The first court of appeals in Texas, today May 20, has granted Howard K. Stern’s Emergency Motion for Temporary Relief and temporarily stays the underlying order compelling production until further order of the Court of Appeals. The second order sets June 3, 2009 as the date on or before which any real party of interest must respond to the Petition for Writ of Mandamus. As soon as the court has issued copies of the 2 signed orders we will have them here for all of you.
We will have more papers up later today in these cases as well as other cases we are following that we have new papers out and uploaded now.

A few days ago I wrote in a post about HKS being in the middle of a criminal trial, and that he should not have to be giving up his computer or any correspondence w/ his lawyers via emails on that computer… I did not know it was called a; “Writ of Mandamus”.

This peaked my curiosity… I went on the main site to make this my first download, and low and behold there are many people there!
I am going to look further into the laws of copyrighting infringement, as I get mad every time those VA supporters at the HangOut come here and copy your documents that you pay for and put them in their own downloads as their docs!

I would like to point out in that Motion these phrases:

This is a matter of law and how it is written, it is not laying blame…
It is NOT selling anyone out…
It is showing clarification.
This frivilous lawsuit will be and should be dismissed due to all of these filings.

Wow, some long reading involved here and right now I do not have the time but boy what I have read really pisses me off. McCabe states that one reason that he USED Rose was to get CBS included in this whole mess. The judge called it a conspiracy, McCabe calls it a legal conspiracy. I wonder how CBS will feel about this.
About the private chat, yes I expect the same privacy that I would if I were on the telephone will someone. This does not mean that I am defaming Virgie or involved in a conspiracy to defame. It means I feel feel to discuss what is happening in my life involving my family or my work. This is not information that I want out on the internet to be copied and discussed by a bunch of people who are down right nasty to those that disagree with their wild theories on the events that happened since Dannielynn’s birth. I might add that most of these same people have been banned from many a forum due to their nastiness. If I am having a bitchy day, it is none of your business. Maybe you people ought to remember what was posted on CTV about Stern’s parents information. Where they worked and what their names were.

Beth [5] they have been waiting for days now for Rose to put these up even went as far during their wait to complain that she did not have them up on the day she mentioned “new documents” in the previous thread. IMO they are all a bunch of losers, they have no problem bashing the site but come to depend on it when they need something.
So, QV admits in an e-mail that Jane was basically in the process of working a deal with People Magazine to publish what QV calls “our Virgie dirt” also post on her site the bragging rights so to speak along with e-mailing Bonnie an apology. Therefore, my question is why the hell QV & Jane not included in this lawsuit. Should not matter that they do not live in Texas I mean McCabe is trying to get Bonnie there and she does not reside in Texas, matter of fact neither does Howard or any of the Media Defendants you know the ones who can afford to pay Virgie’s accumulating dept to O’Quinn Law Firm.
Oops forgot that is the whole reason for adding the bloggers who do reside in Texas. Therefore, this is why even though QV conspired to defame Virgie Arthur she was not added to the lawsuit because she is the one who handed the Texas bloggers to McCabe on a silver platter. Hope whatever QV received in return was worth ruining other people’s lives and my hope is Karma is 10 xs worse for her in the end. I know that is mean to say but that is my opinion.
We will see how this plays out but some are accusing Rose of doing the same thing as QV, however Rose isn’t getting off the hook. I stioll don’t understand why this isn’t in a federal court.

OT, I guess Glen Beck from Fox New says it all. He was just on the View. Whoopie & Barbara were questioning him about an out and out lie he told on his radio show which just recently involved the three of them. The question to GB went something like this…
Are you an investigative reporter? GB – “No”.
Do you check your facts? GB – “No, I’m a commentator”.
Then he tried to backtrack and try to explain himself but no one was buying it. To me this explains everything about cable (news?) shows like GVS, NG, Geraldo etc…the media that destroys people with their “COMMENTATING”. The stations and their hosts try to fool the viewing public into believing that they are legitimate news talk-show programs where in reality they are only fluff entertainment that tries to ruin their choosen victims in their quest for ratings.

The third party motion didn’t add anyone that wasn’t already in the case. CBS will have to stay and let’s face it we need their deep pockets as this case is ridiculous and what Bonnie just added to the courts shows exactly what happen.

