There are new filings in Texas in the Case, a Response to Larry Birkhead in preparation for the hearing this Friday on the Motion to Compel; a Motion for a default judgment on Bonnie Stern, could this be going to California now for the bankruptcy court to decide with no money amount alleged in damages.

July 6, 2009 the Proposed Order for the Court to sign based on the Hearing held July 2, 2009 on Lyndal Harrington. This authorizes Craig Ball the Special Master to just go in and image the emails on the yahoo server for Harrington.

On a final note we have learned that about a year ago right as we were closing out the member section of the main site so people could not come in and harvest information someone copied it, Mark Speer, Wilma Vice, Melinda Burleson, or Red Couch all of them could have copies, but one copy made it to the hands of the O’Quinn law firm. We are glad we closed out the member site and suggested you all do monikers and hide your email addresses but we are still concern about the email server breach, and the copies made by these people as well as others was harvested and what type of TOS or Privacy Policy might have been violated in that. We are doing some research and will let you know when we find out.
NONE of the information from the blog membership list or the forum member list was harvested and sent to the O’Quinn law firm, so we are grateful for that and will keep you all posted as we learn more about this. To the best of our knowledge no previous moderator/admin has ever harvested anything from Rose Speaks and then sent it to any law firm involved in these cases.
Why would anyone want a copy of our member list? I do remember having a screen shot where Red was bragging about getting the list using someone else’s member moniker and password and sending it to the O’Quinn firm At least it was an outdated one. Sad that one site would be targeted over other sites, but I guess we will see what comes out in the wash here so to say on all of this as we try to track back and see when and who.

The emails so far the one where it’s talking about ordering “goodies for the computer” it’s pretty obvious when put in context with the email that Rose is talking about Ken ordering stuff for the computer. Another is talking about what the headlines are saying about LB. (Has anyone else noticed some of those emails are bits and pieces and some don’t have the full headers?) The one between Howard and Bonnie… so what? I don’t see any guts there folks. It’s HKS telling Bonnie he doesn’t need something transcribed. What’s the big deal about transcribing something. It’s something SOMEONE ELSE said in a public interview. Still not anything any of the defendants said. Ok and what does the email, from a company about how to increase traffic to you site, prove?
What is up with these emails? They are obvious copied and pasted and NOT the whole emails. They are out of sequence and really hard to read. Trying to confuse a judge maybe?
Finished emails and honestly, I hope I don’t offend Bonnie if she reads this but, it sounds to me like Bonnie wasn’t to business sauve and asked some friends who knew something about business to help her out. I still don’t see a huge bombshell here.
They haven’t stated a money amount in these filings. Isn’t there something about Montgomery saying that she expected Tx to issue a default judgement against Bonnie and there by throwing it into the CA courts because of the bankruptcy? If that is correct, I see this thing as a win for Bonnie. It would mean no more discovery, no depostition, no more nothing and she is out of it in TX.

This conspiracy law suit is not about Arthur being an abusive mother. Not sure why McC thinks it is. The whole problem that I have been waiting to see dealt with is the “underlying facts” of the conspiracy. Just what are the “underlying facts”?? Was Virgie Arthur defamed?? If not then any talk of a conspiracy is a big waste of time.
So the Birkhead one is ridiculous, imo. Again, McC mentions Anna using defamatory words against VA on TV. Is that part of this lawsuit?? I confess. I did assimilate a list of members. However, two things you should probably know. (1) It had nothing to do with some breech that occurred and (2) no one gave me the names nor helped me compile the list (meaning Red nor Speer – or anyone else – shared their information with me).
Compiling the list was quite easy. Please say too much about them on the internet. All I had to do was watch and pay attention.

Man! How insightful! Regarding foreign depos e.g. Havana’s from Canada. (Is that where it was from? I have forgotten)
“My question lies in the TCR 202 (i think dont feel looking) whereas it seems that for a foreign deposition certain steps are required. None of these were ever taken by the OQ firm, they just took it. Due to that it is my understanding Havana’s depo alone should be completely stricken whereas it is 1/2 of McCabe’s whole petition as well used on EVERY PLEADING following and they should be stricken as well. Which leaves McCabe with Qv as a stand alone, easily disputable using the Rules of Evidence.
Then since technically, per your explanation, QV’s being a statement v a depo, they would not have had to follow the guideline under TX CRP 201 and the Rules of Procedure used in regards to statements to dispute that one and if someone is able to under those rules there is the opportunity of both being stricken whereas again all of McCabe’s original claim and ALL following pleadings relied on something that legally never was.
That is very positive thinking considering the Judge’s movements thus far and that is not to follow the law but the “because I said so” and how even with law on side would she perhaps do a Motion to Dismiss or strike something done illegally? As well, with the Judge’s history do you honestly believe the Defendant’s are going to get out of their jurisdictional appearances. Unfortunately I see nothing but appeals and for some reason McCabe’s intent on delay which to date I can still not see what the purpose for him wanting to delay…

A Manhattan federal judge said today that it’s “preposterous” that former Playboy Playmate Anna Nicole Smith would have watched her ex-boyfriend and lawyer engage in gay sex.
Judge Denny Chin, hearing arguments stemming from a motion from TV reporter Rita Cosby to dismiss a $60 million libel suit against her, said a sex tape featuring Smith’s former boyfriend Larry Birkhead and lawyer Howard K. Stern.
“One point that I find troubling is that Anna Nicole Smith would entertain herself by watching this videotape,” said Chin.
The tape, which lawyers told the judge does not exist, is part of a lawsuit brought by Stern against Cosby, a former MSNBC anchor.
Stern claims that 19 passages inside Cosby’s book, “Blonde Ambition: The Untold Story Behind Anna Nicole Smith’s Death” are untrue and defamatory.
Stern’s suit also names publisher Hachette Book Group USA.
The suit asks for compensatory and punitive damages.
The book also alleges that Stern and Birkhead struck a deal — Birkhead would get custody of his daughter Dannielynn in exchange for Stern being named executor of Smith’s estate.
Cosby’s lawyer Elizabeth McNamara argued that Stern’s reputation “was in tatters” long before the book was released in 2007 following Smith’s death.

In a Motion to Compel LB, McCabe states he wants ALL emails between LB and ANS! He justifies this demand by saying LB needs to read the ‘bloggers’ lawsuit wherein he would see that there is an allegation that ANS was defaming VA on TV and therefore it’s likely she was doing the same in emails.
