Howard K. Stern to Rita Cosby, I Want the Truth to Come Out – Will it Affect the Case in Federal Court in New York?

I am just going to list what was said in the letter which caused the Southern District Federal Court to issue this Order. I will ask the question, dare we hope that all of the loose ends from coast to coast will finally be connected in the attempt allegedly to destroy the life of Howard K. Stern? Could the missing links be about to come out connecting not only Rita Cosby but by the sources Rita Cosby “relied on”? If cases are about the “truth”, then why did Elizabeth McNamara OPPOSE the Court granting this Order?
The Request of the Order that the Southern District Court Honorable Judge Chin signed today and put on PACER with the letter from Lin Wood. Here is what that letter, now turned to an Order, said. “This afternoon, April 7, counsel for Mr. Stern obtained discovery from the State, in the California criminal matter. This discovery was produced subject to a broad protective Order requiring confidentiality of the materials. While I am not at liberty to discuss the details of the discovery obtained, I can state in my place that from an initial review of the materials, this new information has SIGNIFICANT BEARING, not only on Mr. Stern’s reputation, the application of the libel proof doctrine, and the summary judgment issues, but ON THE ENTIRE MATTER PENDING BEFORE THIS COURT. Counsel for Mr. Stern is in the process of seeking permission from the District Attorney in California prosecuting the criminal matter, to provide the discovery to this Court under seal for review in camera and for use under seal in Mr. Stern’s response to the latest Cosby brief.
Due to the critical importance of these documents to the pending summary judgment motions if the District Attorney does not agree to the use under seal of the materials, Mr. Stern will file a formal motion for modification of the California protective order seeking the permission of the California Court to allow this Court to review the materials under seal. Once permission is obtained for the discovery materials to be utilized in this action under seal, Mr. Stern will be incorporating a great deal of the information in his brief in response to Cosby’s brief submitted pursuant to the March 26, 2009 Order.
Cosby seeks to have Mr. Stern’s case dismissed as a matter of law based in part on the recent California criminal charges. Therefore, it is absolutely essential that Mr. Stern have the opportunity to develop a full record concerning those charges to present to this Court for its consideration before ruling on the pending motion.
… to file his, [Stern], brief and present the full and accurate picture of the California criminal proceeding to this Court, including the discovery obtained in the California matter today, [April 7, 2009].
Elizabeth McNamara informed me this afternoon that her client OBJECTS to Mr. Stern’s request for this extension of time.”
Mr. Stern also filed his Reply to Cosby’s Response to Stern’s Motion to Strike Certain Exhibits filed with Rita Cosby’s Motion for Summary Judgment.

Beth, I have followed (along with Rose & yourself) this case since the beginning. Rose has done nothing but try to help in proving
Howard K. Stern of any and all charges. Rose, don’t you feel guilty about anything; I will bet no one besides Mr. Stern’s attorney’s
have done more for Howard than you. My heart goes out to him. I KNOW HE IS A GOOD MAN! He will prevail in the end.
I wonder if this has something to do with Debra Opri suddenly going on attack in the media, after being so quiet for so long?

It looks all the cases will be tied together sooner than later. Hopeful it will right the wrong the media and the people involved with Anna
will have to answer. It seem Howard’s Lawyers strongly believe in him. It is a strong statement in his favor attorney’s with good reputations
are willing to stand up and defend him so strongly.

he couldn’t say to much, but didn’t seem to think the Discovery
on the Case in Cali amounted to much. MOO
That picture is one of my favorites. I am so happy that Judge Chin has ruled in Howard’s favor to allow the California discovery into his court. I just wish it were possible that he could have had all these cases combined into his court. That’s how much faith and respect I have for him. Who knows, HKS, LW and Judge Chin may just put a stop on crap that’s going on in so many courts. I’ll just have to label them the Three Musketeers against the Three Stooges.
Oh, but wait, there’s more than three stooges. 
Oh well, I’ve had a glass of wine, so I’m in the mood to celebrate somthing. lol

Fifi, Good question. How many careers have gone in the crapper or people hiding that stuck their mugs in front of a camera? and for what? It is has been so blatantly clear from day one that there was and is a get Howard campaign that all started from Tx for a shot at the Marshall money, and now it has moved to a political agenda from JB, I am sure that L. Wood is doing all he can to make the truth be known and who has been behind all of this is exposed, Howard will prevail!, I believe that completely. Good for Howard and kudos to L. Wood.

Until then, any content of the discovery should not be released (to my way of thinking)

If the DA has the info, and won’t release the info, and it later turns out that that info was ‘tainted’, would the DA be responsible for pressing bogus charges? Isn’t that who Brown is hanging his hat on?