JMA, I learned a long time ago when dealing with QV, in her mind, it’s never her fault. She always has someone handy to put the blame on. Which tells me exactly how calculating and manipulative she is. Now what Rose has done is defend herself against all of this and has outsmarted the bit*h. I am so proud of her! Proud of Bonnie too!

Virgie Arthur was not defamed by anyone. No one was a part of anything concerning anything to defame Virgie Arthur. Is the way I see it. Adding third parites in no way helps out any of the defendants because the bloggers are still smack dab in the middle. Alls it does is give McC more ammunition. trina, if you want to see it that way, what can I say? It’s your prerogative. For me I find her motion hysterical and don’t believe for one second plastic flowers is helping VA. What I do think is Larry Birkhead is going to have to take responsibility for what he did and frankly my dear, I don’t give a damn.
And it wasn’t about helping VA it is about giving Rose Turner peace to enjoy the little time she has left.
Also, CBS needs to be in this suit fighting for the little guys who don’t have the kind of money they have and that is what it did. It hurt no one, but helped some. Nothing in that motion was something McCabe didn’t already have.

Daisy I have to agree that bringing CBS into this matter brings the big guns at least as long as they don;t settle.I have a question if Lyndal can get out from under will that change the dynamics cause that or rather she is what is keeping the case in Harris county? As for the 3rd party thing…… I have always said that if anyone is going to get sued over the interview in Tx then CBS should be right in the front of the line. It was them after all that aired the damn thing. This basically says, the way I am reading it anyway, that there was no conspiracy but if there was one then these people are the true conspiritors and that would be a true statement. But, we all know there was NO CONSPIRACY. One of the main things wrong with this damn suit is that it is Rose, Lyndal and Butterfly being sued instead of the ones who actually did try to harm VA and that would be QV, Havana and Jane.

I’m not sure if it will get Lyndal and Butterfly out of this malicious and friviolus lawsuit or not. I can see that there is no need for them to be in it anymore as Rose has basically agreed to stay in it the whole time now. With this motion there is no way for her to get out of the suit. Even if McCabe said he wanted to drop her all the sudden…. she can’t do it. So, will it get the others out of it? I don’t know. It has just been filed and hopefully they will file something for dismissal for themselves or be dismissed some other way. Wouldn’t it be great if that does happen?
About my last post, I get the feeling that some took it the wrong way. Some posters are saying that Rose did the same thing as QV. The difference between the two? McCabe released QV from the conspiracy suit. McCabe did not. That is the ONLY thing I meant by that.
If Rose did not file the third party doc, I wonder what McCabe would have done in order to get CBS involved in the state court. This certainly explains why the federal case was dropped by McCabe though doesn’t it?

Something I found funny and messed up in the filings. Lindsay more or less accuses McCabe of conspiring with a Defendant in order to bring in more third parties her words “so that I could not say that they were not allowed to be brought in” and then McCabe claims this is not unusual. Then Lindsay says it is a conspiracy but that is OK with her, WTF.

I guess we will have to wait and see after the autopsy. Drew Peterson’s Attorney gave a statement after the finding and said he spoke to his client and informed him a body was discover and claims Peterson had no reaction.
I have a feeling it is Stacy; I just hope there is evidence to link Drew Peterson.

I was defamed PUBLICLY today by Melinda. So I will answer to her bull PUBLICLY. I get what your saying and normally I would take it to private but this is crap and I’m very angry with this Melinda person. The whole tale is sad but my prayer is healing for all involved.
My husband said Howard may never heal. He looks at it from a man’s point of view and really feels the worse for him. He can not imagine having to live the rest of his life with what Howard has to live with not saving Anna or Daniel. He says, like many of us have said, Howard has to have some sort of shock to his system and tells me not to be hard on him for not being able to help his sis.

Like, he says how a Judge can allow an Attorney to proceed with all the crap McCabe is presenting in front of them, especially since the majority of it is on opinions and or hearsay. Matter of fact just about everyone I have spoken to about it feels the exact same way.
JMA, most people don’t have the resources or drive the OQ law firm has. Howard challenged them and now he has to fight them. I feel bad Bonnie or any of the bloggers got caught up in this but conspiracy and civil law is broad and McCabe is fighting with a vengeance.

