TMZ.com has the story of Larry Birkhead being deposed for a full ten hours yesterday in the Howard K. Stern vs. Rita Cosby and Hachette Books. TMZ.com story highlights “How many times can a guy say he didn’t have sex with another guy?”
That most have been a crowded deposition, thus there I bet were Liz McNamara for Rita Cosby, both of Hachette Books lawyers including Douglas Maynard. There is no telling how many lawyers were there for Howard K. Stern, I would bet at least two for Stern, and of course Larry Birkhead and at least one of his lawyers, probably Michael Trope. Stern and/or Cosby also had the right to be there as parties of the suit.
Larry Birkhead has began to turn over subpoena documents on July 14 per the Letter changed to Court Order filed in the New York Federal Southern District and signed into an Order by Judge Chin on July 15. That letter turned Order did state that Birkhead had until August 6, to turn over those documents and a better privilege log for those documents he is not turning over.
Didn’t someone say he was not cooperating? Seems to me he must be if he volunteer for a 10 hour deposition when the federal rules for a fact witness is only 7 – 8 hours, so that blows that he is hiding anything. If I were Mr. Birkhead I would be a tad miffed that there were no phone calls from Rita Cosby to ask about “vetting” her book before it was published but he is now having to spend 10 hours with her lawyers as she attempts to squirm our of any “defamation with malicious intent”. I have to wonder if she is losing that battle slowing in this.

I would like to read the depo. and see just how much damage he did to Rita. I hope it isn’t sealed.
I’m bummed out that TMZ didnt have more details. WOW Ten hours!..what on earth could Larry have possibly talked about for TEN hours?!!
It would be liked he had to recap every single day he ever spent with Anna. He might as well file HIS lawsuit agaisnt Rita now. She now already knows every single thing about him. I thought that “How many times does a man have to say it?” part was funny.
I hope we get to find out more.
What do you think Rose? Will Larry’s depo be sealed too?? As I’ve said before, if Rita wants to act like a baby and have HER depo sealed, fine.
But unless Larry himself wants to have his depo sealed, I have absolutely no idea why it should be!

TZ, the way I read the judges Order from New York, just like Pol’ and Patrik could talk about their depositions, Larry Birkhead also controls what he chooses to share and with whom he shares that.

the gay tape was also a strategy for Daniel’s inquest. I explain what I think. Like in Bahamas the gay poeples are not accept. The bahamian doesn’t have a good eye on gay.So with Rita’s allegation, they tried to put a reputation or a tag of gay on Howard.It was also to try to influence the jury IMO
I’ve only posted a few comments on the site but I intend to try to get more involved in the posting from now on. I’ve been following the cases on this site for a while now since I got the link for it when Art was reporting almost daily on the story. By the way I haven’t seen anything ANS rleated on Art’s site in about a month? Does anyone know what’s up with this? I’m assuming it has to do with the lawsuit he has been dragged in to.
It never ceases to amaze me the twists and turns in these cases.
When Howard said at Anna’s funeral that he and Anna knew the truth because they lived it I knew then that there was a lot more to this story than the sordid reports in the media, comments by VA & her team and by RC’s book (which I wouldn’t give RC my money so I haven’t read it). I’ve tried to read Rose’s devunking of the book but there is so much stuff to read about the different court cases, media reports, etc that I have had trouble finding time to read everything that I want to. I would like to be able to read everything but it seems there just isn’t enough time in my day even though I stay up all night a lot of nights trying to catch up. My best friend of 36 yrs has beenvery sick for several months so most of my time has been takne up trying to help her.
I do hope that we get to see Larry’s depo. I hope Larry tells everything that went on in the depo that is if he can do so legally. Also it seems inhumane to me to make someone sit through 10 hrs of grueling questioning by lawyers that are trying to hang you out to dry/

You can feel free to write as much as you would like to here. I wish there was a way to catch you up, I have always wanted to do a timeline of this story from the birth of Dannielynn to present time. I also do not seem to find enough time in the day or night anymore.
I sincerely hope your friend will get better, I have had one friend that I have kept in contact with for that length of time. I do not know how I would handle such a close friend being very ill. I hope you both find strength in each other and there will be brighter days ahead for you both.