There are only two people I can think of that would carry any weight with the AG DEA Office,for such a charge,Don Ckark, and moe,I do not think WV,OR Virgie would pull that kind of weight,I still say,that is why Jerry Brown chose the timming ,to do exactly what Rita was doing,asking for summery judgement,to (COVER UP)Someone owed someone a favor,As I read,what was said ,there would only be one reason Elizabeth McNamara,would object,(because the (S) will hit the fan Howard should be allowed any leaway he needs,this is his life and reputation.
This is all sounding positive.. Lin Wood must have some good evidence links to the cases to want this and the Judge seems to agree…

IMO all these cases and yes including the California one are all related. IMO someone involved in the first three cases pushed the issue to the California DOJ and IMO it was Don Clark. Clark struck out with Florida in trying to get the case into Anna’s death reopened. We know Don is involved in all three; he was in Florida courtroom during the fight for Anna’s body. He went to the Bahamas on behalf of Rita Cosby. Now he works alongside McCabe who is employed by O’Quinn. Therefore, it is a no brainer.

I do not know where she thinks she gets off acting like that? A person who said to her daughter I love you but I do not like you. Well, that is here in the US, I do not know about the Bahamas. You can bring a phone message that a person left on your recorder to Court…
as the person who left the message ‘knew’ they were being recorded. (for proof of harassment from an ex for example…)
Yes, in this fragile economy… I bet they have not had one client, nor when anyone finds out who they are and how they were connected with framing innocent people; well I doubt anyone would want to hire them for anything! JMO on it!

Is these Court cases astounding or what? Has anyone in real life seen such greed and steadfast agenda to kill the opponent on so many angles as team Tx has done? Even Jerry Brown has never heard or prosecuted a case in this manner. I think that JB is trying to make new law to further his political career. and I think Rose just being a blogger as we all are just saw that trial by TV is not right. That is not what our justice system basis guilt or innocents on by public opinion but fact and law!, Rose after this is done and said I think you should write a book on how the first amendment has been over looked and you are a great writer and has to live through the unjust persucution for having a opinion.

The big problem I see with Coopers article is that ANS went to CA to file for bankruptcy. Where she lived. ANS’ bankruptcy had nothing to do with TX until a TX resident, Pierce, filed a claim against ANS in CA. Seems to me that TX came to CA. Cooper has is bassackwards, imo.

IMO they hide the involvement of the Marshall family and their attorneys because then they could be added to any suit bought against this cabal of less than stellar attorneys. Isn’t it funny how biased this writer of the article is and Beth You are so right it is laughable.The Marshalls did bring it to California,Anna had to file in her home state and Texas was no longer her home state.Besides the bias the Harris court system has shown towards her and anyone else involved in this mess except for the Texas team.I notice VA is hiding hopefully in shame but I don’t think that is the case.I think they want to say she is not a limited public figure.LOL how can she claim that when she went on every show she could to trash her daughter even before she passed? There will never be an end to payola in our courts.
My ex gave a donation to a third party group that put the money in the judges account. The judge I had has ruined many lives ( family court) in giving children over to abusive parents. She also is married to a cop with a construction business where gets an “in” on city bids.
I was asked to give a donation. Couldn’t afford it.
The exes lawyer was actually probate law and vicious ( the judge let him run the show) where he broke so many laws. I found out through research that he profited a lot from Probate court having a huge amount of real estate in his name as well as running trusts . As matter of fact owning a building where a huge amount of attorneys had their offices.
My judge has never revealed all of her donations. And no one has done anything about that.
Let’s just remind ourselves that JOQ donated 1.5 million to the campaign of Chris Bell who lost.
He was against tort reform which our city desperately needs. But that’s how JOQ makes his living.
It’s even worse that DC is bought and paid for. He is in with the covert community so where does one go for help?
That community comprised of the whom: James Baker 3, Senior Bush and so forth.
So again, if one wanted to bring in the DOJ or what not, it won’t be happening.
So here we are, with yet more victims of a very corrupt system and the men who run it.
When I saw the Marshalls and JOQ in the beginning of the cases I knew where this would all end up: Harris County which I wouldn’t even recommend for my enemies.

Stern’s Motion filed under seal on Feb. 13, the Response by O’Quinn and then the Reply by Stern. If either side feels the hearing should be held under Seal, that side shall file a Motion by April 20 and it shall delineate the reasons and set forth any legal authority supporting such request in an appropriate filing with the Court.

#108, Beverly…somewhere in the filings against the Drs. and Howard, is the idea that instead of just enabling, they gave drugs to a known drug addict. Reading last night elsewhere head Honcho [Einy] confessions. She claims while out of town, someone using the moniker “Law” contacted her comrade Kerry and they [Law] was trying to get in touch with Einy. Once Einy returned home, Kerry fills her in and after having a discussion, they along with Whacko decided to give this person “Law” a throwaway e-mail address so that “Law” could make contact. Now this “Law” person claims they were hired by the O’Quinn Law Firm to watch boards because all major players were posting. Einy claims this “Law” person proved they worked for O’Quinn Law Firm by e-mailing the supposed picture of Daniel deceased. Einy claims this “Law” person is none other than Wilma.
Whacko’s roll in the supposed picture is, she admitted to posting it on a public forum/blog. Furthermore, she is saying she got the picture from WILMA!
Now my questions are…
Why would someone who supposedly was hired by a Law Firm e-mail anything that might be evidence to an ordinary person/blogger?
Why would someone who was hired by this Law Firm feel the need to get in touch with an ordinary person/blogger?
Where did this person hired by the Law Firm get the supposed picture?

