say your posts are excellent and informative, Thank you Beth, and Rose I will check my e-mail. o/t It is hard to breath here and my eyes are burning and can smell it when I go outside and the smoke is so bad and they say containment might not be till Sept. 15th so just know that, we are enclosed and but this is the worst air quality I have ever experienced, It is so hazy and dark cloud over everywhere and no breeze and crazies are out starting new fires all I hear is planes and helicopters going over all day it is not close but the smoke is, today I was driving my daughter to her Dr’s and she is about ready to give birth and to the west fire is the worst and to the east fire is very bad also and we were listening to KFI and someone came on and said a request that if anyone had a direct line to God please pray and I grabbed my daughter’s hand and I said a prayer out-loud and we both felt emotion and cried and all I can say is how F’ed up this is, Fire is frightening, I am well and I hope everyone is well, Please just think of others and animals too.

Well,the little sweethearts start school today,This has been one fast summer,about two weeks of hot weather and thats it. You all are Great! that is why I Love it here!, We are not in any danger from the fires but the smoke is what is so horrendous for us and alot of the schools are closed today so I get to spend the day with my favorite little boy. We had a fire here like last month and I think we are good for the rest of the season, Last night I was looking at the moon and it was real dark yellow-orange very eerie, I can’t believe how stupid some people are, on the radio I am hearing reports that two people thought they could ride out the fire at home in their hot-tub and they were severely burned and others that refuse to leave are calling the Police and Fire depts to get them out and I think if they want to put themselves in danger that is up to them but waiting only puts rescuers in danger so the Fire Captain is saying on the news if anyone chooses to stay behind then they better have a way for loved ones to I.D. their bodies, I have not caught up on the threads except for last night a little on this one and I have alot of docs to read also I hope to do some of that tonight, Yes my thoughts and prayers are also with all the Firemen and women I hear they are coming in from every State to help and people who has homes that are threatened and of course the animals too.
