February 24, 2009 Defendants, Art Harris, Howard K. Stern and Lyndal Harrington filed a Motion to Reconsider asking that the case be transferred the back to the 190th Court based on the fact it appears it was moved to the 280th because of a clerical error and not a Motion by any of the parties.

TZ IMO the significance is to show prejudice of Don Clark and his unreasonable way he “develops evidence”. In part of his open statement we got to read he said he gathered evidence from the internet by reading internet postings.

It means that the Judge they asked will ‘hand it over’ to the Federal Judge in TX to decide…
I do not see any problem after Judge R. in the Fed. Court (TX) sees CBS’s statements, to conclude that there should be ‘something’ done.

Yeah, the judge signed it and IMO had good cause. Things just don’t seem to be going to good for team texas these days…IMO when you don’t do right, they never do.

February 24, 2009 Order referring the Motions Howard K. Stern filed under seal on February 13 as well as Stern’s request to have Don Clark’s deposition released to California Dept of Justice is referred by the rules to the Courts’ Magistrate to disposition or report with recommendations.

Daisy I just finished reading over there and yes she is posting conversations not actual e-mail addresses which I agree with you that is wrong and makes her look very untrustworthy. I notice how Bama is baiting her too; wonder if she is going to fall for it? My guess would be yes due to she seems to be an attention seeker.

NEVER we will always follow our TOS and Privacy Policy, and if any of you find a post on the new forums that is offensive, we promise one of the moderators will be there quick to take care of the problems… I have always wonder why some sites (Topix comes to mind) has TOS but don’t follow them.

I do see where a court ordered Topix to turn over info. on some bloggers that had ruined the life of a couple in Fort Worth Texas. Perhaps lawsuits like that one and Lori Drew will instill ALL sites to have TOS that they DO FOLLOW.

Daisy, the same thing has happened to me, it says to put the code in but there is no where to enter the code. I have been trying for a couple of days and I am still unable to get in. At first it wasn’t accepting the pw and I finally got that figured out, but now I am having problems with the code as there is no where to enter it.

Whatever you do, don’t turn into a forum like Topix!

Feeling kinda queasy, so just looking around. Saw the headlines for the lawsuit that has been filed in Texas concerning the couple and the bloggers. Had read parts of the rebuttel thread concerning rights to free speech and all, but looked into the original thread.

Browse thru a few pages, the normal slams and then posters thinking if worst comes to worse they will get banned. Skip 100 pages or so, the responses are going WAY over the top. And on it goes until the end. And continues. I see so many similarites on another thread. Who can give the best comeback, who gets the knife in their back? Who goes for blood? Hard to catagorize that as debate.

And it didn’t help my queasy stomach.

While in the process of writing this comment I X myself off line so let me try this again

Beth [5] I agree Burris should not have been due to his connection, which he first lied about. Blagojevich should have been allowed to appoint anyone but since he appointed Burris, the Senate should have done further investigation before approving him. IMO the new Governor should have been the one to appoint someone to take Obama’s Senate seat.

In reference to #7, I read that this morning and was glad to see the investigation into Chandra death was still going on and now a possible arrest. I hope this will give her family closure after all these years.

You know they always say, “God never gives you more than you can handle”. I always thought that that was a crock. Some points in my life, I wanted to yell UNCLE! NO MORE! And then with every test, that I somehow managed to come thru on the ‘other side’, it proved helpful to have the knowledge and the insight to help the next person that came along that was going thru those same ‘tests’. Sometimes you just don’t know where those tests/lessons are going to lead and you just have to have faith, that in the long run, you’ve done the best you could with the hand you’ve been dealt.