And a post on TMZ concerning Virgie’s mental status brings to mind that a long time ago I wondered who was advising her to continue with these suits. None were in her best interest. If these suits continue to a courtroom/trial her history will be brought out and scrutinized more so than ever before. By McC admitting that he doesn’t tell her everything or expect her to understand all the different facets of the cases, he is admitting that he is in control of the decisions, not her.
I read a post recently somewhere before Mr. Hogan made his way back to center stage that stated more or less “I’m sorry for the pain of your suffering and you should do something about it”. Is McC prepared for Mr. Hogan to sit on the witness stand? In these suits eyes, only Virgie has suffered a loss. There is another parent and grandfather. She will not be the only star witness emoting.

Bewildered, I think if Hogan was called as a witness for either party that would open a completely new assortment of problems. IMO I do not think the Plaintiffs Attorney acknowledges him as the father/grandfather of the deceased. IMO VA’s Attorneys wanted it to look as though she was the only family member Anna had. JMA, all I can tell you about that group is the way I perceive them and in my mind everything they do is a trick. They are well organized although they attempt to make it seem like something else. or was trying to cut his self a piece of a class action lawsuit and the Marshall money and Howard would have no part of it.
He is trying to settle the score.

JMA, As always Swims makes excellent points, The spin I am reading on other boards it that she has memory loss and her atty’s do not need to keep her informed because she can’t remember what they tell her, My question is, If this is true and she has been this way for years, How can she sue anyone or have any credibility with her claims, does she even know her claims and can she even remember the last time she even talked to her daughter etc.? or it just selective memory loss? Larry Seidlin, the weeping Anna Nicole Smith judge who has chiseled more than a half million dollars from an elderly widow in his condo building, has been removed from the woman’s will.
Or I should say Seidlin’s wife and daughter are off the will, since Seidlin was always shrewd enough to keep his name out of it as he worked to take over Barbara Kasler’s multi-million dollar fortune. Kasler’s family members, caregivers, and an activist named Lyn Evans have managed to remove the parasitical Seidlin (who is greedy at, like, a Tales from the Crypt level) from the widow’s life and possessions.
This news comes a few weeks after a state investigation began into allegations of abuse and exploitation of Kasler by the Seidlins. Here’s the story on that.
“Barbara Kasler began improving physically and mentally once the Seidlins and Rays were driven from her apartment (no surprise there),” Evans wrote the Pulp. “With the improvement came her ability to understand that perhaps Larry Seidlin wasn’t operating in her best interests. Last Thursday at 11:30 PM, Mrs. Kasler called her niece, Corine Kasler, in Pensacola and asked her to take over her affairs. It was the turning point.”
Kasler signed papers removing the Seidlin family from her estate. Evans reports that the trustee of Kasler’s estate, Steve Fuller, and the estate’s attorney, Richard Judd, are being fired. There are all kinds of horrible stories coming out of this, stories of outrageous exploitation from Seidlin and his family that will be heard soon enough.
For now it’s just good news that the exploitation has stopped and Kasler has been taken from Seidlin’s clutches. You just wonder who is going to pay for his daughter Dax’s education at Pine Crest School and all kinds of other expenses now. Poor guy.
A lot of people came together to make it happen. Niece Corine Kasler. Caregiver Monica Izquierdo Vial and another nurse, who will go unnamed for now. Lyn Evans was crucial. And it started with lawyer Chris Roberts, who had the courage to expose the situation in the first place. It’s just too bad Howard Rosen at the Miami-Dade State Attorney’s Office wasn’t quite so effective.
It hasn’t worked out well for him getting involved in the Anna Nicole story and trying to get his 15 min off fame. I can only hope
it works out as well for the rest of them. They have put people that really loved and tried to help her thru hell.
Hope LW puts an end to it soon for HS stern and DL and the DR E sake. I can only assume when they go on about the medicine
they have never been around some one who had a mental break down. It is not a pretty sight and they do medicate them heavy
till they get them in a state they can help them
Liann [157] IMO if Virgie were to try to gain custody of Dannielynn she would most definitely be denied. McCabe has put on a legal document/filing that his client is not sufficiently competent and that her mental ability is impaired so this blows any chances of her going for custody. Looks like McCabe has screwed his own client, not that she would have had a chance anyway. There is no Child Custody Court going to give custody of a toddler to someone who is incapable of caring for that child.