A Difficult Judgment

In a small town, a person decided to open up his Bar business, which was right opposite to a Temple. The Temple & its congregation started a campaign to block the Bar from opening with petitions and prayed daily against his business.
Work progressed. However, when it was almost complete and was about to open a few days later, a strong lightning struck the Bar and it was burnt to the ground.
The temple folks were rather smug in their outlook after that, till the Bar owner sued the Temple authorities on the grounds that the Temple through its congregation and prayers was ultimately responsible for the demise of his bar shop, either through direct or indirect actions or means.
In its reply to the court, the temple staff and devotes denied all responsibility or any connection that their prayers were reasons to the bar shop’s demise.
As the case made its way into court, the judge looked over the paperwork at the hearing and commented: “I don’t know how I’m going to decide this case, but it appears from the paperwork, we have a bar owner who believes in the power of prayer and we have an entire temple and its devotees that doesn’t.”

In some ways it does surprise me and some ways it doesn’t. I was raised to always tell the truth no matter what and to keep your nose clean if you don’t want trouble. I have told Lyndal that I will give her a sworn statement, a lie detector test, whatever she needs to fight this and PROVE that Melinda is a LIAR about more things than one. As for AD, like I said above, I mentioned her in that original post because it surprised me to see her cooperating with McCabe. There seems to be some misunderstanding about what was said by Melinda in court yesterday. She didn’t say that I told her about Lyndal. She said that I told Rose that Lyndal had been robbed and that she hadn’t filed a police report and that I told Lyndal she better file a report. She also said that a lot of people told Lyndal she better file a police report and Lyndal refused to do it. She said that the robbery happened on Dec. 12 and not on Dec. 18 when the police report was made. HUH?? She said that when she saw it filed on the internet with the Dec. 18th date she “felt compelled to come forward.” BULLSHIT…. IT NEVER HAPPENED AND SHE KNOWs IT!! There was some other things that she said that are just outrageous but I will wait to see the transcript before I comment on that since it has nothing to do with me to knowledge except what I have said above.
I do have a question…. if what I have been told she said about me and alleged sequence of events then didn’t the judge catch that Melinda herself said that Lyndal was robbed. If what I have been told is correct then Melinda is saying the conspiracy (my words there) was in Lyndal not filing a police report at the correct time. What difference would it make one way or another. THE FACT REMAINS THAT LYNDAL’S HOUSE WAS BROKEN INTO AND HER COMPUTER AND PLASMA TVS AND ALL KINDS OF STUFF WAS STOLEN.

The thing about Bonnie bothers me but my husband tells me Howard is not able to help her due to his state of mind, he explains it as paralyzing. I feel so bad she is left out in the rain, all by herself and it has to be painful for her. And she was pulled into this by Wood. I just wish Wood would have never started going after OQ and just made a statement that what OQ was saying was not true and left it at that. But, in the end, it is about making money for his firm and it seems in Fl. that is what he did but what good has it done Howard? I say all it has done is cause more stress on him and his family. Very sad situation and he probably can’t get out of it any more then VA can because when you sign these agreements with attorney’s if you pull out you will owe them all the hours they provided. And their attempt is to use as many hours and attorney’s to run up the bill.
Bottom line is that it’s not fair Bonnie and the bloggers are paying the highest price over something Wood started and he didn’t even give Howard a chance to think as it was a very vulnerable time in his life and he felt helpless and here comes Wood huffing and puffing trying to make it appear he will save the day. IMO he took advantage of man who was in grief and couldn’t think straight due to trama.
Daisy….glad to read your husband’s input. It’s always good to get a males opinion, I think. I don’t know Howard or Wood, other than what I’ve read about them, but, I have respect for both of them. As for Howard being taken advantage of by Wood at a vulnerable time, I just don’t see that. People always react to the loss of losing a loved one in different ways, and in Howard’s case….could it be that taking those to court who defamed him was his way of coping with his loss of Anna? I would certainly imagine that dealing with the legal aspects helped him deal with the loss. As far as Mr Wood, remembering back to the article about the loss of his mother, he was so thankful for the attorneys who came to his aid in trying to help his father. I can’t but help feeling that he wanted to help Howard, not only for the money that he could bring to his firm, but also, to return a favor that was once done for him. Enough of my reflections.
