In the Southern District Federal Court for Florida, on Friday, October 17, Krista Barth and Robert Klein squared off and argued on behalf of their clients for an hour and half.
The hearing was in connection to John O’Quinn and the O’Quinn Law Firm Motion for Protective Order for the financial information with the O’Quinn legal team wanting to wait until 30 days before trial to turn that information over. The O’Quinn legal team is also requesting that Howard K. Stern does not have access to the information because Stern “can’t be trusted”. The Minutes of the Court Proceeding states the Court read the Motions, Memorandum of Law submitted by both side, had the hearing and took the matter under consideration and will issue an opinion in the near future.
In other news the Southern District Federal Court of Texas, issued an Order for a November 4 hearing on the status of the case, and the discovery progress in that case between the parties. That hearing is scheduled for November 4 at 4:00 PM.
The Texas State District Court in Houston, the Honorable Tony Lindsey issued an Order on October 15 setting a hearing on the Motions for Art Harris and Bonnie Stern to hear oral arguments on the Jurisdictional issues brought up by the co-defendants. That hearing per the Court Docket, is set for 1:30 PM on November 21, however the court has also issued in its Order that the parties may request a hearing sooner then November 21.
Howard K. Stern’s Answer to the O’Quinn’s Motion for Summary Judgment based on Stern is a public figure and as such cannot prove “malicious intent”, still appears to be due on October 27.
The New York Federal Court has Order that all depositions of the last five witnesses, Don Clark, Wilma Vicedomine, Mark Speer, and both nannies must be completed by Monday, October 20 in preparation for that trial.
In the Federal Court for South Carolina of the Estate of Anna Nicole Smith vs. G. Ben Thompson and Stancil Ford Shelley, there are two filings due, one by Monday October 20, 2008 of the Rule 26(f). The other required filings in the South Carolina Federal Court are due on November 3, 2008 and includes the Rule 26 & 26 (a).
It looks like October and November is going to be two months of many happenings in all cases, in all jurisdictions with filings due and hearings happening. Be sure to keep up with our calendar on the front page of Rose Speaks.com as we keep up with all upcoming dates in all of these cases.

I cannot believe.that statement from the OQ Law Firm,Howard cannot be trusted,I could not get through reading any court docs by the QO Law Firm that was not twisted and turned,to suit how OQ wanted it.If I was the judge,OQ would have had to take it back and correct every false statement,and like a school child,go back and do it right. I do not think it is Howard ,that has to pay clients back,money he stole from them.

I agree Beverly, I have never met nor talked to Howard K. Stern or Lin Wood, but both seem to have a lot of personal integrity, and I have not found any case where either have been sued by clients to get money allegedly owed to them.
The judge is going to need a long holiday after this case The many twists and turns this will take will only held back by the Imaginations of the O’Quinn team. Maybe the judge should write a book on it, then turn it into a soap opera.

You know,I wish I could play matchmaker,I know Howard still hurts deeply over Anna,but Krista Barth is his age,they are both in the same profession,and Howard needs to start living slowly.Life is so short,and MY wish for Howard is,keep his love for Anna,but do not waste your young years,they are gone to fast.Virgie and OQ ARE BITTER,GREEDY PEOPLE,OQ is about to lose a lot of his (empire)and the one thing Virgie thought she had,SHE LOST,HER REPUTATION,and her own child,Anna hated her when she died,Virgie can live with that the rest of her life.

I notice that Jackie Hatton is not on the list of witnesses to be depo’d…. does that mean she can’t be found, is no longer on the witness list or has she already been depo’d?
The only reason O’Quinn wants a protective order for his financial records is that he does not want it known what he has money wise for when a settlement is issued to Howard Stern. In my opinion O’Quinn asking to reveal his worth right before trail is another way to possible hide some assets. I hope the judge sees right through O’Quinn’s entire BS.
My question is, what if the Nannies’ cannot be found to be depo’d?
Thought of a funny. We r so protective over dannielynn, can u imagine us scrutinizing anyone he brings home to her. LOL. The poor lady would have to get thru us for a thorough background/records search etc. And get an OK

As far as requesting the court to deny HKS any access to O’Quinn’s financial records, due to his, supposed untrustworthyness, I’ll use John’s own language for that one…”hyperbole”.
What I feel is ,Lin Wood is not aware of all OQ TV appearances,and Howard is,a lawyer should be able to confer with his client on every aspect of the case,not the aspect OQ decided ,howard should see.This is not OQ CASE,IT IS HOWARD AGAINST OQ.

Tonight I was watching CNN NEWS, when up pops Don Clark,I wish someone would put that fool out to pasture,His comment was “it would be fun to interview the 6 year old kidnapped boy.HE HAS SO MUCH TO TELL.I sure am glad Don Clark finding it fun,lord knows ,the kid has been through a lot,but Don Clark needs fun ROSE,IF YOU HAVE TIME CAN YOU e-mail OCT 20 STERN MOTION,
Beverly he actually said it would “be fun?” What would be so “fun” about interviewing a six year old who just went through such an ordeal? I was going thru some old files and found article where person is talking bout hks suing oquinn and how that will open doors for oquinn thru depos and doc requests to get hks onhaving to do with ans death. sunflower..i was being somewhat funny. I was thinking in particulat to being blamed for things that i didnt do. Such as havana says i sent a specific letter to people mag and HER. Technically the person that forwarded havana the doc could prove it as a lie. Ie a witness. Being that all my data has been so conveniently deleted by various criminals (u would think if i had something oquinn wanted noone would want anything destroyed)!! But i have no access to stuff from all that time period of march april may anymore but know there r various emails that prove others wrong as well show there was no conspiracy. Anyways have to do a list of Potential witnesses for court and wishing i still had everything becuz know theres alot out there and plenty of people that i used to converse with more personally (like email) that might have stuff.
I spent today,watching TRU TV,and the case was almost like Casey Anthony.A mother drowned her little girl in a swimming pool.and the half brother saw her,that child a boy 6or7 years old had to give testimony against his mother.she was founf guilty and sentenced to life in prison.