Art’s has information on the cases in his FORUM not the blog. At the top of Art’s screen there is a light blue stripe with different topics, its the button next to the last. Yes, the lawsuit.
Rose’s has the most up to date stories, information and the most docment filings on the cases, the best site.
We all know this entire mess is Virgie’s fault from beginning to end. Larry now has to waste his time answering stupid questions and producing documents he should not have too. And the most important thing is he has to take time away from Dannielynn. All because of GREED and LIES. Makes me sick to think people are giving Rita a job in journalism after the trash she wrote in that book. That Dannielynn’s grandmother supports.

A lot of those depositions are ’stop and start’ of the question asking part. Rita’s lawyers would possibly ask a question that actually by law would be an invasion of privacy… then Larry’s lawyers would debate with RC’s lawyers on if he legally had to answer the question, a part of a question and so on.
I would love to read the transcript! Besides the content of the [q & a] I do think it would be quite interesting to see how many ‘breaks’ to debate there were.
That charity fund: “D.A.R.E.”, was supposed to get (I believe only 10% of profits from that book of lies and trash talk with many having agendas why they were purposely trying to bring down Howard and Larry…) a small percentage from the sales. I would be curious if that actually happened or what portion they did receive.
As far as Rita and the legal cost… I bet none has come out of her pocket yet, due to ‘insurance’ either seperately purchased by her or through the publishing company or a mixture of both scenerios. I would be curious if insurance was personally obtained by her (prior and recent to the book’s release) as to me that would be very telling. No matter what she said when she went on TV to promote a book that was based on the uncredible word of the likes of someone like Jackie Hatten or Mark Spears…
She KNEW and admitted that she DID NOT ask Larry and HKS their side of these outlandish lies. Jackie seemed to have a big grudge due to her blaming Howard for her brother being in jail, which it was the neighbor and Anna that his incarceration was based on. * Well let me re-phrase that > it was Mark Hatten’s illegal actions that put him in prison for so many years. Mark Spears (Speers) well… let’s put it this way > he was helping Opri (Rita’s friend) any and every which way possible to put Larry in a bad light — as this would help Opri’s battle against her former client.
Yes, all these people seemed to have gotten together to really ‘get and bring down these men’ for a multitude of different reasons for each and everyone of them. It has backfired at every turn almost, these people and their ‘1,000 cuts’… Truth is a Defense and in this case, I so hope it works out for Anna’s men and her daughter. Sometimes depending on how much you have to spend on lawyers can make an unjust outcome… I pray that this never happens in these cases; due to the severities of the false accusations against HKS, LB, site owners and bloggers is just too unjust and plain morally wrong!
Beth I like your posting always pertinent! sure the severity of acusations is a base of this story.We discovery all together what was done to Howard and Dannielynn.After it came to Larry!First Howard was the man to kill,he was the one to eliminate to go get the Marshall monie.VA was sure when she went to Florida that Larry was on her side.He came to her in a courtroom ext.But he was inform by Howard about Anna’s life with her “birth mother” and change his mind ouffff! I can not immagine Dannielynn with VA.

Beth, I was very sorry to hear about your friend, and understand how stressful and physically tiring it is. I have several chronic illnesses that make it very hard for me to read everything. So, I mostly don’t post as I don’t feel up to speed. However, I just wanted to say that I first read Rose’s debunking of ‘Blonde Ambitious’ as the articles were first posted and they were very interesting. Then recently I checked out RC’s book at the public library, which I’ve been able to renew several times over the phone, it is apparently not a very hot item in my city. Anyway, now I’ve gone back and reread all the bebunking articles and everything is so much more clear to me. The travesty that this book has done to the lives of Howard, Larry and Anna’s memory have helped me to understand why Howard & Larry want to sue the pants off of RC. (don’t even like saying her name. I had a nightmare the other night…and she was in it, true fact, I guess it came from all the cramming I’ve been doing on this subject lately.) I just hate to think that Dannielynn may one day read it and how she will feel about everyone she loves being trashed. Between a few tears and the smoke coming out of my ears, I feel even more sick about it.
